Dans ce contexte, l'initiative de cette loi est à saluer car elle renforce l'attractivité du recrutement des sapeurs-pompiers volontaires, souvent mise à l'épreuve. Cependant, le projet de décret présenté en octobre 2023 s'éloigne de la loi initiale d'avril de la même année. La première version du texte d'application limitait la bonification des retraites aux seuls sapeurs-pompiers n'exerçant aucune activité professionnelle. Cette distinction apparaît comme une injustice pour tous les volontaires, qui s'engagent en parallèle de leur vie professionnelle et parfois au détriment de leur vie personnelle. Elle lui demande quel est le délai de parution d'un décret qui refléterait pleinement l'objectif de reconnaissance prévu par la loi n° 2023-270.

Mme Laure Miller alerte Mme la ministre de l'agriculture et de la souveraineté alimentaire sur la pertinence du référentiel appliqué à la certification haute valeur environnementale (HVE) dans le domaine agricole et viticole à partir du 1er janvier 2025. La suppression de la voie B et donc des deux critères globaux, basés sur les parts des infrastructures agroécologiques dans la surface agricole utile et du poids des intrants dans le chiffre d'affaires de plusieurs entreprises agricoles et viticoles, pénalisera certains exploitants, qui font pourtant des efforts environnementaux significatifs sur leurs cultures. Des cultivateurs perdront la certification HVE car ils ne rempliront plus certaines conditions de la voie A, alors que leur activité et leurs efforts environnementaux sont identiques. En plus de dissuader la mise en pratique d'efforts en faveur de l'environnement, ce référentiel menace les exports ainsi que la compétitivité commerciale de certaines exploitations. Elle lui demande si un projet de référentiel plus souple, qui encouragerait les initiatives écologiques tout en accompagnant les exploitants dans leur activité, était envisagé.

Mme Laure Miller appelle l'attention de M. le garde des sceaux, ministre de la justice, sur la législation en vigueur concernant la protection des enfants victimes de violences sexuelles. Selon le juge Édouard Durand, plus de 160 000 enfants sont victimes de violences sexuelles chaque année, cela représente un enfant abusé ou violé toutes les trois minutes. Seulement 3 % des pédocriminels sont déclarés coupables. Ces chiffres attestent que même si des mesures sont effectives vis-à-vis de la lutte contre la pédocriminalité, des dispositions restent à prendre dans l'intérêt des plus jeunes. Beaucoup d'enfants pourraient être sauvés si les signalements des parents protecteurs étaient davantage considérés. Malheureusement, le parent protecteur, celui qui constate les sévices sur son enfant et qui décide d'en informer les autorités n'est très souvent pas pris au sérieux. Ainsi, elle lui demande si des actions seront menées pour assurer la protection des plus vulnérables d'entre eux, notamment via le renforcement des dispositions de l'article 6 du décret du 23 novembre 2021 relatif à la protection du parent protecteur, l'interdiction du recours à la notion de « syndrome d'aliénation parentale » par le parent abusif vis-à-vis du parent protecteur et la création d'une ordonnance de sûreté de l'enfant (OSE), permettant au juge aux affaires familiales de statuer en urgence sur les modalités d'exercice de l'autorité parentale.

En conséquence, de nombreux citoyens doivent faire leur demande avant même de planifier leur séjour. Par ailleurs, Mme la députée soulève une disparité dans les conditions de traitement entre les habitants de Paris, qui peuvent directement se rendre à la préfecture et ceux issus des autres départements. Elle souhaite savoir si une révision plus équitable et efficiente du processus d'obtention du permis international de conduire est envisagée.

