M. Philippe Schreck alerte M. le garde des sceaux, ministre de la justice, sur une situation qu'il estime profondément alarmante et révélatrice d'une grave dégradation du service public de la justice : l'état actuel du droit à l'appel en matière civile. D'une part, les délais d'audiencement atteignent des niveaux proprement inacceptables. Il est ainsi établi que la Cour d'appel d'Aix-en-Provence a officiellement indiqué qu'un dossier en état d'être jugé ne pourrait être audiencé qu'à un horizon de cinq années. Une telle durée, alors même que les parties ont respecté l'ensemble de leurs obligations procédurales, ne constitue ni plus ni moins qu'un déni de justice. Ce délai exorbitant plonge les justiciables dans une insécurité juridique durable les prive de toute visibilité sur l'issue de leur litige et mine profondément la confiance dans l'institution judiciaire. Il témoigne d'un dysfonctionnement structurel majeur de la justice civile en appel. D'autre part, le formalisme excessif issu du décret Magendie modifié conduit à une éviction massive de dossiers pour des motifs d'irrecevabilité, fréquemment relevés d'office par les juridictions, donc malheureusement aussi par convenance ou pour des questions statistiques ou de désengorgement. Cette pratique donne le sentiment que la gestion des flux judiciaires repose désormais davantage sur l'élimination procédurale des affaires que sur leur jugement au fond. Autrement dit, la réduction des délais semble être recherchée non pas par un renforcement effectif des moyens ou une amélioration de l'organisation judiciaire, mais par une diminution artificielle du nombre de recours examinés. Cette situation est d'autant plus incompréhensible que la loi d'orientation et de programmation du ministère de la justice a prévu une augmentation très substantielle des moyens budgétaires précisément destinée à améliorer les délais de traitement. Force est de constater que ces engagements ne produisent aucunement les effets attendus. Or le droit à l'appel constitue une garantie fondamentale du droit à un procès équitable, protégé par l'article 6 de la Convention européenne des droits de l'Homme, tel qu'interprété par la Cour européenne des droits de l'Homme. Dans ces conditions, la combinaison de délais manifestement excessifs, d'un formalisme procédural rigide et de l'incitation à améliorer les statistiques porte une atteinte grave et potentiellement disproportionnée au droit d'accès au juge et à un procès équitable. Face à cette situation, M. le député ne peut que dénoncer une forme de renoncement de l'État à garantir un accès effectif à la justice d'appel. Il lui demande en conséquence comment le Gouvernement peut justifier que des juridictions annoncent publiquement des délais d'audiencement de plusieurs années sans réaction immédiate ; quelles mesures concrètes et urgentes seront prises pour résorber ces délais qui s'apparentent à un déni de justice et, si oui, quand le Gouvernement entend remettre en cause le cadre procédural issu du décret Magendie modifié, dont l'application conduit, dans les faits, à restreindre l'exercice du droit à l'appel, parfois même de manière abusive.

Mr. Philippe Schreck alerts the Minister of Small and Medium Enterprises, Commerce, Crafts, Tourism and Purchasing Power on the exercise of hairdressing activities within certain barber shop type establishments, a subject which has already been the subject of several parliamentary questions in recent months. Under the guise of “beard care” – which are in no way covered by the provisions of articles R. 121-1 et seq., contrary to what the Government asserts - it is clear that the majority of these operators carry out haircuts, therefore "practice all or part of the profession of hairdresser", even though they too often do not have any of the required qualifications, thus creating a distortion of competition to the detriment of local businesses such as hairdressers. The fact that no qualification obligation is required for the registration of these businesses, including under self-employed status, greatly facilitates the evasion of controls and hidden work. Indeed, the Sunday opening of certain barber shops with salaried staff working under the guise of self-employed status, as well as the frequent absence of electronic payment terminals in certain establishments, increases the risks of hidden work and fraud tax. Consequently, he asks what concrete and new measures the Government intends to implement, both to include barber activities in the provisions applying to hairdressing, and to protect our qualified hairdressers by strengthening the effectiveness of controls and by truly fighting against misuse of the legislation.

