Mr. Grégory Labille draws the attention of the Minister of the Economy, Finance and Recovery to the tax reduction from which volunteers can benefit for the costs they incur, having not obtained an answer to the question already asked on December 3, 2019 by his predecessor Stéphane Demilly. A ministerial response, dated June 4, 2019, to question no. 15391 from MP Jean-Marc Zulesi recalls the four conditions, specified moreover in the administrative doctrine published in the official public finance bulletin (BOFiP) referenced BOI-IR-RICI-250-20, so that volunteers can benefit from the tax reduction provided for in article 200 of the general tax code for the costs they incur. One of these conditions, not provided for by article 200 of the CGI, is the following: “it must be established that any person placed in the same situation could have obtain effective reimbursement by the association of the costs incurred if it had requested it. This therefore implies for the associations concerned to provide for this provision in their internal regulations but also to ensure that they have the liquidity which would have enabled effective reimbursement. This last provision may be particularly penalizing for associations that do not have the necessary liquidity. It entails the waiver of reimbursement of expenses incurred by volunteers, putting some of them in financial difficulty. He therefore asks him to please clarify the interpretations resulting from this ministerial response and clarify the Government's position regarding the advisability of relaxing this provision.

Mr. Grégory Labille draws the attention of the Minister of the Economy, Finance and Recovery to article 155 of the finance law for 2021 which modified several articles of the town planning code relating to the development tax. Specifically, this article modified the due date for collection of the tax relating to town planning authorizations. Thus, from January 1, 2023, the tax relating to urban planning authorizations issued will be due from the definitive completion of the operations, within the meaning of article 1406 of the general tax code, that is to say within 90 days from the definitive completion of the work. This modification increases the risk of non-recovery of tax for communities as well as for CAUEs. In fact, the tax can be more easily avoided by voluntarily not completing the work or by not not declaring the completion of the work. This new provision, which comes into force from January 1, 2023, therefore increases the uncertainty of tax collection for local authorities and worries the CAUEs which largely depend on the part of the departmental development tax which is dedicated to them. Thus, he allows himself to ask him about the measures which will be taken to guarantee the effectiveness of the perception revenue under the conditions provided for under the new system as well as on the anticipatory measures taken to offset the imminent financial impact for communities and CAUEs during this transitional period.

Mr. Grégory Labille draws the attention of the Minister of Solidarity and Health to the delays in processing and payment of daily allowances for CESU employees on sick leave. In the context of a shutdown lasting several weeks, it is in fact up to the employee to send a copy of the last 12 pay slips to the CPAM to receive compensation. When the employee has several employers, this takes time and creates sometimes considerable delays in compensation. “Administrative” stress is then added to the stress linked to illness. Also, would it not be possible for URSSAF to directly communicate the data necessary to calculate the rights of employees on sick leave to the CPAM? This is also a long-standing demand of the CNAM. This would avoid inconvenience to those affected who must, in order to heal, put all their effort into energy in the fight against disease. Grégory Labille interroge M. le ministre de l'agriculture et de l'alimentation sur la définition de « l'agriculteur actif » retenue à l'occasion du comité État-régions du 10 novembre 2021, qui devrait conditionner le bénéfice des aides de la PAC à compter de 2023. Les critères retenus dans la définition de l'agriculteur actif sont l'âge, qui doit être inférieur ou égal à l'âge légal de départ à la retraite (67 ans) et l'adhésion à une assurance contre les accidents du travail (Atexa). La condition d'âge inquiète le monde agricole. Ce critère sera très pénalisant pour les agriculteurs en fin de carrière n'ayant pu cesser leur activité avant l'âge de 68 ans soit pour raisons économiques, soit faute d'avoir trouvé un repreneur, ou pour ceux conservant une activité durant les premières années d'exercice d'un jeune repreneur. Cette condition d'âge n'apparaît en outre pas justifiée, dès lors que le renouvellement des générations est loin d'être assuré et que les voisins européens de la France ne prévoient pas forcément d'âge pour l'attribution de la PAC (absence de critère d'âge en Allemagne). Aussi, il lui demande quelles sont les intentions du Gouvernement pour corriger le nouveau dispositif annoncé.