Les sapeurs-pompiers volontaires se multiplient entre leur vie de famille, leur emploi et leur engagement au service des autres pour sauver des vies et soulager les services d'urgences, trop souvent engorgés. article 24 de la loi susvisée visait à garantir aux sapeurs-pompiers volontaires des trimestres supplémentaires pris en compte dans la détermination du taux de calcul de la pension et la durée d'assurance dans le régime, pourvu qu'ils aient au moins effectué dix années de service. Il est indiqué à certains parlementaires que l'éligibilité à la mesure concernée serait subordonnée à un critère d'inactivité. Avec l'ajout d'une telle mesure, l'énorme majorité des sapeurs-pompiers volontaires, qui cumulent une activité professionnelle avec leur engagement, ne bénéficieraient pas des dispositions du décret. Elle lui demande de préciser en amont de la publication du décret si la loi effective sera à l'image de celle votée par les parlementaires, omise du critère d'inactivité.

Mme Laure Miller alerte Mme la ministre de l'éducation nationale et de la jeunesse sur la fermeture d'une classe au sein de l'école maternelle et élémentaire de Châtillon-sur-Marne. C'est une révolution que risque de vivre l'école maternelle et primaire de Châtillon-sur-Marne à la rentrée prochaine : trois niveaux en une seule classe avec d'un côté 27 enfants en maternelle et de l'autre 25 élèves de CE2, CM1, CM2. Sous le coup d'une menace de fermeture de classe, cette nouvelle organisation aurait des conséquences tant sur les élèves que sur les professeurs des écoles. Sur les élèves : certains élèves demandent un suivi particulier, le triple niveau ne permettra pas ce suivi particulier, tant pour les élèves de l'école maternelle souvent peu autonomes que pour les élèves de l'école élémentaire préparant leur entrée au collège. Mme la députée craint que les missions tant de l'école maternelle qui sont de donner envie aux enfants d'aller à l'école pour apprendre, affirmer et épanouir leur personnalité que celles de l'école élémentaire qui sont d'acquérir un socle commun de connaissances, de compétences, de culture et de préparer une entrée au collège ne puissent être totalement remplies. Sur le personnel enseignant : cette fermeture de classe aura également des répercussions sur le personnel enseignant augmentant considérablement la charge de travail déjà importante de ces derniers, le tout dans un contexte anxiogène avec une directrice d'école hors les murs. En effet, la directrice de l'école maternelle aura aussi la direction de l'école primaire. Les deux écoles étant situées sur deux sites différents dans le village, elle n'aura donc que très peu de contacts avec les enfants et une partie du corps enseignant. Alors que le Gouvernement est extrêmement mobilisé sur l'éducation et agit sans relâche au service de l'école, elle aimerait savoir ce qu'elle compte faire sur ce sujet.

Mme Laure Miller attire l'attention de M. le ministre de l'économie, des finances et de la souveraineté industrielle et numérique sur la hausse progressive du prix du tabac à compter du 1er janvier 2024 et jusqu'à l'année 2027. Chaque année, plus de 75 000 personnes décèdent à cause de la cigarette, cette dernière est la première cause de cancer évitable en France et la lutte contre sa consommation est légitime. Néanmoins, la hausse progressive du prix du tabac nuit grandement à l'activité des buralistes, commerçants de proximité indispensables à la vie des citoyens. Effectivement, la hausse susvisée à l'échelle nationale accentue la consommation tabagique des Françaises et Français dans des pays frontaliers, notamment l'Espagne, la Belgique ou Andorre. Un tiers des cigarettes fumées par les citoyens proviennent de l'étranger, cela provoque une perte des recettes pour les bureaux de tabac, pour l'État et incite progressivement à la contrebande. Il est légitime de se demander si ces augmentations sont pertinentes, compte tenu des conséquences qu'elles engendrent. Elle lui demande donc de préciser si les hausses du paquet de cigarettes seront jointes à des mesures d'accompagnement des buralistes et de lutte contre les trafics de contrebande.