M. Philippe Schreck interpelle M. le garde des sceaux, ministre de la justice, sur les effets délétères que pourrait avoir la mise en œuvre du décret « Rationalisation des instances en voie d'appel pour en garantir l'efficience », dit « RIVAGE », actuellement à l'état de projet. La note de cadrage adressée en réponse aux avis récriminatoires des professionnels du droit n'a aucunement rassuré, bien au contraire. En effet, ce projet prévoit notamment la hausse du taux de ressort de 5 000 à 10 000 euros, la hausse du taux de médiation obligatoire, le constat de l'irrecevabilité des appels sans débat ni recours possible et l'exclusion du droit d'appel de certaines matières, comme les obligations alimentaires et les baux commerciaux dont le loyer annuel est inférieur à 15 000 euros. M. le député rappelle à M. le ministre que la véritable façon de régler les différends entre les justiciables est de juger au fond leur contentieux et non de rendre l'accès au juge et au double degré de juridiction - qui constitue un droit fondamental - plus complexe et difficile, voire impossible. Il est rappelé que ce double degré de juridiction doit demeurer un principe et ne peut de la sorte être relégué au rang des exceptions. De plus, s'il entrait en vigueur, ce décret instituerait une justice inégalitaire et à double vitesse, au sein de laquelle le droit d'appel ne serait ouvert qu'aux contentieux financièrement importants, privant d'un droit fondamental les Français les plus modestes. De surcroît, exiger une autorisation préalable d'interjeter appel ou déclarer un appel « manifestement irrecevable » sans débat contradictoire ni possibilité de recours semble heurter des principes fondamentaux et contrevenir à celui de proportionnalité. Il lui demande donc, sinon de renoncer à ce décret inique, de lui indiquer quelles mesures il compte prendre afin de relancer un véritable dialogue avec les acteurs afin que les litiges en cause d'appel ne relèvent pas d'un privilège discrétionnaire et n'obéissent pas à une seule logique statistique, mais bien à un impératif de jugement au fond.

Mr. Philippe Schreck alerts the Minister of Agriculture, Agri-Food and Food Sovereignty to the absolute urgency of reinforced regulation of Canis lupus, especially since the change in counting method on January 1, 2025 confirms the unreliability of the data on wolf populations taken into account until now, while they condition public decisions in this matter. In many departments, wolf attacks are increasing and endangering the very existence of pastoral activities, with losses of 15,000 animals each year. A first official report as of May 31, 2025 indicates at the national level 815 additional findings and 2,500 additional victims, compared to the same period in 2024, and in Provence-Alpes-Côte d'Azur, there are 522 additional findings and nearly 1,500 more victims in just five months. While the lupine population today greatly exceeds the biological viability threshold of 500 wolves recognized by scientists, its proliferation increases the unbearable pressure on breeding. The breeders do not ask for alms: they do not want to be compensated for feeding the wolves, but to make a living from their profession and pass on ancestral know-how. They must be able to keep this predator away from their livestock and be able to defend it in real time. However, the measures of the Wolf Plan 2024-2029 prove to be insufficient and subject to the goodwill of the prefects. When they are issued, when they are not conditioned on costly and sometimes unrealistic protection requirements, shooting authorizations - for defense as well as for sampling - remain too limited and far too slow to be implemented. Mr. Philippe Schreck draws the attention of the Minister for Europe and Foreign Affairs to the worrying situation of twenty-three Armenian prisoners of war, captured and still detained illegally and arbitrarily by the Azerbaijani army. Among them, after mock trials, seven of them were sentenced to heavy sentences. Recently, sixteen others were expected to appear and answer to unproven accusations of " terrorism”, “separatism”, “war crimes”, “crimes against humanity” or “crimes against Azerbaijan”, “slavery”, “forced disappearance of people”… Among them are eight former senior leaders of the former Republic of Artsakh. Already questioned by several parliamentarians, the minister laconically responded that he pays “particular attention to the concerns expressed by organizations defending human rights regarding the fairness of trials and the treatment of the accused” and “repeatedly reminded the Azerbaijani government of its international obligations to respect fundamental rights and will continue to do so. » He also expressed pious wishes regarding their “fair trial” or their “conditions of detention” as well as “the outcome of the negotiation of a peace treaty between Armenia and Azerbaijan. Mr. Philippe Schreck draws the attention of the Minister of State, Keeper of the Seals, Minister of Justice, to the safety of prison officers and the recurring failures in the organization of transfers of dangerous prisoners. On Thursday April 3, 2025, four agents from the Draguignan remand center were victims of a violent attack during a judicial escort to the Draguignan court. While they were supervising a classified inmate escort 3” and suffering from psychiatric disorders, these agents suffered a particularly brutal attack. The prison officers, supported by those of the national police present on site, showed remarkable composure and controlled the individual. Even though they were injured, in addition to being affected by the incapacitating gas they had to use, they carried out their mission to the end and