Mr. Damien Girard draws the attention of Mr. Keeper of the Seals, Minister of Justice, to the situation in the Lorient-Ploemeur penitentiary center and to the consequences of prison overcrowding and lack of staff on detention conditions, staff working conditions and preparation for reintegration. The establishment has a theoretical capacity of 227 places, while its criticality threshold is set at 400 detained people. During his visit, on August 26, 2026, the penitentiary center accommodated 408 people, after reaching a peak of 416 people in July 2026. Currently, 27 people sleep on a mattress placed on the floor, after having been up to 60 in July. The establishment's kitchen is also designed for a maximum of 400 meals. The visit report of the Lorient Bar Association of July 22, 2025 already alerted to this situation. It noted that the criticality threshold had been reached or was about to be reached and highlighted the consequences of overcrowding on the operation of the establishment, particularly in terms of security and access to care, showers, visiting rooms, activities, training and food. This situation is made worse by the lack of staff. The report mentions 111 personnel in uniform, excluding ranks, or around 90% of the theoretical workforce, with six vacant positions, without even counting absences. He emphasizes that this deficit limits the exercise of several rights of detained persons, in particular access to family life units (UVF), care and activities and also affects security conditions. The Lorient prison integration and probation service (SPIP) is also faced with a lack of staff, while it plays an essential role in preparation for release, reintegration and prevention of recidivism. The lack of prison staff would explain in particular the current impossibility of opening the UVF. Since the 2009 prison law, access to these devices has been provided for detained persons. In Ploemeur, the premises have been built and are ready to operate. The people detained are thus deprived of an essential system for maintaining links with their loved ones, particularly with their children. However, maintaining these links constitutes an important lever for reintegration and prevention of recidivism. It therefore appears particularly regrettable that premises already built and immediately available cannot be used due to lack of human resources. A capacity expansion is also planned at the center Lorient-Ploemeur penitentiary, with the installation of prefabricated structures allowing the creation of 50 additional places. Although this extension will partially respond to current difficulties, it cannot constitute, on its own, a lasting response to prison overcrowding. The bar report also highlights the difficulties likely to be caused by this new organization, particularly in terms of security and coordination with the existing establishment. In this context, the MP asks the Minister of Justice what measures the Government intends to take to quickly reduce prison overcrowding at the Lorient-Ploemeur penitentiary center and to fill vacant positions and reinforce the staff necessary for its proper functioning. In particular, he wishes to know the means and timetable planned to enable the effective opening of family life units. He also asks what measures are being considered to strengthen the workforce at the Lorient SPIP, which is essential for supporting detained people, preparing for their release and preventing recidivism.

M. Damien Girard attire l'attention de Mme la ministre des sports, de la jeunesse et de la vie associative sur la situation démocratique préoccupante au sein de la Fédération française de savate boxe française et disciplines associées (FFSBF et DA). La Fédération, délégataire d'une mission de service public et placée sous tutelle du ministère des sports, traverse en ce moment une crise institutionnelle, alors que de nombreux membres démissionnent ou se mettent en retrait à la suite de conflits liés à son fonctionnement. Ses anciens membres démissionnaires révèlent notamment des difficultés d'accès aux documents financiers, des procédures disciplinaires engagées contre des responsables ayant exprimé des désaccords, des atteintes à l'impartialité de ces procédures, un fonctionnement anormal des instances fédérales, ainsi qu'une circonscription de la capacité de décision à un nombre limité de dirigeants. Cette situation pose la question du contrôle de l'État sur les fédérations sportives délégataires de service public et de leur fonctionnement démocratique, notamment quant aux garanties offertes aux bénévoles qui exercent des responsabilités électives. ll lui demande donc quelles sont les actions qu'elle entend mettre en œuvre pour s'assurer du bon fonctionnement démocratique de la fédération délégataire et du respect des droits des élus bénévoles.