Mr. Grégory Labille draws the attention of the Minister of Culture to the effects of the Sofia tax on small booksellers. Law No. 2003-517 of June 18, 2003 relating to remuneration for library loans and strengthening the social protection of authors modified the intellectual property code by creating a 6% tax for booksellers for the sale of books to media libraries due to the fact that the books are read by several readers. At the same time, the law relating to book prices of August 10, 1981 (Lang Law) offered booksellers the possibility of applying a discount of 9% of the book price to communities. In fact, booksellers have no choice but to present quotes including this reduction for orders concerning media libraries and media libraries. Mr. Grégory Labille draws the attention of the Minister of the Economy, Finance and Recovery to the ineffectiveness of current measures to combat unsolicited telephone canvassing. According to a UFC - Que Choisir survey, 100% of French people consider cold calling “annoying” and note that it is increasing. Faced with the demand for consumer protection and in order to put an end to the nuisance caused, law no. 2014-344 of March 17, 2014 relating to consumption established a specific list called “Bloctel” on which citizens who no longer wish to receive unsolicited commercial telephone calls can register. Despite this legislative progress, there are more than 200,500 reports from consumers registered on Bloctel continuing to receive canvassing calls for commercial purposes. Data available as of 30 September 2018 showed that only 1,062 companies had subscribed to Bloctel, of which only 655 still had a current subscription as of September 30, 2018. European Regulation No. 2016/679 known as the General Data Protection Regulation (GDPR) came into force on May 25, 2018 and only requires the consumer's prior consent for automated commercial prospecting, i.e. emails, emails, SMS or faxes, but not cold calling. The proposed law aimed at regulating telephone canvassing and fighting against fraudulent calls was promulgated on July 24, 2020. If this law includes advances such as the ban on canvassing for energy renovation, except under a current contract, or even provisions to better fight against fraudulent calls, it only “regulates” telephone canvassing and remains based on the objective of improving the effectiveness of the Bloctel system, which is largely ineffective. M. Grégory Labille alerte M. le ministre de l'agriculture et de l'alimentation sur la flambée actuelle du prix des engrais azotés. Les agriculteurs se demandent s'ils pourront fertiliser leurs champs au printemps 2022. Les prix des engrais azotés, liés au cours du gaz, ne cessent de s'envoler et ont été multiplié par 4 en quelques mois. La Fédération départementale des syndicats d'exploitants agricoles de la Somme lance l'alerte. Très dépendante du gaz russe, dont le prix ne cesse d'augmenter, l'Europe et ses fabricants d'engrais se trouvent en première ligne. Pour réduire leurs coûts de production, ils fabriquent moins, ce qui fait craindre une pénurie. Alimentées en majeure partie par le renchérissement du gaz naturel, ces hausses des coûts de production sont insoutenables pour une profession déjà sujette à de graves problèmes de financement. Aussi, il souhaite prendre connaissance des mesures de soutien aux différentes filières agricoles prévues par le Gouvernement afin de pallier cette situation. Il lui demande également de détailler les actions prévues aux niveaux national et européen pour combattre cette inflation.

