The purpose of the bill is to speed up the completion of land reform and to centralize the administration of mortgage contracts concluded during land reform in the Land Administration. It is necessary to centralize the management of land installment agreements concluded during land privatization, return and apartment ownership and the performance of mortgagee duties on behalf of the state to the Land Administration, which is the organizer of land privatization. The bill proposes to amend the Land Management Act and the Land Reform Act in such a way that in the future, unreformed land without the possibility of independent use can be merged with a neighboring immovable property with a simple land management procedure. In this case, the unreformed plot of land is no longer entered in a separate registry section in the land register, but the boundaries of the existing real estate are changed. In addition, the draft creates an opportunity to reform the land under the apartment building, if the owner of the dwelling has not submitted an application for establishing apartment ownership by the deadline. A large part is also enabled of the immovable properties encumbered with building rights, which are mostly residential buildings, to be transferred to their builders.

The draft stipulates as unfair trade practices transactions and actions related to payment terms, deliveries and terms of sale, which are prohibited between the buyer and the seller in the supply chain of agricultural products and food. 16 unfair trade practices are listed, nine of which are prohibited in any case and always. For example, the buyer may not unilaterally change the terms of the sales contract, cancel orders with such short notice that it cannot be reasonably assumed that the seller finds another distribution or use option for the product, threatens the seller with commercial pressure measures, etc. The remaining seven unfair trade practices are prohibited unless they have been clearly and unambiguously agreed in advance. For example, if it is not agreed in writing in the supply contract to cover the costs of the agricultural product and food discount, then if the buyer demands to cover such costs, it is considered an unfair trade practice. These transactions do not create legal consequences and are void from the beginning. Supervision of trade practices will be carried out by the Competition Authority, where a structural unit with six positions will be created for this purpose. The Competition Authority must also start publishing the corresponding annual report and submit an overview of the application of the law's requirements and ensuring their fulfillment to the European Commission by March 15 of each year. Provision is also made for violation of the prohibition of unfair trade practices responsibility. The application of up to 300 fine units or arrest is prescribed for a natural person and a fine of up to 400,000 euros for a legal person. The purpose of the bill is to protect sellers of agricultural products and food from unfair trade practices of buyers. The bill takes over the directive of the European Parliament and the Council, which deals with unfair trade practices in relations between companies in the supply chain of agricultural products and foodstuffs.

The bill specifies the content of the activity report to be prepared for the beekeeping year regarding the implementation of the support for the beekeeping sector, as well as the basic documents for the eligible costs necessary to receive the support for the beekeeping sector. It is stipulated that the activity report drawn up for the beekeeping year must include the results of the beekeeping program in addition to the description of the activities. This will make the implementation of the beekeeping program more effective, because from 2018 the European Commission will submit a report based on the performance indicators of the beekeeping year. According to the bill, the eligible costs of the beekeeping program are reimbursed through the PRIA e-service environment on the basis of the payment request and cost documents submitted electronically to the PRIA. Compared to the current procedure, compensation is no longer based on an activity report approved by the evaluation committee. The purpose of the activity report is to evaluate the qualitative implementation of the program and is not necessary for the implemented activities for eligibility assessment. For this, a payment request and documents proving the incurred expenses are sufficient. In addition, the law will be brought into line with European Union law by supplementing the list of measures of the Rural Development Plan with two measures, support for the restoration of agricultural potential and support for agricultural insurance, in which applications no longer need to be assessed, which allows application rounds to be kept open all year round.

The draft will bring the laws into line with the EU plant health regulation and the regulation governing official inspections, which will apply from December 14, 2019. For this purpose, several provisions of the Plant Protection Act, the Organic Agriculture Act, the State Fee Act and the Plant Propagation and Variety Protection Act will be updated or repealed. In addition, the Plant Protection Act will be amended due to the amendment of the corresponding ELI directive. In the Plant Protection Act an important change is the extension of the obligation to submit an economic activity notification to almost all entrepreneurs engaged in the sale of plant planting material. The requirement for an activity permit is also established for those entrepreneurs who want to deal with, for example, wooden packaging material for entrepreneurs who want to issue a plant passport. Funding principles for plant health follow-up are changing. The primary supervision operation is still financed from the state budget. The monitoring fee is established for an inspection that was not initially planned to be carried out, but which is necessary due to a violation discovered during an official inspection. State fees in the field of plant health have also been updated to cover the costs of official inspections. The Organic Agriculture Act establishes the general basis for official inspection and the requirements for sampling and analysis. As a change, the imported organic product will no longer be issued marketing authorizations because the corresponding EU import system has changed. At the same time, state fees for the supervision of organic production will be updated in order to compensate for the increase in supervision costs resulting from the rapid development of the organic agriculture sector.

The bill adds a provision to the Land Reform Act, which establishes the possibility for natural person usufructuary to sublease the land acquired in usufruct to their own, spouse's or relative's company. The bill does not establish a restriction that the business company for which the usufructuary can use the land should be the sole property of himself, his spouse or a relative. The bill adds Article 3 to the Act on the Acquisition of Land Granted to Usufruct in the Land Reform clarification that subleasing the land granted to a natural person in usufruct to the company of oneself, one's spouse or a relative would not exclude the right to buy out later.
