Mr. Christophe Proença draws the attention of the Minister of Labor and Solidarity to the consequences for tourist caves of the regulations relating to the calculation of worker exposure doses to radon. The decree of November 16, 2023 relating to the methods of calculating effective doses and equivalent doses resulting from the exposure of people to ionizing radiation modified the calculation methods applicable in particular to workers exposed to radon. The application of higher dose coefficients can lead to a significant increase in the dose calculated for the same exposure and, consequently, a significant reduction in the authorized presence time of employees in cavities. This situation is particularly worrying for tourist caves, whose operating conditions and morphological, geological characteristics and aerological conditions are very different from one site to another. Tourism and underground heritage professionals do not dispute the need to protect employees against the risks linked to exposure to radon. However, they warn of the fact that a uniform application of these coefficients could not sufficiently take into account the specificities of underground environments and have significant consequences on the sustainability of certain operations, particularly in rural areas, as well as on jobs directly and indirectly linked to this activity. The Council of State, in its decision of July 13, 2026 No. 490924 and 500756, partially annulled the contested provisions. In particular, he judged that the ministerial authorities having taken certain measures were not competent to establish the methods for calculating effective doses and the coefficients applicable to specific workplaces. He also canceled the refusal to repeal certain provisions of the decree of May 15, 2024 and ordered the ministers concerned to proceed with their repeal within two months. This decision therefore constitutes an important step in legal terms, but it does not resolve, in itself, the fundamental question raised by professionals, which is that of the adaptation of the regulations to the realities of tourist caves. Future regulations will have to determine the calculation methods applicable to these workplaces while guaranteeing an appropriate level of protection for employees. Thus, he asks what follow-up the Government intends to give to the decision of the Council of State of July 13, 2026 and, in particular, what regulatory measures it plans to take in this context, and if the Representatives of the tourism and underground heritage sector will be involved in the development of these new provisions, so that the specificities of the different cavities are taken into account and a balance can be sought between the necessary protection of workers exposed to radon and the preservation of a tourist and heritage activity representing several thousand jobs in France.

M. Christophe Proença appelle l'attention de Mme la ministre de l'agriculture, de l'agro-alimentaire et de la souveraineté alimentaire sur les conséquences des récentes décisions de l'Agence nationale de sécurité sanitaire de l'alimentation, de l'environnement et du travail (ANSES) relatives aux produits cupriques utilisés en viticulture biologique. Le cuivre constitue aujourd'hui le principal, et dans de nombreuses situations le seul, fongicide efficace homologué en agriculture biologique contre le mildiou. Son utilisation est déjà strictement encadrée au niveau européen, avec un plafond de vingt-huit kilogrammes par hectare sur sept ans, soit une moyenne de quatre kilogrammes par hectare et par an. Pourtant, dans le cadre du renouvellement des autorisations de mise sur le marché des spécialités commerciales à base de cuivre, l'ANSES a décidé en juillet 2025 de ne réhomologuer qu'un nombre très limité de produits, réduisant considérablement les solutions disponibles pour les viticulteurs. Les deux produits réautorisés sont en outre soumis à de nouvelles restrictions d'usage, notamment l'impossibilité de lisser les doses dans le temps, l'interdiction d'utilisation pendant la floraison et l'instauration d'intervalles minimums entre traitements, compliquant fortement la gestion sanitaire des vignobles biologiques. Cette situation suscite une profonde inquiétude au sein de la filière. Les fabricants concernés contestent les méthodes d'évaluation retenues et estiment que les modèles utilisés pour apprécier les risques environnementaux ne sont pas adaptés aux substances minérales inorganiques telles que le cuivre. Ils rappellent que plusieurs travaux scientifiques ont conduit à remettre en cause certains critères de bioaccumulation et de toxicité appliqués dans le cadre de ces évaluations et demandent depuis plusieurs années une adaptation de la méthodologie utilisée. De leur côté, les organisations représentatives de l'agriculture biologique soulignent qu'aucune alternative pleinement opérationnelle n'est aujourd'hui disponible pour remplacer le cuivre dans la lutte contre le mildiou. Cette situation est d'autant plus préoccupante pour le vignoble lotois que celui-ci traverse une crise profonde. Entre 2022 et 2026, près de 1 300 hectares de vignes ont été arrachés dans l'appellation Cahors, conséquence de la succession des aléas climatiques, des difficultés économiques et des mutations du marché. Alors que de nombreux viticulteurs ont fait le choix exigeant de l'agriculture biologique, il serait paradoxal que l'absence de solutions de protection adaptées les conduise aujourd'hui dans une impasse technique et économique. Dans un contexte où les pouvoirs publics encouragent le développement de la production biologique et la transition agroécologique, M. le député s'inquiète du manque de moyens de protection dont disposent les agriculteurs. Il lui demande comment le Gouvernement entend garantir la cohérence entre les objectifs fixés aux producteurs et les moyens effectivement mis à leur disposition pour protéger leurs cultures, et quelles initiatives il entend prendre afin de favoriser une concertation entre les services de l'État, l'ANSES, les représentants des filières concernées et les experts scientifiques, de manière à garantir que l'évaluation des produits cupriques repose sur des méthodologies adaptées aux spécificités de ces substances et à éviter que des décisions réglementaires ne fragilisent durablement la viticulture biologique française.

