Since April 18, Nicaragua has been experiencing a serious political and security crisis. The toll of this crisis is extremely heavy, following the violent repression which followed the holding of demonstrations and numerous incidents were noted around the blockades which block a large number of roads. The latest information indicates several hundred deaths and more than 2,000 injured. No national French was not reported among these people. France, through the spokesperson for the Ministry of Europe and Foreign Affairs, condemned this violence and the disproportionate use of force and called on the Nicaraguan government to preserve the path of national dialogue, implemented under the auspices of the Nicaraguan Episcopal Conference. This national dialogue is essential to enable a peaceful and negotiated exit from the current crisis, and to allow discussions on democratization and justice to progress. This position was reminded of Minister Sidharta Marin, advisor to President Daniel Ortega for international affairs, who was received at his request at the Ministry of Europe and Foreign Affairs in May. Faced with the scale of this violence and the seriousness of the facts reported by human rights organizations, Man, it is essential that investigations can be carried out to identify those responsible for these actions and bring them to justice. This is why France has also indicated its support for the establishment of an international, autonomous and independent investigation mechanism, as recommended by the Inter-American Commission on Human Rights (IACHR). The number of our nationals registered with the services of the French embassy in Nicaragua is 811 people. The embassy regularly reminds the French community of security instructions. The travel advice sheet is regularly updated and formally advises against travel to Nicaragua and asks French tourists still present in Nicaragua to leave the country. For three months, the embassy has increased the level of implementation of its security plan. This system made it possible, directly or in conjunction with the island leaders, to assist several compatriots, particularly tourists, in order to enable them to leave Nicaragua. The embassy services also made efforts, in conjunction with the French Lycée and the Alliance French of Managua, to continue to ensure the functioning of these two structures. Finally, reinforcement was made available to the embassy. At the same time, France and the EU Member States continue to work together closely to assess the evolution of the situation, particularly on the security level, and to study the modalities that EU support could take to promote a settlement of this crisis, in connection with the Organization of American States.

Ms. Paula Forteza draws the attention of the Secretary of State to the Prime Minister, responsible for disabled people, to the announcement of the fourth autism plan. This question is asked on behalf of Ms. Isabelle Larelle. Le July 6, 2017, the President of the Republic announced the launch of a fourth autism plan at his side. This fourth plan was preceded by a third established for the period 2013-2017. Autism is defined as a “disorder of neurodevelopment appearing during childhood [and] which manifests itself by an alteration of the abilities to establish social interactions and to communicate” (IGAS report no. 2016-094R), is a national priority as announced by the President of the Republic during the campaign. In fact, autism spectrum disorders affect between 91,500 and 106,000 young people under the age of 20 in France and 650,000 people in France in total. However, France is the subject of numerous condemnations regarding the treatment of autism. Thus, the Council of Europe condemned France for discrimination against autistic children, lack of education, schooling, and professional training in 2004, 2007, 2008, 2012, and 2014. Likewise, in 2016, France was sanctioned by the UN for violation of children's rights on this subject. Faced with this observation, a fourth autism plan is being developed in consultation with regional health agencies and is structured around five working groups. The summary of their work as well as the announcement of concrete proposals must take place in February 2018. In this regard, the recurring records of abstention should alert us to the growing unsuitability of the single-member majority system. At the same time, it should be noted that in recent years, other voting methods have been imagined and tested, such as majority judgment voting. We must remember the principle: the voter votes by giving his opinion on all the candidates, based on a common scale of mentions ranging for example from “Excellent” to “Reject”, including “Good” or “Insufficient”. The candidate best evaluated by a majority of voters is then elected, possibly after a second round of voting (as was the case within the framework of the “LaPrimaire.org” initiative, which led to the designation of Charlotte Marchandise as candidate for the presidential election 2017). However, the identity of the donors is never made public. France appears extremely late on this point, particularly compared to other democracies: the United States, the United Kingdom, Germany, Italy, India and Brazil, the identity of the donors and that of the recipient party are public information for donations above a certain amount (200 dollars in the United States for example). The refusal to introduce such transparency is surprising to say the least, especially since political parties are the subject of particularly pronounced mistrust on the part of citizens, as opinion studies regularly highlight. Depuis le 1er juillet 2020, en application de l'article 21 de la loi n° 2018-493 relative à la protection des données personnelles, l'absence de cette « mention explicite » emporte la « nullité » de toute décision individuelle « prise sur le seul fondement d'un traitement automatisé de données à caractère personnel ». Or il semble que les allocations familiales n'affichent toujours aucune « mention explicite » relative à l'utilisation d'algorithmes, notamment s'agissant des demandes de prime d'activité. Elle souhaiterait donc savoir pourquoi cette mesure - aux implications techniques a priori mineures - n'est toujours pas appliquée, plus de quatre ans après la promulgation de la loi pour une République numérique. Cet effort de transparence permettrait pourtant aux citoyens de mieux comprendre les décisions de l'administration, et, s'ils le souhaitent, de faire valoir leurs droits. Deuxièmement, elle aimerait également savoir si la validité des décisions individuelles évoquées précédemment ne risque pas d'être remise en cause, au regard de leur automatisation manifeste.