Mr. Damien Girard draws the attention of the Minister Delegate to the Minister for Ecological Transition, Biodiversity and International Negotiations on Climate and Nature, responsible for the sea and fisheries, to the inadequacies of the seventh regional nitrate action program (PAR7) in the fight against the proliferation of green algae on the Breton coast, in particular concerning mudflats and activities economics that depend on it. Following the conviction of the State by the administrative court, on March 13, 2025, for its shortcomings in the application of European and national regulations intended to protect waters against pollution of agricultural origin, the prefecture of Brittany initiated the revision of PAR7. This new version of PAR7 defines “challenged areas”, representing approximately 20% of the Breton surface area. These areas finally include some of the mudflat watersheds, until now excluded from plans to combat green algae, even though they account for nearly 84% of the ulva stranding areas. In these problem areas, a cap on total nitrogen inputs must be established. In its opinion of June 26, 2026, the environmental authority, however, underlines the limited scope of this measure, the planned ceilings being considered too high, only applying for a period of two years and being restricted to certain territories. Furthermore, the classification of mudflat watersheds as problematic areas is based on a threshold of 29 mg/l of nitrates present in watercourses. This threshold is in no way justified and the proliferation of green algae in the mudflats also depends on other particular factors, still little studied, such as their intense exposure to light or their low exposure to winter storms, which encourages the accumulation of algae from one year to the next. This single criterion also leads to inconsistent situations, such as in the harbor of Lorient where part of the Blavet watershed is classified as a high-stakes area, unlike the Scorff, even though both supply the same mudflat area. The environmental authority highlights the need to define specific objectives for each environment, taking into account not only nitrate concentrations, but also nitrogen flows, phosphorus inputs and stocks and other parameters influencing the development of green algae. These mudflats constitute essential reservoirs of biodiversity, serving as nurseries for numerous species of fish, molluscs and birds. Their degradation weakens the trophic chain and all economic activities that depend on it, notably fishing and oyster farming. Green tides on mudflats therefore require particular attention, based on in-depth studies carried out on a case-by-case basis on each of the sites concerned. Thus, although PAR7 presents significant developments in the fight against green algae, it still appears largely insufficient to protect coastal ecosystems, particularly mudflats, as well as all the activities that depend on it, in particular fishing and aquaculture. He therefore asks what measures the Government intends to implement to respond to the injunction to take “all necessary measures” in order to protect coastal waters and the economic activities that develop there, in addition to the only regulatory system announced. He also asks him how the Government understands better integrate mudflats into the plan to combat green algae and whether it plans to conduct studies to define, for each bay and each mudflat, objectives adapted to their ecological specificities.

Mr. Damien Girard draws the attention of the Minister of Labor and Solidarity to the consequences of the delay in publication of the implementing decrees relating to the suspension of the 2023 pension reform, provided for by the social security financing law for 2026, adopted by Parliament in December 2025 and whose entry into force is set for September 1, 2026. To date, lack of publication of these decrees in the Official Journal , the suspension voted by the national representation has no effect. Therefore, Retirement Insurance is not able to confirm to policyholders their retirement dates and continues, in fact, to apply the rules resulting from the 2023 reform. This situation directly penalizes policyholders close to the liquidation of their rights, in particular those born in 1963 and at the beginning of 1964 for traditional careers, as well as than those born in 1964 and 1965 for long careers. For these groups, the lack of effective application of the suspension can result in several additional months of activity. This situation places them in a situation of uncertainty which is all the more detrimental as retirement applications must be submitted several months before the desired effective date. Policyholders are thus prevented from calmly organizing their end career and anticipate their administrative and financial situation. He therefore wishes to know the deadlines within which the implementing decrees will be published, in order to ensure rapid implementation of the suspension decided by the national representation and to provide policyholders as well as pension organizations with essential visibility.

Les zones de protection forte visent à assurer une protection renforcée des espaces terrestres et maritimes présentant des enjeux écologiques significatifs. Elles s'inscrivent dans le cadre de la Stratégie nationale pour les aires protégées 2030 et répondent à l'objectif national de protéger 30 % des écosystèmes terrestres et marins et 10 % sous protection forte. Une zone de protection forte est définie par le décret n° 2022-527 du 12 avril 2022 pris en application de article L. 110-4 du code de l'environnement comme « une zone géographique dans laquelle les pressions engendrées par les activités humaines susceptibles de compromettre la conservation des enjeux écologiques sont absentes, évitées, supprimées ou fortement limitées, et ce de manière pérenne, grâce à la mise en œuvre d'une protection foncière ou d'une réglementation adaptée, associée à un contrôle effectif des activités concernées. » Il s'agit d'une labellisation permettant de reconnaître un haut niveau de protection qui est préalablement garanti par un outil règlementaire limitant ou supprimant les pressions humaines pouvant compromettre la conservation des habitats, espèces et services écosystémiques, de manière pérenne, comme par exemple un arrêté de protection de biotope, une réserve naturelle ou des réglementations permettant la mise en œuvre des documents d'objectifs de sites