Mrs. Marietta Karamanli draws the attention of the Minister, to the Minister of State, Minister of Ecological and Inclusive Transition, responsible for transport, to the situation of the Le Mans-Alençon railway line. Indeed, its current state due to corrosion of the sleepers supporting the track has led since 2017 to decide on slowdown zones increasing journeys and reducing the possible rotation of equipment. As it stands, none of the work planned has, to his knowledge, started. Local authorities which have invested to improve access and parking lots share users' fears of a reduction in traffic. At the same time, a project for a railway stop near the Le Mans hospital center (and a few tram stations from the university), located along the Le Mans-Alençon line, is being studied. A proposal was formulated in 1998 and a project had been studied since 2012. The cost of such a stopover with corresponding services (4 per day) by 2023 is, as it stands, estimated at 9.6 million euros (91% borne by local authorities). This system would allow the station to be relieved of congestion by users having the possibility of getting off there and taking the tram serving the city at the same place, thus limiting the use of individual vehicles and improving transport times for everyone. Regarding the work, she asks him what the timetable is and what programmed and financed improvements are already planned and will be undertaken in the short term on the Le Mans-Alençon line. Ms. Marietta Karamanli draws the attention of the Secretary of State to the Minister for Europe and Foreign Affairs to the Government's action in favor of tourism and in particular support for the activity of lodges in rural areas. This local tourism sector has more than 40,000 owners and offers more than 70,000 accommodations across France, which corresponds to a turnover of more than one billion euros. Since 2017, the law has provided for the obligation of affiliation to the social security regime for the self-employed (RSI) for individuals who derive income from their property rental activities whose amount exceeds a certain threshold, allowing them to be considered as earned income (23,000 euros); otherwise income from furnished tourist rentals is considered as property income only subject to social security contributions (CSG/CRDS) in rate of 17.2%. It is true that there was a risk of competition between people having activities declared to the tax administration and paying social contributions, either to the RSI or to the agricultural social mutuality (MSA) and the others. She would like to know whether an assessment could be made of the setting of this threshold with regard to the need to support local economic activity, offering the possibility to low-income families to go on vacation whether to the sea, the countryside or the mountains and also contribute to the attractiveness of territories, including to an audience outside France.

Ms. Marietta Karamanli draws the attention of the Minister of Economy and Finance to the situation of the Chambers of Commerce and Industry (CCI) which are economic development tools serving the territories, following the drastic reduction in the credits allocated to them via assigned taxes. The finance bill for 2018 provided for a reduction of 400 million euros over four years in allocated credits. Instead of giving visibility to CCIs on the evolution of their tax resources, government decisions have rather done the opposite. Their missions, namely support for the creation and sustainability of businesses and support for professional and higher education, are undermined, some fear having to put in place social plans and others, despite the choice to pool activities between themselves and with others partners, not being able to invest for the future. She asks him if an evaluation, by region and by department, can be carried out to support the said CCIs. She would like to know if the State intends to monitor which areas of activity are “impacted” and those which, depending on the projects of each of them, could be promoted and financed in a sustainable manner. Mrs. Marietta Karamanli draws the attention of the Minister of the Interior to the conditions of application of the specific seniority advantage (ASA) created by Law 91-775 of July 26, 1991 relating to various provisions relating to the civil service, for the benefit of civil servants working in difficult neighborhoods. This benefit corresponds to a seniority bonus of one month for each of the first three years of continuous assignment. in the eligible service then two months per additional year of continuous assignment. An interministerial decree of January 17, 2001 established the list of sectors eligible for the specific seniority advantage. It determined that only the police districts reporting to the general secretariats for police administration (SGAP) of Paris and Versailles benefit from it. The Council of State seized on the regularity of the decree considered (CE March 16, 2011) that the determination limited to the SGAP of Paris and Versailles constituted an error of law because it did not take into account the reality on the ground as affirmed by the law. Since then, this advantage has been open only to civil servants assigned to 161 public security districts (CSP) (mainland and overseas) specified by a decree of December 3, 2015 based on four criteria: rate of delinquency-numbers; effective rate of criminal violence; actual rate of outrages and rebellions; urban violence rate-effective. The new order is not retroactive. This results in differences in treatment that are sometimes inconsistent with the reality on the ground; Île-de-France and provincial services whose staff does not fall within a constituency, even with territorial jurisdiction, are excluded; many civil servants