Mme Marie-Agnès Poussier-Winsback attire l'attention de M. le ministre de l'économie, des finances et de la souveraineté industrielle, énergétique et numérique sur l'inégalité de traitement fiscal entre certaines communes résultant du décalage entre la clé de répartition de l'imposition forfaitaire sur les entreprises de réseaux (IFER) nucléaire et le zonage du plan particulier d'intervention (PPI). Le déploiement des sites de production d'énergies renouvelables et décarbonées ne peut se faire sans l'adhésion des territoires qui accueillent ces installations. Cette acceptabilité repose largement sur un principe simple : les collectivités qui supportent les contraintes liées à la proximité d'un site de production doivent pouvoir en percevoir une juste contrepartie. Or, depuis l'accident de Fukushima, les communes situées dans un rayon de vingt kilomètres autour d'une centrale nucléaire sont intégrées à un PPI, qui organise les mesures d'information et de sûreté des populations face au risque nucléaire. Ces communes partagent ainsi les contraintes liées à la proximité de l'installation, sans pour autant bénéficier des mêmes retombées fiscales que les communes d'implantation, la clé de répartition de l'IFER nucléaire ne tenant pas compte de ce zonage. Il en résulte un sentiment d'injustice territoriale : les risques sont partagés, mais pas les bénéfices. Une piste de réforme consisterait à faire correspondre la clé de répartition de l'IFER nucléaire aux communes situées dans le périmètre du PPI, en construisant par exemple une clé fiscale dégressive entre les différentes zones de risque, afin d'amortir la perte de recettes pour les départements d'accueil actuels. Mme la députée a conscience que cette évolution soulèverait des questions pratiques, par exemple sur la manière de traiter les communes situées à la frontière de deux zones. Cependant, ces difficultés ne doivent pas empêcher d'avancer sur un sujet qui conditionne directement la confiance des territoires envers la politique énergétique nationale, en particulier en Seine-Maritime, département durablement engagé aux côtés de la filière nucléaire avec les nouveaux EPR2 sur le site de Penly et la centrale de Paluel. Ainsi, elle souhaite savoir si le Gouvernement entend engager une réflexion sur une meilleure articulation entre la fiscalité applicable aux installations nucléaires et les zones de risque qui leur sont associées, au service d'une solidarité fiscale plus juste envers les territoires concernés.

Jean-Luc Warsmann appelle l'attention de Mme la ministre déléguée, porte-parole du Gouvernement auprès du Premier ministre, et ministre déléguée, chargée de l'énergie auprès du ministre de l'économie, des finances et de la souveraineté industrielle, énergétique et numérique, sur les conséquences énergétiques et opérationnelles de l'application de l'accord franco-belge du 8 septembre 1998 relatif au débit de la Meuse sur le fonctionnement de la centrale nucléaire de Chooz. Depuis le début du mois d'août 2026, EDF a été contrainte de procéder à l'arrêt des deux réacteurs de 1 450 MW (Chooz B1 et Chooz B2). Ces arrêts s'expliquent par la baisse importante du débit de la Meuse provoquée par la sécheresse estivale, combinée au respect des seuils fixés par la convention bilatérale signée entre la France et la Belgique. L'accord signé le 8 septembre 1998 définit un débit minimal garanti de la Meuse à la frontière franco-belge afin d'assurer la préservation de la ressource en eau, la protection des écosystèmes aquatiques et la satisfaction des usages situés en aval. Si la sauvegarde de l'équilibre écologique du fleuve constitue une priorité, l'application de ce cadre conventionnel conduit à retirer simultanément du réseau électrique national une puissance décarbonée de 2 900 MW pendant plusieurs semaines au cœur de l'été. Dans un contexte marqué par l'accentuation du dérèglement climatique et par la répétition prévisible des épisodes de sécheresse, cette situation soulève des interrogations cruciales quant à la souveraineté et à la sécurité d'approvisionnement énergétique du pays. L'accord bilatéral en vigueur ayant été conçu il y a près de trois décennies, ses modalités d'application méritent d'être interrogées au regard des réalités climatiques et industrielles actuelles. En ce sens, il lui demande si le Gouvernement envisage d'initier des échanges avec les autorités belges afin d'évaluer ou de moderniser les dispositions de l'accord de 1998, de manière à concilier plus efficacement la protection de la biodiversité fluviale et la continuité de la production électrique. Il lui demande également quelles mesures d'anticipation ou d'aménagement en amont de la Meuse sont étudiées par l'État et EDF pour atténuer la fréquence et la durée des arrêts de production imposés au site de Chooz lors des périodes de fortes chaleurs et de faible pluviométrie.

Department of Defense Appropriations Act, 2027 This bill provides FY2027 appropriations to the Department of Defense (DOD) for military activities.