Natura 2000. Préalablement à leur adoption, ces outils réglementaires font l'objet d'une phase de concertation prévue par le code de l'environnement à laquelle les professionnels de la conchyliculture, mais aussi de la pêche à pied, tout comme les pêcheurs de loisir ou tout autre usager de ces espaces peuvent contribuer. Les zones de protection forte ne sont pas des espaces « sous cloche »: des activités humaines peuvent être présentes dans ces zones à condition qu'elles respectent les critères du décret n° 2022-527. Pour cela, l'instruction technique du 8 septembre 2025 relating to la reconnaissance des zones de protection forte des espaces maritimes précise qu'une analyse sera réalisée au cas par cas, et liste des activités jugées comme devant faire l'objet d'une vigilance et de limitations particulières. Bien que non exhaustive, cette liste ne mentionne pas les activités conchylicoles. Dans le cadre de la mise à jour des stratégies de façades maritimes en fin d'année dernière, les services de l'Etat en façade ont identifié des zones prioritaires pour le développement de la protection forte. Ces zones, qui ont fait l'objet de la décision ministérielle du 17 octobre 2024, ont été largement concertées lors du débat public « La Mer en débat » qui s'est tenu du entre novembre 2023 et avril 2024 sur les quatre façades maritimes métropolitaines. L'objectif de cet exercice de planification spatiale en mer est de concilier les différents usages de la mer et des littoraux dans le respect des écosystèmes. Il garantit le développement de la conchyliculture, activité essentielle à la vitalité des territoires littoraux. La notion de jachère de l'estran repose sur la mise au repos temporaire de certaines zones de l'estran afin de favoriser la restauration des habitats naturels et la reconstitution de l'écosystème. Elle ne relève pas d'une nouvelle catégorie d'outils juridiques mais s'appuie sur des outils réglementaires existants qui ont fait l'objet d'une phase de concertation avant d'être adoptés, par exemple des arrêtés de protection de biotope, des arrêtés de protection des habitats naturels, des arrêtés d'occupation temporaire du domaine public maritime naturel ou tout autre dispositif adapté aux spécificités du site entrainant une protection des habitats et espèces de l'estran, dont l'application peut être limitée dans le temps. Ainsi, la jachère de l'estran désignée sur l'île de Ré en janvier 2026 s'inscrit au sein de deux sites Natura 2000 identifiés pour le fort intérêt écologique de la zone, notamment pour la nidification du Gravelot à collier interrompu, et s'appuie sur la protection réglementaire associée. Le développement des activités ostréicoles fait l'objet dans ce cadre d'une évaluation d'incidences, telle que prévue par le code de l'environnement.

Mr. Damien Girard alerts the Minister of Agriculture, Agri-Food and Food Sovereignty of the risk of closure of the last local slaughterhouse in Morbihan. The number of slaughterhouses in France has declined sharply in recent decades, from around 400 in 2003 to nearly 220 today. Nearly 30% of these slaughterhouses are public and provide an essential slaughtering service, particularly for farmers and farmers engaged in short circuits. These structures face increasing profitability difficulties. Although the closures concern both public and private slaughterhouses, volumes tend to be concentrated in a limited number of large private slaughterhouses. There is thus an economic and geographical concentration of this essential link in the sector for the benefit of large industrial groups. Many slaughterhouses nearby suffer from competition from much larger slaughterhouses, processing much higher volumes. For two years, the rate of closure of these local slaughterhouses has accelerated, with at least one closure per month. The disappearance of a local slaughterhouse has direct consequences for breeders. Certain services become inaccessible, such as the emergency slaughter of injured animals, and transport distances lengthen considerably. Breeders must travel tens of additional kilometers for slaughter and then to recover the carcasses, which significantly increases their workload and their costs, in a context where working conditions are already grueling and cash flow is weakened. Due to a lack of a nearby slaughterhouse, some farms are forced to cease their activity. However, local slaughterhouses constitute an essential link in the food chain. They make it possible to limit workloads, to promote peasant breeding, to support short circuits and direct sales, guaranteeing better remuneration for breeders. They also allow farmers to keep an eye on the slaughter conditions of their animals. Their disappearance leads to a loss of value for local livestock and a shift towards long distribution circuits which do not benefit the territories. In 2023, the Ministry of Agriculture initiated diagnostic work to build a “slaughterhouse strategy”, intended to respond to the crisis in the sector. This approach, however, did not result in any concrete action and appears to have been abandoned. In Morbihan, the Vannes slaughterhouse, the last multi-species slaughterhouse of the department, could close soon. Breeders risk finding themselves unable to have their animals slaughtered and, consequently, to continue their activity. This means that all livestock farming in the territory is under threat. Faced with this situation, breeders have organized themselves to create a cooperative society of collective interest, the SCIC abattoir des breeders du Morbihan (SCIC ADEM), with the aim of maintaining a sustainable local slaughterhouse. The prefect of Morbihan was opposed to the creation of a new slaughterhouse, for fear of competing with the existing private slaughterhouse in Vannes. It was then agreed that this slaughterhouse could be taken over by SCIC ADEM, a project financially supported by the Gulf of Morbihan - Vannes agglomeration community. Studies relating to buildings, land and the equipment was carried out in 2024. However, in September 2025, the owners of the Vannes slaughterhouse indicated that they did not wish to sell the slaughterhouse at the proposed price and announced its closure, despite the dialogue efforts undertaken by the prefecture, the community and the SCIC. He therefore asks her what actions she intends to implement to save the last slaughterhouse in Morbihan and, more broadly, to support and sustain local slaughterhouses throughout the country.

