Ms. Blandine Brocard draws the attention of the Minister of Labor to the situation of multiple employers of the same employee with regard to medical monitoring obligations. Article R. 4624-14 of the Labor Code amended by Decree No. 2016-1908 of December 27, 2016 provided in its initial wording the possibility of concluding an agreement between employers of the same employee to carry out only one employment medical examination and mentioned the distribution of the burden of medical supervision. Since January 1, 2017, reinforced medical surveillance has been replaced by reinforced individual monitoring and the new wording of article R. 4624-14 ignores this possibility of contractual sharing of the burden. However, we can read on the website of the Ministry of Justice and on service-public.fr: “If the employee is recruited by several employers, a single visit hiring takes place if the employers have concluded an agreement providing for the distribution of the financial burden of medical surveillance of employees or are covered by a sector agreement providing for this distribution. However, when questioned on this point, occupational health services indicate that in the event of an accident at work, employers who have not directly signed up to an occupational health service would not be deemed to have carried out their obligation in terms of compulsory surveillance of employees. In the case, for example, of individual employers who are considering hiring an employee for a few hours per week, the undistributed cost of the hiring visit and medical follow-up may constitute a barrier to employment. As the author of the question indicates, legitimate interest is one of the legal bases provided for by European Regulation No. 2016/679 of April 27, 2016 establishing the general regime for the protection of personal data in Europe - known as GDPR - authorizing the implementation of processing of personal data. Legitimate interest is not precisely defined by the GDPR, however the economic interest of a company does not allow not in itself characterize a legitimate interest capable of authorizing the processing of personal data. More precisely, the National Commission for Information Technology and Liberties (CNIL) identifies three criteria so that legitimate interest can constitute the legal basis for the processing of personal data. The interest pursued by the organization must first be legitimate. The CNIL considers that the character legitimate interest can be presumed if three conditions are met: - The interest is manifestly lawful; - It is determined in a sufficiently clear and precise manner; - It is real for the organism concerned, and not fictitious. Then the processing of personal data must be necessary. This implies in particular that the data controller must ensure that there is no less intrusive means for life deprived of achieving this objective than of implementing the envisaged treatment. Finally, the processing must not conflict with the rights and interests of the people whose data is processed, taking into account their reasonable expectations. The data controller must therefore verify that the interests he pursues do not create an imbalance to the detriment of the rights and interests of the people whose data are processed. This balancing of the rights and interests in question must be carried out for each processing operation. Concretely, the CNIL offers a three-step methodology to assess the relevance of legitimate interest as a legal basis for processing personal data: - Identification of the legitimate nature of the interest pursued by the data controller and verification of the necessary nature of the processing in view of this objective; - Assessment attacks on the interests and rights and freedoms of individuals and taking into account their reasonable expectations; - Balancing of these elements and, where appropriate, definition of additional measures.

Mrs Blandine Brocard alerts the Minister for Europe and Foreign Affairs about the abuses perpetrated in the Democratic Republic of Congo (DRC). This Sunday, February 25, 2018, a Catholic march against the continued power of the President of the DRC was dispersed by the police using tear gas and live ammunition, leaving at least two dead and several injured according to the UN; a balance sheet which adds to that of repressions of December 31, 2017 and January 21, 2018. The Congolese president, who violated the constitution by refusing to leave power on December 19, 2016, now seems to be freeing himself from the so-called "New Year's Eve" agreement which provided for a new presidential election within a year. It welcomes the adoption by the European Union of restrictive measures against those close to the president occupying positions of responsibility in state administration and in the chain of command of the security forces in the DRC. However, although France has strongly condemned the violence committed by the security forces, it asks it to please indicate whether sanctions are envisaged to put an end to human rights violations and obstacles to the electoral process, in particular the severance of all military and police cooperation with the DRC.