The Open Government Partnership (OGP) is a multilateral international partnership (governments-civil society) aimed at promoting open government: transparency of public action, in particular through the opening of public data; participation of citizens in the development and evaluation of public policies; integrity of public action and public officials; use of new technologies in favor of openness and accountability. France has been a member of the steering committee since April 2014 until 2021. It co-chaired it from 2016 to 2017, on this occasion hosting the OGP World Summit in Paris in December 2016. Beyond regular representation on the various bodies, member countries undertake to put in place national action plans, responding to the challenges of the partnership. France is currently committed to a plan which it will have to justify putting into action at the end of 2020 comprising a total of 21 commitments made by 13 ministries, 3 government agencies, the Court of Auditors and the High Authority for the Transparency of Public Life (HATVP). These are organized around 5 axes: transparency of public action; the opening of digital resources and open innovation; strengthening citizen participation approaches; open government serving the global challenges of our century, development, environment and science; the opening of courts and independent administrative authorities. France's participation in the partnership demonstrates its commitment to a new form of democracy, linked to citizens' demands for development. The digital department, through the Étalab mission, has always been in charge of the operational support of France's involvement. At the institutional level, President Emmanuel Macron was present during the OGP handover ceremony, which was held on the sidelines of the 72nd United Nations General Assembly in September 2018. She would like to know the involvement that France will maintain in this partnership and which ministry and teams are responsible for carrying out the commitments made.

This question is asked on behalf of citizen Clément Castelin, as part of the Citizen Questions to Government initiative. Directive 2000/84/EC regulates the time change for Member States and responds to a need for harmony within the European Union, made up of three different time zones. The time change is not unanimous; its effectiveness is becoming increasingly contested by the European Parliament, citizens and a growing number of Member States. The European Commission spoke directly to the citizens of the Member States, as part of a public consultation between July 4 and on August 16, 2018, having collected the opinions of 4.6 million European citizens. More than 80% of voters are in favor of removing the time change. By virtue of the principle of subsidiarity, and if the proposed directive is adopted, it is up to each Member State to choose its time zone. However, the European Commission calls on Member States to adopt a unified time system. She considers that a lack of coordination “would harm the internal market by leading to an increase in the costs of cross-border trade, inconvenience in the organization of transport, communications and travel, as well as a reduction in productivity in the internal market for goods and services”. To date, any employee with at least one year of seniority on the date of birth of their child has the right either to the benefit parental educational leave, during which the employment contract is suspended, or a reduction in working hours (as long as this part-time activity remains greater than or equal to sixteen hours per week). These arrangements end no later than the child's third birthday. However, some parents would like to be able to benefit from it for longer, given school schedules, in order, for example, to be able to to take care of their child on Wednesdays. Also, the MP would like to know if the Government plans to extend the benefit of parental leave or the reduction of working hours on the basis of article L.1225-47 of the labor code; she emphasizes that such a reform would have no impact on public finances, these two measures being uncorrelated from the shared child education benefit (PreParE), paid by CAF for parents who reduce their activity to look after their children.

First of all, it appears that certain communities do not respect the technical requirements applicable to pedestrian paths. That concerns, for example, sidewalks that are impassable for strollers or wheelchairs. However, the decree of January 15, 2007, implementing decree no. 2006-1658 of December 21, 2006 relating to technical requirements for the accessibility of roads and public spaces, provides that the minimum width of the path is 1.40 meters free of furniture or any other possible obstacle. On the other hand, cyclists complain about the dangerousness of certain pole-type equipment, the location of which can sometimes cause falls. She would therefore like to know what measures have been taken by the Government to support communities in securing roads and whether more restrictive measures are being considered to ensure their compliance.

