Summary

Lorsqu’ils concluent un marché global portant sur la rénovation énergétique d’ouvrages de bâtiment ou d’infrastructure, les acheteurs peuvent déroger aux dispositions des sections II et III du chapitre I er du titre IX du livre I er de la deuxième partie du code de la commande publique. Ces dispositions sont applicables aux contrats pour lesquels une consultation a été engagée ou un avis d’appel public à la concurrence a été envoyé à la publication avant le 31 décembre 2022, en ce compris, le cas échéant, les marchés subséquents passés sur le fondement d’accords-cadres ayant fait l’objet desdites mesures avant cette date.
