Mr. Dominique Potier draws the attention of the Minister of National Education and Youth to the consequences of the baccalaureate reform on artistic options. Until the reform of the baccalaureate, optional options offered high school students the possibility of regular artistic practice as well as the valorization of their work by obtaining points in the baccalaureate (points above 10 being doubled for the first option). However, the 2021 baccalaureate reform includes options for continuous assessment, which itself will represent 40% of the final grade. This reform risks penalizing artistic options to the extent that it is feared that high school students will abandon three hours of teaching per week which would not be valued in the final exam. If this reform were to lead to a drop in numbers within artistic options, and therefore With class closures, a cultural void is to be feared for certain high schools and territories. The serious attack on two guards at the Condé-sur-Sarthe prison on March 5, 2019 once again shows their very great vulnerability, particularly in the event of prepared and determined actions in a context of radicalization. Mr. Dominique Potier alerts the Prime Minister to the worrying situation suffered by several residents of Meurthe-et-Moselle following the drought phenomena which have affected France since 2015 and the direct consequences of which are the movement of clay present in the soil. Homes are affected every year by the appearance of cracks, some of which are large and get worse over the months. THE public infrastructures are also affected (roads impassable due to embankment sliding, closures of rooms due to the appearance of excessively large cracks, etc.). However, the lack of recognition of a natural disaster prevents fair compensation for victims. A collective of around forty municipalities in Murhe-et-Mosellane has also filed a request with the administrative court of Nancy with a view to the cancellation of the decree of November 22, 2016, refusing recognition of the state of natural disaster for the summer of 2015. A new appeal was also filed in 2018 following the drought episode of the same year. The number of homes affected has been increasing over the years. Mr. Dominique Potier draws the attention of the Minister of Solidarity and Health to the lack of recognition of the home help profession. Present alongside people who are dependent due to age or disability, home helpers carry out essential daily tasks, reassure families and bring comfort to homes. Their action allows for dignified home care. However, this profession suffers today of a lack of attractiveness which strains the job market and home helpers can no longer meet the demand for help and support that dependent individuals would need due to the lack of labor. This lack of attractiveness is attributable to poor working conditions. In 2014, the information report made on behalf of the Senate Social Affairs Committee on home help by Senators Jean-Marie Vanlerenberghe and Dominique Watrin presented data from the General Directorate of Social Cohesion (DGCS): home helpers were paid on average 832 euros net per month (the average salary being 1,190 euros net for employees working full-time and 717 euros net for those working part-time). At the same time, the average net salary in France was 2,225 euros. Intervention with a fragile and dependent public, atypical hours that are difficult to reconcile with family life, as well as the constantly increasing workload make the conditions of practice of the profession challenging. These working conditions make home helpers a population at risk in terms of sick leave and work accidents. Since the signing of the national collective agreement for the branch of help, support, care and home services of May 21, 2010, the amount of the mileage allowance for home help, set at 0.35 euros/km (including 0.13 euros for fuel), has not changed, unlike the prices of fuel and the number of trips made each day. Realism does not involve opposing economics and ecology but on the contrary to create, in particular by law, the conditions for transitions allowing these two requirements to be reconciled. The economy cannot be consolidated sustainably by freeing itself from fundamental ethical principles. Agreeing to expose other human beings, other territories, to uses that France would have refused for itself is not ethically acceptable and is not in the country's own interest in term in an increasingly interdependent world. The sustainability of productive employment in France must be the subject of all attention. However, the giants of the phytopharmaceutical industry have the financial means and time necessary to replace the incriminated molecules with alternative solutions and thus guarantee the sustainability of French production sites. These taxes are the domestic consumption tax on gas natural (TICGN) and the internal consumption tax on energy products (TICPE). France's situation in terms of energy transition is far from satisfactory. Article 7 of European Directive 2012/27/EU on energy efficiency requires Member States to reduce their energy consumption by 1.5% per year (excluding transport sector). However, France is falling behind on its objectives: in 2017, according to the Climate-Energy Observatory, France exceeded its final energy consumption objective by 4.2%. In this context, the renovation of the building stock, which represents 45% of the country's energy consumption, is a major