Mr. Christophe Proença draws the attention of the Minister of Health, Families, Autonomy and People with Disabilities to the worrying deterioration of access to dermatological care in many territories, and particularly in the Lot department. While national prevention campaigns legitimately encourage the population to consult quickly in the event of a suspicious skin lesion in order to promote screening. early onset of skin cancer, many patients find it increasingly impossible to obtain an appointment with a dermatologist within a time frame compatible with public health requirements. This situation is particularly worrying in Lot, a department of 176,473 inhabitants which today only has one private dermatologist working part-time and one hospital dermatologist. This treatment offer extremely limited leads to waiting times incompatible with the needs for prevention, diagnosis and monitoring, whether for suspected melanomas or carcinomas, but also for severe chronic inflammatory diseases whose consequences on the quality of life, mental health, professional activity and social life of patients are major. This shortage is part of a worrying national context. There France has only around 2,850 dermatologists for nearly 68 million inhabitants, or around 3.25 specialists per 100,000 inhabitants, a level well below the estimated needs. Delays in accessing consultations reach several months in many territories and sometimes exceed an entire year. The explosion in these recourses to care can be explained in particular by the evolution of sun exposure behavior since the 1980s: the practice of voluntary tanning without appropriate protection and the rise of UV cabins contributed to a real and documented increase in skin cancers and chronic dermatological pathologies. These skin diseases constitute a major public health issue. In fact, each year, nearly 200,000 skin cancers are diagnosed in France and around 20 million people live with a pathology. dermatological, often chronic and disabling. This reality has also led the World Health Organization to recognize, in May 2025, skin diseases as a global public health priority. Health professionals are already mobilizing through specialized care teams, tele-expertise systems or innovative territorial organizations. In several departments, breeders faced with the discovery of an outbreak of bovine tuberculosis report difficulties in carrying out the health procedures implemented. If the need to preserving the health status of France and fighting effectively against this disease cannot be disputed, the operators concerned nevertheless underline the complexity of the protocols applied, the difficulty in understanding certain analysis results as well as the need for clearer information throughout the procedures. The breeders concerned express in particular the need to better understand the scientific criteria and sanitary conditions which lead to decisions on selective or total slaughter, as well as the articulation between the different screening tools used. In situations where the very future of the farm is at stake, the quality of dialogue and education appear essential to guarantee adherence to the health measures implemented. Furthermore, the economic consequences of these procedures can be particularly heavy for farms concerned. Several professionals are wondering about the methods of evaluating slaughtered animals, particularly when herds present specific characteristics linked to milk production, genetic selection or the zootechnical value of the animals. They also question the adaptation of the benchmarks used to current economic realities, in particular to all the costs of production. Beyond the technical and financial aspects, these situations also lead to strong human and psychological pressure on breeders and their families, faced for several months with uncertainty regarding the future of their farm. He asks what measures the Government intends to implement to strengthen information on procedures for managing outbreaks of bovine tuberculosis, improve supporting the breeders concerned and ensuring that administrative deadlines remain compatible with the management requirements of agricultural operations.

Mr. Christophe Proença draws the attention of the Minister of the Economy, Finance and Industrial, Energy and Digital Sovereignty to the situation of children who have lost one of their parents prematurely and who therefore find themselves penalized in asset transfer schemes. Indeed, the current regime for donations and inheritances allows each child to benefit from a reduction of 100,000 euros per parent. However, when a parent dies prematurely, children are often required to mobilize all or part of this reduction as part of the inheritance opened upon their death. They can then no longer fully benefit, in the years that follow, from the same transmission possibilities as children whose two parents are still alive. This situation is particularly badly experienced by the families concerned. While they have already suffered the human and emotional ordeal of the loss of a parent, they sometimes discover, at the time of a donation or subsequent transmission, that this disappearance also has the consequence of reducing the tax advantages to which they could have claimed if both their parents had remained alive. Mr. Christophe Proença draws the attention of the Minister of Culture to the need to lift the cap on taxes allocated to the National Music Center (CNM), namely the tax on current music and variety shows as well as the tax on free and paid music streaming. The proceeds from these two taxes are entirely intended to support the development of players in the music and variety industry. This mechanism of redistribution, based on upstream pooling of revenues from music distribution and targeted downstream reallocation, constitutes a particularly virtuous and efficient lever. It is part of a logic comparable to that implemented in the cinema and audiovisual sector, making it possible to structure a sector that is at once creative, innovative and economically dynamic throughout the national territory as well as in the international. However, the current ceilings set at 58 million euros for the entertainment tax from 2026 and 21 million euros for the streaming tax now appear unsuitable for the structural evolution of the market and the growing needs of the music industry, in full transformation (digital and ecological transitions, equality issues, innovations linked to artificial intelligence, development international). Regarding the tax on ticketing for shows, its yield has experienced sustained growth since the end of the health crisis, reaching 49.3 million euros in 2023, 55.74 million euros in 2024, then 64.5 million euros in 2025. This dynamic, driven in particular by the increase in attendance, the increase in ticket prices and the development of large show infrastructures, leads to a exceeding the ceiling, leading to the return to the general State budget of revenues