brought their attacker back to the remand center. This umpteenth event raises several questions and observations, unfortunately all too recurring. On the one hand, while these agents demonstrated - it must be remembered - impeccable management and exemplary conduct, they only benefited from the support of the management and the head of detention of the Draguignan remand center. On the other hand, while having regard to the recognized dangerousness of the individual, the last circular from the Minister relating to the doctrine of employment of prison security teams - which would be dated February 20, 2025, but is still not published on Légifrance - would require the presence of a supervisor and at least three agents, this escort was certainly made up of four agents, but without any supervision! However, it appears in reality that many other escorts are not carried out in compliance with the obligations regulations, often in much more degraded and dangerous conditions than in the present case. This observation is all the more serious as it echoes the tragedy of Incarville, on May 14, 2024. While at the Draguignan remand center, according to the union organizations, only 11 agents out of 23 are actually stationed at the ESP - specifying that the minimum number of 30 agents, planned but not achieved, turns out to be largely underestimated. He him asks if he plans to immediately allocate the personnel essential to the proper execution of the ESP's missions and, failing that, but in a much more secure manner, to concretely organize the use of videoconferencing and the conditions for traveling to prisons for magistrates.

Mr. Philippe Schreck draws the attention of the Minister of State, Keeper of the Seals, Minister of Justice, to the evaluation of the system and procedures for the appearance of juvenile offenders. France is facing a disintegration of its criminal treatment system for minors, with in particular an increased lengthening of the time between the commission of the offense and the conviction of the said minor. The establishment of the judgment in two hearings of a minor, whatever the type of crime, supposed to constitute an improvement in the quality of justice and an acceleration of the processing of cases, produces a number of negative effects. Indeed, the results are quite different: with the gap procedure in matters of criminal judgment of minors established by article 93 of law no. 2019-222 of March 23, 2019, it takes more than 18 months after the acts committed for the minor to be applied - or not - to a sanction, thus reinforcing a feeling of impunity which inevitably leads them to question authority, to recidivism, to the commission of increasingly serious acts and to becoming a long-term criminal. It appears that the Ministry of Justice is slow to draw the consequences, although visible and concrete, from this state of affairs. Unless there is an error or omission, there is no serious study to date and the data Statistics are only available until 2020. Since then, it's been a total blur! The MP therefore asks the Minister to make public the statistical data and studies proving or not the announced advantages of this system of caesura between the declaration of guilt and the pronouncement of the sanction. Mr. Philippe Schreck draws the attention of the Minister of Ecological Transition, Energy, Climate and Risk Prevention to the proliferation of projects linked to waste management in the 8th district of Var, which arouse strong opposition among residents due to their location and the impacts they generate on the environment and the living environment. Among these projects are the waste quarry inert in Draguignan (Granégone), located in a sensitive natural area, at the foot of the village of Ampus; the XXL Aups recycling center, located in a remarkable rural area; the Fonsante project, adjoining the shores of Lake Saint-Cassien; the Draguignan mega-incinerator, planned in the immediate vicinity of a residential area. These projects present several worrying common characteristics: a clearly unsuitable location, generating environmental risks and multiple nuisances (pollution, increase in road traffic, degradation of local ecosystems, etc.); an excessive concentration of projects and sites already in operation nearby, increasing nuisance for local populations; an oversizing of infrastructures, exceeding the real needs of the territories concerned, which suggests management going far beyond the scale of the region, with the potential reception of waste from other territories, including waste with a high contamination potential; a lack of prior consultation, with residents systematically presented with a fait accompli. If territorial solidarity in terms of waste management is an imperative, it is crucial that this solidarity respects the specificity and fragility of rural territories, such as those of the 8th district of Var, which are home to remarkable landscapes and sensitive natural areas. Consequently, the MP asks the Minister to immediately put in place a moratorium on all waste management projects in this constituency, in order to allow a reassessment of their relevance and their location, in a logic of territorial coherence and respect for local particularities and strengthen transparency and consultation with local populations and elected officials. He would like to know the measures that the Government intends to take in this direction and to guarantee both the protection of this district, of which tourism is one of the primary riches, and appropriate planning which takes into account the real needs of the territories concerned, while limiting the environmental and health impact of the waste management infrastructure.

