Leurs conditions de travail ne permettent pas une organisation adaptée aux élèves qui ont besoin de continuité (intervenants multiples dans une même journée, caractère aléatoire des heures d'intervention qui leur sont accordées). Par ailleurs, 62 % des AESH sont employés à temps partiel et perçoivent une rémunération n'excédant pas les 750 euros nets par mois pour un contrat de 24 heures. Ils sont nombreux à devoir cumuler plusieurs emplois dans l'éducation nationale et le périscolaire pour pouvoir vivre. Aussi, compte tenu du rôle déterminant que jouent ces professionnels dans l'accompagnement des personnes en situation de handicap, il est urgent de s'assurer que les élèves bénéficient de l'accompagnement qui convient à leur situation et que les AESH puissent obtenir une revalorisation significative ainsi qu'une réelle reconnaissance. Dans cette perspective, il serait opportun d'accorder aux AESH des contrats à temps plein selon le nombre d'heures d'ouverture des établissements (24h ou 32 h selon que l'on se trouve en primaire ou en secondaire) ainsi qu'un CDI après une période raisonnable et non après six ans comme à l'heure actuelle. Elle souhaiterait donc connaître les mesures que le Gouvernement entend prendre pour revaloriser le métier d'AESH et améliorer la prise en charge des enfants en situation de handicap à l'école ?

Mme Sylvia Pinel interroge M. le ministre des solidarités et de la santé sur la nécessité d'une meilleure reconnaissance et revalorisation de l'ensemble des professionnels médico-sociaux. De nombreux organismes employeurs alertent quant aux conséquences des mesures du Ségur de la santé sur l'attractivité du secteur médico-social en raison des disparités de traitement. En effet, les personnels travaillant dans le secteur privé non lucratif sont pour certains toujours exclus des mesures de revalorisation salariale malgré leur engagement quotidien auprès des plus vulnérables. Cette différence de traitement fait que certains professionnels qui exercent le même métier, parfois dans un même établissement, se voient traités de manière différente. Il est par ailleurs important de rappeler qu'en dix ans, le pouvoir d'achat des salariés des structures associatives a baissé de 25 %. En outre, ces organismes insistent sur l'épuisement et le sentiment de relégation des professionnels de l'accompagnement (métiers éducatifs et sociaux, médicaux et administratifs) qui sont de plus en plus nombreux à quitter le secteur du handicap. Ces derniers se sentent isolés et souffrent du manque de reconnaissance de leurs compétences et de leurs engagements. La crise sanitaire a accentué leur découragement et les associations du réseau subissent de plein fouet ces pénuries. En effet, la carence de personnel est très importante et de nombreuses structures sont contraintes de fermer certains services notamment pour les actes les plus quotidiens et essentiels à la vie : toilettes ou aide aux repas. Alors que les besoins, accrus par le vieillissement de la population, sont toujours plus forts, il est urgent de mettre un terme aux iniquités créées par le Ségur de la santé et d'acter une réelle reconnaissance de l'ensemble des professionnels médico-sociaux. Aussi, elle souhaite savoir quelles mesures le Gouvernement entend prendre pour remédier à cette pénurie croissante de personnel qui met gravement en péril l'égalité d'accès aux soins et à l'accompagnement médico-social dans les territoires.