Ms. Blandine Brocard reminds the Minister of National Education of the commitment made by the Government, during the examination of the finance bill for 2018, to supplement the community development fund (FDVA) with an additional 25 million euros to compensate for the removal of the parliamentary reserve provided for by the law of September 15, 2017 for confidence in political life. In fact, the FDVA constitutes a more relevant support for associations, according to objective, transparent allocation methods and in consultation with local stakeholders, which was not guaranteed by the parliamentary reserve. The increase in credits for this fund is therefore part of a renewed State policy towards the associative world, which occupies an irreplaceable social and economic place in the life of the Nation. Nevertheless, the financing of associative life from this new allocation was to be specified at the start of the 2018 financial year, however no implementing decree has been issued to date. Ms. Blandine Brocard draws the attention of the Minister of Solidarity and Health to the status of speech therapists. Many citizens - young children, seniors, people with disabilities, victims of illness or accidents - suffer from communication disorders linked to voice, speech or language. In this context, the work carried out by speech therapy professionals in the assessment and treatment of these disorders is unanimously recognized today. However, if obtaining the diploma recognizing the quality of speech therapist today requires continuing five years of study after the baccalaureate, the remuneration offered to them in the hospital civil service corresponds to salary scales at bac + 3 level. These remuneration levels thus encourage a growing number of speech therapists to turn away from the civil service hospital to favor work in private practice. However, everyone recognizes that hospital services need the skills of these health professionals. In this context, the index reclassification carried out by decree no. 2017-1263 of August 9, 2017 seems to have only partially answered the question of the fair recognition of the skills of speech therapists. Ms. Blandine Brocard questions the Minister of State, Minister of the Interior, on the representation of municipalities in the governance bodies of the metropolis of Lyon from 2020. This metropolis, the result of the merger between a public establishment of intermunicipal cooperation (Grand Lyon) and part of the Rhône department, is the only metropolis in France which today has the status of a full-fledged territorial collectivity. The law of modernization of territorial public action and affirmation of metropolises, known as the "MAPTAM law", promulgated on January 27, 2014, provided in its article 54 paragraph 1 that future metropolitan councilors will be elected by direct universal suffrage during the next elections scheduled for 2020. The electoral method thus imposed by the law will substantially modify the representation of the municipalities by de facto excluding a large part of these are the decision-making bodies of the Lyon metropolis. Indeed, the list vote, established in new electoral constituencies, will no longer allow the full representativeness of the municipalities and will not guarantee that each of them can have at least one seat on the future metropolitan council. Many mayors will thus see themselves ousted from the governance of a metropolis at the birth of which they nevertheless participated and of which they had managed a large part of the skills for almost fifty years. This electoral method, provided for by the MAPTAM law, risks being perceived by mayors throughout the national territory as a real obstacle to the development of other metropolises in France, even though the model of the metropolis of Lyon as a local authority with a special status has demonstrated its effectiveness. Cytoreductive surgery combined with hyperthermic intraperitoneal chemotherapy (CCR/HIPEC) can cure or prolong the survival of these patients. The closure in November 2018 of the hospital care center Lariboisière, which carried out more than 120 CHIP per year, required the transfer of its activity to other centers which drastically limit the number of annual treatments due to the non-coverage of CHIP by the CPAM and a financial loss for the establishments of 15 to 20,000 euros per treatment. Ms. Blandine Brocard draws the attention of the Minister of Solidarity and Health to the future of the care of people with rare peritoneal cancers. Due to their rarity and specificity, peritoneal tumors require management by multidisciplinary teams composed of trained and specialized experts. However, on October 31, 2018, the management of the Lariboisière hospital group announced the closure of its center, a member of the RENAPE network, for economic reasons linked to strategic decisions to reduce the number of beds in this establishment. This decision worries patients followed in this hospital for whom the disappearance of the center represents a loss of chances of recovery. More broadly, this closure raises fears of other closures of centers in the RENAPE network for economic reasons. Madam Deputy reminds the Minister of the objective of the 2014-2019 cancer plan which is to “guarantee appropriate care in terms of skills and expertise for all patients, in order to avoid a loss of opportunity and to ensure equity on the national territory, regardless of the place of care”. She therefore questions her about the measures she intends to take to ensure the continuity of care for those affected. of rare cancers of the peritoneum, in particular those of patients followed at the center of the Lariboisière hospital, while highlighting a possible solution proposed by Professor Marc Pocard, who directed the closed service at Lariboisière: this would involve urgent consideration of the question by the High Health Authority concerning the possibility of reimbursing hyperthermic intra-peritoneal chemotherapy for rare cancers of the peritoneum.