Mr. Philippe Schreck questions the Keeper of the Seals, Minister of Justice, on legal aid granted to foreigners in an irregular situation. Article 3 of Law No. 91-647 of July 10, 1991 very widely grants legal aid to foreigners "without residence conditions", that is to say in an irregular situation, so that they can challenge the measures of remaining in the waiting zone, refusal to issue a residence permit or residence, an obligation to leave French territory or a ban on return or movement on French territory, an expulsion measure, administrative detention or transfer to another State of an asylum application. Ordinance No. 2020-1733 of December 16, 2020 facilitated and extended the possibility of granting legal aid. Thus, in addition to the subsidies granted to associations campaigning in this area, the taxes paid by the French are used to pay the legal costs of foreigners in an irregular situation so that they can remain in the country at all costs and indefinitely. There is therefore - at least implicitly - a real “legal aid for foreigners” which is to justice what medical aid to foreigners (AME) is to health! Nevertheless, the latter - which the Senate had decided to remove in 2023, at first reading of the bill to control immigration, improve integration, to replace it with emergency medical aid - has an official existence, is budgeted, is subject to a vote in Parliament, at least excluding abuse of the use of article 49, paragraph 3, of the Constitution... However, this "legal aid to foreigners in an irregular situation" exists in fact, but is not the subject of any procedure specific legislation, does not appear as such in the budgets of the Ministry of Justice; As for the financial data on the subject, they are non-existent or not public. This reform mainly concerned land transport between hospitals, clinics or any other health structure. These establishments must now cover the costs of land medical transport and have entered into public contracts with medical transport operators. However, too many public health establishments do not respect their contractual obligations, in particular payment deadlines, vis-à-vis medical transport companies. These delays are now reaching 6 to 8 months, thus putting their co-contractors in a situation of unacceptable financial precariousness. Mr. Philippe Schreck questions the Minister Delegate to the Minister of the Interior and Overseas Territories and the Minister of Ecological Transition and Territorial Cohesion, responsible for local authorities and rurality, on the division of the France rural revitalization map (FRR), a system which replaces that of rural revitalization zones (ZRR). It appears that, in its application, this new device proves to be disconnected from the realities on the ground and the real needs of the municipalities and even arbitrary with regard to the disparities appearing in bordering areas between departments. This is the case of Var and more particularly of its 8th district which lists all of the 35 municipalities classified as ZRR until now, 4 of which are “in mountain areas continuing to benefit from the effects of the classification since 2017”. The latter, as well that around ten others will suddenly be removed from the system, while eight new municipalities will enter it. It is therefore not a question of small local developments, but of an upheaval for an entire territory. The incomprehension of the local elected officials concerned and those of neighboring municipalities, who are also indirectly impacted, is total. The announcements concerning Haut-Var create as much discomfort as insecurity legal and fiscal for voluntary mayors who make long-term projects and fight to carry them out, but see their efforts called into question by decisions concerning their municipality, but established on intermunicipal criteria of a statistical nature which ignore the qualitative questions of isolation, distance from public services, aging of the population, dynamism, medical deserts... Moreover, with regard to measures taken in the neighboring department of Alpes-de-Haute-Provence, the announcements relating to the Var municipalities which are undergoing unjustified downgrading are received with all the more incomprehension as the difference in treatment is arbitrary and unjust and inequitable. Finally, the present situation perfectly illustrates the inadequacy between the policy of forced grouping of municipal skills carried out by the last successive governments, which we find in the decision to maintain the criteria of the rural revitalization system at the intermunicipal level while all the associations of mayors and rural mayors are calling for a return to the municipal level. He therefore asks her not to proceed with any downgrading of municipalities in the Var and questions her about the measures she intends to take to involve all local elected officials and nationals in discussions relating to France rurality revitalization concerning them and, more broadly, to the social and economic development impacting the territories of which they are the elected representatives.