Dumistes (territorial artistic teaching assistants: ATEA) are professionals holding a level 6 diploma (RNCP classification). They are trained to musical education at school and more broadly artistic and cultural education (EAC), which constitutes one of the Government's priorities. They are awaiting a response to the numerous injustices and inequalities affecting them, as was recalled on the occasion of the conference on salary prospects for the public service, organized at the initiative of the Minister on September 21, 2021. To achieve the announced objective of a “ reduction of salary gaps between ministries, in order to put an end to certain unfair situations and encourage mobility", they ask for the alignment of the treatment of ATEAs with that of school teachers, certified teachers and teachers in vocational high schools reporting to the state civil service. Today, dumists cannot access category A in their discipline. To give them this access, They are asking for the creation of a new discipline within the employment framework of artistic education teacher (category A): “artistic and cultural education”, accessible to Dumists as well as other ATEAs. From September 3 to 11, 2021, France hosted the IUCN World Congress in Marseille during which the President of the Republic delivered an inaugural address. This organization participated in the inventory of threatened fish species which classified the European eel (Anguilla anguilla) as “critically endangered”. of extinction” at the global level. However, its draft decree of October 2021 defining, distributing and managing the quota of European eel less than 12 centimeters for the 2021-2022 fishing season worsens the already very fragile survival of this species. It proposes a quota of 56.55 tonnes for 2022 to which is added the quota of 8.45 tonnes from the Ministry of Ecological Transition, i.e. an overall quota of 65 tonnes, which equates to an increase of 13% compared to the previous season. More precisely, article 1 of its decree authorizes a quota of 26 tonnes of consumption. This authorization is particularly problematic because it is a “dead loss” for biodiversity, which is highly criticized by the national scientific committee. Indeed, this total projected quota of 65 tonnes exceeds the highest value among the values proposed by the committee national scientist (51.9 t). It exceeds the estimate provided by the most optimistic model on recruitment values with the lowest probability (25%) of reaching the objective. The proposed quota is far from that which allows management according to the precautionary principle (19.4 t for the most pessimistic recruitment model with a probability of 75% of achieving the objective). The quota it has set therefore poses long term the continued existence of the European eel, already classified as critically endangered globally on the IUCN red list. Mr. Grégory Labille alerts the Minister of National Education, Youth and Sports to the growing disparity, despite government announcements, in the allocation of overall hours between country high schools and those in the cities. Singularly, the Lamarck high school in Albert, a town of 10,000 inhabitants, has experienced a loss of more than a hundred hours of overall allocation since January 2019. The Lamarck high school has more than 1,000 students. The year 2021, despite the covid-19 crisis, is no exception and the Amiens rectorate announced in January 2021 the additional reduction of 30 hours in overall allocation for the Lamarck high school. Not only is it in contradiction with the recommendations of the report “Les invisibles de la République” by Salomé Berlioux, this continued reduction condemns high schools like that of Lamarck to optimize hours available and to self-censor on support programs for students in difficulty, on the establishment of language centers or on support for students wishing to integrate preparatory classes. Mr. Grégory Labille draws the attention of the Minister of Ecological Transition to the development of wind power in France. Following on from the question he sent to her on Thursday January 14, 2021 during the control week, he would like a more precise response from the Minister on the reasons which push the Government to make wind energy a key element of the energy transition when it is neither particularly ecological nor a satisfactory long-term response to enable France to move away from nuclear power. First of all, the MP contests the Minister's assertion of a French opinion mainly favorable to the installation of wind power as she indicated during her response of January 14, 2021. 7 wind mast installations out of 10 are subject to appeal before the administrative courts; the 2019 IFOP survey indicates that 80% of French people perceive the installation of wind turbines as the result of unilateral decisions and not concerted with the populations. The survey specifies the significant standard deviation between the “very good images” and the “very bad images” (8.22 vs. 11.45) which implies that the depreciation of wind turbines increases as respondents become more informed about wind power. Then, wind energy will not allow a real energy transition which will detach France from nuclear power because its cost is too high and its effectiveness is too uncertain. Concerning its cost, the Minister repeated that the average price of electricity produced by wind power was now less than 60 euros per megawatt hour. However, the sales price for wind power at EDF is 91 euros per megawatt hour. The indicated price of 60 euros is deducted from state subsidies. To arrive at 15% of the total electricity produced by wind power, the estimated cost oscillates between 73 and 90 billion euros compared to 80 billion euros for nuclear power, which provides 75% of carbon-free electricity in France. Not only is wind energy more expensive, it is also less secure: its production can vary in a day from 30 to 1 and the reliance on its use alerts Faith Birol, the executive director of the International Energy Agency. Thanks to MaPrimeRénov, the French can reduce the cost of their energy renovation work, provided that they are carried out by an RGE-certified company (recognized as guarantor of the environment). To benefit from it, households must request it on the maprimerenov.gouv.fr website. The procedure is exclusively digital, no advisor is available by telephone, generating a certain frustration with the lack of a contact person to obtain information when the person encounters a problem on the platform. However, numerous computer bugs have been identified: unanswered files, site which malfunctions, supporting documents impossible to upload. Many beneficiaries are still waiting for the aid to be paid, although this is supposed to occur within 15 working days once the file is complete. According to the ANAH, which is in charge of the system, the average response time is even 11.5 working days. However, for the poorest households, these payment delays weigh heavily on the budget. Mr. Grégory Labille draws the attention of the Minister of Territorial Cohesion and Relations with Local Authorities to the injustice of certain taxes allocated to EPCIs since the MAPTAM and NOTRe laws. More precisely, the “management of aquatic environments and flood prevention” competence has been devolved to the EPCI since January 1, 2018 and they contribute, as such, to the financing and maintenance of rivers. In the specific case of the Haute Somme commune community (CCHS), an implementation project presented by AMEVA reports a budget of 4,269,512 euros for 5 years, including 2,523,128 euros payable by the EPCI for the maintenance of the Somme river. To finance this sum, a tax would be levied on built and non-built property tax as well as on companies subject to the CFE. Many municipalities belonging to the CCHS believe that the basis of this tax is unfair due to the particularity of the Somme river: its course crosses ponds and marshes belonging to private owners who exploit, rent and freely enjoy their properties. Thus, the creation of this tax would mean that a large number of taxpayers would pay for the maintenance of a river largely owned by a small number of private owners. Likewise, only 7 municipalities out of the 60 would actually benefit from this interview. He therefore asks if specific arrangements could be made within the framework of the law and how it is possible to better distribute this tax.