Mr. Damien Girard questions the Minister of Cities and Housing on the consequences of the new ANAH agreement terms on the supply of social housing in the private sector. The new agreement rules of the National Housing Agency (ANAH), implemented since 2022 through the Loc'Avantages systems (Loc 1, Loc 2 and Loc 3), aim to encourage the mobilization of private housing for social purposes, in return tax advantages. However, these tax advantages are now attributable to personal income tax and no longer, as before, to property income. This development raises serious difficulties on the ground and raises numerous questions among owners engaged in social or very social rental approaches. In Lorient, for example, a rental intermediation association, engaged for more than ten years in housing people in very precarious circumstances, including families with children, relies on a stock of nearly thirty private sector housing units. Until now, the use of social or very social ANAH agreements made it possible to convince supportive owners, thanks to significant tax reductions that partially compensate for deliberately very moderate rents. But the new regime questions stakeholders in the field on the effects of the reform, concerning owners who are not taxed on their earned income, on a possible accumulation of tax advantages for owners renting several dwellings and on the possibility of allowing bare owners to benefit from the system when the usufructuary is not subject to income tax. It appears that neither ANAH nor ADIL provide any precise answers on these issues. He is therefore questioning it so that a precise response on these particular cases is provided to housing stakeholders on the terms of ANAH agreement on the supply of social housing in the private sector and so that a comprehensive educational methodological guide can be made public on the ministry's website.

Mr. Damien Girard alerts the Minister of Labor and Solidarity on the consequences of the reduction in financial aid for work-study programs in higher education. Work-study training is an essential lever for professionalizing students, which makes it possible to combine academic training and integration into the world of work. This is why it is the subject of public support, in particular through unique learning aid. Thus, in Brittany, many university courses, such as the Masters in Cultures and Transitions at Sciences Po Rennes and Cultural Heritage, Natural Heritage at Bretagne Sud University, include work-study as an integral part of their educational approach. These bac +5 level courses train highly qualified professionals, called upon to exercise non-relocatable professions, at the service of territories, heritage, culture and connections. social. Work-study allows a strong anchoring in the realities on the ground and responds directly to the needs of local cultural actors: associations, local authorities, public cultural establishments, museums, heritage sites... However, reception structures, often financially weakened in the cultural sector (especially associations), cannot bear the cost of welcoming a work-study student alone without the state support. The Government has initiated, through the finance laws for 2025 and 2026, a progressive but significant reduction in public support for work-study programs, which would have direct and immediate consequences: drop in the number of work-study contracts, weakening of the public university courses concerned, decline in access to these professions for the least advantaged students and ultimately weakening of policies cultural and heritage in our territories. Furthermore, the obligation imposed on a student without a contract three months after the start of the school year to leave their training appears incompatible with public service missions. It is not a question here of defending a system in an undifferentiated manner, but of pleading for targeted and reasoned maintenance of work-study assistance for sectors which are fully in the general interest and the sector associative and which do not have access to the same financing capacities as other sectors of activity. If the reduction of the deficit and the fight against certain excesses are justified - in particular those of private training built or developed to capture this financial resource -, this effort cannot have the consequence of weakening essential training in already fragile sectors, such as culture and the sector associative. In this context, he asks what work-study support measures will be reserved for the associative and cultural sector, particularly for bachelor's and master's level training, which are particularly in need.