Mme Sylvia Pinel interroge Mme la ministre de l'enseignement supérieur, de la recherche et de l'innovation sur les conséquences de la réforme de la première année commune aux études de santé. Alors que cette réforme prévue par la loi n° 2019-774 du 24 juillet 2019 relative à l'organisation et à la transformation du système de santé avait notamment pour objectif l'égalité et la réduction du taux d'échec des étudiants, les chiffres récemment publiés laissent à penser qu'il n'en sera rien. En effet, cette année, les étudiants PASS et LAS devront partager la capacité d'accueil en seconde année d'études de santé avec les derniers redoublants PACES sans que le nombre de places ait significativement augmenté. Pourtant l'exposé des motifs de la loi du 24 juillet 2019 prévoyait une augmentation pour cette année de transition afin de ne pas créer d'inégalités au détriment des étudiants primants. Des budgets spécifiques destinés à l'augmentation de cette capacité d'accueil ont par ailleurs été intégrés dans l'étude d'impact de ladite loi. En réponse au courrier de Mme la députée du 3 février 2021, Mme la ministre indiquait avoir confié aux universités et aux ARS la responsabilité de fixer les effectifs, en lien avec les besoins de leurs territoires, et que son action se limite à fixer le cadre général et l'accompagnement. Si ce dernier axe est en effet important, il est toutefois de son ressort de garantir la bonne mise en œuvre de cette réforme et de veiller à l'égalité des étudiants sur l'ensemble du territoire. C'est pourquoi le collectif national PASS LAS demande légitimement l'augmentation de 33 % de la capacité d'accueil en seconde année des formations en santé, sur le modèle des universités ayant déjà testé la réforme dès 2019. Par ailleurs, au vu des conditions de préparation particulièrement éprouvantes liées à la crise sanitaire, notamment la préparation à distance, une révision du dispositif en cas d'échec au concours semble judicieuse. Aussi, elle souhaiterait connaître les réponses que le Gouvernement peut apporter aux vives préoccupations des étudiants concernés et de leur famille.

Mme Sylvia Pinel interroge M. le ministre des solidarités et de la santé sur le manque de matériels de protection sanitaire pour l'ensemble des personnes devant se rendre sur leur lieu de travail, assurant les fonctions indispensables à la vie de la Nation. Il faut de toute urgence mettre à leur disposition des équipements en quantité et qualité requises. En effet, si le personnel soignant en première ligne face au virus doit recevoir en priorité ce matériel, les professionnels au contact de personnes dépendantes, ou en unité de soins (EHPAD, SSR, USLD), les biologistes médicaux ou encore les personnes travaillant dans les crèches ou dans les établissements médico-sociaux, notamment auprès de personnes handicapées, doivent tous être protégés. Mme la députée pense également aux pompiers, forces de l'ordre, ambulanciers, commerçants ainsi que toutes les entreprises qui travaillent pour permettre aux Français de vivre. Sur le terrain, ils ont besoin de masques, de blouses, sur-blouses, de sur-chaussures, de gants, de lunettes ou encore de charlottes. Aussi, elle souhaiterait savoir quelles mesures il entend mettre en place afin de fournir des équipements de protection à tous ces professionnels mobilisés. Elle l'interroge également sur les dispositions prises par le Gouvernement pour faciliter une production de ce matériel au niveau national, ainsi que pour sécuriser le transport de ces marchandises stratégiques depuis l'étranger.

Mme Sylvia Pinel interroge M. le ministre de l'économie et des finances sur le besoin de clarifier l'ordonnance n° 2020-319 du 25 mars 2020 portant diverses mesures d'adaptation des règles de procédure et d'exécution des contrats publics pendant la crise sanitaire née de l'épidémie de covid-19. Si l'autorité concédante ne peut suspendre l'exécution d'un contrat de concession afin notamment d'assurer la continuité du service public mais modifie significativement les modalités d'exécution prévues au contrat, l'article 6.6 de cette ordonnance ouvre droit à une indemnisation pour le concessionnaire afin de compenser les surcoûts non prévus. L'ordonnance fait ici application du principe d'imprévision et vise à couvrir les frais liés aux mesures de protection sanitaire à mettre en œuvre sur chantier ou sur site dans le cadre de la crise actuelle. Toutefois, l'ordonnance ne fait pas état de ce droit pour les marchés publics. Pourtant, la mise en place de mesures de protection sanitaire s'impose également au titulaire du marché public tenu de poursuivre l'exécution, même partielle, du service ou des travaux. Sur site ou sur chantier, ces mesures sont coûteuses et s'ajoutent aux difficultés financières que traversent les entreprises, compromettant la bonne poursuite des opérations. Aussi, elle souhaite savoir quelles mesures le Gouvernement entend prendre pour assurer l'indemnisation des dépenses liées aux mesures de protection sanitaire dans le cadre des marchés publics, cette disposition n'étant actuellement pas prévue dans le cadre de l'ordonnance n° 2020-319 du 25 mars 2020.

