Ms. Geneviève Levy draws the attention of the Minister of Higher Education, Research and Innovation to the project to create a higher technician certificate in mechatronics. Mechatronics is the alliance of mechanics, electronics and IT grouped into a single system. An alliance of skills used to put “intelligence” into a mechanical product in order to control it, monitor it, to alert, or obtain information and improve the performance of all types of equipment. The shipbuilding and repair sector, present mainly in 4 regions in France including Provence-Alpes-Côte d'Azur, is growing strongly. Since 2010, the number of jobs in shipbuilding and repair has increased, unlike the industry as a whole. It is shipbuilding and ship repair that record the greater progress. The southern region offers real job potential in this industrial sector positioned on maintaining complex, highly technological and high value-added vessels in operational conditions. Faced with the emergence of this new profession, engineering diplomas, masters and professional licenses are currently emerging. A strong demand from the Ministry of Defense led national education, from 2016, to set up an additional “mechatronics” mention in the Var. If the additional term "mechatronics" was able to respond urgently to the needs for qualifications and employment in the national navy, it turns out that this additional term will no longer meet the high added value requirements essential to the naval industry of today and tomorrow. The attention of the Minister for Ecological and Inclusive Transition was drawn to the creation of a public asbestos eradication center which would be an independent administrative and legal structure, placed under the authority of political, union, associative and citizen bodies, whose mission would be framed by specifications as part of a multi-year plan decided during the security financing bill social (PLFSS). It should be remembered that in a July 2014 report, the Senate Social Affairs Committee raised the need to ensure the coordination of actions in the field of asbestos and recommended the establishment of “an interministerial structure, endowed with real decision-making power”. It is for this purpose that the interministerial asbestos action plan (PAIA) was put in place, at the initiative of the Prime Minister in December 2015, for a period of three years (until December 31, 2018). It is a continuation of the national working group “Asbestos and fibers” (GT NAF) created by decree no. 2008-101 of January 31, 2008 and renewed in 2013 for a period of four years, which made it possible to organize technical discussions between all the stakeholders concerned by the subject of asbestos. Given the transversality of the problem of asbestos, the PAIA involves the ministries responsible for labor, health, housing and the environment and breaks down State action in the field of asbestos into 5 axes and 23 actions: Axis 1: Strengthen and adapt the communication and dissemination of information of all the actors concerned; Axis 2: Improve and accelerate professionalization; Axis 3: Facilitate and support the implementation of the regulation ; Axis 4: Support research and development approaches on asbestos; Axis 5: Equip yourself with knowledge, monitoring and evaluation tools. The PAIA thus makes it possible to amplify the initiatives of all the stakeholders concerned on common strategic objectives and to identify priorities with regard to the resources that can be mobilized. It involves the entire sector in a collective approach which combines both the rise in competence of stakeholders in matters of asbestos and the standardization of practices in order to guarantee, throughout the national territory, equal treatment of workers. This plan, focused mainly on the construction sector, is intended to improve risk prevention for the general population and workers by facilitating the implementation of regulations, supporting the increase in skills of stakeholders in the different areas of activity concerned and supporting research and development approaches. Given its upcoming term on December 31, 2018, it appeared relevant to the four lead ministries that an evaluation be carried out, through a joint mission of the General Inspection of Administration (IGA), the General Inspectorate of Social Affairs (IGAS) and the General Council for Environment and Development sustainable development (CGEDD), whose work will particularly focus on the following points: evaluate the work implemented within the framework of the PAIA over the period 2015-2018 and formulate recommendations on the continuation of the actions of this plan; decide on the possibility and conditions in which the governance of the PAIA would replace the GT NAF; decide on the most relevant interministerial exchange format to address the “natural asbestos” theme; take stock of the application of “asbestos” regulations in buildings (priority public health aspect). The conclusions of this referral are expected in the first half of 2019 in order to allow an informed decision regarding the optimization of the PAIA system and its missions. Furthermore, with regard to the management of asbestos waste, the minister's attention was drawn to the need to modify the regulations by prohibiting their burial in favor of inerting processes either by vitrification or by sulfuric or nitric acid bath. The ministry has taken note of this proposal, however, since the inerting of asbestos by soaking in sulfuric or nitric acid is not a treatment method currently provided for by the environmental code, it is appropriate that this process of treatment of asbestos waste must first be assessed. For the record, with this objective, the ministries (health, housing, environment, work) set up by decree no. 2017-34 of January 13, 2017 a commission for the evaluation of technical innovations in the field of asbestos (CEVALIA) whose mission is to evaluate in the field of detection and treatment of asbestos. It is therefore appropriate to invite project leaders innovative in the management of asbestos waste through new processes, such as acid baths, to be part of this evaluation process by CEVALIA. Finally, it is desired to establish a map of asbestos sites, in order to establish an asbestos removal strategy prioritizing, in the first place, those open to the public. Only family allowances can be shared between the parents who have effective and permanent responsibility for the child in the event of alternating residence effectively implemented. Other family benefits, including the childcare benefit, cannot be shared between parents whose child is subject to an alternating residence measure, in application of the rule of singleness of the beneficiary. However, parents have the possibility of jointly requesting a change in the benefit after a minimum period of one year. With regard to personal housing assistance, it is currently possible for each of the two parents to benefit from it for the accommodation they occupy, subject to meeting the conditions for granting it under common law (resources, regularity of stay, decency, surface area, etc.). The decision mentioned by the Council of State dated July 21, 2017 concerns the consideration of children in alternate care in the scale for calculating personalized assistance. According to this decision, the principle of the single recipient does not preclude the taking into account of children in alternate residences when determining the amount of housing assistance, by application of articles L. 351-3 and R. 531-8 of the construction and housing code. Aware of the difficulties encountered by separated families, interministerial technical work has been undertaken to determine the best way to take alternate residence into account when calculating the amount of housing assistance while limiting the possible negative effects of sharing assistance on parents and ensuring the sustainability of the management complexity induced by a reform of this type. The solutions that will be released for personal housing assistance could in this respect constitute a first step in re-examining the principle of the single recipient applicable to family benefits.