issue. Among the support mechanisms for the energy renovation of buildings (tax credit for the transition energy, zero-rate eco-loan, value added tax at 5.5% for work to improve energy quality, aid from the “Living Better” program of the National Housing Agency, energy check, exemption from property tax for energy saving work, etc.), energy savings certificates (CEE) constitute a powerful mass tool in favor of the fight against energy poverty. So, with a target of 1,600 TWh cumac of energy savings, including 400 TWh cumac for the benefit of households experiencing energy poverty, the amount of obligations weighing on energy suppliers for the period 2018 and 2020 is estimated at nearly 9 billion euros, or approximately ten times the annual cost of the tax credit for the energy transition (879 million euros in 2019). From 2006 to 2014, the General Directorate of Energy and of the climate estimates that the CEE system has contributed to the financing of energy saving work to the tune of 24 billion euros. The system is particularly advantageous for the five million households in a situation of fuel poverty (according to figures from the National Energy Poverty Observatory) thanks to the establishment of so-called “precariousness” CEEs and it has sought since January 1, 2018 to achieve the objective eradication of fuel poverty in ten years. From mainland France to overseas, the ONF manages nearly 11 million hectares of public forests belonging to the State and local authorities. The French forest is the third largest European forest in terms of surface area (apart from the Guyanese forest). It is the main European forest in terms of biodiversity both in terms of the plant species that make it up and the wildlife that inhabits it. It is one of the major lungs of Europe and the main natural instrument in the fight against global warming. It represents 25% of the surface national forest. Finally, it is the main source of wood production in France. The ONF's missions are located at the crossroads of economic, ecological and social issues, which makes it a key player in the service of sustainable development and the energy transition. Every day, foresters ensure the maintenance, development and renewal of forests and natural spaces. With his experience of Manager of public forests, the ONF offers services to communities, businesses and individuals wishing to enhance their natural spaces. At the request of the State, the ONF also carries out several missions of general interest in the field of natural risks: protection of the coastline, restoration of mountain terrain or even defense of forests against fires. However, in a financial context difficult and faced with hundreds of job cuts in the years to come, the ONF seems to be turning towards a policy of increased logging, to the detriment of sustainable forest management. M. Dominique Potier alerte Mme la ministre des solidarités et de la santé sur les conditions de travail des 661 000 infirmiers de France, qui représentent près d'un soignant sur deux. La surcharge de travail et le personnel insuffisant entraînent une frustration et un mal-être des infirmiers en poste et en cours d'apprentissage. Ils sont divisés entre leurs valeurs de soignants et la charge de travail qui doit être réalisée dans un temps imparti souvent trop court. Le manque de personnel oblige les infirmiers de structures à revenir travailler sur leurs temps de repos. Les étudiants font parfois office de main-d'œuvre bon marché pour équilibrer les plannings ou les arrêts non remplacés. La charge de travail conduit à une déshumanisation des soins prodigués aux patients. Ce rythme de travail important, la demande d'une polyvalence absolue sans accompagnement, la non-prise en compte des compétences et plus généralement le manque de considération conduisent à l'épuisement professionnel, voire au suicide. Les 90 000 étudiants infirmiers de France ne font pas exception et subissent directement les mauvaises conditions de travail de leurs encadrants. Selon l'étude « Mal-être des étudiants en soins infirmiers: il est temps d'agir » (septembre 2017) de la Fédération nationale des étudiants en soins infirmiers, la situation est alarmante: à titre indicatif, plus de 40 % des étudiants en soins infirmiers déclarent consommer des médicaments psychotropes, plus de 30 % faire des crises d'angoisses et un sur deux avoir vu sa santé physique et psychologique se dégrader au cours de sa formation. Le montant même de la rémunération des infirmiers est parmi les moins bons des pays de l'Organisation de coopération et de développement économiques (OCDE): selon le Panorama de la Santé 2017 de l'OCDE, la rémunération moyenne des infirmiers à l'hôpital équivaut à 0,95 fois le salaire moyen national en France, quand il est en moyenne 1,14 fois supérieur au salaire moyen dans les pays de l'OCDE à 29. La situation est identique pour les étudiants infirmiers, qui reçoivent une indemnité de stage de 28 euros par semaine en première année et de 50 euros en fin de formation, sans aucune compensation financière particulière lorsqu'ils travaillent de nuit ou le week-end. Les conditions d'exercice des infirmiers en libéral, maillon essentiel de la continuité territoriale en matière de santé, leur permettent toujours plus difficilement de prendre en charge les soins à domicile humainement, partout et pour tous, notamment du fait d'une nomenclature des actes médicaux incohérente et incomplète. La richesse du système de santé français ne réside pas