Mr. Grégory Labille draws the attention of the Minister of Culture to the situation in the dance sector. Following several interviews with the Union Dance Unions (UDS), Mr. MP wishes to alert it to the specificity of the difficulties of the dance sector, which suffers from support measures unsuited to its diversity, its seasonality and the structure of its turnover. With more than 6 million practitioners and 2.7 million of jobs in France in 2019, the dance sector is a very diverse cultural sector. It includes young intermittent workers, self-employed people, training institutes and private companies. The dance sector also has a particular seasonality which lasts for the vast majority from the month of September of the year n to the month of June n + 1. The sources of income mainly come from memberships and income shows organized during the beginning of summer. However, memberships fell by 40% in 2020 compared to 2019 and shows were canceled due to the pandemic. Support measures were quickly taken by the Government to support this sector via solidarity funds as well as partial unemployment, but it is clear that additional, more precise measures adapted to the particularity of this sector must be made. The UDS particularly insisted on two short-term priority measures: firstly, improve the coherence and harmonization of administrative measures taken in the territory for the dance sector, secondly, integrate the dance sector into the recovery plan to compensate for the drop in membership which will continue in 2022 and 2023. On improving coherence and harmonization administrative measures taken in the territory for the dance sector, the UDS deplores the unilaterality of the measures, the lack of consultation preliminary to their enactment and their incessant modification. Particularly the three decrees (that no. 2020-1310 of October 29, 2020 prescribing the general measures necessary to deal with the covid-19 epidemic within the framework of the state of health emergency, that of December 14, 2020 and that n° 2021-173 of February 17, 2021 modifying decrees n° 2020-1262 of October 16, 2020 and n° 2020-1310 of October 29, 2020 prescribing the general measures necessary to deal with the covid-19 epidemic within the framework of the state of health emergency) were very poorly perceived by both the actors in this sector as well as by administrations. The UDS reports that the payment of solidarity funds is very different depending on the regions and that opening authorizations are also very linked to the arbitrariness of the prefect without a homogenization of conditions at the national level. The UDS therefore requests that better harmonization of these measures and instructions be initiated by the Government to respond to this administrative imbroglio. Concerning the integration of the dance sector into the recovery plan in order to compensate for the drop in membership, the UDS estimates that part of these memberships will be recovered in September 2022 from the younger public but that the majority of adult members will not return for several years. The UDS then asks that the dance sector be largely integrated into the recovery plan in order to compensate for the loss of memberships. In addition, the situation of young businesses and self-employed people who are not eligible for the solidarity fund and the partial unemployment is particularly alarming. He therefore asks whether additional measures to respond to the issues raised by the UDS are planned.