which are nevertheless essential to financing the sector. This mechanism directly weakens the capacity of the CNM to support actors, in particular via the right to draw live shows, the operation of which is incompatible with ex post capping. Ultimately, maintaining the ceiling could lead to a situation in which the resources of the CNM would be entirely absorbed by drawing rights, to the detriment of selective aid, thus compromising its very mission of equalization and structuring support for the sector. Regarding the tax on music streaming, its product, still in the ramp-up phase, is also experiencing significant growth in a context of continued market growth, both in terms of paid subscriptions and advertising revenue. The current ceiling of 21 million euros appears, again, to be disconnected from the economic realities of the sector and the associated financing needs. In this context, the removal of the ceiling from these two taxes appears to be an essential measure to guarantee the sustainability and effectiveness of the financing model of the French music industry. The AFPA carries out essential national missions of reception, orientation, training engineering, qualification and integration of the public, in particular job seekers and people undergoing retraining. In 2024, it trained 93,000 people, including 50,000 job seekers, with an exam success rate of 81.8% and an access to employment rate within six months of 72.5%, which attests to the effectiveness of its model. However, in a professional training system largely based on competition through calls for tender, the AFPA finds itself weakened. The financing proposed does not allow always cover the real costs of qualifying technical training requiring professional platforms, heavy equipment and specific educational engineering. This logic sometimes favors training at low structural cost, to the detriment of diploma courses meeting the sustainable needs of sectors in tension. Furthermore, the reduction in funding dedicated to accommodation and catering highlights difficulty for trainees whose remuneration can be limited to 769 euros per month, compromising effective access to training for the most precarious groups. In a constrained budgetary context for all higher education establishments, the University of Toulouse - Jean Jaurès today seems to be faced with restrictions which directly affect the operation of the IRT. The non-renewal of positions has already led to the cancellation of certain training courses and is weakening the financial balance of the Institute, jeopardizing essential subsidies, in particular those of the regional directorate of the economy, employment, labor and solidarity and of the Occitanie region. These decisions come even though an audit of the Ministry of Education higher education and research was expected in order to identify solutions to ensure the sustainability of the structure. Created more than twenty years ago, the IRT d'Occitanie plays a major role in the university training of trade unionists in the region and in the implementation of systems for validating acquired experience (VAE) for elected officials, community volunteers and employee representatives. Mr. Christophe Proença draws the attention of the Minister of Ecological Transition, Biodiversity and International Negotiations on Climate and Nature to the particularly worrying situation of the French photovoltaic sector, which is today going through a period of major uncertainty, due to the delay in publication of the Multi-Annual Energy Program (PPE 2025-2035). Many Industrial players, particularly rural businesses, report that the lack of clear and stable decisions threatens not only their activity, but also thousands of direct and indirect jobs. Like Fermes de Figeac or the Puymelec company, in its constituency, this represents nearly 10 million euros in turnover and 33 permanent jobs on which families in the region depend. The scenarios currently mentioned within the framework of the PPE, in particular R1 and R2, which provide for low development of solar power, are seen as equivalent to an implicit moratorium on photovoltaic activity. Under these conditions, companies see the cessation of new projects and the total absence of activity as soon as current projects end. The photovoltaic sector nevertheless constitutes an industrial sector that creates sustainable jobs and not relocatable, while participating in the production of low-carbon energy and achieving France's climate commitments. Mr. Christophe Proença draws the attention of the Minister of the Armed Forces and Veterans to the posthumous attribution of the combatant's card and the tax consequences for the widows of veterans. The combatant's card, the allocation of which is provided for by the code of military disability pensions and war victims, gives access to various rights, in particular, from the age of 74, to an additional half-share of the quotient family for the calculation of income tax for its holder. This half-share is also recognized for widows or widowers of veterans, provided that the deceased spouse was able to benefit from it for at least one year, which assumes that he or she has reached the age required for the attribution of the fighter's card or the fighter's pension before his death. However, in many cases, soldiers who have fully fulfilled the conditions giving entitlement to the fighter's card have not requested it during their lifetime or have died before reaching the age required for allocation of the half tax share. As a result, their widows or widowers find themselves deprived of this advantage, even though the military record and professional career attest to their spouse's acquired right. This situation has been highlighted on several occasions by parliamentarians, notably in terms of tax injustice towards the widows of veterans who died before the age of 65, excluded from the system despite their status as nationals of the National Office for Veterans and War Victims. Furthermore, according to estimates from parliamentary work, as of January 1, 2023, around 870,000 people benefited from the combatant's card, including nearly 200,000 veterans of external operations under the age of 65. years, and the ONAC-VG (National Office for Combatants and Victims of War) provided care for approximately 730,000 widows of all ages, of whom 673,000 were over 74 at that date. Mr. Christophe Proença draws the attention of the Minister of Transport to the particularly degraded situation of night trains and, more broadly, to the operation of the so-called territorial balance rail lines, in particular those serving the Massif Central and the south-west of France. Several recent events illustrate a profound deterioration of the public rail service. Thus, a night train linking Aurillac to Paris is remained immobilized with its passengers on board for almost nineteen hours. Such downtime, which would have been unimaginable just a few decades ago, seriously questions the organization, anticipation