Mr. Philippe Chassaing questions the Minister of Agriculture and Food about the complexity of the “case-by-case” examination procedure imposed by the regional directorates for the environment, planning and housing (DREAL) prior to the planting of poplars. Today, clearings subject to authorization under the forest code with a view to land reconversion covering a total surface area (even fragmented) of more than 0.5 hectare (ha) are subject to review on a case-by-case basis. The first afforestation of more than 0.5 ha is also affected by this obligation. Also, owners wishing to transform a meadow or cultivated land into a poplar grove must engage in a procedure that is both long and complex, consisting of completing an 11-page Cerfa form (for which the explanatory note itself contains 10 pages) and waiting for the investigation phases by the DREAL (5 weeks minimum) and final decision by prefectural decree. Moreover, the issuance of authorization from the State representative conditions the right to benefit from aid schemes linked to afforestation. At a time when poplar resources are insufficient to satisfy industrial demand, this procedure is proving dissuasive for foresters who plan to invest in the planting of poplars, provided that the surface area of the plots to be afforested rarely exceeds 1 ha. Consequently, raising the threshold from 0.5 ha to 10 ha - surface area from which the owner can request approval of a simple management plan, in which environmental aspects can be taken into account in a more specific way - would be likely to revive poplar plantation projects. Thus, and without ignoring the usefulness of case-by-case examinations, he asks it to examine the advisability of relaxing the procedure for plots of less than 10 ha, in order to support the populculture sector and economy.

Mr. Philippe Chassaing draws the attention of the Minister of Ecological Transition to the consequences of Decree No. 2020-828 of June 30, 2020 (supplemented by an order of the same day) modifying the nomenclature and procedure in matters of water policing. This text provides that all work aimed at restoring the natural functionality of aquatic environments and ecological continuity is now subject to simple declaration (and not plus authorization) with, as a corollary, making environmental and social impact studies, public inquiries, as well as information for citizens and local residents' groups, obsolete. The direct impact is that it could be carried out more easily to destroy water environments of anthropogenic origin, that is to say shaped by man throughout history (bays, canals, ponds, bodies of water, etc.), without taking into consideration their ecological role (conservation of the biotopes which have been formed in these environments), tourism and heritage (the 60,000 mills of France representing the third heritage of the country). Indeed, the mills, which contribute to the richness of the landscapes and local heritage, when they are deprived of the watercourses which feed them, risk being condemned in the long term. While the authorization and investigation process public adversarial system consists precisely of a procedure for organizing consultative and deliberative democracy, its suppression should logically generate legal insecurity. In addition to the lack of information on the projects that could see the light of day in their department, associations and local elected officials fear that they will no longer be able to file litigation against the orders authorizing the destruction of "obstacles to ecological continuity” in watercourses. While the circular of April 30, 2019 relating to “the implementation of the action plan for a peaceful policy of restoring the ecological continuity of waterways” has, it seems, hardly allayed the concerns of elected officials and local residents' groups, the latter are now contesting the regulatory provisions aimed at overriding local consultation and are demanding a ecological transition which is not punitive, but “participatory” and reasoned, applied on a case-by-case basis, as close as possible to the field, with the assistance of all local actors and in the common interest of the territory. Mr. Philippe Chassaing draws the attention of the Minister of Solidarity and Health to the conditions of practice and replacement in pharmacies for indoor use (PUI). Since Decree No. 2017-883 of May 9, 2017, these conditions have evolved to become more strict. From now on, any pharmacist who wishes to practice in PUI must hold one of the specialized studies diplomas (DES) referred to in article R. 5126-101-1 of the health code public, unless you can prove that you have worked in PUI for a duration equivalent to two years full-time over the last ten years. Apart from this exceptional regime - which will end on June 1, 2025 - replacement within the PUI remains the prerogative of DES holders and, incidentally, pharmacy interns (under certain conditions). Mr. Philippe Chassaing draws the attention of the Minister of National Education and Youth to the difficulties encountered by educational establishments which welcome and educate refugee children, from nursery school to college, within the framework of the UPE2A system. Support and integration into their classes of these arriving children who speak no or very little French, who have sometimes never been to school, or who have been in Koranic schools, require special care and dedicated human, material and financial resources. However, some of these schools have indicated that they have to arbitrate between the support granted to students in the UPE2A system and the support granted to other children in school, which is obviously poorly accepted by families. In her constituency, the head of a college has alerted at the end of the 2017-2018 school year about the difficulty she had in closing her budget due to the inadequacy between the funding that had been allocated to her compared to the realities of her college. In fact, it is the very first establishment in Dordogne to open a class intended for arriving non-speaking students. This rural college, which today receives 23 students as part of the UPE2A, has not seen its resources increase to as much. The 3,000 euros allocated to this college from social funds were entirely used to cover tuition, accommodation and canteen costs for two students covered by the UPE2A system. It was a case of extreme urgency which required the arbitration of the head of the establishment, which does not contribute to the successful integration of these children into the school. This is the reason why he wishes to alert him of the risk incurred by this type of educational establishment. He asks him if it is possible to ensure that the social funds allocated to establishments no longer depend only on the number of establishments but on their real needs. If certain establishments manage a boarding school, in rural areas, and do everything possible to include allophone children, disabled children or children with great social or academic difficulties, cannot we attribute to them additional social funds based on objective criteria? Mr. Philippe Chassaing draws the attention of the Minister of Solidarity and Health to the remuneration of speech therapists in the hospital sector. The comparison in terms of career progress nevertheless shows significant differences between staff with equivalent university degrees in the hospital environment. During their career, the differences also tend to increase. Recent measures taken by the ministry in favor of practitioners hospitals has allowed an upgrade of the index scale and therefore of their number. However, gaps remain between staff with equivalent university diplomas. Also, he asks whether measures are being considered to harmonize the remuneration of health professionals working in the hospital sector, to make them more homogeneous with regard to the diplomas and autonomy of staff.