M. Grégory Labille interroge Mme la ministre déléguée auprès du ministre de l'éducation nationale, de la jeunesse et des sports, chargée des sports, sur les mesures visant à soutenir les salles de sport fermées depuis le 24 septembre 2020 afin de limiter la diffusion du virus de la covid-19. Constatant que le Gouvernement a annoncé un plan de relance à hauteur de 15 millions supplémentaires en 2021 mais que ces mesures risquent d'être insuffisantes, il interroge Mme la ministre si d'autres mesures complémentaires sont prévues pour les salles de sport afin qu'elles puissent faire face à leur charge. Plus précisément, il demande à Mme la ministre déléguée, s'il est prévu de la part du Gouvernement d'inciter plus efficacement les bailleurs à reporter voire à annuler les loyers payés par les salles de sport. Parallèlement, s'il était prévu de la part du Gouvernement de favoriser le report des emprunts bancaires contractés par la salle des sports comme cela avait été fait via l'ordonnance n° 2020-306 du 25 mars 2020, ainsi qu'une action sur les collectivités locales afin de reporter les taxes foncières ou la CFE. Il souhaite également savoir si des mesures spécifiques interviendront après la décision de rouvrir les salles de sport et, précisément, si des campagnes de promotion pourraient être prévues ou une réduction de TVA à 5,5 % pour compenser la perte d'adhérents des salles prévue.

Indeed, in the Albert territory, the vaccination center was closed due to a lack of available vaccines during the last week of January 2021 while the Péronne vaccination center on February 1, 2021 no longer had sufficient doses to honor the scheduled appointments. In As a result, many vaccinations have been postponed until April 2021 or canceled. The MP therefore alerts the Minister of Solidarity and Health to this situation where communities like Albert implement significant logistics and considerable human resources, all in a context of budgetary restrictions, only to ultimately suffer the organizational failure of the State. He therefore asks him if any solutions are intended to supply municipalities and particularly rural communities more efficiently.

Mr. Grégory Labille alerts Mr. Keeper of the Seals, Minister of Justice on criminal policy in matters of road traffic and particularly on that relating to accidents caused by drivers in a state of intoxication or under the influence of drugs. He reminds the Minister of the sad story of September 17, 2020 where a young medical student aged 21 was fatally struck by a drunk driver with 1.94 grams of alcohol per liter of blood while his driving license was revoked. He also reminds him of the dismay of the inhabitants of Amiens regarding the decision of the Amiens Court of Appeal of November 9. The Court of Appeal in fact sentenced the driver to three years in prison, two of which were suspended, while authorizing a modified sentence using an electronic bracelet. The murderer will therefore not receive any penalty of prison closed. The MP recalls that in 2019, 3,244 people lost their lives on the roads of mainland France and that drunk driving is one of the leading causes of death on the road with almost a third of fatal accidents attributable to it directly or indirectly. This figure, which has been growing continuously for 10 years, requires a strong reaction from the Ministry of Justice and in particular a policy stronger deterrent. He therefore asks him whether measures concerning criminal policy in matters of road traffic are planned in view of what he has previously mentioned and whether precise statistics concerning drunk driving offenses can be communicated publicly.