M. Philippe Schreck interroge M. le garde des sceaux, ministre de la justice, sur les actions qui vont être impactées par la baisse des budgets de la justice dans le cadre du décret du 21 février 2024 portant annulation de crédits. Par ce décret, le ministre de l'économie, des finances et de la souveraineté industrielle et numérique a annulé 10 milliards d'euros en autorisations d'engagement et 10,17 milliards d'euros en crédits de paiement sur le budget pour 2024, pourtant à peine adopté à l'aide de l'article 49, alinéa 3, de la Constitution. Le budget de la justice est amputé de 327 877 590 euros en autorisations d'engagements, soit de 2,30 % du budget initial, dont 117 598 514 euros (-1,73 %) sur le programme 107 « Administration pénitentiaire », 129 196 532 euros (-2,72 %) sur le programme 166 « justice judiciaire » ou bien 42 978 821 euros (-5,59 %) sur le programme 310 « Conduite et pilotage de la politique de la justice ». Nonobstant l'inflation qui progresse toujours inéluctablement, la réalisation des projets et objectifs sur lesquels M. le garde des sceaux s'était engagé dans la loi du 20 novembre 2023 d'orientation et de programmation du ministère de la justice 2023-2027 apparaît plus que compromise, seulement trois mois après la publication de cette loi. De fait, le budget qui devait enfin donner à la justice les moyens d'assurer ses missions se révèle, une fois de plus, être la variable d'ajustement de ce Gouvernement, comme ce fût le cas de ses prédécesseurs. M. le député interpelle M. le garde des sceaux quant aux actions qui seront sacrifiées, alors que toutes sont pourtant indispensables pour que soit restaurée la justice et que les Français retrouvent un semblant de sécurité. Ainsi, la planification de la construction des 18 000 places de prisons continuera-t-elle à souffrir d'une inexorable procrastination ? Les objectifs de recrutement du personnel pénitentiaire, sans lesquels les prisons promises ne pourront pas fonctionner ni même ouvrir, ainsi que ceux des greffiers et des magistrats, demeureront-ils des chimères ? Il lui demande donc de préciser quelles actions seront amputées de leurs budgets et pour quels montants et comment, dans ces conditions, il compte tenir sa promesse de construire 18 000 places de prison et en assurer le fonctionnement effectif.

Mr. Philippe Schreck draws the attention of the Minister of the Interior and Overseas Territories to the demands of municipal police officers, a few months before the opening of the Olympic Games. In recent weeks, strike movements have agitated municipal police forces against a backdrop of social demands. Among the latter, all legitimate, the integration of policy premiums into the basis for calculating their pensions, like the national police, attracts attention. In fact, it would only be the fair remuneration for a difficult profession which is becoming more and more difficult to exercise, even though their technical skills are only increasing. The Olympic and Paralympic Games are thus apprehended by municipal police officers. Being already short of personnel to ensure the daily security of the French, they will be overstretched throughout French territory and particularly in the towns and villages which will be crossed by the Olympic Flame, as well as around the games sites. It is therefore essential that the State takes into consideration the demands of municipal police officers so that it standardizes the social situations of the different police forces. Mr. Philippe Schreck questions the Keeper of the Seals, Minister of Justice, on legal aid granted to foreigners in an irregular situation. Article 3 of Law No. 91-647 of July 10, 1991 very widely grants legal aid to foreigners "without residence conditions", that is to say in an irregular situation, so that they can challenge the measures of remaining in the waiting zone, refusal to issue a residence permit or residence, an obligation to leave French territory or a ban on return or movement on French territory, an expulsion measure, administrative detention or transfer to another State of an asylum application. Ordinance No. 2020-1733 of December 16, 2020 facilitated and extended the possibility of granting legal aid. Thus, in addition to the subsidies granted to associations campaigning in this area, the taxes paid by the French are used to pay the legal costs of foreigners in an irregular situation so that they can remain in the country at all costs and indefinitely. Mr. Philippe Schreck questions the Minister of Transformation and Public Service on the employment of disabled people in the public service. As in the private sector, any public employer employing at least 20 full-time agents or their equivalent is required to employ, full-time or part-time, disabled people in the proportion of 6% of the total number of paid agents. Failure to comply with this obligation has led, since January 1, 2006, to the payment of an annual contribution to the Fund for the integration of disabled people in the public service (FIPHFP). As part of the PLF for 2023, by circular NOR CCPB2211594C of April 19, 2022, the budget director (Ministry of the Economy, Finance and Recovery) removed the transversal indicator of compliance with the obligation to employ disabled people, claiming that “ data relating to beneficiaries of the employment obligation for disabled workers are published as part of the annual report on the state of the civil service”. However, the latest annual report on the state of the civil service shows that of the different public services that of the State is the worst performer with a rate of 4.40% as of December 31, 2021 (see page 62). This report remains completely silent on the contributions paid to the FIPHFP. Indeed, in addition to their mission of authenticating