Mr. Philippe Chassaing draws the attention of the Minister of Culture to the subject of Decree No. 2017-1244 of August 7, 2017 relating to the prevention of risks linked to noise and amplified sounds. Members of the AGI-SON collective came to express their concerns about the application of this decree which risks disrupting the world of music. Several topics were discussed. First, lowering the dB(A) limit from 105 to 102 decibels and the new consideration of dB(C), produced by low frequency music, the limit of which is set at 118 decibels. However, dB(C) are very present in certain aesthetics such as electronic music or reggae among others. Thus, this music generally exceeds the limit of 118 dB(C), and this risks leading music professionals to the following dilemma: complying with the risks censoring certain musical aesthetics or avoiding this censorship but then becoming illegal. Secondly, this decree provides that the new limits must be measured in “any place accessible to the public”. Currently, measurements are established on averages, from now on they must be the same for everyone, whether you are in front of the stage or on the opposite side. This compliance of the rooms broadcasting amplified music risks having a significant cost for music professionals, which makes them worried. Consequently, he asks it to best support professionals in the sector by creating consultations so that everyone, institutional actors, health actors and music professionals, have participated in the reflection on the implementation of this decree and that they respond to concerns supported by the Agi-Son association.

M. Philippe Chassaing appelle l'attention de M. le ministre de l'agriculture et de l'alimentation sur le phénomène d'enfrichement des terres agricoles, qui tend à prendre de l'ampleur dans les espaces ruraux sans être pour autant suffisamment documenté. Conséquence de la déprise agricole et du morcellement du foncier, mais aussi de la négligence de certains propriétaires ou de successions en déshérence, l'enfrichement non maîtrisé soulève plusieurs problèmes majeurs, que ce soit en termes de sécurité civile (intensification du risque incendie), de salubrité publique (prolifération de gibiers nuisibles) ou d'aménagement du territoire dans une double perspective écologique (dégradation du paysage, modification des biotopes) et économique (frein à l'activité agricole). C'est la raison pour laquelle de nombreux élus ruraux et organisations professionnelles appellent de leurs vœux une réhabilitation de ces réserves foncières pour en préserver la finalité agricole. Si, à cet effet, il existe déjà une palette d'outils zonaux (ZAP, PPEANP, SCOT, PLUi), juridiques (procédures de mise en valeur des terres incultes ou des biens vacants et sans maître, obligation légale de débroussaillement, obligation d'entretien « pour motifs d'environnement ») et contractuels (baux ruraux tels que le commodat, conventions de mise à disposition avec la SAFER, associations foncières agricoles ou pastorales, obligations réelles environnementales), force est de constater qu'ils sont, pour certains d'entre eux, méconnus par les acteurs locaux et donc sous-utilisés, tant et si bien que la politique publique peine à réguler la multiplication des parcelles laissées à l'abandon. Cette difficulté découle de deux causes principales. La premiére est d'abord le flou définitionnel autour de la notion de « friche agricole », qui désigne aujourd'hui un état transitoire entre la terre inexploitée (depuis au moins trois ans) et le boisement (à partir de trente ans). La deuxiéme est , corollairement, l'inégale avancée des inventaires quinquennaux des friches par les commissions départementales de préservation des espaces naturels, agricoles et forestiers (CDPENAF). Bien qu'elles disposent d'une pluralité d'instruments pour appréhender la réalité de l'enfrichement dans chaque territoire (imagerie satellitaire, logiciels géomatiques comme « ID Friches », registre parcellaire graphique issu des déclarations PAC, fichiers fonciers « MAJIC » de la DGFiP, sans oublier les indispensables vérifications sur site), la plupart de ces instances n'ont semble-t-il pas encore entamé le travail de recensement par manque de temps et d'effectifs, mais aussi faute d'une méthodologie claire et harmonisée. Au total, si l'on peut saluer certaines initiatives locales, à l'instar de l'application collaborative « Open Friche Map » en région Provence-Alpes-Côte d'Azur, il demeure néanmoins impossible, à ce stade, de mesurer avec précision l'étendue de l'enfrichement des terres agricoles en France. Or l'identification rigoureuse des friches est un préalable nécessaire à l'application de plusieurs dispositions du code rural et de la pêche maritime, à commencer par la procédure de mise en valeur des terres incultes ou manifestement sous-exploitées (articles L. 125-1 à L. 125-15). C'est pourquoi il conviendrait de pouvoir quantifier le phénomène d'enfrichement à l'échelle nationale. Aussi, il l'interroge sur la possibilité de donner un véritable statut à la friche agricole qui serait ancré dans le droit rural. Il lui demande également la position du ministère sur l'opportunité de mettre en place un observatoire national du foncier chargé de dresser un état des lieux global de l'enfrichement et d'en suivre l'évolution sur la base des remontées des CDPENAF. À défaut, il souhaiterait connaître les propositions alternatives du Gouvernement pour piloter le travail de recensement des friches dans un souci d'efficacité et de cohérence entre les différents territoires. Enfin, il sollicite des éléments concrets permettant d'évaluer la pertinence et les limites des différents dispositifs existants en matière de prévention et de lutte contre l'enfrichement à outrance des terres agricoles.