working in sectors affected by social and security problems do not benefit from this advantage; finally the criterion of numbers is called into question because it is sometimes disconnected from the delinquency observed. She wishes to know, on the one hand, how after the annulment of the first decree the careers of agents will be reconstituted by not depriving them of acquired rights, and on the other hand, how the 1991 law could be improved to allow an extension of the advantage by taking into account not only an assignment but also an exercise in difficult areas, finally how the implementing texts could concern all agents since their missions are actually carried out in a sensitive territory. Mrs. Marietta Karamanli draws the attention of Mrs. Keeper of the Seals, Minister of Justice, to the situation of children, adults living abroad and born to a French parent living in France. In the country of birth, these children may not have been recognized by the mother but only by the father. The act of recognition established by the mother after her child comes of age, if it establishes his filiation, has not, having regard to article 20-1 of the civil code, impact on nationality (Court of Cassation, 1st civil chamber, January 9, 2007). At the same time, a minor child born abroad and recognized by the mother abroad requires that his birth certificate be transcribed to the French authorities in the country. No deadline is set for requesting the consular transcription. In both cases, these children may encounter difficulties in coming to France family reunification title. Ms. Marietta Karamanli draws the attention of the Minister of Agriculture and Food to the standards set in terms of collective catering. In 2022, 50% (half) of the products (in value) served must meet one or more quality criteria and 20% must come from organic farming or farms in conversion. So-called “exotic” products such as certain fruits (citrus fruits, bananas), cocoa, coffee, olives, seafood and cured meats would constitute 43% of imports of organic products, with France producing no or very little of some of these products. The most imported product categories would be fruits, vegetables, groceries and non-alcoholic beverages. A study published in 2018 by the National Consumer Institute showed that certain organic products contained traces of undesirable substances (pesticides, plasticizers, solvents, veterinary residues and other contaminants). The study noted that “the pesticide levels found in the vast majority of products tested do not exceed the maximum residue limit (MRL)” but that this is high because it is the same as that applied to conventional products. They wish to examine measures aimed at both the material recognition due and the more global recognition of the Nation in their respects. The first case includes the request for a reconnection of the military disability pension point (PMI) with the evolution of prices, more compensation sensitive to the victims of nuclear tests, the effective application of the benefits of the double campaign to the combatants of North Africa. Ms. Marietta Karamanli draws the attention of the Minister of Solidarity and Health to the implementation of appropriate means aimed at combating Lyme disease and rapid and effective treatment of patients affected by this pathology. This infectious disease is caused by a bacteria (Borrelia) transmitted via a tick bite. This disease can affect various organs such as the skin, joints and nervous system. Its effects can be serious and disabling for those affected. It appears that there are various approaches to detecting the disease in possibly affected patients, detection by antibody tests or by a set of signs and symptoms (through a national diagnosis and care protocol). As it stands, many patients would not be identified early enough to benefit treatments limiting the appearance of later stages of the disease. She therefore asks him what initiatives have been taken by the ministry and health stakeholders to establish an effective strategy for prevention, fight against disease and patient care, particularly through better, broader and faster detection of the disease.

Ms. Marietta Karamanli draws the attention of the Minister of Action and Public Accounts to the effects of withholding tax for people benefiting from tax reductions for their accommodation in an accommodation establishment for dependent elderly people (EHPAD). The tax reduction is equal to 25% of the expenses retained within the annual limit of 10,000 euros per person accommodated. The maximum tax reduction is therefore 2 500 euros per person accommodated. The tax reduction normally applies to expenses actually incurred which are reduced by the amount of aid linked to dependency and accommodation such as the personalized autonomy allowance (APA) or social assistance from the department. In the case of a couple of people concerned taken as an example, the taxes before reduction are estimated at 3,182 euros; with the reduction of 2,500 euros, they should pay more than 682 euros. However, the State asks them to pay the entire amount due before reduction, i.e. 3,182 euros in 2019, before being reimbursed. In order to avoid any collection of a debt which would ultimately be noted as not being due, several solutions exist consisting either of modifying the ceilings or rates of reductions, or of neutralizing the taxation by taking into account the provisional nature of the amount due from that the situation linked to accommodation in an EHPAD is indicated and declared. Regularization would then take place later. She asks what initiatives the Government intends to take to neutralize a mechanism automatically increasing income tax without taking into account the legitimate reductions linked to old age and accommodation arrangements.