dans sa rentabilité, mais repose sur ses soignants expérimentés. Dès lors, une revalorisation du ratio soignant-soigné semble indispensable pour permettre d'accueillir au mieux une population qui a évolué (vieillissante, polypathologique, parfois précaire). Par ailleurs, une nouvelle formation des directeurs d'établissement et des cadres de santé à la prise en charge des risques psychosociaux ainsi que des techniques d'encadrement qui favorisent le bien-être au travail pour s'attaquer efficacement à l'épuisement professionnel des soignants sont à mettre en place. Enfin, une meilleure prise en compte de la fatigue physique du corps des soignants, avec de vraies propositions de reclassement et une reconnaissance des congés pour longue maladie, est nécessaire. Pour les infirmiers libéraux, la reconnaissance de tous les nouveaux soins non énumérés et non codifiés ainsi que la réévaluation de la nomenclature de la sécurité sociale régissant la facture des libéraux et ne permettant pas actuellement une prise en charge cohérente des soins à domicile s'imposent. Le plan « Ma santé 2022 », annoncé par le Gouvernement en septembre 2018, ne répond pas aux attentes des infirmiers, qu'il évoque d'ailleurs à peine. Sur un budget de 3,4 milliards d'euros d'ici 2022, seuls 920 millions y sont consacrés à l'investissement hospitalier. Il l'interroge donc sur la manière dont le Gouvernement se propose de réellement prendre en compte les revendications légitimes du corps infirmier, indispensables pour garantir la santé des soignants et celles de leurs patients et essentielles à la pérennité d'un système de soins de qualité digne d'un État-providence à la française.

M. Dominique Potier alerte M. le ministre de l'agriculture et de l'alimentation sur l'urgence de créer une autorité unique de contrôle sur la chaîne alimentaire, dans le cadre d'une approche globale des risques intégrant enjeux sanitaires et lutte contre les pratiques frauduleuses ou trompeuses. Au début du mois de décembre 2017, la révélation de la mise sur le marché de laits infantiles contaminés par des salmonelles par l'entreprise Lactalis a mis en évidence des dysfonctionnements dans le dispositif de sécurisation sanitaire de la chaîne alimentaire. Des propositions aimed at améliorer le fonctionnement des autorités compétentes, voire à mettre en place une autorité unique de contrôle, ont ensuite été formulées dans un rapport d'information du Sénat (n° 403 du 5 avril 2018) ainsi que par la commission d'enquête mise en place par l'national assembly et présidée par le député Christian Hutin (n° 1179 du 19 juillet 2018). Ces propositions rejoignent par ailleurs les dispositions prévues par le règlement européen du 15 mars 2017, qui fixe le cadre des contrôles officiels sur the whole of la chaîne alimentaire, et dont l'entrée en application est prévue pour le 14 décembre 2019. article 1er de ce règlement précise que les contrôles officiels doivent prendre en compte une approche globale des risques, associant aux enjeux de sécurité et de salubrité ceux qui visent à garantir, par des pratiques commerciales loyales, la protection et l'information des consommateurs. En effet, pour des raisons liées à la mondialisation des échanges, à la complexification des circuits commerciaux et à une pression toujours plus forte sur les prix, ces deux enjeux sont devenus étroitement liés. Un problème sanitaire peut révéler l'existence d'une fraude (ce fut le cas des œufs contaminés au fipronil à l'été 2017), de la même façon qu'une fraude peut soulever des questions sur la sécurité de la chaîne alimentaire (comme dans le cas du scandale de la viande de cheval en 2013). L'affaire Lactalis a mis au jour un éclatement des compétences et une dilution des responsabilités entre la direction générale de l'alimentation (DGAL), qui dépend du ministère de l'agriculture et de l'alimentation, et la direction générale de la concurrence, de la consommation et de la répression des fraudes (DGCCRF), rattachée quant à elle au ministère de l'économie et des finances. Ainsi, les établissements fabriquant des poudres de lait infantile sont soumis à un agrément sanitaire délivré par les services de la DGAL, mais la DGCCRF dispose d'une compétence spécifique dans le secteur de l'alimentation infantile. A l'heure où la France souhaite renforcer sa politique d'aide publique au développement, et où un accent particulier est mis à la coopération Europe-Afrique, la sélection économique opérée par cette augmentation des frais d'inscriptions semble alors aller à contrario du multilatéralisme revendiqué. Par ailleurs, cette réforme induirait que les universités se dotent d'une mission nouvelle de contrôle de la situation juridique, relevant pourtant du champ de compétence préfectoral. En effet, lorsqu'un agriculteur a un revenu fiscal très faible, environ 50 % du SMIC, les autorités compétentes peuvent lui permettre d'accéder à ces droits. Pour pouvoir prétendre au RSA, l'exploitant agricole doit avoir un revenu inférieur à 10 000 euros. Or le revenu fiscal est calculé sur la base d'un abattement de 87 % du total de ses ventes et des primes, à l'exception de l'ICHN qui est elle est comptabilisée sans abattement. Cette prise en compte de l'ICHN à 100 % de sa valeur est anachronique par rapport aux autres composants du revenu. Au vu des conséquences sociales de ce mode de calcul, il l'interroge sur les raisons de cette décision et le cas échéant sur les moyens pour remédier à ce qui semble en l'état être une injustice.