Cette question est posée au nom de la citoyenne Valentine Bardon, dans le cadre de l'initiative des « Questions citoyennes » au Gouvernement. En février 2021, afin de faire face aux effets de la crise sanitaire, le Gouvernement annonçait la mise en place d'un accès gratuit aux protections périodiques pour les étudiantes. Cette promesse reposait sur deux tristes constats. Premièrement, que 1,7 million de femmes n'auraient pas les moyens de se procurer régulièrement des protections périodiques. Deuxièmement, que cette précarité menstruelle toucherait une étudiante sur trois. La mise à disposition de protections périodiques gratuites et respectueuses de l'environnement devait débuter dès le mois de mars 2021, dans les résidences universitaires des CROUS et les services de santé universitaires (SSU), avant d'être étendue à d'autres points de distribution « sur l'ensemble des campus universitaires » à compter de la rentrée 2021. Pourtant, certaines étudiantes affirment aujourd'hui n'avoir pas eu connaissance d'une quelconque distribution gratuite au sein de leur campus. Elle aimerait ainsi savoir quel bilan le Gouvernement tirait de cette initiative et surtout ce qui est prévu pour qu'il remplisse pleinement les objectifs qu'il s'était fixés.

Mme Paula Forteza appelle l'attention de M. le ministre des solidarités et de la santé quant à l'accompagnement prévu pour les femmes qui subissent une fausse couche. Relativement tabou et peu documenté, ce phénomène est loin d'être mineur. Certains estiment en effet que près d'une femme sur trois subirait une fausse couche au cours de sa vie. En France, 15 % des grossesses s'arrêteraient spontanément au cours du premier trimestre, ce qui représenterait environ 20 000 fausses couches par an. Pour les futurs parents, cette épreuve est souvent un choc auquel la société ne prépare guère. On observe en outre une forte disparité, dans la mesure où la femme se voit généralement prescrire un arrêt de travail, à l'inverse de son conjoint. Or si l'on veut avancer vers une plus grande égalité au sein du couple et une déconstruction des rôles et des tâches traditionnellement assignées, on doit aussi permettre au conjoint, quel que soit son genre ou son statut, de s'impliquer tout au long des évènements liés à la grossesse, de se sentir directement concerné, dans les hauts comme dans les bas. La Nouvelle-Zélande l'a bien compris et a ainsi adopté en mars 2021 une loi accordant un congé spécial de trois jours, tant à la personne traversant une fausse couche qu'à son conjoint. Elle aimerait ainsi savoir si le Gouvernement envisage d'instaurer un congé similaire en France.

Traditionnellement, dans le pays, les élections ont toujours lieu des dimanches, comme le fixent les articles L. 55 et L. 56 du code électoral, notamment pour les élections législatives et municipales. La montée de l'abstention et l'évolution du mode de vie des Français (davantage de travail le dimanche, départs en week-end, etc.) invitent toutefois à engager une réflexion sur ce moment clé de la démocratie française. Au Royaume-Uni, par exemple, les électeurs se rendent aux urnes les jeudis pour désigner leurs députés. L'élection présidentielle américaine a de son côté systématiquement lieu un mardi. Elle aimerait ainsi savoir si le Gouvernement envisage de modifier le jour de tenue des élections, ou d'ouvrir les bureaux de vote sur plusieurs jours (par exemple du dimanche au mardi).

Mme Paula Forteza interroge M. le ministre de l'Europe et des affaires étrangères au sujet de la sécurité des employés d'ONG œuvrant à l'étranger. Cette question est posée au nom du citoyen Marc Le Brize dans le cadre de l'initiative des « questions citoyennes » au Gouvernement. L'attaque meurtrière ayant eu lieu au Niger, en août 2020, et durant laquelle sept employés de l'ONG Acted ont perdu la vie, souligne malheureusement l'importance des risques auxquels sont exposés les travailleurs humanitaires déployés dans les pays à risque. Ce drame est d'autant plus regrettable que ces Français ont été assassinés dans une zone jaune, selon la catégorisation du ministère des Affaires étrangères, soit une zone en « vigilance renforcée » qui correspond à un statut intermédiaire entre vert et orange. Se pose ainsi la question du recrutement et de la formation des personnes envoyées par certaines associations humanitaires dans des zones dangereuses, là où armée et entreprises n'envoient que des personnels hautement qualifiés. Elle aimerait dès lors savoir quels sont les dispositifs en vigueur, et si le Gouvernement envisage de prendre de nouvelles mesures à ce sujet.