Mme Sylvia Pinel interroge M. le ministre des solidarités et de la santé sur les demandes formulées par les chirurgiens-dentistes du fait des conditions d'exercice extrêmement difficiles dans lesquelles ils se trouvent en cette période de crise sanitaire. Depuis le début de la crise, le conseil de l'ordre de la profession, en accord avec le ministère de la santé, a notamment demandé aux cabinets dentaires de fermer afin d'éviter que les praticiens, leurs personnels et leurs patients ne soient au contact du virus. Pourtant, et malgré cette exposition prononcée du fait de la proximité du travail avec la zone buccale, ces professionnels ont pris leurs responsabilités et ont organisé des soins d'urgences, avec des volontaires, afin de permettre une continuité de soins aux Français. Toutefois, ils ne disposent pas d'un approvisionnement suffisant d'équipements de protection sanitaire et manquent notamment de masques FFP2 et de blouses pour pouvoir rouvrir leurs cabinets et assurer ainsi la permanence des soins et la prise en charge satisfaisante des patients du point de vue sanitaire. Aussi, elle souhaite savoir dans quel délai ces professionnels de santé disposeront du matériel de protection en quantité suffisante pour pouvoir exercer dans des conditions optimales et ainsi rouvrir leurs cabinets.

Mme Sylvia Pinel attire l'attention de M. le ministre des solidarités et de la santé sur l'absence de revalorisation salariale des aides à domicile. Alors que les personnels soignants des Ehpad, titulaires et contractuels, ont obtenu une revalorisation salariale dans le cadre des mesures gouvernementales du Ségur de la santé, les professionnels des services de soins infirmiers à domicile (SSIAD) ou des services de soins à domicile (SSAD) n'ont à ce jour bénéficié d'aucune augmentation durable. L'annonce du versement d'une prime covid à leur profit, en cas de poursuite d'activité pendant le confinement, est insuffisante face au manque de reconnaissance dont ils souffrent. En effet, le personnel du secteur de l'aide à domicile a été et demeure en première ligne auprès des personnes vulnérables. À cet égard, la crise rappelle le besoin urgent de repenser les politiques du grand âge et de revaloriser les métiers du soin et de l'accompagnement afin d'améliorer leur attractivité et créer des emplois de proximité dans les territoires. Aussi, elle souhaite connaître les réponses que le Gouvernement souhaite apporter à cette problématique urgente qui inquiète légitimement les aides à domicile.

Mme Sylvia Pinel attire l'attention de M. le ministre de l'Europe et des affaires étrangères sur la question des prélèvements forcés d'organes en Chine. En effet, depuis plusieurs années déjà de nombreuses personnes, dont la plupart issue de minorités religieuses et ethniques, sont malheureusement victimes de prélèvements forcés. Ces organes, alors revendus à des prix exorbitants par des cliniques du pays, attirent de nombreux patients du monde entier qui se voient proposer une greffe très rapide et programmée. Alors qu'en France, les dons sont régis par des principes de volontariat, d'anonymat et de gratuité avec un consentement libre et éclairé, la Chine, qui pourtant en janvier 2015 a annoncé qu'elle arrêtait d'utiliser les organes de prisonniers mis à mort, semble ne pas tenir compte des préconisations de nombreux autres pays et de l'atrocité de ces faits. Aussi, elle souhaiterait savoir si le Gouvernement entend enfin ratifier la convention dite de Compostelle contre le prélèvement illicite d'organes humains datant de mars 2015 et quelles mesures concrètes il envisage de mettre en œuvre pour lutter efficacement contre ces trafics d'organes.