and operational capacity of the national rail system. This situation is all the more incomprehensible given that the State is devoting several billion euros to renovating the rail network. At the same time, Markets have been entrusted to foreign companies, while industrial and technical know-how remains in France, although weakened. The result observed by users, however, is that of a degraded service, massive cancellations and a feeling of abandonment in many areas. The population is overwhelmed. The Aurillac-Brive line is an emblematic illustration of this. Designed to circulate daily according to the programming documents, it actually experiences numerous deletions. Between November 25, 2025 and January 2, 2026, 29 train cancellations out of 36 planned movements were recorded. This situation undermines the continuity of public service and equal access to rail transport. The elimination of essential rail connections also constrains certain users, particularly since Figeac, to take buses in the middle of the night to reach Brive and try to access the night train, in conditions unworthy of a modern public service. Added to these difficulties is a persistent opacity of pricing, in particular on the SNCF Connect application, denounced by local user committees, which weakens the readability of the offer and equal access to the public rail service. The choices made in terms of maintenance also question. Repair operations are no longer carried out in the Brive workshops, which are now largely deserted, but transferred to Chalindrey, in the Grand Est. This choice appears difficult to justify while railway and industrial activities persist locally, particularly in Brive and Biars-sur-Cère. Finally, worrying pricing dysfunctions were reported by the Committee of defense of the Aurillac-Bretenoux/Biars-Brive line. For the same TER journey, on the same train, at the same time, prices can vary from 13.10 euros to 17 euros, solely depending on how the destination is entered on the SNCF Connect application, including for a user holding a youth advantage card. This pricing opacity poses a problem of transparency, equal access to public service and readability for users. The MP wishes to emphasize the fact that it is unthinkable to continue to weaken the public rail service while asking citizens to favor the train in national discourse. The inhabitants of Lot no longer accept promises without follow-up. They demand actions, reliable trains and services that meet their needs. In this context, he wishes to question him on several points. He him asks what concrete measures the State intends to take to guarantee the continuity and reliability of night trains, particularly on the lines serving the Massif Central; how the Government explains the very high level of traffic cancellations on certain lines that are scheduled as daily; if a reassessment of the maintenance and location choices of railway workshops is considered in order to preserve the existing skills in the territories concerned and what measures will be taken to guarantee transparent, fair and understandable pricing of journeys, regardless of how destinations are entered. The departmental federation for fishing and the protection of the aquatic environment of Lot is indeed alerting on two major challenges for local fish biodiversity: on the one hand, the difficulties encountered in obtaining regulated exemptions from the bans on the destruction of the great cormorant, even though the wintering numbers remain at a high level and the predation exerted on fish populations is estimated at more than 85 tonnes per year in the department; on the other hand, the proposed moratorium on eel fishing yellow in fresh water, currently under consultation, which would mainly target recreational fishing, while the causes of the decline of the European eel are multiple. Indeed, the pressure exerted on the eel results in particular from the overfishing of glass eels, obstacles to migration linked to hydraulic structures, the deterioration of water quality and the disappearance of wetlands, while measures to regulate the large cormorant, strictly regulated by regulations, remain difficult to implement at the local scale. The federation emphasizes that concentrating regulatory effort solely on recreational fishing, which is already heavily regulated, would be ecologically ineffective and socially poorly perceived, if other pressures are not simultaneously addressed. Mr. Christophe Proença draws the attention of the Minister of Health, Families, Autonomy and People with Disabilities to the risks of weakening the public hospital service created by certain recent measures which, in practice, introduce a distortion between public and private establishments, even though public hospitals are today at the heart of healthcare provision in many territories. In a context marked by high medical tensions, the public hospital service ensures continuity of care, particularly in rural or under-resourced areas. As such, it requires stronger support and fair rules. However, the decree of September 5, 2025 extending the application of article 33 of law no. 2021-502 imposes on public hospitals a much more restrictive recruitment framework than that applicable to lucrative or private establishments. associative. In fact, this article obliges the public accountant to reject the payment of temporary medical remuneration exceeding the regulatory ceilings and provides for referral to the administrative court in the event of an irregularity. These provisions, which only concern public establishments, place them in an unfavorable situation for recruiting the practitioners essential to maintaining activities, whereas the private sector, not subject to the same restrictions, can offer more attractive conditions. This asymmetry risks leading to unequal access to medical services for patients, particularly in areas where the public hospital is the only recourse. Cette pénurie nuit gravement à la continuité des soins et conduit à une situation très anxiogène pour les patients, mais également pour les officines ne pouvant dispenser le traitement. Les pharmacies sont autorisées à remplacer la spécialité prescrite par une préparation magistrale, selon les recommandations établies par l'ANSM, ce qui constitue une alternative lorsque les spécialités pharmaceutiques sont en rupture. Toutefois ce dispositif se heurte à des coûts de fabrication non compatibles avec les conditions tarifaires fixées par arrêté. La prise en charge par l'assurance maladie de ces préparations n'est que partielle, ce qui décourage les pharmacies spécialisées à poursuivre ladite fabrication. Ainsi, les patients sont laissés pour compte et se retrouvent sans traitement. Dans le département du Lot, comme partout en France, la santé des citoyens est un enjeu majeur. Il lui demande quelles mesures immédiates peuvent être mises en place pour permettre le remboursement total des préparations par l'assurance maladie et assurer la continuité des soins.