L'expérience de la Convention citoyenne pour le climat (CCC) fut intéressante à plus d'un titre, démontrant notamment qu'un consensus éclairé pouvait émerger entre des citoyens très différents, ayant eu le temps de s'instruire et de débattre de manière approfondie. Cependant, contrairement aux engagements du chef de l'État, qui avait promis de reprendre « sans filtre » les propositions de la CCC, le Gouvernement a présenté un projet de loi qui ne reprend que partiellement les conclusions des travaux des citoyens, et qui reste donc dans une large mesure insuffisant au regard des enjeux. Elle aimerait ainsi savoir quelles sont les motivations qui ont fondé un tel choix.

Mme Paula Forteza interroge Mme la secrétaire d'État, auprès du ministre de l'économie et des finances, sur le besoin de revoir le dispositif Bloctel afin de mettre fin aux appels téléphoniques intrusifs dans la vie privée des citoyens. Cette question est posée au nom du citoyen Jean François Barthale qui, comme de nombreux citoyens, reçoit régulièrement des appels téléphoniques à des fins commerciales même en étant inscrit au service Bloctel. Le dispositif Bloctel, entré en service le 1er juin 2016, semble aujourd'hui inefficace. L'association de défense des consommateurs UFC-Que Choisir a publié une étude début 2017 qui assure que pour 82 % des personnes interrogées, le dispositif n'a pas permis une réduction des démarchages téléphoniques. Les débats à l'Assemblée nationale sur la proposition de loi visant à renforcer les droits des consommateurs en matière de démarchage téléphonique témoignent de l'importance de ce sujet et de l'urgence qu'il y a à trouver une solution à cette problématique. Lors des débats parlementaires, les entreprises du secteur ont alerté sur l'impact que des mesures très restrictives pourraient avoir sur l'emploi dans de nombreuses filières (énergie, assurances, habitat). Mme la secrétaire d'État a réuni, le 23 juillet 2018, l'association UFC-Que Choisir, des entreprises et des parlementaires pour trouver des solutions contre ces pratiques abusives, sous l'égide du Conseil national de consommation. Elle lui demande donc de lui préciser, suite à cette première concertation, quelle est la position et la feuille de route du Gouvernement pour trouver un système efficace qui permette aux Français de se protéger contre le démarchage téléphonique tout en prenant en compte l'impact sur les activités commerciales et l'emploi à court terme.

Mme Paula Forteza attire l'attention de Mme la secrétaire d'État, auprès du Premier ministre, chargée des personnes handicapées, sur l'annonce du quatrième plan autisme. Cette question est posée au nom de Mme Isabelle Larelle. Le 6 juillet 2017, le Président de la République a annoncé la préparation d'un quatrième plan autisme auprès de Mme la secrétaire d'État en charge des personnes handicapées. Ce quatrième plan a été précédé d'un troisième établi pour la période 2013-2017. L'autisme se définissant comme un « trouble du neuro-développement apparaissant au cours de l'enfance [et] qui se manifeste par une altération des capacités à établir des interactions sociales, et à communiquer » (rapport IGAS n° 2016-094R), est une priorité nationale comme l'a annoncé le Président de la République lors de la campagne. En effet, les troubles du spectre autistique touchent entre 91 500 et 106 000 jeunes de moins de 20 ans en France et 650 000 personnes en France au total. Pourtant, la France fait l'objet de nombreuses condamnations quant à la prise en charge de l'autisme. Ainsi, le Conseil de l'Europe a condamné la France pour discrimination à l'égard des enfants autistes, défaut d'éducation, de scolarisation, et de formation professionnelle en 2004, 2007, 2008, 2012 et 2014. De même, en 2016, la France a été sanctionnée par l'ONU pour violation des droits de l'enfant à ce sujet. Face à ce constat, un quatrième plan autisme est en cours d'élaboration en concertation avec les agences régionales de santé et s'articule autour de cinq groupes de travail. La synthèse de leurs travaux ainsi que l'annonce de propositions concrètes doit avoir lieu en février 2018. Elle l'a prie de bien vouloir détailler les suites données au troisième plan autisme, et tout particulièrement aux mesures n'ayant pas été mis en place. Elle lui demande quelles sont les raisons de ce retard et comment elle envisage de le pallier. Enfin, elle souhaite connaître les mesures phares du quatrième plan autisme.