Mr. Damien Girard questions the Minister of National Education on the serious shortcomings of taking into account regional languages and in particular Breton, in the reform of initial teacher training. While teaching today constitutes the main vector of transmission of the Breton language, the recent sociolinguistic survey commissioned by the Brittany Region highlights a worrying drop in the number speakers: only 2.7% of residents say they speak Breton “very well” or “fairly well”, while more than half of the population is unaware of the existence of Gallo. This situation makes a proactive teacher training policy essential. However, despite the commitments made by the State within the framework of the Brittany State-Region convention for the transmission of the languages of Brittany (2022-2027) and the provisions of the law of May 21, 2021 known as the “Molac law”, the ongoing reform of school teacher training does not make it possible to meet the specific needs of bilingual education. The announced creation of a new training course in Rennes is not accompanied by the transformation of the education sciences license backed by a PPPE in Brest into a bilingual school teaching license (LPE), nor by the opening of a bilingual LPE French-Breton in Rennes. The LPE “Breton language course” license announced for the start of the 2026 school year provides for linguistic reinforcement limited to 100 hours over three years, a volume that is clearly insufficient in view of the requirements of the special external “regional languages” competition, whose language tests represent 30% of the overall mark. Furthermore, the decree of January 12, 2026 establishing the national framework for teaching and education masters does not contain any reference to regional languages or bilingual education, contrary to the objectives set by article L. 312-11-2 of the education code, which provides for the teaching of regional languages as part of the normal timetable. The planned margins for territorial adaptation, limited to 10% of the hourly volume, do not make it possible to build coherent training in bilingual education. This situation contrasts with the systems put in place in other territories, notably in Corsica or New Aquitaine, where structured bilingual licenses and courses are being deployed. It compromises the creation of a pool of candidates for the specific recruitment competition for Breton-language school teachers, even though the need for bilingual teachers is proven. Finally, the lack of training for “non-bilingual” teachers to the teaching of regional languages makes the application of the “Molac” law illusory, while comparable training exists for the teaching of modern foreign languages in primary school. In this context, he questions him on the measures that the Government intends to take to: fully integrate regional languages into initial teacher training; create teaching licenses for bilingual schools French-regional languages adapted to the real needs in terms of Breton language training for future teachers; and guarantee, in accordance with the law, the effective right of students to the teaching of Breton during school time.

Mr. Damien Girard questions the Minister Delegate to the Minister of the Armed Forces and Veterans about the Fonderie de Bretagne. He asks her if she is going to let the financiers decide the fate of the Fonderie de Bretagne, a tool of sovereignty for the French defense industry. The Fonderie de Bretagne located near Lorient produced for the automobile industry and for Renault for decades. But from 2024, this donor of order, although at the origin of the Foundry, abandoned it, to relocate its subcontracting. Result: judicial recovery and the technical unemployment of nearly 300 employees. A buyer appeared: Europlasma, arrived thanks to the help of the State and local authorities. We produced no shells, zero,” warns the CGT of the site. “We are still very partially active. And we don't see Europlasma's desire to truly invest in industrial facilities.” He This is a highly strategic sector. At a time when the word "sovereignty" is on everyone's lips, found in every speech, the State should be concerned about the situation of the Fonderie de Bretagne and its 260 employees: should their fate be left in the hands of financiers? Why not put this company in the hands of Thalès, the new client? Why not nationalize, at least temporarily, to (re)build the sector? At a minimum: Will the Minister set up a committee to monitor the investments promised by the buyer Europlasma? He would like to know his position on this subject.

Mr. Damien Girard alerts the Minister for Europe and Foreign Affairs about the situation of the Kurds in Syria. The recent offensive by the Syrian government, led by Ahmed Al-Charaa, on January 13, 2026, against the Kurds of Rojava breaks the integration agreement signed in March 2025. It destabilizes a region already bloodless, both by the resumption of clashes and by the de facto release of several hundred Islamist fighters who were previously held by the Autonomous Administration of North and East Syria (AANES). The decisive contribution of the Kurds in the fight against Daesh cannot be forgotten. France must remain loyal to its allies, contribute to the credibility of the ceasefire and fully play its role as mediator. It must commit, to the fullest extent of its means, so that a political solution is found, allowing the return of peace and respect for the fundamental rights of Syrian Kurds. The European Union also has a role to play, in particular by mobilizing commercial leverage to exert pressure. The end of the clashes must lead to effective guarantees of security and autonomy, ensuring respect for the fundamental rights of the Kurds. This is an essential condition for lasting peace and the reconstruction of Syrian territory. He asks her therefore the measures he intends to take so that his positions in favor of the Kurds translate into concrete actions and real guarantees.