First attributed by the rector to internal dysfunctions within the academic commission, this suspension actually seems linked to budgetary decisions on a national scale. Il a récemment été indiqué qu'un reliquat de 257 millions d'euros issus du budget de la PAC pourrait être redéployé. En commission, Mme la ministre a évoqué la possibilité d'affecter « une part significative » de cette enveloppe au soutien de l'agriculture biologique, sans toutefois en préciser l'ampleur ni les modalités. M. Christophe Proença interroge M. le ministre auprès de la ministre du travail, de la santé, de la solidarité et des familles, chargé de la santé et de l'accès aux soins, sur les modalités d'application de la réforme de l'internat de médecine générale. La mise en œuvre prochaine de la quatrième année du diplôme d'études spécialisées (DES) de médecine générale en janvier 2026 soulève de nombreuses interrogations, notamment sur la place accordée aux centres de santé dans ce nouveau dispositif. Si l'objectif de cette réforme est de renforcer la formation des futurs médecins et de mieux les préparer à l'exercice autonome, il apparaît regrettable que les centres de santé ne soient, à ce jour, nullement intégrés dans la réflexion sur les terrains de stage et d'encadrement de ces futurs professionnels. Les centres de santé, au nombre de 900 en France et en constante augmentation, jouent un rôle essentiel dans l'accès aux soins, notamment dans les territoires ruraux. Les collectivités territoriales investissent dans des locaux partagés, fournissent jusqu'au matériel et supportent les charges de fonctionnement. Elles répondent aux attentes des jeunes professionnels de santé : exercice salarié, travail en équipe pluridisciplinaire, charge administrative réduite. Ne pas intégrer les centres de santé à la mise en œuvre de la quatrième année d'internat risque non seulement de fragiliser ces structures, mais également d'aggraver les inégalités sociales et territoriales de santé, déjà très marquées. Dans les zones très rurales, comme dans le département du Lot, les centres de santé représentent parfois l'unique recours médical pour une population vieillissante, éloignée des pôles hospitaliers et de la médecine de ville. Exclure ces structures des lieux de stage viendrait compromettre les perspectives d'installation des jeunes médecins dans ces territoires et accentuerait la désertification médicale. Aussi, il souhaite savoir si le Gouvernement entend revoir le périmètre d'application de la réforme de la quatrième année de médecine générale ou le préciser, afin d'y intégrer pleinement les centres de santé comme lieux de formation et d'apprentissage pour les médecins juniors.

À ce jour, très peu d'offres adaptées existent sur le marché pour couvrir les risques liés à l'utilisation partagée de véhicules hors des plateformes commerciales classiques. Dans la pratique, les groupes d'autopartage fonctionnent souvent à titre expérimental, sur la base de la confiance entre membres où en cas de sinistre, l'emprunteur s'engage à prendre en charge les réparations causées, généralement moyennant un défraiement au kilomètre. Toutefois, il est particulièrement complexe d'estimer la valeur cumulée du malus généré par un sinistre jusqu'à son extinction, ce qui rend difficile l'imputation équitable de ce coût à l'emprunteur. Cette incertitude freine le développement de l'autopartage entre particuliers et expose les propriétaires à des risques financiers importants. Il souhaite connaître quelles sont les mesures en attente d'être mise en œuvre pour encourager les assureurs à proposer des contrats adaptés à l'autopartage entre particuliers, permettant ainsi de sécuriser juridiquement et financièrement cette pratique, tout en favorisant la mobilité partagée et la transition écologique.