Mme Paula Forteza interroge M. le ministre de l'éducation nationale sur l'utilisation du logiciel libre dans le réseau scolaire. Cette question est posée au nom de Madame Marie-Odile Morandi. Dans la loi du 7 octobre 2016 pour une République numérique, l'article 16 demande aux administrations qu'elles « encouragent l'utilisation des logiciels libres et des formats ouverts lors du développement, de l'achat ou de l'utilisation, de tout ou partie, de ces systèmes d'information ». Dans son rapport public annuel 2018, la Cour des comptes a reconnu l'intérêt du logiciel libre, décrit comme un « puissant facteur d'efficience et d'influence » mais aussi une façon de répondre à un « enjeu de sécurité et de souveraineté ». Dans la réforme du baccalauréat, le ministre annonce l'introduction d'une nouvelle matière « humanités numériques et scientifiques » qui permettra aux étudiants d'engager une réflexion autour des enjeux de société liés aux nouvelles technologies. En outre, la mise en place du plan numérique pour l'éducation, en partenariat avec les collectivités locales, permettra aux enseignants et aux élèves de profiter de toutes les opportunités offertes par le numérique dans une philosophie de transmission et de partage. Elle lui demande de bien vouloir détailler la position du ministère quant à l'utilisation du logiciel libre dans le contexte de la numérisation du réseau éducatif en cours. Mme la députée souhaite savoir si des dispositions permettant au ministère et à ses partenaires de contribuer au développement du logiciel libre et de leurs communautés sont prévues. La citoyenne Marie-Odile Morandi propose notamment que le ministère puisse soutenir financièrement (ou sous forme de « dons ») le développement du logiciel libre dans le secteur de l'éducation. Elle souhaite savoir si M. le ministre y serait favorable.

Mme Paula Forteza alerte M. le ministre d'État, ministre de l'intérieur, sur le besoin urgent de dématérialiser l'envoi des certificats de vie. Cette question est posée au nom du citoyen Guillermo Mimica, résidant au Chili qui, comme de nombreux Français établis à l'étranger, se heurte régulièrement à l'interruption de sa pension, due au retard ou à l'égarement des certificats de vie envoyés par les services postaux aux caisses de retraite en France. Afin de verser les pensions, les caisses de retraite (légale et complémentaire) doivent s'assurer que la personne en question est toujours en vie et cette justification passe par l'envoi de ces certificats. Aujourd'hui, les caisses de retraite ne les acceptent pas sous format dématérialisé, même s'ils sont certifiés par les autorités locales ou par les postes consulaires français du pays de résidence. Les Français résidant dans des pays comme le Chili ou le Cambodge, où les services postaux sont défaillants, voient donc leur pension de retraite régulièrement suspendue. Elle le prie de bien vouloir étudier les possibilités de faire évoluer la réglementation tout en maintenant, bien sûr, un haut niveau d'exigence sur l'authentification de ces documents. Le Gouvernement s'est engagé à dématérialiser et simplifier les démarches administratives pour tous les Français et à restaurer la confiance des citoyens en leur administration : elle lui demande ce qu'il en est des certificats de vie.

Mme Paula Forteza attire l'attention de Mme la ministre des solidarités et de la santé sur la mise en place d'un carnet de santé numérique. Cette question est posée au nom de M. Damien Di Nome. La loi de modernisation de notre système de santé du 26 janvier 2016 prévoit la mise en œuvre d'un dossier médical partagé. Ce dernier permet de fluidifier le suivi du patient en contenant notamment les comptes rendus hospitaliers, les allergies et antécédents, les médicaments prescrits, etc. Un décret d'application, entré en vigueur le 4 juillet 2016, a précisé les conditions d'application du dossier médical partagé. Toutefois, sa généralisation n'a pas encore eu lieu alors que la demande des citoyens est forte. Sa création est pour l'instant réservée aux ouvrants-droits majeurs du régime général de la sécurité sociale affiliés à la caisse d'assurance maladie du Bas-Rhin, de Bayonne, des Côtes-d'Armor, du Doubs, de la Haute-Garonne, de l'Indre-et-Loire, du Puy-de-Dôme, de la Somme, du Val-de-Marne. Elle la prie de bien vouloir détailler la généralisation du dossier médical partagé à l'ensemble du territoire et du public et lui demande à quelle échéance ce déploiement sera finalisé et si l'ensemble des publics sera concerné.