Article 22 bis of Law No. 83-634 of July 13, 1983 on the rights and obligations of civil servants opens the possibility for public employers to participate, on an optional basis, in financing the supplementary social protection (PSC) of their agents. In the territorial civil service, the PSC system was established by Decree No. 2011-1474 of November 8, 2011 relating to the participation of local authorities and their public establishments to the financing of the complementary social protection of their agents and its four implementing decrees of the same day. This legal framework allows communities to provide financial assistance to their agents who subscribe to contracts or regulations relating to health and welfare. Article 24 of the decree of November 8, 2011 specifies that the participation of local authorities and their public establishments constitute personal assistance. To the extent that it constitutes a personnel cost of a social nature, this financial assistance from communities intended for their agents constitutes an operating expense. In accordance with the provisions of the circular of February 26, 2002 relating to the rules for imputation of local public sector expenditure, the employer's participation in the financing of the PSC cannot correspond to an investment expenditure which essentially includes operations resulting in a modification of the consistency or value of the heritage of the community or establishment (purchases of durable materials, construction or development of buildings, etc.). The Government also wished to commission the General Inspectorate of Finance, the General Inspectorate of Social Affairs and the General Inspectorate of the Administration in order to carry out an assessment of the level of support for public employers of the PSC in the three sides of the public service. Mme Geneviève Levy attire l'attention de Mme la secrétaire d'État, auprès du Premier ministre, chargée des personnes handicapées, sur le statut des assistants de vie scolaire. À la rentrée 2017, il a été difficile pour les rectorats d'académie de recruter les 50 000 AVS nécessaires pour accompagner les élèves handicapés. Le statut, précaire, n'attire naturellement pas les candidats. Accessible avec un baccalauréat, sans formation spécifique alors que les handicaps à affronter sont divers et lourds, la fonction d'AVS est précaire. Il s'agit d'un contrat à durée déterminée, renouvelable chaque année pour 6 ans maximum, et majoritairement à temps partiel, alors que le temps plein est de 1 150 euros nets. En moyenne, un AVS gagne 680 euros. La tâche est pourtant importante pour des dizaines de milliers d'enfants et leur famille. Il s'agit de permettre à l'enfant de rester scolarisé dans un établissement ordinaire au milieu d'enfants sans difficultés. Il s'agit de permettre à des familles d'appréhender sereinement le quotidien de leur enfant handicapé et d'être soutenue par une personne de confiance. Enfin il s'agit de sécuriser les parcours de l'enfant et de l'AVS, l'un n'ayant pas à chaque rentrée scolaire l'obligation de s'habituer à un nouvel adulte référent, à lui expliquer ses besoins et l'autre pouvant inscrire sa vie professionnelle dans la durée. Actuellement c'est de la précarité que l'on propose à 50 000 travailleurs et l'absence de reconnaissance et de valorisation de leur travail. À la rentrée 2017, le Gouvernement a engagé dès octobre une concertation entre les ministères de l'éducation nationale, de l'enseignement supérieur et le secrétariat d'État aux personnes handicapées pour remettre à plat le statut des AVS et entamer le chantier de la professionnalisation. C'est pourquoi elle aimerait connaître l'avancée de ces travaux, les pistes engagées et le calendrier de mise en œuvre de cette réforme.