Mr. Damien Girard alerts the Minister of Culture about the withdrawal of the culture-defense protocol from the citadel of the Morbihan commune of Port-Louis. This decision comes without prior information and directly threatens the budgets devoted to the maintenance and restoration of this historical heritage of the country of Lorient. The citadel houses the Maritime Museum and the East India Company Museum, the latter being the property of the city of Lorient. The exit from the protocol raises fears of a disengagement of the State, in particular of the regional directorate of cultural affairs of Brittany, whose technical and financial support is essential to the preservation of this exceptional site. Mr. Damien Girard alerts the Minister of Agriculture and Food Sovereignty to the scale of ammonia emissions in France, their deleterious effects on public health and the environment as well as the lack of transparency in the publication of data relating to these emissions. Ammonia is a toxic gas, 94% produced by agricultural activities (97% in Brittany, according to Air Breizh, an approved association for monitoring ammonia). air quality), in particular industrial livestock farming and the excessive use of nitrogen fertilizers. Aucune autre disposition législative ne conditionne l'accès à l'école à la maturité physiologique des enfants. Tout enfant de plus de 3 ans doit donc pouvoir être inscrit dans une école maternelle. Cependant, il est prévu que les enfants scolarisés en petite section d'école maternelle puissent bénéficier, à l'initiative de leur famille, d'un aménagement de leur temps de présence à l'école. La loi du 26 juillet 2019 précitée n'emporte pas nécessité de modifier le statut particulier du cadre d'emplois des agents territoriaux spécialisés des écoles maternelles (ATSEM). Le décret n° 2018-152 du 1er mars 2018 indique explicitement que les ATSEM sont chargés de l'assistance au personnel enseignant pour l'accueil et l'hygiène des enfants, et qu'ils peuvent également assister les professeurs dans les classes accueillant des enfants à besoins particuliers. Le décret n° 2018-152 du 1er mars 2018, à la suite d'une concertation menée sur la base d'un rapport des inspections générales de l'administration et de l'éducation nationale, avec l'Association des maires de France et les représentants du personnel, a revalorisé le statut des ATSEM, notamment en renforçant les perspectives d'évolution de carrière et en leur ouvrant des voies d'accès, par concours interne ou par promotion interne, aux cadres d'emplois des agents de maîtrise (catégorie C+) et des animateurs territoriaux (catégorie B). Les ATSEM sont, en outre, éligibles au nouveau dispositif global de promotion interne tel qu'il résulte du décret n° 2023-1272 du 26 décembre 2023 modifiant les dispositions statutaires relatives à la promotion interne dans la fonction publique territoriale. La promotion interne des agents des collectivités territoriales est soumise à des quotas. Ce décret est venu assouplir ce mécanisme de contingentement avec notamment le passage de la règle de 1 promotion pour 3 recrutements externes à la règle de 1 pour 2, en vue de faciliter la promotion des agents et de simplifier la gestion des ressources humaines par les employeurs territoriaux. Pour ce qui concerne la rémunération, les employeurs territoriaux disposent d'importantes marges de manœuvre dans le cadre du régime indemnitaire tenant compte des fonctions, des sujétions et de l'engagement professionnel (RIFSEEP), applicable au cadre d'emplois des ATSEM en application du principe de parité défini à article L. 714-4 du code général de la fonction publique, pour valoriser les missions des ATSEM dans la limite d'un plafond fixé à 12 600 euros annuels bruts. S'agissant du temps de travail, la durée annuelle de travail des ATSEM est celle du droit commun, soit 1607 heures en vertu de article 1er du décret n° 2001-623 du 12 juillet 2001 relating to l'aménagement et à la réduction du temps de travail dans la fonction publique territoriale. L'organe délibérant peut, néanmoins, après avis du comité social territorial, réduire la durée annuelle de travail pour tenir compte de sujétions liées à la nature des missions et à la définition des cycles de travail qui en résultent, et notamment, en cas de travail en équipes ou de modulation importante du cycle de travail (art. 2 du décret de 2001 susvisé). Le juge rappelle que le champ des dérogations à la durée annuelle de travail de 1607 heures est « expressément limité aux seules hypothèses de sujétions intrinsèquement liées à la nature même des missions » (CAA Paris 13 décembre 2021 N° 21PA05761). S'agissant de la retraite, certains emplois de la fonction publique territoriale présentant un risque particulier ou des fatigues exceptionnelles sont classés dans la catégorie active et ouvrent la possibilité de partir de manière anticipée à la retraite sous certaines conditions. Le classement des emplois dans la catégorie active est fixé par arrêté du 12 novembre 1969 relating to classement en catégorie active de certains emplois des agents de la fonction publique territoriale et de la fonction publique hospitalière, plusieurs fois modifié. Au regard de la définition très restrictive de la catégorie active et des cadres d'emplois concernés par celle-ci, la catégorie active n'a pas été étendue aux ATSEM. Enfin, il est à noter que les conditions de travail des ATSEM ont fait l'objet d'un axe prioritaire du Fonds national de Prévention (FNP) géré par la Caisse nationale de retraites des agents des collectivités locales (CNRACL). Un appel à projets a ainsi été lancé en février 2020 afin d'inciter les employeurs territoriaux à déployer des démarches de prévention spécifiques au métier d'ATSEM. A l'issue, le FNP a publié des recommandations afin d'aider les employeurs territoriaux à la compréhension des risques, la réalisation de diagnostics et la mise en place de plans d'actions afin de prévenir les risques. Le Gouvernement attentif aux conditions de travail et à l'attractivité du métier d'ATSEM s'est mobilisé pour la rédaction d'une charte d'engagement pour une meilleure reconnaissance des compétences professionnelles des ATSEM. Cette charte a été signée le 21 novembre 2023 par le Gouvernement et les employeurs territoriaux. L'objectif est de favoriser la reconnaissance du rôle joué par les ATSEM au sein des écoles maternelles pendant le temps scolaire, de faciliter la relation avec les personnels enseignants et plus globalement d'améliorer leur qualité de vie au travail. Enfin, des réflexions sont en cours par le Gouvernement pour simplifier l'accès aux concours sur titre.