Mr. Philippe Chassaing questions the Minister of the Interior following the promulgation of the decree fixing the change in the speed of vehicles on secondary two-way roads without a central divider from 90 km/h to 80 km/h in the Official Journal of June 17, 2018. The main argument of this measure, which was integrated into a set of provisions, is to reduce the number of deaths on the roads and the number of injuries. Six months later, this essential measure for preventing road accidents has remained unpopular, particularly in rural areas. Also, in order to facilitate its acceptance by the population, the question of the use of the additional reports, undoubtedly resulting from the difficulties in changing one's driving habits, is essential. It would indeed be useful if we could be precise about the use of funds collected in the form of fines since July 1, 2018, but also on the increase in the volume of fines following this transition. Mr. Philippe Chassaing draws the attention of the Minister of National Education to the teaching of economic and social sciences (SES) and their appearance in the common core in second grade, as part of the high school reform that he is currently leading. The MP reminds him that at the end of the 1960s, the SES were introduced to high school and formed what the teaching staff called a third culture alongside the humanities and sciences by giving birth to a new sector, B or ES. Today, this sector represents a third of general baccalaureate holders, it seems obvious to be interested in this teaching and what it conveys. Several reports have pointed out the lack of knowledge of young French people in sociology and economics. The appearance of SES within the common core is a first step. Indeed, this would raise awareness of mechanisms of society and issues such as growth, employment or inequalities and to familiarize them with the world of business. Furthermore, as this subject has its own stream, it would be welcome if SES were taught in the same way as literature or science in order to provide students with a real common base of knowledge. Based on this idea, he asks him if it would be possible, in his opinion, for the SES to be taught in second grade from 3 hours per week.

Mr. Philippe Chassaing draws the attention of the Minister of Solidarity and Health to the request and proposal from the MSA Tutelles Association, a structure in charge of managing legal protection measures, created by the MSA Dordogne Lot et Garonne to help isolated people who cannot manage themselves and reside in the department. The department is very concerned due to the aging of its population, the isolation people both at the family level and because of their residence, very often in sparsely populated rural areas. Each management structure benefits from an allocation intended to finance all of its expenses. A forecast number of measures is also defined but it very rarely corresponds to the needs and the number of measures actually distributed by the judges. This leads associations to refuse measures if the number budgeted is achieved or to manage unfunded measures. It does not lead to the search for maximum efficiency. The establishment of a multi-year contract of objectives and means (CPOM) would provide security for financiers and managers, and would induce dynamic and responsible management. This approach planned by the State could not be implemented in Dordogne. The MSA tutelles association would like to be able to experiment with it and would commit to very specific objectives both in terms of cost and quality. The originality of the proposed approach would lie in the fact that in return for these commitments, the activity would no longer be supervised in order to better meet the needs of the territory. The Association also suggests being able to experiment when possible with the implementation of administrative support measures for the benefit of families, which would reduce the number of guardianship measures stricto sensu and therefore the expenses. This is why he asks him if setting up such an experiment is possible.