judicial documents, clerks have a general mission of assisting magistrates. The justice orientation and programming law provides for the additional recruitment of 1,500 clerks, even though to respect the usual ratio of 1.2 clerks per magistrate, at least 1,800 would be needed. However, while it is laudable, this objective will in any case come up against the lack of attractiveness of the clerk's profession, particularly at the index level and this situation risks getting worse... It appears in fact that the 2023 index grid project is a source of concern and discontent for these professionals: if the indices are “slightly” increased, this increase is accompanied by a systematic reduction in step with all the harmful consequences that result in terms of career development. By way of illustration, a clerk who is currently at index 392 and at step 5 will see his new index raised to 395, but his step demoted to 3. This unfair system is one of the causes of the social movement which currently affects all registries of France and the crisis of attractiveness risks being aggravated and constituting a lastingly insurmountable obstacle to achieving the recruitment objectives provided for in the 2023-2027 orientation and programming law. Within the eighth district of Var, the Pays de Fayence includes 9 municipalities, or nearly 29,000 inhabitants. This area has 3 middle schools but no high schools. Thus, every day, nearly 1,000 high school students have to travel to establishments in Var and the Alpes-Maritimes. The need for a high school within the Pays de Fayence is not contested by any actor, quite the contrary. For more than 20 years, the construction of a high school has been planned in the town of Montauroux, which has reserved the necessary land base for it. On multiple occasions, the PACA Regional Council has announced the construction of this establishment, with great communication. An information panel was even posted on place. Several “laying the first stone” ceremonies were organized, always on the eve of electoral deadlines or for the regular communication needs of the former president of the region. However, only these single stones have been laid and this project remains desperately at a standstill. However, the opening of this high school is increasingly essential. It is always necessary for the sake of territorial coherence and educational, taking into account school rhythms. The emergency is increasingly strong and also arises from social and environmental imperatives while the question of transport over several dozen kilometers is a daily ordeal for nearly 1,000 high school students and their families, whose transport budget is burdened by general inflation. More generally, the blocking of this project, expected for a generation, maintains the territorial divide and the feeling of abandonment of territories by public services. M. Philippe Schreck appelle l'attention de M. le garde des sceaux, ministre de la justice sur les dysfonctionnements récurrents du dispositif des bracelets anti-rapprochement et la nécessité de sa refonte complète et urgente. Le dispositif des bracelets anti-rapprochement doit normalement permettre à une victime d'être alertée dès que son agresseur s'approche à l'intérieur d'un périmètre déterminé. Mais, depuis l'origine du déploiement, de nombreux dysfonctionnements ont été répertoriés. Le premier contrat avec Allianz a tourné au fiasco et a été résilié par l'administration. Le nouveau contrat avec la société Stanley Security dont l'acquisition par Securitas a été finalisée en juillet 2022 ne semble pas apporter plus de satisfaction selon les témoignages concordants d'associations de défense des droits des femmes, de magistrats et de délégués syndicaux de personnels pénitentiaires en charge de la question. En effet, à la piètre qualité des bracelets souvent en panne s'ajoutent les problèmes récurrents d'indisponibilité des matériels figurant pourtant en stock. Le dispositif s'avère inadapté en zone urbaine à cause de la densité de population et des transports, nonobstant la fiabilité du matériel de géolocalisation. Plusieurs associations, avocats et magistrats ont déjà alerté le ministre et ses services sur les nombreuses défaillances en matière d'alerte des victimes et de surveillance des auteurs. Ainsi, les alertes intempestives peuvent oppresser les personnes protégées au point qu'elles renoncent à un système qui constitue une menace pour leur équilibre psychologique. D'un autre côté, face aux nombreux dysfonctionnements des bracelets, il a déjà été constaté que l'opérateur privé diffère des signalements et déclare ultérieurement une résolution d'incident. Une telle omission conduira un jour au drame. Mais même en cas d'alerte de l'opérateur, les agents des services pénitentiaires d'insertion et de probation relèvent que joindre une personne sous surveillance revient à l'informer de l'éventualité d'une défaillance du matériel. Ils préfèrent donc s'abstenir en espérant maintenir l'effet placébo de la mesure et s'en remettent aux services de police et de gendarmerie. Néanmoins, les fausses alertes sont devenues tellement habituelles que les levées de doute ne sont plus effectuées systématiquement, voire deviennent l'exception. Il appert que le système est malheureusement techniquement défaillant et l'organisation du dispositif doit être totalement repensée, urgemment. La délégation à des opérateurs privés pose difficulté : pour ces missions essentielles, la recherche de productivité est incompatible avec l'efficacité et la sécurité des concitoyens. M. le député demande donc à M. le ministre d'informer pleinement les parlementaires des dysfonctionnements du dispositif bracelets anti-rapprochement et lui demande quelles mesures il compte prendre pour y remédier au plus vite.