A disabled person can use the disability compensation benefit to compensate a family caregiver who, in any event, cannot be employed. The amounts received are nevertheless taxable under non-commercial profits and subject to social security contributions. In fact, many family caregivers stop working to be able to care full-time for a seriously ill, dependent or disabled loved one. The reasons may be the inability to finance a care assistant or to find a qualified person. The drop in income they may experience if they worked before is only partially compensated via the PCH, itself subject to social security contributions. These are the family caregiver's only professional income. She asks him if there is a regulatory possibility that extra-legal aid from the community could compensate all or part of the charges thus paid by the caregiver when the amount received from the PCH is modest. They are normally welcomed in an educational unit welcoming arriving allophone students (UPE2A). Sometimes they have only been speaking French for two or three years. During the French exams for the baccalaureate they are sometimes in a fragile situation not having regard to an insufficiency of work or success in the various subjects in which they prepare for the exam but due to the duration of the test being a little too short. The only adjustment they can make is the postponement of an early French year to the final year. The very study of texts has evolved, calling for a more collective and shared classroom approach to representations with reliable tools and cultural elements whose effect is lasting. but perhaps less noticeable on the day of the exam. Having limited help (dictionary) or slightly longer, supervised and monitored time could be a solution. In certain academies, slight adaptations of the description or the establishment of a list of texts to prepare and present, adapted, are also adapted, knowing that these adaptations vary, as they stand, from one academy to another. Ms. Marietta Karamanli draws the attention of the Minister of Action and Public Accounts to the effects of withholding tax for people who have experienced a drop in resources following taking parental leave in 2018. By making 2018 a blank year, parents who have taken such leave in 2018 will see their income drop but their taxes paid in 2019 will not take this into account. Conversely, parents who took it in 2017 will have seen their taxes decrease in 2018 and in other years their taxes will take into account their “maintained” income. Likewise, parents taking leave in 2019 will immediately see their 2019 taxes take into account the drop in professional income. All of them will have ceased their professional activity one year out of three years and therefore, all things being equal, have a similar loss of income but they do not will not see their situation treated equally. A mechanism should be provided to take into account the exceptional drop in 2018 income compared to 2017 income; this could take the form of a modernization tax credit for recovery to be used on 2019 or 2020 taxes, based on the difference in usual income and the reduction in 2018. She would like to know the measures envisaged by the Government to respond to the situation of parents who have seen their income drop over three years but for whom the time of leave modifies the tax following the implementation of recovery at source over the period.

According to INSEE data, nearly 8% of retirees (2014 data) live below the poverty line. However, geographical disparities are significant and the averages cover inequalities. Since 1987, pensions paid by the general social security system have evolved according to inflation, which should guarantee their purchasing power. However, several factors lead to an estimated difference for the lowest-income retirees of between 4% and 6% between resources and purchasing power after a little over twenty years of retirement: changes in pensions paid by other schemes (Agirc, Arcco, civil service); increases in social security contributions and taxes; increase in constrained expenses (gas, electricity, fuel). Net purchasing power deteriorated in the mid-1990s for retirees who suffered increases in social security contributions on pensions and developments specific to the Agirc regime or the civil service regimes. Ms. Marietta Karamanli draws the attention of the Minister of Solidarity and Health to the application of article 114 of the law to modernize our health system authorizing, as part of the care pathway, for patients suffering from a long-term condition, the attending physician to prescribe a physical activity adapted to the pathology, physical capabilities and medical risk of the patient. This article of law, which recognizes the role of physical activity in the preventive and curative care of patients and establishes sport on prescription, was the subject of an implementing decree dated December 30, 2016. The decree designates health professionals (those mentioned in articles L. 4321-1, L. 4331-1 and L. 4332-1) and the professionals authorized to deliver its activities.