The black bee ( Apis mellifera mellifera ) is a subspecies of the European honey bee, present in Europe for more than a million years. Lively, autonomous and resistant, it adapts remarkably well to disruptive elements (parasites, diseases, climate change). Particularly effective for collecting and disseminating pollen, it also plays a major role in pollination and the development of local biodiversity. Its genetic heritage is therefore essential for the future of bees and biodiversity. Like other bee species, the black bee faces major threats, including the intensive use of pesticides, loss of biodiversity due to intensive agriculture, as well as diseases and parasites such as varroa. Furthermore, French beekeepers tend to import subspecies of bees that are docile and profitable in the short term, such as the Italian bee or the Buckfast bee. Crossings with these exogenous bees, less autonomous and less adapted to the environment, give rise to more fragile hybrid bees. The absence of a legal framework promotes the massive introduction of exogenous bees and hybridization. Thus, the unique genetic heritage of the black bee threatens to gradually disappear. To date, no strong legal protection guarantees the preservation of the black bee in France, classified as a domestic bee. However, scientists from the CNRS, the National Museum of Natural History and the European Federation for the Conservation of the Black Bee warn of the urgency of creating genetic conservatories of black bees. These sanctuaries aim to prohibit the importation of non-native bees and beekeeping practices that are disrespectful to bees (overfeeding, transhumance). In France, there are eleven sanctuaries but effective protection remains insufficient today. The island of Groix (Morbihan) is home to one of the last populations of black bees still pure in France. Thanks to its geographical isolation, it has escaped the hybridization which weakens the species on the continent. The bees live there independently and wildly. Human intervention is limited: beekeepers simply harvest surplus honey, without chemical treatment or transhumance. Beyond the black bee, the island of Groix is home to remarkable wealth, with 113 species of wild pollinators. However, the absence of a strict legislative framework weakens this sanctuary. A simple municipal decree prohibits the introduction of non-local bees, but control remains very limited and ineffective, thus threatening the genetic integrity of the colonies. Citizen mobilization has intensified to demand effective protection of Groix pollinators, with a petition having collected more than 100,000 signatures. The signatories request a reinforced legal protection of pollinators on the entire island of Groix, the effective ban on any importation of exogenous bees on the island and intensive breeding practices. The “3DS” law of February 21, 2022 recognizes metropolitan island municipalities “as a set of territories whose sustainable development constitutes a major objective of national interest due to their social, environmental, cultural, landscape and economic and requires that their differences in situations be taken into account in the implementation of local and national public policies. This law thus justifies specific regulations on the island of Groix to protect this unique and fragile ecosystem. Mr. Damien Girard draws the attention of the Minister of Ecological Transition, Energy, Climate and Risk Prevention to the road work projects that could have harmful consequences on the Grand Site de France Wild Dunes of Gâvres in Quiberon. An exceptional natural space and true reservoir of biodiversity, this site, certified since 2018, extends over 35 kilometers of dunes. Furthermore, these dunes and ponds de Gâvres have been classified since 1976 under the law of May 2, 1930 and have been a Natura 2000 site since 2002. For decades, the surroundings of the tombolo de Gâvres and its 6 kilometers of road as well as the surroundings of gray dunes, have suffered from overcrowding: cars, kitesurfers, fishermen, hikers... This situation gives rise to a very large number of conflicts of uses. Despite several bans, the state does not seem succeed in regulating or channeling these flows which harm the site. The Gâvres isthmus is also threatened by continued coastal erosion which could lead Gâvres to become an island. In this context, the project to repair departmental road 158 and the project to create a “greenway” for cyclists calls into question local stakeholders and landowners who have not been consulted. These two projects are considered as incompatible with the law of August 8, 2016 for the reconquest of biodiversity and landscapes by the inspectors of the General Inspectorate of the Environment and Sustainable Development (IGEDD). No study of car traffic, road safety, solid environmental assessment or overall mobility plan is attached to the file. The social utility of these projects must be understood by taking into account the issues safety, risk management and environmental protection. The opinion on the IGEDD project specifies these elements: "as it stands, the demonstration of the compatibility of the project with law 2016-1087 for the reconquest of biodiversity, nature and landscapes and with the provisions applicable to Natura 2000 sites has not been provided." He therefore asks him if there are plans to ask the authorities and in particular the prefect of Morbihan, a suspension of the project allowing the necessary studies to be carried out under satisfactory conditions and to carry out respectful consultation with all the stakeholders concerned.