À l'heure des obligations imposées par Vigipirate et d'une demande justifiée des citoyens d'une présence accrue des forces de police dans les rues des territoires, les agents de police municipale sont fortement sollicités, au même titre que les agents de la police nationale. Ils multiplient donc les astreintes à la demande de leur hiérarchie. Or la compensation de ces astreintes doit nécessairement se faire sous la forme de prise de repos compensateur et non d'un paiement de l'astreinte au terme du décret 2015-419 du 14 avril 2015. Ces dispositions réglementaires particulières à la fonction publique territoriale s'expliquent aisément dans une logique de maîtrise budgétaire, mais la sécurité publique nécessite actuellement une présence accrue sur le terrain. Or le système de repos compensatoire engendre des difficultés conséquentes dans la gestion des effectifs et aboutit automatiquement à la réduction de la présence policière en tenue sur le terrain. Il serait donc opportun que soit élargi à la police municipale le régime des filières techniques qui bénéficient explicitement au terme du décret d'une exception permettant le paiement de l'astreinte au lieu du repos compensateur. C'est pourquoi elle lui demande de bien vouloir compléter les textes réglementaires relatifs à la fonction publique territoriale pour permettre aux forces de police municipale de bénéficier de la souplesse du régime compensatoire des astreintes.

Mme Geneviève Levy attire l'attention de M. le ministre d'État, ministre de l'intérieur, sur les moyens de sécurité allouée au territoire toulonnais. En 2017, ce sont 5 personnes qui ont été blessés par balle dans les quartiers de la Beaucaire et des œillets. En janvier 2018, un homme est mort abattu et deux autres ont été blessés gravement par armes à feu toujours dans le quartier des œillets. La présence de la drogue est récurrente dans ces secteurs et malgré un investissement sans précédent, de rénovation des habitats, d'installation d'équipements de services publics, obtenu par la municipalité auprès de l'ANRU, le bien vivre ensemble dans certains quartiers toulonnais sont menacés. Alors que le Gouvernement vient de lancer l'expérimentation de la police de sécurité du quotidien, Toulon, qui possède pourtant plusieurs ZSP, ne bénéficie pas de ce nouveau dispositif à la différence des autres métropoles méditerranéennes que sont Marseille et Nice. Cette décision du Gouvernement est décevante pour les élus locaux et les habitants de cette agglomération qui se donnent les moyens de trouver des solutions à la lutte contre la délinquance. La police municipale abat un travail quotidien important, de même que la police nationale malgré des moyens nettement insuffisants accordés par l'État, mais aucune initiative locale ne peut avoir autant de poids que des moyens supplémentaires accordés par l'État. Aussi elle aimerait connaître quelles sont les mesures prévues par le Gouvernement pour lutter contre la recrudescence d'actes de violences aux personnes et contre l'augmentation des trafics de stupéfiants qui minent certains quartiers de Toulon.