M. Christophe Proença appelle l'attention de Mme la ministre du travail, de la santé, des solidarités et des familles sur l'inégalité de traitement des aides-soignantes des services de soins infirmiers à domicile (SSIAD). En 2020, le Ségur de la santé a créé une mesure importante, dite Laforcade, visant à revaloriser les métiers du soin en attribuant une indemnité forfaitaire mensuelle de 238 euros bruts aux professionnels soignants, auxiliaires de vie et aides-soignants à compter du 1er janvier 2022. Cette mesure, saluée pour sa reconnaissance du rôle crucial de ces professionnels, a cependant laissé de côté une catégorie essentielle : les aides-soignantes des SSIAD. Ces professionnels, qui assurent le maintien à domicile des aînés et des personnes en situation de handicap, souvent en zones rurales isolées, font face à des conditions de travail particulièrement difficiles (horaires coupés, longs trajets, risques liés aux déplacements), sans pour autant bénéficier de la même reconnaissance financière que leurs collègues exerçant en EHPAD. Cette exclusion crée une discrimination inacceptable et met en péril l'attractivité de ces services indispensables, alors même que le maintien à domicile est une priorité de santé publique. Il est important de souligner que certains SSIAD, notamment ceux gérés par l'ADMR et relevant de la convention collective nationale de la branche de l'aide à domicile (BAD), sont exclus de la mesure Laforcade en raison de l'application de l'avenant 43 BAD. Cet avenant, bien qu'il vise à améliorer les conditions salariales, est perçu par certains comme moins avantageux que la prime Ségur/Laforcade (environ 183 euros nets par mois). Cette situation crée une inégalité supplémentaire au sein même des SSIAD, où certains professionnels bénéficient de l'avenant 43 tandis que d'autres, dans des structures différentes, pourraient potentiellement prétendre à la mesure Laforcade. Face à cette situation, il lui demande les actions concrètes qu'elle compte engager afin de corriger cette inégalité de traitement et garantir aux aides-soignantes des SSIAD l'accès à la mesure « Laforcade », assurant ainsi la pérennité de ces services essentiels et une juste reconnaissance de leur engagement. Plus précisément, il lui demande si elle peut indiquer si des mesures sont envisagées pour permettre aux SSIAD relevant de la convention BAD de bénéficier de la mesure Laforcade, tout en tenant compte des spécificités de l'avenant 43 ; une clarification de la politique d'attribution de ces primes est essentielle pour assurer une équité salariale et une motivation accrue des professionnels du secteur.

Christophe Proença attire l'attention de M. le ministre auprès du ministre de l'économie, des finances et de la souveraineté industrielle et numérique, chargé de l'industrie et de l'énergie, sur les préoccupations majeures de la filière solaire suite aux annonces faites de baisse du tarif d'achat dans le projet d'arrêté S21. La filière photovoltaïque française est aujourd'hui en grande inquiétude, en raison des perspectives négatives d'évolution réglementaire. Les mesures imposeraient une baisse drastique du tarif de rachat de l'électricité pour les installations de 100 à 500 kW et prévoient leur passage en appel à projets simplifié dès le 1er juillet 2025. Or ces installations représentent un secteur clé de la transition énergétique et un levier essentiel pour l'économie locale, avec plus de 67 000 emplois sur le territoire. Dans les départements ruraux, la plupart des projets concernés sont des projets agricoles, sur les toitures des bâtiments existants ou neufs, et n'ont pratiquement aucun impact s'ils sont conduits dans le respect du paysage et des espaces environnants. En favorisant les grands projets au sol, l'arrêt des projets 100-500 kWc risque d'accroître l'artificialisation des terres et de donner un avantage compétitif aux grands groupes d'investissement, souvent étrangers, au détriment des petites entreprises françaises qui développent des solutions sur bâtiments existants. Cette réorientation va à l'encontre des engagements pris dans le cadre du plan pluriannuel de l'énergie (PPE), qui fixe un objectif de 5 GW de nouvelles capacités solaires par an. En revoyant les objectifs trimestriels de raccordement à la baisse comme il est envisagé, même en appel d'offres simplifié, très peu de projets seront réalisés en toiture. Les acteurs du secteur, notamment les PME de la circonscription de M. le député, ont des prévisions de baisse de leur chiffre d'affaires de -50 %, menaçant directement leurs activités et leurs emplois. Les nouvelles conditions tarifaires (passage à 9,5 cents/kWh puis 8,5 cents/kwh puis 7,5 cents/kWh) rendent les projets économiquement non viables, alors que la France fait face à un déficit énergétique estimé à 172 TWh dans les prochaines années. De manière très pragmatique, les projets qui font vivre les PME françaises d'installation dans les territoires comme dans le département du Lot, sont là encore essentiellement destinés à des agriculteurs ou leurs groupements. Les surfaces de toiture permettent très largement le développement du photovoltaïque, avant de privilégier les sols, tout en favorisant une rémunération complémentaire des agriculteurs à moyen et long terme. La question de l'artificialisation des sols est particulièrement une source de préoccupation avec la présence d'une agriculture de qualité et d'élevages emblématiques comme celui de la brebis des Causses du Lot. Enfin, la CRE elle-même a critiqué les choix annoncés, qui risquent de ralentir l'essor du photovoltaïque en toiture, pourtant essentiel pour un développement équilibré des énergies renouvelables et dans le respect des sols. Dans ce contexte et compte tenu du caractère crucial de ce sujet pour l'indépendance énergétique et l'emploi en France, il lui demande quelles mesures le Gouvernement envisage pour garantir la pérennité des projets photovoltaïques de 100 à 500 kW, en particulier pour les agriculteurs, préserver l'emploi dans cette filière et assurer une transition énergétique compatible avec les objectifs du PPE.