Depuis le lancement de l'Agenda rural annoncé par le Premier ministre en septembre 2019, le Gouvernement a déployé plusieurs mesures aimed at renforcer le dynamisme et l'attractivité des centres-villes des villes moyennes et des petites villes: création des ORT, dès 2018 lancement du programme « Petites villes de demain » qui concerne près de 1 600 communes, opérations de revitalisation des territoires (ORT) dès 2018, soutien de 45 M€ au développement des « tiers-lieux » via la labellisation « Fabrique de territoires » jusqu'en 2022, ou encore création de nouvelles licences IV, non transférables au sein d'une même région. Ces mesures ont également été accompagnées d'outils fiscaux aimed at renforcer la revitalisation des centres-villes. Ainsi, la loi n° 2019-1479 du 28 décembre 2019 de finances pour 2020 a instauré (aux articles 110 et 111) deux nouveaux dispositifs zonés destinés à soutenir les entreprises commerciales et artisanales dans les villes petites et moyennes. Ces dispositifs permettent aux communes et aux établissements publics de coopération intercommunale (EPCI) à fiscalité propre d'exonérer totalement ou partiellement de cotisation foncière des entreprises (CFE) et de taxe foncière sur les propriétés bâties (TFPB) les entreprises exerçant soit une activité commerciale dans une zone de revitalisation des commerces en milieu rural (ZORCOMIR), soit une activité commerciale ou artisanale dans une zone de revitalisation des centres-villes (ZRCV). Les arrêtés listant les communes répondant aux conditions d'éligibilité à ces dispositifs ont été respectivement publiés les 16 octobre 2020 et 6 janvier 2021 au Journal Officiel de la République française. Pour bénéficier de ces exonérations en 2022, les collectivités territoriales classées en ZRCV et en ZORCOMIR devront prendre une délibération avant le 1er octobre 2021, conformément aux dispositions de article 1639 A bis du code général des impôts. Dès lors, le Gouvernement n'envisage pas de recourir à article 37-1 of the constitution pour mener des expérimentations de zones franches. Les nouveaux dispositifs zonés (ZORCOMIR et ZRCV) constituent déjà des réponses fortes et pourront, le cas échéant, faire l'objet d'ajustements à l'occasion d'un premier bilan.

M. Grégory Labille alerte M. le ministre de l'intérieur sur l'amendement 2750 rectifié du projet de loi d'accélération et de simplification de l'action publique déposé par M. Guillaume Kasbarian. M. le député considère que cet amendement va dans le bon sens en ce qu'il permet une simplification de l'expulsion de squatteurs, en réduisant l'incertitude juridique pour les propriétaires d'une maison secondaire, ainsi que la responsabilisation accrue de l'administration à travers l'obligation de réponse du préfet dans un délai de 48 heures. Toutefois, cet amendement n'est pas encore suffisant et des injustices demeurent. Singulièrement, le cas de squat de la maison de M. Roland dans la ville de Toulouse montre les lacunes d'application de la loi. Ici, alors que le préfet a donné raison à M. Roland sur la situation de squat, le juge a rejeté la demande d'expulsion au motif du prolongement de la trêve hivernale jusqu'au 1er juin 2021. Il souhaite connaître l'avis du Gouvernement sur la manière d'améliorer le dispositif législatif qui, malgré son renforcement, ne permet pas encore de fait un recours de manière rapide et satisfaisante.

M. Grégory Labille attire l'attention de Mme la ministre de la culture sur la situation des médiathèques rurales qui n'ont pas vu leur situation s'améliorer malgré la livraison du rapport Orsenna - Corbin en 2018. Ce rapport, qui va dans le bon sens, proposait de dessiner « la médiathèque du futur » qui deviendrait un « temple de la culture » avec une offre culturelle plus diversifiée, des horaires d'ouvertures élargis ainsi que des moyens financiers étoffés. Si l'augmentation des moyens pour les bibliothèques et les médiathèques est une réalité, beaucoup de médiathèques dans les territoires ruraux n'ont pas encore bénéficié de ces augmentations de moyens. Singulièrement, la médiathèque intercommunale de l'Est de la Somme est ouverte 31,30 heures par semaine pour un territoire de 20 600 habitants, ce qui est honorable par rapport aux moyennes pour des territoires équivalents, et avec 5 personnes qualifiées dans l'équipe. Il souhaite savoir si des moyens financiers et techniques supplémentaires sont prévus pour aider ces médiathèques rurales, qui permettent à de nombreux citoyens français de bénéficier d'infrastructures culturelles de qualité.