However, States must continue to implement measures to control this pest. Among these, the mass trapping of this pest, the first act of biocontrol, has been recommended by the FAO since the Rome conference in March. 2012. Regarding the meteorological context: rain, floods, heatwave, they must adapt to all pathologies and all ages of life and also ensure the care of potentially dangerous patients or psychologically unstable who can sometimes be violent and aggressive. Finally, they are required to train regularly in the current context of attacks in order to prepare for the worst with regular exercises in the field of multi-victims but also Nuclear, Radiological, Bacteriological and Chemical (NRBC) risks. Regarding supervision missions, they are very present since they supervise all year round student nurses, nurse anesthetists, ambulance drivers, submarine nurses, doctors passing their emergency medicine skills, medical interns, corresponding SAMU doctors, administrative staff and student executives. Les contraintes purement administratives alourdissent en effet considérablement les tâches des fonctionnaires et mobilisent une forte proportion d'entre eux, alors qu'ils pourraient être redéployés dans leurs missions d'investigation dans cette période où le besoin est patent. La simplification des procédures répondrait à cet objectif, notamment : en regroupant en 2 les cadres d'enquête, en mettant en place la dématérialisation de la procédure, plus conforme à une modernisation des moyens, en instaurant une organisation de la procédure par enregistrement vidéo, l'enquêteur n'ayant plus qu'à rédiger une synthèse, en allongeant la durée de garde à vue à 48 heures, permettant d'effectuer plus d'auditions dans un cadre moins contraint, en permettant la saisine des objets à l'occasion des perquisitions de nuit, en étendant les compétences des OPJ à l'ensemble du territoire, supprimant les lourdeurs fixées par l'art. 18-4 du code de procédure pénale. Les différentes contraintes, ainsi que des conditions de travail particulièrement mises en exergue par l'état d'urgence contribuent au quotidien à accroître les difficultés de tous ordres auxquelles sont confrontés les fonctionnaires de police et engendrent d'autant pour eux, une situation du malaise, préjudiciable à terme à la mobilisation de leurs forces, malgré l'engagement dont ils font preuve dans l'exercice de leurs missions. Ces dernières semaines ces tirs nocturnes se multiplient dans les quartiers, du fait d'un petit nombre de citoyens ignorant les règles élémentaires du vivre-ensemble. Ces tirs génèrent de réelles nuisances sonores, un sentiment d'insécurité et des tensions qui peuvent avoir des conséquences graves. Incivilités, violences verbales voir physiques, lorsque des voisins interpellent les fauteurs de trouble, se multiplient. Les forces de l'ordre prévenues souvent n'interviennent pas faute d'effectifs de nuit suffisants et jugeant ces nuisances sonores mineures. En outre, ces tirs de mortier et de feux d'artifice sont dangereux pour l'intégrité physique des auteurs, et des passants. Ces dispositifs explosifs sont même devenus des armes, lancées contre les forces de l'ordre. Il est impératif que des ordres soient donnés par les autorités des forces de l'ordre pour contenir et diminuer drastiquement ces situations. Les citoyens sont lassés par l'inaction des pouvoirs publics à ce sujet et se sentent abandonnés. C'est pourquoi elle souhaiterait connaître les mesures mises en œuvre pour lutter contre les tirs de mortier et de feux d'artifice.

Mme Geneviève Levy attire l'attention de M. le ministre des solidarités et de la santé sur les personnels de santé officiant dans les services de soins infirmiers à domicile. Les infirmiers et aides-soignants des SSIAD, à l'instar de leurs collègues en hôpital ou en Ehpad, ont été pleinement mobilisés lors de la crise sanitaire. Ils se sont chargés du maintien à domicile des personnes âgées et handicapées. Pourtant, ils sont exclus du Ségur de la santé et de la revalorisation salariale qui a découlé des négociations. À l'heure d'une incitation au développement de la médecine ambulatoire et où l'on prône le maintien à domicile pour les plus fragiles, cette exclusion n'est pas acceptable. Ils sont des professionnels de santé qui assurent des services de proximité, du lien social. Ils travaillent dans des conditions difficiles, avec des publics qui ont des risques psychosociaux plus présents. Or cette absence de revalorisation salariale est vécue comme une injustice; elle sera la source d'une fuite des personnels des SSIAD vers des structures hospitalières ou médico-sociales et creusera encore les inégalités territoriales d'accès à la santé. C'est pourquoi elle demande si le Gouvernement va rouvrir les négociations et intégrer les personnels des SSIAD dans les avancées du Ségur de la santé.

Mme Geneviève Levy attire l'attention de M. le ministre des solidarités et de la santé sur la création d'un numéro d'appel unique d'urgence. Un rapport remis au ministre au mois de décembre 2019 préconise la création d'un nouveau numéro d'appel d'urgences, le 113, élargi aux situations d'urgence immédiate. Il s'agirait de supprimer les treize numéros actuels pour n'en avoir plus qu'un seul. Ce 113 serait pris en charge par les plateformes Samu-santé auxquelles les sapeurs-pompiers ne seraient pas associés mais seraient mobilisés par les Samu-santé pour réaliser les interventions. Les sapeurs-pompiers s'inquiètent légitimement du danger d'un dispositif de numéro unique qui mêlerait les demandes de soins non programmés ou le simple conseil médical avec les urgences immédiates et vitales. Ce canal unique mettrait à mal la performance de la réponse apportée en termes de délai et de qualité selon les acteurs du secteur. Les sapeurs-pompiers proposent que les demandes de soins non programmés trouvent une réponse au 116 117, qui représente le numéro européen d'assistance médicale et n'a pas vocation à recevoir les appels relevant d'une urgence immédiate, qui eux seraient traités sur le 112. C'est pourquoi elle souhaiterait connaître l'avis du Gouvernement sur la réforme à venir du service d'accès aux soins.