However, the cost of this large orthopedic equipment is often a barrier for amputees and their families. This financial limit is partly offset by the action of associations which since 2014 work for free access, via equipment loans, to “running blades” and other equipment. However, these prostheses are classified as “leisure” devices and are therefore not reimbursed by social security. While refundable products benefit from a reduced value added tax rate of 5.5%, leisure equipment is subject to a rate of 20%, which weakens the effect of the associative fundraising work. Mr. Dominique Potier alerts the Minister to the Minister of Territorial Cohesion and Relations with Local Authorities, responsible for cities and housing, about the weakening of the right to housing for the poorest people resulting from the law on the development of housing, development and digital technology (ELAN). M. Dominique Potier appelle l'attention de M. le ministre de l'agriculture et de l'alimentation sur l'urgence de réformer le système des calamités agricoles pour faire face à la crise agricole. En réponse à l'ampleur et la gravité de la sécheresse qui frappe l'agriculture française, il est capital que ce dernier puisse jouer pleinement sa mission de solidarité. Il en va de la survie d'une part significative des élevages, indispensables à l'économie et à l'emploi des espaces ruraux, de la souveraineté alimentaire de la France et de l'équilibre écologique des systèmes de production. Or le système des calamités pourrait, en l'état, exclure de façon ubuesque une part significative des éleveurs. Le point de blocage principal réside dans la prise en compte dans l’instruction du régime des calamités agricoles d'un plafond de 3 000 Unités fourragères (UF) par Équivalent vache laitière (EVL), totalement désuet au regard des progrès de la génétique végétale et animale ainsi que de l'évolution des modes de production. La deuxième aberration relève du mode de calcul du déficit minimum de 900 UF/EVL ouvrant les droits à indemnisation (soit 30 % de la référence). En effet, la perte de production estimée par l'enquête administrative est déduite du barème départemental et permet de calculer un solde résiduel de production fourragère. Or, lorsque cette donnée est soustraite en valeur absolue du plafond de référence, cela peut conduire mécaniquement à un chiffre inférieur à celui du déficit minimum requis, alors même que le pourcentage de perte réel est nettement supérieur. À titre d'exemple, la Meurthe-et-Moselle a subi, sur environ 100 000 ha (toutes productions fourragères confondues), une perte de 43 % de ses récoltes en moyenne pondérée, soit 1 900 UFL/EVL. Le barème départemental étant de 4 100 UF/ EVL, le solde résiduel est de 2 200 UF/ EVL. Une fois déduit du plafond de référence national de 3 000 UF/EVL, il est obtenu une perte calculée de 800 UF/EVL, ce qui est inférieur au seuil minimum requis de 900 UF/EVL ! Sur le plan intellectuel, cette façon de compter mêlant valeurs absolues et relatives défie l'entendement... Elle génère sur les territoires une terrible injustice ! L'exemple du Grand Est est particulièrement éclairant, avec 8 départements sur 10 ainsi mis « hors-jeu »... Il est urgent de changer la donne. Par ailleurs, d'autres écueils sont aujourd'hui identifiés sur le terrain, comme la non prise en compte des consommations estivales de fourrage par le cheptel ou la comparaison entre l'année du sinistre et les cinq précédentes. Ce dernier point a pour conséquence de créer une double peine pour les territoires précédemment déjà frappés par la sécheresse. Les pistes de réformes envisageable devront, selon M. le député, porter sur la révision nationale et, le cas échéant, la régionalisation des seuils de références, sur un changement des modes de calcul permettant une association des données plus cohérente et enfin sur l'effacement des années de calamités (annulation ou référence standard) dans les moyennes quinquennales. Pour faire face à la détresse des éleveurs, il souhaite savoir quelles concertations et quel calendrier le ministre entend engager afin de rendre opérationnel le système des calamités et d'en optimiser l'effet à court et moyen terme.
