Ms. Bérangère Abba alerts the Minister of the Economy and Finance about untimely and intrusive telephone canvassing. Article L. 223-1 of the Consumer Code, resulting from Article 9 of Law No. 2014-344 of March 17, 2014 relating to consumption, prohibits a professional, under penalty of a fine, from approaching consumers registered on the list by telephone, directly or through a third party acting on their behalf. of opposition to Bloctel telephone canvassing and with which it has no current contractual relations. Mme Bérangère Abba attire l'attention de Mme la garde des sceaux, ministre de la justice, sur les conditions d'indemnisation du forfait destiné à couvrir les menues dépenses des conciliateurs de justice. Comme le prévoit le dernier alinéa de l'article 1er du décret du 20 mars 1978 : « Les conciliateurs de justice bénéficient d'une indemnité forfaitaire destinée à couvrir les menues dépenses de secrétariat, de téléphone, de documentation et d'affranchissement qu'ils exposent dans l'exercice de leurs fonctions. Cette indemnité est versée trimestriellement. Un arrêté conjoint du garde des sceaux, ministre de la justice, et du ministre chargé du budget en fixe le montant. Le premier président de la cour d'appel et le procureur général près ladite cour peuvent autoriser, sur justificatifs, un dépassement de cette indemnité dans la limite fixée par ledit arrêté ». À ce jour, l'article 1er de l'arrêté du 21 décembre 2016 fixe le montant annuel de l'indemnité forfaitaire à 464 euros. La cour d'appel de Dijon, comme le prévoit la circulaire sur les conciliateurs de justice du 27 juillet 2006, conditionne le versement de cette indemnité forfaitaire : « au vu d'une déclaration sur l'honneur, établie par leurs soins, de la réalité de leur activité, accompagnée du décompte des dépenses occasionnées dans l'exercice de leurs fonctions ». Or cette exigence de justification des dépenses nie la notion d'indemnité forfaitaire, instaurée par l'arrêté précité et représente une contrainte non justifiée à l'exercice de la fonction bénévole de conciliateur de justice. Elle lui demande donc de préciser sa position sur le sujet et de confirmer la nécessité ou non de détailler les dépenses engagées.

Mme Bérangère Abba attire l'attention de M. le ministre d'État, ministre de la transition écologique et solidaire, sur le dispositif de prime à la conversion des véhicules 2019 et plus particulièrement sur la prime dédiée aux « gros rouleurs ». Cette prime s'adresse aux personnes qui parcourent plus de 30 km entre leur domicile et leur travail (60 km aller-retour) ou plus de 12 000 km dans le cadre de leur activité professionnelle avec leur véhicule personnel. Les conditions d'attribution de cette prime à la conversion imposent au demandeur d'être le titulaire de la carte grise du véhicule depuis au moins un an pour pouvoir en bénéficier. Cela étant, lorsque le véhicule appartient à deux conjoints mariés sous le régime de la communauté, cette condition pose un problème d'application lorsque le « gros rouleur » n'est pas celui au nom duquel a été établi le certificat d'immatriculation. La même difficulté existe pour les couples pacsés ayant opté pour le régime de l'indivision. Elle lui demande donc de lui indiquer ce que le Gouvernement propose pour permettre à ces couples de bénéficier de la prime dédiée aux « gros rouleurs ».