Ms. Blandine Brocard draws the attention of the Minister of State, Minister of Ecological and Inclusive Transition, to the revision of the draft instruction of June 4, 2015 (NOR TREL1904750J), which defines the notion of "territorial project", prior to the financing by water agencies of water storage projects. Faced with recurring episodes of drought and heatwaves which hit the country, the resilience of farms in the face of the consequences of climate change will inevitably require better management of water resources. The delay taken by France in terms of irrigation is worrying. Between 2003 and 2013, the area equipped for irrigation in the country stagnated while the European average increased by 13.4%. With only 6% of the useful agricultural area irrigated, France now ranks 9th in Europe, behind the Mediterranean countries, but also northern countries like Denmark and the Netherlands. Faced with this delay, the Government recently undertook to revise the instruction of June 4, 2015, which defines the notion of “territorial project”, prior to the financing by water agencies of water storage projects. The danger these substances represent, particularly because they can cause strong dependence, is known. But beyond the question of resorting to these treatments - necessary in certain situations - there is that of free movement of unused medicines, particularly after the death of the patient or a change in prescription. The prescription of opioids is regulated by the public health code and the National Council of the order adds recommendations for doctors and pharmacists. However, once medications are prescribed, patients – or their loved ones – can keep unused supplies. Some pharmacists even refuse to take back these medications for destruction due to their special status. This gives rise to various risks such as being thrown into household waste, becoming part of a trafficking circuit or even being shared with other individuals without a prescription. Thus, the regulations could provide for the recovery of medicines not used by the prescribing doctor in the event of a change in prescription or, when of a death, by the doctor recording it. Ms. Blandine Brocard questions the Minister of State, Minister of Ecological and Inclusive Transition, on the compatibility between the fight against global warming and economic growth. However, on a global scale, energy consumption is essentially carbon-based, so that we can establish that the increase in GDP implies the increase in the quantity of CO2 released into the atmosphere. In this sense, the commitment to reach 32% of renewable energies in the French energy mix by 2030, in accordance with the energy transition law for green growth, is satisfactory news. However, two thirds of the energy consumed will remain of fossil origin. The scientific reports from the IPCC and Meadows agree on the need to reduce CO2 emissions by 2 to 6 in order to stem global warming, and to this end recommend reducing GDP by 3% per year, even though the OECD at the start of 2018 forecast growth for France of 2.2%. Ms. Blandine Brocard draws the attention of the Minister of Health, Families, Autonomy and People with Disabilities to Decree No. 2026-548 of June 25, 2026 relating to the taking into account of the allowances of local elected officials in the calculation of the allowance for disabled adults (AAH), taken in application of article 97 of Law No. 2019-1461 of December 27, 2019 relating to commitment to local life and proximity to public action. This decree had been awaited for almost six years: article L. 821-3 of the social security code, as amended by the 2019 law, already provided for a partial exclusion of job allowances from the calculation of the AAH, but no implementing text had been published until now. Requested by the General Directorate of Social Cohesion, the National Consultative Council for Disabled People (CNCPH) issued an opinion on May 18, 2026 unfavorable on this draft decree, considering that the terms of reduction adopted assimilate the compensation of local elected officials to a salary, whereas according to him it is a compensation for the costs and time devoted to the exercise of the mandate and not a professional income. This file is also the subject of careful monitoring in Parliament: in the Senate, Ms. Frédérique Puissat questioned the Government on June 18, 2026 (written question no. 09207) on the opportunity to revise the decree in favor of a more favorable method of calculation and to follow certain recommendations of the CNCPH, including a guarantee of non-regression for AAH holders, this question being, as of June 18, 2026, still awaiting a response; the same day, Mr. Aymeric Durox also questioned the Government (oral question no. 1194S) on the timetable for publication of this decree, a response having been provided in public session on July 7, 2026. Ms. Blandine Brocard questions the Minister of the Interior about the rental of private homes offered on online platforms for the organization of festive events and the means of action of mayors. The development of short-term rental platforms has favored the emergence of a range of private homes rented for the organization of private parties, seminars, weddings or other events sometimes welcoming several dozen people. Although these activities respond to growing demand, they nevertheless raise significant difficulties in terms of security and public peace. Indeed, some of these properties seem to be operated in an almost professional manner without their compliance with the rules applicable to establishments open to the public (ERP), particularly in terms of fire safety and accessibility, being clearly established. Furthermore, these gatherings are frequently the cause of noise pollution, parking problems, and even disturbances to public order, giving rise to numerous complaints from local residents. Faced with these situations, local elected officials question the extent of their powers and the means at their disposal to prevent and stop abuses. In particular, they wish to know under what conditions these rentals can be considered as falling under the regulation of ERP, what obligations are incumbent on owners who carry out such an activity and what controls can be implemented. She therefore asks him to specify the powers available to mayors, under their general and special police powers, to enforce the rules applicable to fire safety and personal protection, as well as to combat neighborhood disturbances linked to these activities. Ms. Blandine Brocard draws the attention of the Minister of Labor, Health and Solidarity to the drafting of administrative letters intended to inform people reaching the age of 62 and receiving the allowance for disabled adults (AAH) of the options available to them. If a person receiving AAH is unemployed at the age of 62, they are requested by the family allowance fund (CAF) and retirement insurance to exercise their retirement rights. She is warned that if she does not take this step, she will stop receiving AAH when she reaches 62 years of age. If she does so, she will continue to receive the AAH until her pension is liquidated. She can also refuse to retire but will also stop receiving AAH. This is not the case for a person carrying out a professional activity who has the possibility to continue said activity and to make a request for retirement liquidation under the conditions of common law, in particular regarding the retirement age. This person, continuing to work, can also continue to receive the AAH. However, the wording of letters from retirement insurance and the CAF makes the disabled worker think that he will stop receiving the AAH if he decides to continue his activity. She wishes that she studies the drafting of these letters so that the recipient is fully informed of their rights.

