Article L. 544-1 of the Social Security Code provides that "the person who takes care of a child suffering from an illness, a disability or the victim of an accident of particular gravity making it essential sustained presence and restrictive care benefits, for each day of leave provided for in Article L. 1225-62 of the Labor Code, from a daily parental presence allowance. However, concerned parents and representative associations are now warning of the delays in processing their files, preventing, de facto, many parents from caring as they should for their children with disabilities or seriously ill. Mr. Robert Le Bourgeois draws the attention of the Minister of Health, Families, Autonomy and People with Disabilities to the future of the Asalée system, following the publication of the report from the General Inspectorate of Social Affairs (IGAS) dated June 24, 2025, devoted to “control of the management and deployment of the Asalée system”. This report, which highlights the usefulness of the Asalée system in supporting people suffering from chronic diseases, highlights major management problems. These problems include financial shortcomings, risks of conflicts of interest, a lack of compliance with the law of associations, labor and public procurement, as well as administrative governance perceived as indecisive and lax. The recent tragedy which affected the Swiss commune of Crans-Montana has indeed awakened painful memories in the department of Seine-Maritime, bereaved by the Cuba Libre fire in August 2016 in Rouen. If French legislation had largely evolved following the drama of "5-7" in 1970, that of Cuba Libre should have pushed to drastically increase controls and change the regulations, particularly concerning the categorization (4 or 5) of these establishments: Cuba Libre was in fact declared as a category 5 establishment for its bar-restaurant activities on the ground floor while it also hosted, in the basement, nighttime activities and dancing (category 4), not declared. The numerous complaints from the neighborhood, particularly for noise pollution, should however have made it possible to identify this clandestine activity, to carry out sufficient checks in order to regularize the administrative situation of Cuba Libre: thus, an unannounced check would certainly have made it possible to avoid this terrible accident. Robert Le Bourgeois appelle l'attention de M. le ministre de l'économie, des finances et de la souveraineté industrielle et numérique, sur l'inutile complexité que constitue la procédure de remboursement des taxes de malus écologiques pour les familles nombreuses. En effet, au-delà de la question de la justesse du malus en lui-même, la procédure actuelle pour obtenir une réduction place les familles nombreuses dans une impasse. Beaucoup de familles se voient en effet soumises à ce malus et prétendent ensuite à la réduction à laquelle elles ont droit, selon les conditions fixées. Pour autant, ces familles ciblent deux problématiques. La première concerne le délai de remboursement, théoriquement fixé à 30 jours, mais qui, semble-t-il, est parfois plus important. La seconde concerne les montants que les familles sont tenues d'avancer avant remboursement, s'élevant souvent à plusieurs dizaines de milliers d'euros. M. le député appelle donc l'attention de M. le ministre sur l'opportunité d'appliquer la réduction sur les malus CO2 et masse dès l'achat du véhicule. L'administration fiscale est tout à fait en mesure de mettre en place un tel dispositif et celui-ci serait accueilli très positivement par les familles comme par les concessionnaires automobiles, en tant qu'il faciliterait et favoriserait l'achat de véhicules neufs par les ménages. Il lui demande ce qu'il compte faire à ce sujet.

Robert Le Bourgeois appelle l'attention de Mme la ministre de l'agriculture, de la souveraineté alimentaire et de la forêt sur les difficultés que rencontrent les producteurs de pommes de terre dans sa circonscription. Le Comité permanent des végétaux, animaux, denrées alimentaires et alimentation animale (CPVADAAA), également connu sous le nom de Standing committee on plants, animals, food and feed (SCOPAFF), comité technique permanent rattaché à la Commission européenne, a interdit début octobre 2024, l'utilisation du métribuzine. Les autorisations de mise sur le marché de ce produit herbicide, essentiel dans la lutte contre les adventices en pommes de terre, doivent être retirées sous six mois, avec une possible période de grâce de douze mois maximum accordée par chaque État membre. Après le retrait de produits phytosanitaires à base de métirame et de diméthomorphe à l'échelle européenne et nationale ces derniers mois, la filière pomme de terre continue de subir des interdictions sans solutions alternatives. Cette décision met de nouveau en péril l'avenir de la production de pommes de terre en France et en Europe, malgré les appels répétés depuis 2023 de l'Union nationale des producteurs de pommes de terre (UNPT) pour garantir le maintien de la substance. Il lui demande donc de bien vouloir lui indiquer comment sont prises les décisions du SCOPAFF et sur quels critères se basent la position de la France. Il souhaite savoir quelles évaluations le Gouvernement compte mettre en place afin d'évaluer l'impact des prochaines interdictions de produits phytosanitaires à venir et ainsi garantir la sauvegarde de la souveraineté alimentaire du pays.

