Summary

The Riigikogu ratified the Ottawa Convention prohibiting the use, stockpiling, production and transfer of anti-personnel mines and requiring their destruction in March 2004, a few weeks before Estonia was accepted as a full member of the North Atlantic Treaty Organization. The Ottawa Convention entered into force for the Republic of Estonia on November 1, 2004. The explanatory note states that anti-personnel mines were used in many military conflicts of the second half of the 20th century as a fighting tool for the weaker party, which could not afford greater firepower, i.e. bomber air force, combat helicopters and artillery. In the new situation, Estonia is forced to do everything possible to strengthen the military national defense. We also cannot afford that in the event of a war, other countries that refrained from joining the Ottawa Convention could use anti-personnel mines on the territory of Estonia, while we ourselves should not. From the above circumstances as a result, compliance with the requirements of the Ottawa Convention, which prohibits the use, stockpiling, production and transfer of anti-personnel mines and requires their destruction, is no longer in Estonia's national interest. It weakens our defenses. In connection with the denunciation of the Ottawa Convention, Estonia can assume a unilateral obligation to refrain from selling or otherwise transferring anti-personnel mines to other countries and declare that it will not use anti-personnel mines outside its territory.