If Article L. 124-13 of the Education Code provides that, for internships lasting more than two months, the internship agreement must provide for the possibility of leave and authorization of absence for the benefit of the trainee during the training period in the workplace. professional or internship, the regulations provide no provision for these leaves and authorizations of absence. Mrs Blandine Brocard questions the Minister of the Interior and Overseas Territories on the validity of voter consultation operations by communities and the control of this by State representatives. Article R. 1112-18 of the general code of local authorities provides that the consultation of voters is organized under the conditions provided for by articles R. 1112-1 to R. 1112-17 applicable to the local referendum. The article R. 1112-7 provides that “two identical types of ballot papers, printed in black on white paper, one bearing the answer “YES” and the other the answer “NO”, are provided by the community which decided the referendum”. Article L. 1112-20 provides that “the voters indicate by yes or no whether they approve the draft deliberation or act presented to them”. Article R. 1112-6 provides that article R. 40 of electoral code relating to the distribution of voters into polling stations applies to local consultations and therefore that voters are distributed by order of the prefect into as many polling stations as required by local circumstances and the number of voters. However, during various voter consultation operations, ballots were offered with the words “FOR” and “AGAINST” followed by a sentence which does not represent either deliberation nor an act. Concerning the last consultation in February 2024 in Paris, the consultation took place in 222 polling stations while the prefectural decree of August 28, 2023 taken in application of article R. 40 of the electoral code distributes Parisian voters into 901 polling stations for all voting operations between January 1 and December 31, 2024. She would like to know the provisions it includes take so that the control of compliance with the legislation and regulations of these consultations or referendums is effective.