M. Philippe Schreck rappelle à M. le garde des sceaux, ministre de la justice, son engagement auprès des parlementaires en matière d'évaluation des politiques pénitentiaires au regard du taux de récidive par régime de peine. Lors de l'examen de la séance publique du volet dépenses de la mission Justice du projet de loi de finances pour 2023, M. le garde de sceaux s'est opposé à l'adoption de l'amendement n° 1885 relatif à la création d'un indicateur portant sur le taux de récidive annuel jusqu'à cinq ans pour chacun des régimes de peine ( Journal officiel de l'Assemblée nationale n° 72, pages 4770 et 4771). Le rapporteur a indiqué que « l'absence d'un indicateur sur le taux de récidive est liée non seulement à des difficultés d'ordre méthodologique, mais aussi à l'absence de données pour le construire » et concluait que « nous sommes d'accord, cela n'est pas satisfaisant et le ministère de la justice peut mieux faire en matière de pilotage ». M. le garde de sceaux a ajouté que « sur le plan de la politique pénale, comme dans d'autres matières, il est très utile de savoir si l'on est efficace ou non. Ces outils d'évaluation, nous ne les avions pas ; nous souhaitons les développer ». Pour justifier son opposition à l'adoption de cet amendement, M. le ministre a annoncé qu'« une mission d'évaluation des politiques pénitentiaires débutera dans quatre jours au sein de la direction de l'administration pénitentiaire ». Force est de constater que, plus de deux mois après cette annonce, cette mission d'évaluation n'a fait l'objet d'aucune autre communication et nul n'en a jamais plus entendu parler. Or analyser la récidive dans le temps et par régime de peine est essentiel avant de pouvoir examiner la pertinence du plan d'action issu des États généraux de la justice annoncé dernièrement par M. le ministre. La communication - préalablement au dépôt prévu au printemps 2023 des projets de loi correspondant à ce plan d'action - des taux de récidive par an jusqu'à 5 ans pour chacun des régimes de peine est donc impérative, d'autant que le pôle d'évaluation des politiques pénales à la direction des affaires criminelles et des grâces disposerait bien des données correspondantes et des statistiques demandées. Il lui demande donc de lui préciser quels sont la composition, la mission exacte, le calendrier et les modalités de suivi des travaux de la mission d'évaluation des politiques pénitentiaires qui, selon ses dires, a été installée quatre jours après le débat budgétaire, et de lui communiquer les documents administratifs correspondants.

M. Philippe Schreck alerte M. le ministre de la santé et de la prévention sur les discriminations géographiques en matière de santé et d'accès aux médicaments. Bien que l'ensemble du corps médical ait alerté le Gouvernement sur les tensions d'approvisionnement sur de nombreuses familles de médicaments, cela depuis plusieurs mois, le pays subit aujourd'hui une pénurie d'une ampleur sans précédent. Ainsi, on constate des ruptures d'approvisionnement qui concernent notamment plusieurs références d'antalgiques, d'anti-inflammatoires et d'antibiotiques. Or ces ruptures semblent affecter certaines régions plus que d'autres, les zones rurales plus que les métropoles. Ainsi, M. le député constate que le Haut-Var cumule désertification médicale, fermeture des urgences et aujourd'hui rupture totale de médicaments essentiels. Pourtant, au lendemain des dernières élections législatives, M. le député a alerté M. le ministre sur la dramatique fermeture des urgences de Draguignan (question écrite n° 55 publiée au JO du 12 juillet 2022, page 3420) et, après relance, a reçu une réponse laconique et déconnectée des réalités tant locales que nationales, reprenant presque mot pour mot la communication générique du Gouvernement (réponse publiée au JO du 1er novembre 2022, page 5094). Depuis, la situation a empiré avec la fermeture récente des urgences de Fréjus, une situation officiellement temporaire mais officieusement reconductible, voire prochainement définitive. La situation des concitoyens a aussi empiré du fait de la discrimination géographique que de nombreux élus de tous bords constatent en matière de santé. Ainsi, force est de constater que certains médicaments en rupture depuis plusieurs semaines dans toutes les pharmacies situées dans un rayon de près de 100 kilomètres autour de la principale ville de la 8e circonscription du Var sont toujours restés disponibles à Paris ou d'autres métropoles. De fait, il existe une inégalité en matière de santé et aux déserts médicaux succèdent désormais des zones de non-droit à la santé. Il l'appelle donc à rétablir sans délai le droit fondamental à la protection de la santé sur l'ensemble du territoire et lui demande de rendre compte régulièrement aux représentants de la Nation de l'évolution des ruptures de médicaments par famille médicamenteuse et par département.