Mme Sylvia Pinel attire l'attention de Mme la ministre des solidarités et de la santé sur la réforme de l'assurance chômage prévue, et ses conséquences sur les assistantes maternelles. En effet, il est apparu dans les négociations préalables que leur allocation de retour à l'emploi (ARE) serait diminuée voire supprimée. Le mode de calcul de cette indemnisation, soit le cumul emploi et chômage sans contrainte de temps serait amené à être modifié, ce qui équivaut à une perte de 30 à 300 euros pour les assistantes maternelles. Or, selon l'UNEDIC, les deux tiers des assistantes maternelles sont en situation de cumul salaire-allocation au regard de la nature de leur métier, puisqu'elles sont dépendantes des besoins des parents, pour un revenu mensuel avoisinant les 1 400 euros bruts. Leur situation est extrêmement précaire car soumise aux ruptures de contrat aléatoires. La réforme envisagée risque donc d'aggraver cette situation mais également de provoquer une crise de vocations, alors que le besoin d'assistantes sociales est croissant, notamment dans les territoires ruraux. En effet, les crèches sont vite saturées et la création de places est un coût pour les collectivités qui ne peuvent pas toutes répondre à cette demande. Cette profession ne saurait être une variable d'ajustement budgétaire. C'est pourquoi elle souhaiterait savoir ce que prévoit réellement le Gouvernement sur ce point et insiste sur le fait de ne pas pénaliser la profession des assistantes maternelles.

Mme Sylvia Pinel attire l'attention de Mme la ministre des solidarités et de la santé sur la question des remboursements des prothèses dentaires et de l'impact économique sur les professionnels du secteur. En effet, les prothésistes dentaires ont dû lourdement investir ces dernières années dans des technologies onéreuses pour produire des full zircones multicouches plus esthétiques dont la biocompatibilité et la solidité sont bien supérieures aux autres alliages tels que le nickel-chrome ou le cobalt-chrome. Le Gouvernement a décidé d'appliquer un plafonnement du remboursement pour la zircone tout céramique à 440 euros au détriment d'un plafonnement de l'imax et de la céramique métal à 500 euros alors que l'Union européenne pose la question de l'interdiction de certains alliages en pratique dentaire pour des raisons sanitaires (comme la baisse de la fécondité ou des effets cancérigènes). Aussi, elle souhaite connaître les intentions du Gouvernement sur les plafonds de remboursement et les différents « reste à charge » des prothèses dentaires dont la zircone.

Mme Sylvia Pinel attire l'attention de Mme la ministre des solidarités et de la santé sur la pérennité des laboratoires de biologie médicale dans les territoires. Ces dernières années, la financiarisation de la biologie médicale libérale s'est accentuée, provoquant la concentration du secteur à 5 - 6 acteurs dominants contrôlés par des investisseurs financiers tiers à la profession et contraints par leur système de financement à maintenir une stratégie de croissance externe à tout prix. Les laboratoires de proximité sont donc progressivement rachetés et centralisés dans des grands centres, qui gèrent à la fois des centaines de médecins et plusieurs établissements de soins. Le temps d'obtention des résultats est rallongé, ce qui est dangereux pour une prise en charge rapide des patients. Cela entraîne donc la disparition à terme dans de nombreux territoires, notamment les territoires ruraux et périurbains, de l'offre d'examen de biologie médicale, ainsi qu'un risque important de chantage fait à l'État sur les tarifs et les règles applicables par les acteurs résiduels restants. Cette accélération a été rendue possible grâce à un contournement des règles par les acteurs financiers de la profession, car les directeurs généraux des agences régionales de santé et les ordres compétents ne disposent pas du pouvoir de s'opposer à des opérations violant les règles impératives fixées par l'article L. 6223-8, et que ces violations ne sont pas constitutives d'infractions soumises à sanction administrative au sens des articles L. 6241-1 et suivants du code de la santé publique. Une solution concrète serait d'obliger les structures administratives à installer des automates pour des examens simples dans des lieux de prélèvement. Aussi, elle souhaite savoir si elle serait favorable à une telle mesure et à affirmer plus concrètement les pouvoirs de contrôle et de sanction des directions générales des ARS sur ce sujet.