Ms. Blandine Brocard draws the attention of the Minister of the Interior and Overseas Territories to the wild display during electoral periods which not only creates inequality between candidates who respect the legislation and those who exempt themselves from it knowing that they will hardly be worried, but also has a lasting impact on the environment of the municipalities and the countryside. Article L. 51 of the electoral code prohibits any display outside of the panels official and free expression billboards where they exist. It also provides that the mayor or, failing that, the prefect may, after formal notice from the candidate(s) in question, proceed to automatically remove the posters. Articles L. 581-34 and L. 581-35 of the environmental code also seem to apply to electoral posters, as mentioned indirectly in article L. 581-35. In fact, apart from a few rare invalidations of elections when the difference in votes is small, it seems that these measures are very rarely applied, while wild electoral display seriously harms democracy and has a lasting impact on the environment. The mayors of the smallest municipalities do not have the means to enforce these provisions and do not have the certainty of being compensated for the automatic filing if they manage to carry out a formal notice and this is not followed up. Mrs Blandine Brocard questions the Minister of Ecological Transition and Territorial Cohesion on a response to a written question which gives rise to legal uncertainty. In his written question no. 3087, MP Lionel Causse questioned the ministry on the sale of parking spaces intended for visitors. He asked “if a change in the regulations in this area is envisaged in order to condition the sale of tickets parking for visitors to a favorable decision by the mayors concerned. » The question was therefore whether a right of veto could be given to mayors in the event of a sale. In the response published in the Official Journal on January 3, 2023, the Minister indicates that “conditioning the sale of a parking lot by a syndicate of co-owners to a favorable decision by the mayor concerned could lead to prohibiting the syndicate to transfer his property and therefore oblige him to remain owner of it. This would infringe on the right to freely dispose of one’s property, an attribute of the right to property protected by the Constitution.” The response also addressed the question of the town planning code by indicating that "the provisions of articles L. 151-30 and R. 151-44 of the town planning code provide that the regulations of the local town planning plan may contain obligations of creation of parking areas and specify the type and main characteristics of the parking spaces. Furthermore, if the local town planning plan sets a number of parking spaces to be respected when carrying out a construction operation, compliance with this obligation is assessed at the time the building permit is issued. The local town planning plan cannot therefore prevent the subsequent sale of the parking spaces”. Following this reasoning, as soon as a developer obtains his certificate of conformity, the parking spaces imposed as intended for visitors could be sold and the property no longer be in compliance with the PLU. In this case, what is the point for a municipality to request the creation of parking spaces for visitors, if they can be immediately sold after the end of the real estate operation, visitors finding themselves obliged to park on public property, which the PLU wanted to avoid? To make an analogy, the regulations of a PLU can require the planting of a certain number of trees on a plot. Once compliance is achieved, the trees could then be removed, because the PLU regulations would no longer apply. Failure to comply with the provisions of the regulations of a PLU constitutes a criminal offense under articles L. 610-1, L. 151-2 et seq. of the town planning code, punishable by article L. 610-1 of the same code, the offense being independent of the fact that a town planning authorization is necessary. The regulations of a PLU apply as long as they are not replaced by a new regulation which would remove this obligation to create visitor spaces. At that point, their sale would no longer be contrary to the regulatory provisions. She therefore asks him to please clarify the legality of the sale of places intended for visitors in contradiction with the regulations of a PLU and whether this sale could constitute an offense punishable by article L. 610-1 of the town planning code criminalizing the perpetrators of the facts.

Ms. Blandine Brocard alerts the Minister of the Economy, Finance and Industrial and Digital Sovereignty to the growing number of scams linked to identity theft, rental of accommodation - particularly for students - and the ease of obtaining a bank identity statement with a stolen identity. The tension on the rental market causes rental candidates to be less vigilant about rental conditions. transmission of personal information to supposed property owners publishing fraudulent advertisements on connection platforms. Over a single day and for the city of Lyon alone, the MP was able to identify no less than twenty potentially fraudulent advertisements on these platforms. Before even being able to visit the accommodation, the candidate is asked for a complete file including information such as tax property, copy of identity document, proof of address, tax notice. They are then informed that their application has been accepted and that a guarantee transfer must be made before visiting the property. For this purpose, the scammer sends the candidate a RIB from a French bank, or even a copy of an identity document to reassure the candidate. The documents requested from the candidate are then used by the scammers to open new accounts on online banks, particularly those offered in tobacco shops, in order to organize the following scam. The MP invites the Minister to strengthen banking regulations to in particular prevent any withdrawal from a newly created account without verification of address by post to the address indicated on the documents provided. She wants to know his intentions on this matter.