M. Philippe Chassaing attire l'attention de Mme la ministre des sports sur le manque d'encadrement de la loi concernant les ball-traps permanents. La loi régissant l'installation d'un ball-trap (article A. 322-142 du code du sport) semble être suffisante pour les ball-traps ponctuels (évènement temporaire) mais pas pour les établissements permanents. Les ball-traps permanents impliquent des nuisances sonores, environnementales continues et non négligeables. À ce titre, il souhaite l'alerter sur le cas particulier de la commune de Servanches en Dordogne qui a vu s'installer un ball-trap permanent. La loi du 20 décembre 2014, dite loi de simplification administrative, a permis cette installation sans demande d'autorisation ni dépôt d'un dossier d'évaluation d'incidences. Une association d'habitants de cette commune a fait la démonstration des conséquences néfastes de cette installation en termes de nuisances sonores, et de pollution des sols et de l'eau en raison de l'utilisation et de la concentration de métaux lourds (plomb) dans les cartouches. Les plaintes des habitants, avec l'appui d'un collectif, ont conduit la préfecture de la Dordogne à suspendre cette activité le temps d'une mise en conformité concernant les nuisances sonores. Un rapport de l'ARS avait en effet mis en évidence des nuisances sonores au-delà de la limite légale et relevé des dysfonctionnements en matière de sécurité. Il semble que la pollution causée par l'usage de grenaille de plomb ne fasse en revanche l'objet d'aucune restriction pour l'instant. Toutefois, cet arrêté étant suspensif, la mise en conformité par le propriétaire pourrait lui permettre de rouvrir son centre de tir. Aussi, il se permet de l'interpeller car l'implantation de telle installation de manière permanente peut faire l'économie d'une autorisation administrative basée sur une étude d'impact et d'une communication publique.

L'accessibilité des services au public est au cœur des missions portées par le ministère de la cohésion des territoires. En effet, il s'agit de s'assurer que the whole ofs citoyens aient accès à des services adaptés à leurs différents besoins, sur tout le territoire. Le ministère de la cohésion des territoires est pleinement impliqué dans la lutte contre les fractures territoriales. Comme il a pu être évoqué lors de la réunion organisée fin septembre par la préfète de Dordogne dans le cadre de la conférence nationale des territoires, deux outils sont utilisés à ce titre: les schémas départementaux d'amélioration de l'accessibilité des services au public et les maisons de services au public. Les schémas départementaux d'amélioration de l'accessibilité des services au public, co-élaborés par le préfet de département et le président du conseil départemental, en associant les établissements publics de coopération intercommunale (EPCI), sont basés sur un diagnostic de l'offre de services à l'échelle départementale et prévoient un plan d'actions sur 6 ans aimed at renforcer l'armature des services. Le schéma prévoit notamment un plan de mutualisation qui peut notamment être concrétisé par la création de maisons de services au public. Les maisons de services au public (MSAP) délivrent une offre de proximité à l'attention de tous les publics et participent aux actions de l'État en matière de médiations numérique, sociale et environnementale. Ainsi, de l'information transversale de 1er niveau à l'accompagnement de l'usager sur des démarches spécifiques, les MSAP articulent présence humaine et outils numériques. Elles rassemblent, dans un lieu unique, des agents qualifiés et formés à l'accueil et à l'information du public, et plus particulièrement au développement de la technologie numérique et de ses usages (notamment la visio-conférence) qui permettent d'améliorer l'efficacité des services au public, voire de réduire les distances. Aujourd'hui, 1200 Maisons de services au public sont ouvertes sur the whole of territoire, portées par des collectivités, des associations ou par le groupe La Poste. Dans le département de la Dordogne, 12 Maisons de services au public sont d'ores et déjà déployées. Les trésoreries peuvent être partenaires des MSAP et y être présentes sous une forme permanente ou assurer des rendez-vous. Avant de poursuivre leur déploiement, le ministère de la cohésion des territoires souhaite connaître les ambitions exprimées dans le cadre des schémas par les acteurs locaux qui seront compilés et analysés par le commissariat général à l'égalité des territoires avant la fin du premier semestre 2018. Ce travail permettra, dans le cadre du dialogue mis en œuvre par la conférence nationale des territoires, de déterminer en lien avec les collectivités le niveau d'un éventuel déploiement complémentaire.