Ms. Bérangère Abba draws the attention of the Minister of Agriculture and Food to the situation of staff at the National Forestry Office (ONF). The inter-union has been denouncing a tense social climate for several months and alerting us to growing suffering at work. In Haute-Marne, the ONF manages the forests of SIGFRA, the oldest and largest forestry union in France which has more than 8,000 hectares of municipal forests. The Territorial Unit (UT) of Auberive has developed expertise in the management of irregular high forests, which is today praised and whose quality was recently recognized by the National Nature Protection Council (CNPN) during the examination of the draft charter of the 11th national park dedicated to the lowland deciduous forest. This forest management has the particularity of promoting biodiversity and naturalness, of developing a large diversity of species to better prevent climate change and increase the production of quality wood. This expertise gave rise to the creation of an irregular forest school. This unique project in France requires significant work from the UT teams, which is in addition to the usual work of the agents. However, for many months, not all positions within the UT of Auberive have been permanently filled. The agents deplore not being able to work normally anymore. Ces plateformes collaboratives, dématérialisées sur Internet, facilitent la rencontre entre l'offre et la demande. Elles permettent l'échange de services (travaux mécanisés, mise à disposition d'outils) et contribuent à réduire les charges des exploitations, en préservant leur trésorerie. Elles peuvent être un moyen de valoriser du matériel sous utilisé ou des stocks dormants. Elles pourraient devenir un outil de développement précieux pour l'agriculture, sans toutefois concurrencer les entreprises de travaux agricoles, puisqu'elles reposent sur des échanges, sans règlement en numéraire. Ces échanges font l'objet d'une facturation réciproque qui donne lieu au versement de la TVA et sont donc assimilés à des prestations de services. De ce fait, ils sont aujourd'hui accessibles pour une entreprise agricole individuelle, mais demeurent interdits pour une société civile agricole. Elle lui demande comment le ministère envisage d'accompagner le développement de ces plateformes qui pourraient stimuler l'économie agricole et quelles mesures il compte prendre pour permettre aux sociétés civiles agricoles (GAEC, SCEA, EARL) d'utiliser ces plateformes.

Mrs Bérangère Abba draws the attention of the Secretary of State, attached to the Minister for Europe and Foreign Affairs, responsible for European affairs, to the Fund for European Aid to the Most Deprived (FEAD). This instrument, established by the 2014-2020 multiannual financial framework, represents a major source of financing for food distribution associations in France. It makes it possible to provide vital emergency aid which constitutes a gateway to social inclusion. Based on food aid, associations are in fact developing numerous actions: housing assistance, budgetary advice, access to rights and the fight against the digital divide, access to culture and leisure, micro-credit, job search assistance, etc. In its draft multiannual financial framework 2021-2027, the European Commission has proposed the grouping of different instruments financial institutions with a social vocation, including the FEAD, in a new fund: the European Social Fund (ESF+), which would be allocated a total of 101 billion euros over the period. Regarding the level of intervention, the Commission proposes that each Member State must allocate at least 2% of its ESF+ funds to combating material deprivation. If the States stick to this minimum, 2 billion euros will therefore be allocated to food aid at European level, a decrease of almost half compared to the previous period. She asks him what measures the Government is considering to defend this European policy during budgetary negotiations, to implement it in France and allow associations to sustainably fight against poverty.

Mme Bérangère Abba attire l'attention de M. le ministre de l'action et des comptes publics sur le devenir des trésoreries rurales, notamment celles de Bourbonne-les-Bains, Bourmont, Nogent et Wassy qu'il a récemment décidé de maintenir après concertation avec les élus de Haute-Marne. Le réseau de la DGFIP évolue du fait de la transformation des missions et des évolutions technologiques connues par l'administration. Il s'adapte également aux changements de comportements et d'usages des particuliers comme des collectivités induits par les nouvelles technologies. Lors de l'annonce du maintien des trésoreries haut-marnaises, le ministre de l'action et des comptes publics souhaitait réexaminer de manière plus globale l'implantation du réseau de la DGFIP afin de mieux tenir compte des objectifs d'aménagement et d'équilibre des territoires selon le principe de « déconcentration de proximité ». Ce principe vise à redistribuer l'implantation du réseau de la DGFIP, à l'échelle nationale comme à l'échelle locale, des métropoles et chefs-lieux de département, vers les zones plus rurales, en veillant à préserver la meilleure accessibilité des services publics pour les Français. Elle lui demande quelles dispositions concrètes sont envisagées pour appliquer ce principe de « déconcentration de proximité » et comment les personnels de ces trésoreries, les usagers et les élus peuvent être associés à cette réflexion d'ensemble et à une expérimentation locale.