Mme Blandine Brocard alerte M. le ministre délégué auprès du ministre de la transition écologique et de la cohésion des territoires, chargé de la ville et du housing, sur une application hétérogène des conditions de calcul des aides personnalisées au housing lorsque plusieurs personnes partagent un appartement avec des baux séparés. En effet, article R. 821-4 du code de la construction et de l'habitation définit la colocation par la cotitularité du bail ou de l'engagement de location. La signature de baux distincts devant alors être considérée comme une location simple. Or il semble que certaines caisses d'allocations familiales appliquent une décote des APL pour les personnes titulaires d'un bail distinct répondant aux conditions de décence définie par la loi. Elle lui demande de clarifier les conditions d'attribution des aides afin que tous et notamment les étudiants, puissent bénéficier d'aides équivalentes.

Mme Blandine Brocard interroge M. le ministre de l'économie, des finances et de la relance sur les conséquences de la création de MaPrimeRenov' en remplacement du crédit d'impôt prévu à l'article 200 quater du CGI sur l'article 1383-0 B du CGI. En effet, suite à la création de MaPrimeRenov', la liste des dépenses d'équipement mentionnées à l'article 200 quater du CGI est désormais figée aux dépenses réalisées avant le 31 décembre 2020. Mme la députée souhaite donc connaître les conséquences pour une collectivité qui prendrait une délibération d'exonération postérieurement au 31 décembre 2020 en application de l'article 1383-0 B du CGI et, notamment, si certains aménagements réalisés postérieurement au 31 décembre 2020 peuvent bénéficier de l'exonération de TFPB votée par la collectivité.

Mme Blandine Brocard alerte M. le ministre de l'économie et des finances sur les pratiques des opérateurs de télécommunications et internet qui s'apparentent à de la vente forcée interdite par l'article L. 121-12 du code de la consommation. Sous prétexte d'enrichir l'offre du client, l'opérateur l'abonne automatiquement à une option payante après lui avoir envoyé un simple courriel lui signifiant, de manière peu claire, qu'il a la possibilité de refuser l'option. Il s'agit donc bien là, comme réprimé par le code de la consommation, d'un contenu numérique non fourni sur support matériel qui n'a pas fait l'objet d'une commande préalable du consommateur. Certains opérateurs tentent également de contourner la législation en proposant au consommateur de commander une option gratuite, puis de la transformer en option payante sans que cela ait été prévu dans le contrat initial. Elle souhaite connaître les dispositions qu'il peut prendre pour faire cesser ces pratiques.

Mme Blandine Brocard alerte Mme la ministre des solidarités et de la santé sur les conditions d'exercice de la profession d'orthopédiste-orthésiste. L'article 2 de l'arrêté du 1er février 2011 relatif aux professions de prothésiste et orthésiste pour l'appareillage des personnes handicapées énonce que les orthopédistes-orthésistes sont seuls autorisés à concevoir, fabriquer, adapter, délivrer et réparer certains dispositifs médicaux sur mesure, parmi lesquels les ceintures médico-chirurgicales de soutien ou de maintien, les corsets orthopédiques d'immobilisation, les bandages herniaire, les orthèses élastiques de contention des membres et les vêtements compressifs pour grands brûlés. La profession s'inquiète aujourd'hui d'une possible ouverture de l'habilitation à délivrer ces appareillages à des professionnels de santé non-diplômés, au terme d'une courte formation. Un tel élargissement engendrerait non seulement des difficultés économiques certaines pour les orthopédistes-orthésistes eux-mêmes, comme pour les écoles de formation agréées, mais induirait surtout un risque sérieux pour la santé des patients. En effet, la délivrance d'un appareillage de série inadapté pourrait leur causer des effets secondaires indésirables, avec, en conséquence, un coût supplémentaire pour la sécurité sociale. Elle souhaiterait donc savoir si une modification des modalités de délivrance des appareillages de série est envisagée par le Gouvernement, et si oui, quelles mesures sont étudiées pour protéger le savoir-faire des orthopédistes-orthésistes.

