Ms. Sandrine Lalanne draws the attention of the Minister of National Education to the examination conditions imposed on students in private establishments outside of a contract and the resulting inequalities of treatment. Students educated in private establishments outside of a contract preparing the same national diplomas as their peers in the public or private establishments under contract are subject to significantly different examination procedures. At the baccalaureate, they are forced to take up to 23 final tests, compared to 7 for other candidates, their results obtained in continuous assessment not being taken into account. At the secondary school certificate, they are deprived of the oral test, although it constitutes the common base of knowledge and skills. Depuis plus de 20 ans, l'Agence nationale des fréquences (ANFR) surveille le marché national afin de s'assurer que les appareils radioélectriques, notamment les téléphones portables, respectent la réglementation européenne, à savoir la directive 2014/53/UE. Sur le terrain, les agents assermentés de l'ANFR effectuent des prélèvements sous scellés dans les points de vente ou les entrepôts. Les produits sont ensuite testés en laboratoire, et l'ANFR décide, selon les résultats, des suites à donner (pouvant aller jusqu'au retrait et rappel du marché). Au sein de l'Union européenne, la France se distingue par l'intensité et la régularité de ses contrôles en matière de surveillance du marché des téléphones, contrairement à certains autres États membres tels que l'Espagne, les Pays-Bas, la Finlande, la Norvège et la Belgique qui privilégient des actions ponctuelles, conduites sous forme de campagnes et on des volumes de contrôle plus restreints notamment en raison du coût important des mesures de DAS (débit d'absorption spécifique). Les Gouvernements successifs ont donc veillé à ce que ces produits massivement utilisé par les Français, proches ou au contact du corps, ne mettent pas en danger leur santé et leur sécurité. En 2025, soixante-douze téléphones ont été contrôlés, ce qui représente 67 % du marché en valeur. Dix-sept téléphones ont été déclarés non-conformes: neuf pour dépassement des valeurs réglementaires du DAS (le DAS est l'énergie transportée par les ondes électromagnétiques absorbée par le corps humain) et huit pour une autre raison telle que l'absence de documentation technique ou de marquage CE. Après mise en demeure de l'ANFR, quatre de ces téléphones ont fait l'objet de mesures correctives de la part du fabricant, consistant schématiquement en une baisse de puissance du téléphone par mise à jour logicielle, rendant les niveaux de DAS compatibles avec les seuils réglementaires. L'ANFR n'a pas manqué d'ordonner le retrait, et le rappel, des produits pour lesquels aucune mise en conformité n'était proposée. Face à ce constat d'une surveillance de marché dynamique, prenant des mesures strictes tout en restant proportionnées, il apparaît important de réfuter, ou de nuancer et de contextualiser, les allégations mises en avant par une seule association et dont vous vous faites l'écho. Tout d'abord, s'agissant de la transparence, l'ANFR communique systématiquement auprès du grand public et des entreprises de la chaîne de commercialisation, les résultats des évaluations des produits non-conformes et des mesures mises en œuvre (via la publication de communiqué de presse, des notifications ciblées…). Les niveaux de DAS de chaque téléphone évalué sont disponibles en open data. Il est exact que certains rapports d'essai du laboratoire mandaté par l'ANFR n'étaient pas publiés in extenso du fait d'une mention explicite au II bis de article L. 43 du code des postes et des communications électroniques qui dispose que les documents de la procédure de sanction ne sont communicables qu'aux personnes en faisant l'objet. Il était donc nécessaire que la CADA (Commission d'accès aux documents administratifs) se prononce en faveur de la communicabilité de tels documents pour que l'ANFR procède depuis à une publication systématique. En tout état de cause, l'absence de publication du rapport d'essai ne nuisait pas à l'information sur les résultats de l'évaluation de conformité et les mesures qu'ils avaient suscitées. De plus, l'association prétend que l'ANFR n'informe pas correctement, à travers l'application dédiée « ICSMS », la Commission et les États membres des non-conformités et des mesures prises en conséquence. Or, l'ANFR procède bien à cette information mais signale en priorité les équipements pour lesquels les mesures mises en œuvre au niveau national n'ont pas apporté une réponse sur the whole of marché intérieur de l'Union européenne. Enfin, cette association cite de manière manifestement tronquée des éléments de la décision d'exécution de la Commission européenne du 19 août 2025 dont l'objet était de déterminer si la décision de retrait de l'iPhone 12 prise par l'ANFR était justifiée et devait être étendue sur the whole of marché intérieur. Cette décision de la Commission européenne complète et argumentée donne sur tous les points satisfecit à l'ANFR quant à l'évaluation de la conformité de cet équipement et aux mesures prises. Elle partage la position de l'ANFR sur le rejet de la proposition faite par Apple de brancher sur l'iPhone 12 un module de sa conception pour qu'il réussisse sans problème les tests de conformité de DAS. Aussi, l'association devrait-elle être plutôt rassurée qu'inquiète car la Commission a démontré que les évaluations réalisées par l'ANFR prennent bien en compte les usages raisonnablement prévisibles des équipements.

This situation creates a clear distortion with the obligations imposed on manufacturers Europeans, subject to a rigorous regulatory framework. Despite the restricted and already regulated distribution of injectable products, the National Medicines Agency (ANSM) indicated that it received between August and September 2024 reports of eight serious cases of botulism, a neurological disease following illegal injections by non-doctors. Three new patients have recently been admitted to intensive care. It is therefore urgent to respond in sanitary conditions adequate to the growing demand of patients and also extracting the latter from an underground economy constituting a certain loss for State revenue, such as the 20% VAT on aesthetic medicine procedures. If the regulation of doctors practicing aesthetic medicine is essential in the short term, it is urgent, with regard to practitioners already trained and practicing aesthetic medicine for many years, without any losses, to accelerate the implementation of the recognition of their training and their acquired skills, through regulatory reform, in order to formalize their skills and their specificity. The validation of acquired knowledge and experience (VAE), although promised for two years, has still not been implemented. It is also urgent to broaden the conditions of prescription and delivery (CPD) of the botulinum toxin for aesthetic purposes to all aesthetic doctors so as not to facilitate and encourage the illegal practice of medicine and the dangerous drift of “fake injectors”. This reform is a question of public health, justice for health professionals and European coherence.