Mme Sylvia Pinel attire l'attention de M. le ministre d'État, ministre de la transition écologique et solidaire, sur le financement des CLI (commissions locales d'information) développées auprès de toutes les installations nucléaires et ce dans un intérêt local de protection des personnes et de l'environnement. En effet, instituées en 1981 à des fins d'information, de dialogue et de suivi, ces commissions ont vu leurs missions et compétences s'élargir et se renforcer avec la loi n° 2006-686 du 13 juin 2006 relative à la transparence et à la sécurité en matière nucléaire (TSN). Élargissant leur champ de compétences et d'actions, nouvelles exigences qui représentent un coût, le législateur a prévu d'octroyer de nouveaux moyens aux CLI en instaurant un prélèvement sur la taxe des installations nucléaires prévue par l'article 43 de la loi de finances pour l'année 2000. Cependant, à ce jour, 12 années après la publication de la loi TSN, la mise en œuvre de ce prélèvement n'est toujours pas réalisée sous prétexte d'une trop grande complexité. Aussi, elle souhaiterait connaître les orientations du Gouvernement en la matière pour assurer le bon fonctionnement des CLI qui jouent un rôle important de sûreté et de transparence.

Mme Sylvia Pinel attire l'attention de Mme la ministre des solidarités et de la santé sur la réforme du « reste à charge 0 » en optique. Bien qu'ambitieuse et de justice sociale cette dernière suscite néanmoins, tant sur le fond que sur la forme, quelques questionnements et inquiétudes auprès des opticiens. En effet, sur le plan sanitaire le texte prévoit une prise en charge du renouvellement des équipements pour des baisses d'acuité très significatives, supérieures à 0,5 dioptrie, ce qui laissera durant plusieurs mois certains patients, les moins aisés, en difficulté avec un appareillage inadapté. Le renoncement aux soins, pointé du doigt dans le rapport de la commission des comptes de la santé de 2017, sera malheureusement toujours d'actualité pour cette partie de la population. Sur un plan plus économique, les inquiétudes des opticiens se portent sur les coûts de production des lunettes qui seront bien supérieurs aux tarifs fixés pour l'offre sans reste à charge. Ces exigences de qualité ont un coût et les répercussions pourraient être néfastes pour l'ensemble des acteurs de la filière de santé visuelle. Par ailleurs, sur la forme il est à regretter le choix du Gouvernement qui semble vouloir privilégier la voie réglementaire au détriment du législatif. Aussi, elle souhaiterait connaître les orientations du Gouvernement sur ces questions essentielles pour l'accès aux soins des citoyens.

Mme Sylvia Pinel attire l'attention de M. le ministre de l'économie et des finances sur le dispositif d'allègement des charges patronales spécifiques pour les salariés saisonniers TO-DE (travailleurs occasionnels-demandeurs d'emploi), qui a prouvé son efficacité sur l'emploi au sein des entreprises agricoles françaises et qui est remis en question dans la prochaine loi des finances pour 2019. En effet, de nombreux agriculteurs ont exprimé leurs vives et légitimes inquiétudes sur le sujet évoquant les nombreuses difficultés auxquelles se heurtent les employeurs du monde agricole notamment une distorsion de concurrence avec les autres pays de l'Union européenne. Les secteurs comme celui de l'arboriculture, le maraîchage, l'horticulture, la viticulture, ou encore des producteurs de semences, qui emploient régulièrement de la main-d'œuvre occasionnelle, seront les plus impactés par cette modification et en particulier en Occitanie où environ 125 671 contrats TO-DE sont conclus. Déjà fragilisés par les nombreux aléas climatiques de ces derniers mois, il est à penser que cette mesure ne viendrait qu'ajouter des difficultés à ces secteurs. Aussi, elle souhaiterait connaître les intentions du Gouvernement en la matière.