Conscient que l'éducation à la sexualité est essentielle pour le respect de soi et le respect d'autrui, mais aussi que sa mise en œuvre se heurte à des difficultés, le ministère chargé de l'éducation nationale a renforcé sa mobilisation depuis plusieurs années. Lancé à la rentrée 2022, le label « égalité filles-garçons » vise à mettre en cohérence et valoriser les politiques d'établissement qui, en se fondant sur le pilotage, la formation des personnels, l'action pédagogique, l'action éducative et les partenariats, concourent notamment à garantir un climat scolaire dégagé du sexisme et des violences sexuelles. Par ailleurs, le ministère chargé de l'éducation nationale est co-pilote de la stratégie de développement des compétences psychosociales chez les enfants et les jeunes 2022-2037. Dans ce cadre, il a notamment généralisé, à la rentrée 2024, des séances aimed at développer l'empathie et les comportements altruistes et prosociaux dans les écoles, ce qui contribue à améliorer les relations à soi et les relations aux autres et à prévenir les comportements violents. Enfin, l'éducation aux médias et à l'information et les outils du Clemi sont utilisés pour prévenir les cyberviolences sexistes et sexuelles. En 2023, un groupe de travail réunissant les acteurs de l'éducation à la sexualité (administrations, associations, experts) a permis de dégager des points de convergence pour renforcer l'effectivité et la qualité des séances. Des mesures ont ensuite été annoncées en juin 2023, dont la saisine du Conseil supérieur des programmes (CSP) pour élaborer un programme d'éducation à la sexualité et le déploiement d'un plan de formation qui vise les formateurs et les intervenants. À la suite de ces annonces, en mars 2024, une consultation nationale menée sur le projet de programme du CSP, auprès de tous les personnels de l'éducation, des organisations syndicales, d'autres ministères et institutions publiques et des associations a permis d'aboutir à un projet de programme définissant une progression adaptée à l'âge et à la maturité des élèves. Le 29 janvier 2025, le Conseil supérieur de l'éducation (CSE) a voté à l'unanimité le programme d'éducation à la sexualité qui se décline en deux volets: « l'éducation à la vie affective et relationnelle » à l'école maternelle et élémentaire et « l'éducation à la vie affective et relationnelle, et à la sexualité » au collège et au lycée. Publié au BOENJS n° 6 du 6 février 2025, il incarne l'ambition du ministère sur le sujet. Son application, dès la rentrée de septembre 2025, concernera tous les élèves, de la maternelle au lycée. Conformément au code de l'éducation, qui définit cette éducation obligatoire, ce programme sera mis en œuvre à travers au moins trois séances annuelles spécifiques. Il rappelle que l'éducation à la sexualité vise l'égalité de considération et de dignité, en particulier l'égalité entre les femmes et les hommes, contribue à la lutte contre toutes les discriminations, sensibilise au principe du consentement et contribue à la prévention des différentes formes de violences, notamment de violences sexistes et sexuelles (y compris l'inceste). Le ministère est donc pleinement mobilisé sur la réalisation des objectifs posés par la loi. Il poursuit les efforts engagés depuis plusieurs années pour garantir l'effectivité des séances d'éducation à la sexualité.