À terme, il reste à souligner que ce sont des fermetures qui sont envisagées et à chaque fermeture d'un domaine touristique en France, c'est l'influence du pays qui diminue. Sans compter un point tout aussi important dont M. le député doute que Mme la ministre ne connaisse pas le sujet, mais ces fermetures menacent directement l'activité économique des zones rurales où ces sites sont souvent essentiels pour l'hébergement, la restauration, le commerce et l'artisanat locaux. De plus, cette décision intervient de manière abrupte alors que les recommandations de la Commission internationale de protection radiologique (CIPR 137) sont encore en cours d'examen par la Commission européenne et que la directive européenne 2013/59 Euratom reste la référence en vigueur pour les États membres. Ainsi l'arrêté ministériel semble donc anticiper hâtivement les conclusions des analyses européennes en cours. Les membres de la Fédération du tourisme et patrimoine souterrain ne minimisent pas les risques liés au radon et sont conscients de l'importance de ce sujet, mais ils demandent des clarifications sur leur avenir. De plus, les cas de figure sont multiples, chaque grotte étant différente dans un aspect morphologique, géologique et aérologique pouvant induire des situations face au radon totalement différente. Ainsi, il souhaite connaître les mesures qu'elle compte prendre afin de concilier la protection des travailleurs exposés au radon dans les grottes touristiques avec la nécessité de préserver l'activité économique et le patrimoine de ces sites, en tenant compte des spécificités de chaque cavité et des discussions en cours au niveau européen.

M. Christophe Proença attire l'attention de Mme la ministre du travail, de la santé, des solidarités et des familles sur le témoignage d'un habitant de sa circonscription et plus largement sur l'avenir du cannabis thérapeutique en France après le 31 mars 2026. Cet habitant, diagnostiqué de poliomyélite à l'âge de 6 ans, souffre d'une asymétrie de 5 cm entre ses membres inférieurs. Suite à un acte de bravoure où il a secouru un voisin victime d'un accident domestique, il a développé un syndrome post-poliomyélite, entraînant des douleurs chroniques importantes. En 2019, sur recommandation d'un médecin d'un centre anti-douleur, une demande a été faite auprès de l'ARS pour qu'il puisse bénéficier du cannabis thérapeutique via le Marinol. La récente annonce de la prolongation de l'expérimentation du cannabis médical jusqu'au 31 mars 2026 est une avancée significative. Cette décision offre un répit aux patients actuellement traités et ouvre la voie à une possible généralisation. Cependant, l'incertitude persiste quant à l'avenir de ces traitements au-delà de cette date. Le ministère de la santé a franchi une étape cruciale en notifiant à la Commission européenne les textes définissant le cadre de production et d'autorisation du cannabis à usage médical. Cette démarche laisse entrevoir la possibilité d'une généralisation du cannabis thérapeutique d'ici fin 2025 ou début 2026. Néanmoins, plusieurs questions restent en suspens. Quelles mesures concrètes sont envisagées pour assurer la continuité de ces traitements après le 31 mars 2026 ? Quel sera le statut légal du cannabis thérapeutique à long terme, au-delà de la période transitoire de cinq ans prévue par la législation actuelle ? Comment le Gouvernement compte-t-il garantir l'accès équitable à ces traitements, notamment en matière de remboursement par l'assurance maladie ? Quelles dispositions seront prises pour évaluer l'efficacité à long terme de ces traitements et ajuster le cadre réglementaire en conséquence ? Au-delà, cette situation illustre l'importance cruciale de ces traitements pour de nombreux patients souffrant de douleurs chroniques résistantes aux thérapies conventionnelles. Il est essentiel de leur offrir une visibilité sur l'avenir de leur prise en charge. Dans ce contexte, Mme la ministre peut-elle éclairer M. le député sur la stratégie du Gouvernement concernant l'avenir du cannabis thérapeutique en France après 2026 ? Quelles garanties peut-on apporter aux patients comme l'exemple cité quant à la pérennité de leur traitement ? Il souhaite connaître les éclaircissements qu'il pourra lui apporter sur ce sujet crucial pour la santé et la qualité de vie de nombreux Français.

