Law on Amendments to the Defense Service Act (language requirement for military service)

Based on the bill, all conscripts must know the Estonian language at least at the B1 level from the beginning of 2027. If the professional has not been educated in Estonian or his language skills cannot be identified based on the databases, he must take a B1 language level exam. The draft stipulates that if a professional does not pass the B1 level exam, he must pass the Integration Foundation within one year organized language course and take the exam again. The state pays for the first language course. In case of failure to appear for the level exam or failure to participate in language courses without a valid reason, the Defense Resources Board is provided with the right to apply administrative coercive measures against the professional according to the Defense Forces Service Act. The requirement stipulated in the bill is necessary to minimize life-threatening situations that may arise due to lack of language skills, because below B1 level a conscript with Estonian language skills cannot acquire information related to the safety of weapons, ammunition or explosives. The practice so far has shown that a conscript with poor language skills may not really acquire all the material important for military training, but some of it may remain at the level of mechanical memorization without real understanding. A conscript with poor language skills may not understand the instructions necessary for a soldier to survive and commands.

In 2026, the bill allows for the contribution of up to three defense personnel to the North Atlantic Treaty Organization mission in Iraq (NATO Mission Iraq - NMI). The NMI was established in 2018 in response to a request from the Iraqi government to support Iraqi defense capability building. The mission's activities are directed against threats from the Alliance's south more broadly, helping Iraq build sustainable, transparent and effective security structures to enhance their capacity in the fight against terrorism, preventing the return of ISIS and stabilizing the country. The mission's activities are carried out in close cooperation with the Iraqi government and the Office of the National Security Adviser, and until September 2025 with the operation Inherent Resolve of the US-led international anti-ISIS coalition. In 2025, the leading country of the NMI is France, which took over this role from the Netherlands. NATO member states participate in NMI and Australia and Austria as partners. Estonia started contributing to the NATO operation in November 2017 by sending a defense soldier with demining expertise to Iraq. In 2019, Estonia sent one military policeman to the NMI. In 2021, in addition to a staff officer, Estonia contributed six months to the NMI with a 36-member force protection group as part of a Danish unit. Since 2022, we have contributed with one staff officer, and Estonia plans to continue this way as well in 2026.

The Law on Amendments to the Defense Service Act and Amendments to Other Acts Related Thereto

The bill expands the opportunities for participation in the activities of the Defense Forces to include more reservists, conscripts and civilians working in the Defense Forces than before. For this purpose, several laws are being amended, including the Defense Forces Service Act and the Defense Forces Organization Act. The changes are intended to increase flexibility and efficiency in the deployment of personnel without the need to increase the number of active duty personnel in peacetime positions. The bill creates a new type of service - voluntary service - which allows reservists to temporarily participate in the performance of the tasks of the defense forces in a non-commissioned position. This includes, for example, training conscripts as instructors, manning standing readiness units or participating in international military operations (RSOs). According to the bill, conscripts' opportunities to contribute to the tasks of the Defense Forces will be expanded, allowing them to participate after completing certain training in international naval operations. The conscript must give written consent to this. The law is being changed so that in the navy, where conscripts make up a significant part of the crew, it would be possible to get practical experience in NATO mine countermeasure groups, which is very valuable from the point of view of training. The amendment is strictly a necessity of the Navy and the participation of conscripts in other international missions is excluded. Estonia has a third conscripts from the crew of naval ships. For more than 20 years, Estonia has been participating in NATO's permanent mine countermeasures group, where conscripts also get sea and ship internships. However, NATO has decided to join these anti-mine ships in the composition of its rapid response unit, which is why these ships formally participate in an international military operation. Since conscripts cannot participate in military operations according to the current law, a situation has arisen where Conscripts' ship practice remains scarce on the ships of the mine countermeasures group. The bill provides an opportunity for civilians working in the Defense Forces and civil service employees to participate in military exercises and undergo the necessary training. This will help reduce the need for active duty troops in peacetime and allow better use of available resources.

The Riigikogu's draft decision allows the participation of up to 110 defense personnel in the US-led international military operation Inherent Resolve in 2024. After the physical defeat of ISIS and the collapse of the caliphate, the operation will focus on stabilizing the security situation in Iraq and Syria. US combat troops left Iraq by the end of 2021, and US-Iraqi defense cooperation became CJTF-OIR then mainly as a center for training, consulting, defense assistance and intelligence information sharing. The goal is to help our main partners, the Iraqi Armed Forces and the Syrian Democratic Forces (SDF), stand up for themselves in the fight against ISIS. At the same time, the capture of the leading figures of ISIS continues. In supporting the training of the Iraqi security forces, there is close cooperation with NATO and Iraq with the government. The explanatory letter states that participation in international military operations demonstrates Estonia's commitment to contributing to peace and stability in the world and supports Estonia's security policy goals. The fight against terrorism is one of the priorities of the security policy of the United States. By continuing to participate in the United States-led international counter-terrorism operation in a region important to them In the Middle East, Estonia contributes to the very good alliance between Estonia and the United States, as well as defense and security cooperation. The NATO Non-Combat Training and Advisory Mission (NATO Mission Iraq - NMI) was established in October 2018. The mission's activities are aimed at countering threats from the Alliance's southern direction more broadly, helping Iraq build sustainable, transparent, inclusive and effective security structures to increase their capabilities in the fight against terrorism, preventing the return of ISIL and stabilizing the country. To achieve this, NATO advises Iraqi security structures. NMI trains Iraqi security forces in close cooperation with the Iraqi government. NMI advises and conducts training, but does not participate in combat operations with Iraqi forces. Participating in the mission in Iraq gives Estonia the opportunity to actively help those coming from the southern wing of the alliance in mitigating threats, contribute to NATO's collective security and support allies and partner countries in the fight against terrorism.

The bill proposes to the Government of the Republic to draw up a comprehensive national defense development vision extending up to 2045 and a new emergency national defense development plan based on it until the year 2034. National defense developments must be in line with and also proactive with the needs of modern warfare and take into account the hitherto unchanged threat from an aggressive neighboring country. The development of Estonian national defense capabilities can rely primarily on quality and to science-based developments in the country's military capabilities.
