Après le premier alinéa du I de l’article 25 ter de la loi n° 83‑634 du 13 juillet 1983 portant droits et obligations des fonctionnaires, il est inséré un alinéa ainsi rédigé : « La nomination d’un fonctionnaire qui a bénéficié d’une disponibilité dans les trois années précédentes est préalablement soumise à l’avis de la commission de déontologie de la fonction publique. ».
