Question 15076 — Agricultural social mutuality

The future objectives and management agreement (COG) 2026-2030 which will soon be signed between the central fund of the agricultural social mutuality (CCMSA) and the State will focus primarily on ensuring that the quality of service provided to the socially insured meets the best standard, particularly in terms of payment of benefits, both legal and extra-legal (health and social action). In this light, the current COG negotiations are take place in a constructive climate between the CCMSA teams and the supervisory ministries. The draft agreement is, in fact, advanced, because the State and the MSA share numerous priorities such as, in addition to the level of quality of service provided to the insured in a homogeneous manner throughout the territory, the strengthening of the position of the central fund with a view to improving its management of the network, as well as the means necessary to ensure that it has an IT system that meets the standards of other social security funds. This search for quality of service is also accompanied by a search, shared with the MSA, for efficiency. In this regard, the question of the employment pattern is an important point of the discussions. This new COG is therefore part of a context which is binding on all social security organizations, particularly in an optimal search for productivity gains in their activities, without ever degrading the quality of the service provided. Support for agricultural employees and non-employees, active and retired, their dependents (especially children), as well as the prevention of agricultural unhappiness must indeed remain the cornerstone that guides the negotiation of this 2026-2030 COG.

En 2025, le budget de la défense des forêts contre les incendies (DFCI) relève de deux lignes pilotées par la Ministre en charge de la forêt: l'action 26 du programme 149 permet depuis de nombreuses années de financer les mesures dans les zones historiques sud et sud-ouest d'un montant de 16,19 millions d'euros (M€) en autorisation d'engagement. Ce montant est globalement stable depuis plusieurs années et a, encore une fois, été préservé. Par ailleurs, les crédits dits « planification écologique », inscrits sur l'action 29 du programme 149, permettent, de manière inédite depuis 2024, de renforcer l'action en matière de DFCI et d'assurer le déploiement national des mesures prévues par la loi n° 2023-580 du 10 juillet 2023 aimed at renforcer la prévention et la lutte contre l'intensification et l'extension du risque incendie. L'enveloppe 2025 de la planification écologique n'était effectivement pas fléchée par type d'actions spécifiques dans le cadre du government bill de finance, mais la DFCI fait bien parti des priorités identifiées au titre de la planification écologique en matière de forêt. En effet dans un contexte de climate change, de nouveaux territoires sont désormais classés en zone à risque de feu de forêt et méritent des investissements préventifs. Aussi, si les crédits planification écologique forêt sont effectivement en baisse par rapport à 2024, une enveloppe de près de 17 M€ avant gel devrait pouvoir être dédiée aux opérations d'appui aux politiques DFCI programmées en 2025. En ce qui concerne le volet territorial, les directions régionales de l'alimentation, de l'agriculture et de le forêt ont été notifiées en juin des crédits disponibles. Aussi dans un contexte budgétaire qui nécessite des efforts de la part de tous, la politique de défense contre les incendies de forêts constitue bien une priorité by the government.

Par plusieurs arrêts du 13 septembre 2023, la Cour de cassation a écarté l'application de la législation française au motif que celle-ci n'était pas conforme au droit de l'Union européenne, notamment à la directive 2003/88/CE du Parlement européen et du Conseil du 4 novembre 2003 concernant certains aspects de l'aménagement du temps de travail, ainsi qu'à article 31 paragraphe 2 de la Charte des droits fondamentaux de l'Union européenne. Est notamment en cause le fait que le droit français écartait l'acquisition de congés payés pendant les périodes d'arrêts maladie. En lien avec les partenaires sociaux, le ministère du travail, du plein-emploi et de l'insertion examine les conditions d'une mise en conformité de notre droit national en veillant à ce que celle-ci permette de sécuriser les entreprises dans les conditions les plus satisfaisantes possibles, en tenant compte des exigences européennes posées notamment par la Cour de justice de l'Union européenne et constitutionnelles (le Conseil constitutionnel vient d'être saisi d'une question prioritaire de constitutionnalité à laquelle il doit répondre d'ici le 15 février 2024).

Ms. Geneviève Darrieussecq draws the attention of the Minister of Ecological Transition and Territorial Cohesion to the removal of mill thresholds and roadways. According to data published by the French Biodiversity Office, around 12,000 structures have been partially or completely destroyed in the space of 12 years in France, mainly mill roads. This policy of destruction is based on a desire to give back a “natural” character to rivers. However, these small traditional dams are essential for preserving water and maintaining aquatic habitats suitable for life. They are intended to store large volumes of water in rivers, which are seriously lacking during periods of global warming. The succession of these small dams is very adapted to the seasonality of the French climate, with an excess of winter rain. and a summer shortage. By raising water levels and slowing flows across the entire French hydrographic network, they preserve hundreds of millions of m3 of fresh water during summer droughts and play a key role in water storage in alluvial and deep water tables. The destruction of water reservoirs in rivers therefore contributes to aggravating water shortages in the basins where they have been carried out but also endanger natural environments. On the occasion of the vote on the law to combat climate change and strengthen resilience to its effects on August 22, 2021, the destruction of water mill pavements was formally prohibited, to preserve French heritage but above all to protect water resources and natural environments. Yet despite this adoption and shortages increasingly frequent in the country, water agencies have maintained their policy of financial incentives for the destruction of water reservoirs in France. Furthermore, a proposal for a European regulation for the restoration of nature sets out an objective of restoring 25,000 km of free-flowing watercourses by 2030 on a European scale; and this despite the French counter-example. The Member wishes to know whether solutions are being considered to enforce the law adopted in August 2021. She also questions France's position at the European level with regard to the proposed regulation for the restoration of nature.