Mme Laure Miller appelle l'attention de M. le ministre de la santé et de la prévention sur la fin du financement de l'hébergement des professionnels de santé de l'association Asalée (Action de santé libérale en équipe) par la Caisse primaire d'assurance maladie. L'association en question, créée en 2004 et présente dans tous les départements français depuis 2022, joue un rôle important dans la lutte contre l'engorgement médical et pour l'amélioration du suivi des patients en mettant en étroite coopération les médecins généralistes et les infirmiers. L'expansion de ce dispositif de coopération médicale a fait ses preuves dans le suivi de nombreuses pathologies chroniques (diabète de type 2, BPCA, risque cardiovasculaire élevé, troubles cognitifs) et compte aujourd'hui à son service près de 800 médecins généralistes qui coopèrent avec 1 800 infirmières et infirmiers. Le budget de l'association dépendait à 95 % du ministère de la santé et de l'assurance maladie ; la suspension du financement de l'hébergement des professionnels Asalée dès la fin de l'année 2023 traduirait une prise en charge du dispositif médical par les départements et les collectivités territoriales. Une telle mesure serait susceptible de conduire à une gestion des services Asalée au cas par cas, ce qui affaiblirait les garanties de stabilité de ce dispositif de santé et intensifierait les inégalités territoriales. Se pose alors la question du maintien de cette activité au regard de cette évolution. Elle lui demande donc de préciser si le Gouvernement compte apporter une réponse pérenne quant à l'hébergement des professionnels Asalée, qui tendent à prendre une place croissante dans la lutte contre l'engorgement médical et les inégalités territoriales.

Détectée pour la première fois en 1982 au Japon, cette maladie a subi une mutation ces dernières années, développant de manière importante, ses capacités à tuer les abeilles et à se transmettre. Malheureusement cette maladie, s'ajoute aux différents maux qui causent déjà des pertes majeures aux producteurs apicoles. Elle voudrait savoir quelles mesures ont été auparavant prises par le Gouvernement pour sécuriser l'activité des apiculteurs, tout en protégeant les abeilles, les insectes pollinisateurs indispensables à la vie.

Mme Laure Miller attire l'attention de M. le ministre de la santé et de la prévention sur les difficultés rencontrées par l'établissement français du sang (EFS) au lendemain de la journée mondiale du don du sang. En fin d'année 2022, 75 présidents et administrateurs de comités et unions départementales de don du sang ont écrit au Président de la République afin de lui faire part de leur inquiétude quant à l'avenir du don du sang en France. En effet, près d'un million de patients bénéficient en France de dons de sang et de plasma, dans des conditions d'autosuffisance dont il faut se réjouir. Le modèle français, éthique et souverain, constitue une fierté. Pourtant, ce modèle est aujourd'hui fragilisé par des moyens financiers jugés trop justes pour que les associations bénévoles puissent réaliser un nombre de collectes conséquents et puissent avoir les moyens de faire preuve d'originalité et d'inventivité pour aller chercher les donneurs volontaires là où ils sont et motiver davantage de donneurs potentiels. Aussi, elle lui demande comment le Gouvernement compte garantir la pérennisation du modèle transfusionnel français, notamment grâce à des actions correctrices sur la gestion des personnels médicaux collecteurs, au niveau des prix de vente du plasma, des aides directes versées à l'EFS mais aussi pour aider l'EFS à se renouveler pour convaincre davantage de Français à donner leur sang.

Mme Laure Miller appelle l'attention de M. le ministre de l'agriculture et de la souveraineté alimentaire sur les futures installations de jeunes dans des exploitations agricoles, ce qui apparaît être un grand enjeu pour les années à venir. En effet, il semblerait que la direction régionale de l'alimentation, de l'agriculture et de la forêt (DRAAF), ait prétendu que le « parcours à l'installation » n'était plus obligatoire pour pouvoir bénéficier de la dotation jeunes agriculteurs. Cette décision apparaît étonnante, tant la création ou la reprise d'une exploitation agricole impose prévision et approfondissement. Ce parcours va en effet permettre de rendre possible un projet tout en développement des compétences professionnelles indispensables à la gestion d'une structure agricole. Elle lui demande de bien vouloir lui confirmer si le « parcours à l'installation » va bien rester un passage obligatoire dans le parcours d'un jeune souhaitant ouvrir son exploitation agricole.