M. Christophe Proença appelle l'attention de M. le ministre de la fonction publique, de la simplification et de la transformation de l'action publique sur la réforme statutaire visant à revaloriser la fonction de secrétaire de mairie adoptée le 30 décembre 2023 et la circulaire d'application édictée par la direction générale des collectivités locales en date du 18 octobre 2024. Les mesures de la circulaire ont été une déception partagée par nombre de secrétaires de mairie en catégorie C1. Ces agents, qui œuvrent au quotidien pour maintenir un service public de proximité dans les communes rurales, avaient reçu l'assurance de M. le ministre de la fonction publique qu'ils seraient inclus dans la voie de promotion vers les fonctions de secrétaire général de mairie. La circulaire d'application de cette réforme, en date du 18 octobre 2024, ne respecte pas cet engagement, excluant les agents C1 des dispositifs de promotion interne dérogatoire, en contradiction avec les annonces faites. En effet, dans une interview écrite accordée à la presse locale à l'occasion du Congrès des secrétaires de mairie en date du 12 octobre 2024, M. le ministre déclare que la circulaire « va faciliter l'application de cette loi, notamment pour les catégories C1 » et « permettra de progresser et de suivre un parcours pour des secrétaires recrutés en catégorie C1, qui vont pouvoir avoir accès à une progression de carrière et donc passer dans les échelons et catégorie supérieurs de façon facilitée ». Les secrétaires de mairie en catégorie C1 sont souvent au premier rang pour répondre aux besoins des citoyens dans les petites communes. Ce recul dans la mise en œuvre pratique de la réforme est un signal négatif qui pourrait encore fragiliser l'attractivité des postes de secrétaires de mairie, pourtant cruciaux pour l'administration locale, notamment en milieu rural. M. le député appelle l'attention de M. le ministre sur le besoin primordial de mettre en conformité la circulaire de la DGCL et les engagements pris le 12 octobre 2024, par l'inscription d'un accès équitable aux possibilités de promotion interne dérogatoire pour les agents en catégorie C1. Au-delà de la situation des agents de cette catégorie, M. le député tient à rappeler l'importance de revaloriser l'ensemble de la fonction de secrétaire de mairie, indispensable au bon fonctionnement des communes rurales. Cette profession, véritable cheville ouvrière des services publics de proximité mérite une reconnaissance plus forte pour garantir l'avenir d'un service public local efficace et accessible. Il lui demande quelles sont ses intentions à ce sujet.

M. Christophe Proença alerte Mme la ministre de l'agriculture, de la souveraineté alimentaire et de la forêt sur l'état de la filière noix dans le sud-ouest de la France, en particulier dans les départements du Lot, de la Corrèze et de la Dordogne. Cette filière agricole a subi une conjugaison de crises catastrophiques au point de mettre en péril économique les exploitations agricoles. La propagation des maladies fongiques, des parasites et le dérèglement climatique sont autant de causes objectives qui conduisent à des récoltes calamiteuses qui se cumulent à une crise concurrentielle internationale. En 2023, le Gouvernement a mis en place un plan exceptionnel de crise pour soutenir les exploitants impactés. Cette aide prévoyait une prise en charge des pertes à hauteur de 80 % des récoltes. M. le député souhaite attirer l'attention de Mme la ministre sur des critères inadaptés, retenus par l'administration pour définir l'éligibilité des exploitations au dispositif : tout d'abord, il est demandé aux exploitants un taux de spécialisation pour l'obtention de cette aide, qui doit être supérieur ou égal à 25 % du chiffre d'affaires total. Ce critère est particulièrement pénalisant, car les exploitations lotoises sont en grande majorité en polyculture. La noix n'étant pas l'activité principale de l'agriculteur, ce score n'est pas atteint dans la très grande majorité des cas. Cependant, dans le territoire concerné, un agriculteur a besoin de compter sur la viabilité de toutes ses productions s'il veut survivre. Ensuite, le second critère est celui du taux de perte de chiffre d'affaires sur la production par rapport aux années précédentes : les services du ministère imposent un seuil minimal de perte de chiffre d'affaires à 20 %. Les années de références ont toutes été impactées par des crises répétées pour la filière noix. Ainsi, il est impossible de se fier à ces résultats pour atteindre ce seuil, tant la production a été mauvaise. Ces deux critères cumulés excluent donc 9 exploitations sur 10 dans le département du Lot. M. le député demande à Mme la ministre d'analyser finement la situation de cette filière au regard de la crise économique vécue par les agriculteurs et de réinterroger les critères appliqués pour ces calamités agricoles. Il l'interroge sur la possibilité de remobiliser des crédits spécifiques pour soutenir l'investissement dans cette filière. Outre les problématiques sanitaires et climatiques, la production de noix a besoin d'un plan de relance ambitieux pour donner aux agriculteurs le sentiment que la France croit dans l'avenir de la filière noix et dans ses signes officiels de qualité. Ce plan d'investissement pour restaurer les verger devrait être ouvert à tous les producteurs, quel que soit la taille des exploitations. Il souhaite connaître ses intentions à ce sujet.