Mme Geneviève Levy attire l'attention de Mme la ministre des solidarités et de la santé sur la prestation compensatrice du handicap (PCH). Cette allocation est versée aux familles d'enfants handicapés. Elle a toujours été considérée comme fiscalement non imposable et n'était pas prise en compte dans le calcul des ressources pour l'obtention d'allocations délivrées par les caisses d'allocations familiales et en particulier le revenu de solidarité active. Or, depuis 2017, certaines CAF, dont celle du Var, s'appuient sur une circulaire de la CNAM de 2012, pour prendre en compte dans le calcul du RSA la PCH, alors même que le code de l'action sociale et des familles l'exclut. Cette situation conduit à des situations dramatiques, car outre la diminution du RSA ou sa suppression pure et simple, il est aussi demandé le remboursement des trop-perçus. Ces CAF sont inflexibles, refusent toute médiation et invitent les familles concernées à introduire des recours en justice. Le Conseil d'État a d'ores et déjà condamné plusieurs conseils départementaux à rembourser les indus versés par les familles. Cette insécurité juridique et financière n'est pas tolérable et d'autant plus qu'elle n'existe que dans certaines CAF. C'est pourquoi elle souhaiterait qu'elle lui donne des instructions explicites pour rétablir l'exclusion de la PCH dans le calcul des revenus demandés par les CAF pour l'attribution du RSA.

Mme Geneviève Levy attire l'attention de Mme la ministre des solidarités et de la santé sur la gestion des heures supplémentaires des personnels hospitaliers. L'article 15 du décret 2002-9 du 4 janvier 2002 et l'article 6 du décret 2002-598 du 25 avril 2002 limitent le recours aux heures supplémentaires par principe à 15 heures mensuelles et à 18 heures pour les infirmiers spécialisés, sages-femmes, et manipulateurs en radiologie. Les heures effectuées au-delà de ce plafond mensuel doivent être soit récupérées, mais cela s'avère impossible en raison des effectifs limités, soit versées sur un compte épargne temps mais cela est limité à 75 heures par an. L'application stricte des décrets empêche de compenser l'absentéisme, voire de remplacer les équipes lors de récurrentes situations conjoncturelles comme les périodes d'épidémie, ou structurelles comme la permanente suractivité du service des urgences. Par exemple au centre hospitalier intercommunal de Toulon - La Seyne, malgré la possibilité de faire appel à des intérimaires, la situation devient critique dans plusieurs services tels que la réanimation, la pédiatrie, la néonatologie, l'oncologie, car bien que ces salariés temporaires soient de bonne volonté, ils ne disposent pas des compétences spécifiques. C'est pourquoi elle souhaiterait connaître les mesures envisagées par le Gouvernement pour harmoniser les quotas d'heures supplémentaires entre les trois fonctions publiques et ainsi assurer l'offre et la permanence des soins, et la continuité du service public hospitalier.

Mme Geneviève Levy attire l'attention de M. le ministre de l'économie et des finances sur l'avenir du site industriel Transfix de La Garde dans le Var. La société Transfix, implantée sur cette commune depuis 1978, conçoit, fabrique et commercialise des transformateurs de distribution électrique. Elle emploie environ 300 personnes, fait vivre de nombreux sous-traitants, et représente le 3ème employeur privé du département. Transfix travaille beaucoup à l'export avec les marchés africains et compte comme fournisseur principal ENEDIS. Transfix est le dernier fournisseur français de transformateurs de distribution électrique, et la concurrence internationale, dont les coûts de production sont plus faibles, rend la situation financière de l'entreprise critique. Les dirigeants ont donc signé avec les partenaires sociaux un accord de maintien et de préservation de l'emploi et de compétitivité pour préserver le site de La Garde et les emplois. Le Gouvernement doit s'assurer que ce site industriel survive non seulement pour le maintien de l'emploi et de l'activité économique dans le département mais aussi pour maintenir l'indépendance nationale dans la réalisation de ces matériaux spécifiques au secteur de l'énergie. C'est pourquoi elle souhaiterait savoir ce que compte entreprendre le Gouvernement pour venir en aide à l'entreprise Transfix.