Des maires et présidents de communautés de communes ont en effet été informés que, faute de crédits disponibles dans le programme 152, M. le ministre a autorisé la suspension temporaire du paiement des loyers dus pour l'occupation des casernes. Ces loyers sont pourtant essentiels à la santé budgétaire des collectivités territoriales. Pour cause, il apparaît que la situation en Nouvelle-Calédonie et la sécurisation des jeux Olympiques et Paralympiques ont consommé une part importante du budget initialement alloué. Il l'interroge donc sur le choix politique de faire reposer les conséquences de cette mauvaise gestion budgétaire sur les collectivités territoriales et attire son attention sur la nécessité d'ouvrir des crédits supplémentaires pour le programme 152 dans les plus brefs délais.

Le tri à la source des biodéchets, c'est-à-dire le fait de trier séparément des autres flux de déchets les déchets de table et de cuisine, constitue une mesure phare de l'économie circulaire. Elle présente de multiples bénéfices comme une meilleure gestion des déchets (limitation des déchets mis en décharge), une baisse des émissions de gaz à effet de serre, et une opportunité de produire du biogaz ou du compost à partir de ressources locales. C'est pourquoi la mise en place de ce tri a été généralisée par la loi antigaspillage de 2020, en adéquation avec le droit européen. En effet, dans le cadre de la transposition de la directive cadre sur les déchets qui a acté la mise en place du tri à la source des biodéchets en Europe, la loi antigaspillage de 2020 impose à the whole ofs collectivités de proposer des solutions de tri à la source des biodéchets à leurs administrés depuis le 1er janvier 2024. En outre, cette loi interdit la fabrication de compost issu de la fraction fermentescible des ordures ménagères par les installations de tri mécano biologiques à partir du 1er janvier 2027, afin de préserver la qualité des matières fertilisantes et des sols. Ces évolutions législatives et réglementaires mettent en évidence que l'avenir de l'installation de Brametot ne pourra reposer à court et moyen terme sur un modèle de production de compost à partir de biodéchets: l'obligation de tri à la source des biodéchets implique que la teneur en matières fermentescibles des ordures ménagères va graduellement baisser, condamnant cette activité à moyen terme. Pour autant, les installations de tri-mécano-biologique ne sont pas tenues réglementairement d'arrêter leur exploitation, et pourraient même représenter un atout pour le territoire à d'autres titres. La technologie de l'usine de Brametot peut en effet présenter un impact positif dès lors qu'elle permet de favoriser le recyclage de matériaux qui ont échappé à la collecte sélective des déchets, comme par exemple les métaux ou les matières plastiques, qu'elle permet de réduire la quantité de déchets mis en décharge, ou qu'elle permet de conduire à une valorisation énergétique des déchets non recyclables (via la production de Combustibles Solides de Récupération). A la demande du Ministère en charge de la transition écologique, l'ADEME a engagé des travaux pour identifier avec les filières concernées les possibilités de repositionnement de ces installations de tri-mécano-biologique sur les activités présentées ci-dessus. Les conclusions de ces travaux devraient être disponibles en 2025. Dans l'attente de ces éléments, la prise en compte des spécificités locales et l'accompagnement des acteurs impliqués dans la gestion de l'installation sont assurés par les services déconcentrés de l'État. Ces derniers, qui se sont fortement investis sur le dossier depuis plusieurs années, pourront ensuite accompagner ces acteurs vers une conversion (si nécessaire) ou un encadrement à droit constant.