Ainsi, on constate des ruptures d'approvisionnement qui concernent notamment plusieurs références d'antalgiques, d'anti-inflammatoires et d'antibiotiques. Or la bonne délivrance de certains de ces médicaments est pourtant essentielle - voire critique ou vitale - pour bon nombre des concitoyens. Le décret n° 2021-349 du 30 mars 2021 relatif au stock de sécurité destiné au marché national était pourtant censé protéger les Français d'une situation telle que le pays la connaît aujourd'hui. Force est de constater les insuffisances flagrantes de ce texte concernant de nombreuses spécialités médicamenteuses, ainsi que les manquements dans son application par « les titulaires d'autorisation de mise sur le marché et les entreprises pharmaceutiques et organismes exploitant ou distribuant en France un médicament ». Il lui demande donc comment le Gouvernement compte agir tant pour mettre fin à l'actuelle pénurie de médicaments essentiels que pour réviser et faire appliquer ledit décret, d'autant que le Gouvernement est garant du respect du droit fondamental à la protection de la santé.

M. Philippe Schreck interroge M. le ministre de l'intérieur et des outre-mer sur le maintien de l'obligation vaccinale covid-19 concernant les pompiers volontaires. La France et la Grèce demeurent les derniers pays européens où l'ensemble des personnels travaillant dans un environnement médical, qu'ils soient soignants ou non, sont indistinctement astreints à l'obligation vaccinale contre la covid-19 et sont suspendus en cas de défaut de vaccination. Or la Grèce semble s'engager sur la réintégration des personnels administratifs d'ici la fin de l'année. La question des personnels n'ayant aucun contact avec les malades et personnes fragiles se pose aussi en France, particulièrement en ce qui concerne les soldats du feu. En effet, durant l'été dernier, avec la sécheresse historique et la multiplication du nombre d'incendies, la France a dû faire appel à la solidarité européenne. Or les autres pays européens n'ont pas le même niveau d'exigence et ne réalisent aucun recensement des personnels vaccinés ou non. Ainsi, des pompiers français non vaccinés ont été remplacés par d'autres eux aussi non vaccinés, mais étrangers. Cela est ubuesque. Dans des départements particulièrement exposés aux incendies, comme le Var, le recours aux volontaires est impératif et il est inconcevable de persister à opposer l'obligation vaccinale à des personnels qui pourraient être affectés exclusivement à la lutte contre les incendies et risques majeurs. Il lui demande quelles considérations objectives s'opposent à la reprise des missions des pompiers volontaires non vaccinés, a minima concernant les activités de lutte contre les incendies et risques majeurs qui ne nécessitent pas de contact avec les personnes malades.

M. Philippe Schreck interroge M. le ministre de la santé et de la prévention sur la situation du service des urgences du centre hospitalier de Draguignan, une nouvelle fois fermé le soir et le week-end. Cet hôpital se situe au centre d'un vaste territoire et représente un bassin de population de plus de 130 000 habitants. L’accès aux soins est concrètement refusé à une partie de la population varoise caractérisant ainsi une rupture d'égalité entre les citoyens mis en situation de danger sanitaire. Cette situation, loin d'être ponctuelle, perdure depuis de longs mois. Ainsi il souhaite demander au Gouvernement ce qu'il compte mettre en œuvre, dans l'urgence, pour apporter des effectifs permettant à la population de retrouver un accès à des soins dignes et décents.