Mme Blandine Brocard appelle l'attention de Mme la secrétaire d'État, auprès du Premier ministre, chargée des personnes handicapées sur la situation des personnes handicapées logées dans le parc social par souci d'accessibilité. Celles-ci, si elles dépassent un certain seuil de revenus, doivent s'acquitter du supplément de loyer de solidarité (SLS), un surloyer qui doit en principe être minoré du fait de leur handicap, car elles sont « réputées à charge » au sens de article 196 A bis du CGI, à condition de disposer d'une carte d'invalidité. Une réponse ministérielle publiée en 2014 (QE n° 33957) confirmait le droit pour ces ménages de se prévaloir d'une minoration du surloyer auprès des bailleurs sociaux au moyen de la présentation de la copie de cette carte d'invalidité lors de l'enquête annuelle SLS. Pourtant, de nombreux témoignages, notamment de couples dont une personne est valide et l'autre en situation de handicap, rapportent des difficultés avec les bailleurs sociaux. Ainsi, pour refuser la minoration du surloyer, un bailleur social a pu déclarer qu'une personne handicapée faisant partie du couple, n'est pas considérée comme à charge au sens de article 196 A bis du code général des impôts. Elle lui demande donc de clarifier les éléments dont il est tenu compte pour le calcul du SLS acquitté par les personnes en situation de handicap logées en HLM.

Mme Blandine Brocard interroge M. le ministre de l'action et des comptes publics à propos de la non-reconduction du « bonus VAE », cette aide d'État plafonnée à 200 euros pour l'achat d'un vélo à assistance électrique à hauteur de 20 % de son montant. Comme M. le ministre l'a confirmé le 28 septembre 2017, cette prime sera supprimée à compter de février 2018, et ce alors même que le Gouvernement s'est engagé à encourager financièrement le recours aux modes de transport les moins polluants. La députée s'étonne que ce bonus VAE soit supprimé tandis que l'aide à l'achat d'un scooter électrique est maintenue et que des aides sont également accordées pour le passage d'un véhicule polluant à un véhicule récent, même si ce dernier est équipé d'un moteur diesel. La suppression de cette prime risque de porter un coup important au développement économique de la jeune filière cyclable et, plus largement, aux politiques en faveur des mobilités actives sur les territoires. La députée entend l'argumentaire de M. le ministre selon lequel tant que l'État supporte cette prime, les collectivités ne seront pas incitées à financer l'achat de VAE, mais doute que cette suppression annoncée provoque le sursaut espéré de la part des collectivités. Aussi, souhaiterait-elle savoir si des alternatives à la non-reconduction pure et simple du bonus VAE pourraient être envisagées : par exemple une aide moins élevée, 10 % du montant du VAE plafonnée à 100 euros, mais qui inciterait probablement nombre de collectivités à abonder pour rendre le dispositif plus incitatif pour les habitants de leur territoire. Ou encore, par exemple, un abondement de l'État aux dispositifs proposés par les collectivités à hauteur de 50 % de ceux-ci, qui pourrait être plafonné à 200 euros.

Mme Blandine Brocard interroge M. le ministre d'État, ministre de la transition écologique et solidaire sur sa vision de la politique de l'eau en France. Alors que l'agriculture intensive est la principale cause des pollutions de la ressource aquatique, à hauteur de 70 % pour les pesticides et de 75 % pour les nitrates, elle ne finance que 7 % de la redevance pollution des agences de l'eau, le reste étant très majoritairement payé par les consommateurs, en violation du principe pollueur-payeur qui régit pourtant la directive cadre 2000/60/CE pour l'eau. Et alors même que les exemples étrangers prouvent que le coût de la réduction des nitrates au niveau agricole est moins élevé que celui des enlèvements des nitrates de l'eau polluée, seul un tiers du budget des agences de l'eau est à ce jour alloué aux campagnes de prévention, l'essentiel étant dédié à la dépollution des eaux. Tel est le cas, par exemple, des villes scandinaves qui versent des aides aux propriétaires pour le reboisement des périphéries, afin d'assainir les nappes phréatiques. Par ailleurs, les aides publiques à l'agriculture sont encore très minoritairement versées aux modèles agricoles moins consommateurs de pesticides, d'engrais et d'eau. Au regard de ces éléments, et suite à la réflexion initiée dans le cadre des états généraux de l'alimentation, elle souhaiterait connaître les pistes de réformes explorées par le Gouvernement pour faire évoluer la politique de l'eau par rapport à la transition écologique.