The National Association of Wards of the Nation orphans of war or duty continues to highlight the discrimination introduced by Decree No. 2000-657 of July 13, 2000 establishing a reparation measure for orphans whose parents were victims of persecution anti-Semitism as well as by Decree No. 2004-751 of July 27, 2004 establishing financial assistance in recognition of the suffering endured by orphans whose parents were victims of barbaric acts during the Second World War. If these two texts constitute indisputable progress in compensating the children of the victims of Nazi barbarity during the Second World War, the fact remains that the War orphans and wards of the Nation who have lost a parent during other conflicts are today subject to differentiated treatment. She therefore wishes to know if the Government is considering more equitable recognition between the different categories of war orphans and wards of the Nation.

Mrs. Bérangère Abba draws the attention of the Minister of Culture to the mission entrusted by the President of the Republic to Mr. Stéphane Bern for the identification of real estate assets in danger and the search for innovative solutions in order to ensure the financing of essential work. Out of 2,000 monuments already identified, 251 priority projects spread throughout the territory and 18 emblematic projects have already been selected thanks to reports from the general public with the support of the Ministry of Culture and the Heritage Foundation. La Française des jeux estimates that it can donate 15 to 20 million euros for these sites in danger. Crowdfunding and corporate sponsorship will also be mobilized. The financing needs of these projects are estimated at 54.4 million euros for work valued at 328 million euros. The selected projects must be supported in the creation of their financing plan and technical file by State services and by volunteers from the heritage foundation. Mme Bérangère Abba alerte M. le ministre de l'agriculture et de l'alimentation sur les conséquences d'une réduction des doses de cuivre autorisées sur la filière viticulture biologique, notamment en Champagne. La Commission européenne va devoir se prononcer sur la réappropriation du cuivre au niveau européen comme substance active de protection de la vigne. Or les discussions européennes laissent présager une réduction des doses de cuivre autorisées, de 6 kg/ha/an lissés sur 5 ans actuellement, à 4 kg/ha/an non lissés. La filière champagne biologique, encore confidentielle jusqu'à la fin des années 2000, a connu un essor sans précédent ces dernières années, avec une croissance à deux chiffres. La Fédération régionale de l'agriculture biologique et l'association des champagnes biologiques ont mené une enquête interne auprès des vignerons certifiés bio de Champagne sur leur utilisation de cuivre pour lutter contre le mildiou de la vigne au cours des six dernières années. Il en ressort que la limitation des doses de cuivre à 4 kg/ha/an stopperait le développement de la viticulture biologique en Champagne, voire la ferait disparaître presque totalement sans lissage, cassant ainsi l'essor de la filière champagne bio. Cette enquête plaide pour une adaptation des doses utilisables à l'échelle régionale et le développement de travaux de recherche sur la protection des cultures. Par conséquent, elle lui demande quelle position il compte défendre concernant le renouvellement de l'homologation du cuivre et sa déclinaison au niveau national dans le cadre des autorisations de mise sur Marché (AMM).

Mme Bérangère Abba attire l'attention de M. le ministre d'État, ministre de l'intérieur, sur la généralisation des télé procédures relatives aux demandes de certificats d'immatriculation de véhicules qui s'opèrent désormais via le site de l'Agence nationale des titres sécurisés (ANTS). La simplification de ces démarches constitue une avancée puisqu'elle permet aux usagers d'effectuer leur demande en ligne depuis n'importe où, à n'importe quelle heure de la journée, y compris les soirs et les week-ends. L'usager n'a plus besoin de se déplacer ni d'attendre au guichet de la préfecture. Petit à petit, les dysfonctionnements techniques sont résolus grâce à des mesures correctives. Toutefois, certains usagers peinent encore à réaliser ces démarches en ligne et sont contraints de passer par la prestation payante d'un professionnel. D'autre part, la procédure en ligne impose le règlement par carte bancaire et les collectivités locales ne disposent pas de ce mode de paiement. Elle lui demande quelles sont les solutions envisagées pour permettre aux collectivités de s'acquitter de ces démarches en ligne, sans avoir à faire appel à des professionnels habilités et à payer un surcoût pour ces démarches.
