The Government is committed to full transparency regarding the progress of the projects which will make it possible to achieve the objectives set by the President of the Republic: guarantee by 2020 access to good broadband (at least 8 Mbit/s) everywhere in the territory and generalize quality mobile coverage by allowing all uses of 4G; and provide all territories with cutting-edge digital infrastructure by 2022 offering very high speed access (>30 Mbit/s). The number of very high-speed subscriptions is constantly increasing and stood at 7.5 million in June 2018, representing almost 26% of fixed subscriptions in France. 56% of premises are now eligible for very high speed broadband in France. The objective of the France Très Haut Débit Plan is to reach 100% by 2022. Nearly 11 million premises are eligible for optical fiber up to subscriber (FttH) at the end of the first quarter of 2018. There should be nearly 27 million people able to benefit from it in four years. The Government has accepted the commitment proposals from operators Orange and SFR concerning the FttH deployment by 2020 in the main cities. Nearly 13 million premises will benefit from a commercial fiber offer to the subscriber by 2020. Within the framework of article L.33-13 of the Postal and Electronic Communications Code (CPCE), the Regulatory Authority for Electronic Communications and Postal Services (Arcep) will ensure compliance with these commitments at the national level and may sanction possible breaches. In addition, the Government has secured the envelope of 3.3 billion euros dedicated to the France Très Haut Débit Plan for the financing of public initiative networks supported by communities territorial. All the departments are engaged in ambitious projects which will bring very high speed to rural areas thanks to a technological mix composed of optical fiber to the subscriber, very high speed on the telephone network or very high speed via radio networks (terrestrial or satellite). In order to provide a connectivity solution to the 6% of households who will not benefit from a good broadband via wired networks in 2020, the Government is offering financial support to affected individuals of up to €150 for the installation of internet reception equipment via satellite or terrestrial wireless networks. The new “Territorial Digital Cohesion” window, endowed with 100 million euros, will directly support user equipment. As announced by the Prime Minister in Cahors on December 14, 2017, the window is being set up and will be operational from 2019. Private investors demonstrate a strong desire to invest in fiber optic networks, in addition to the public initiative, by requesting little or no public subsidy. La plateforme gérée par l'Agence nationale des titres sécurisés (ANTS) est un excellent début mais elle rencontre de nombreux dysfonctionnements pour la délivrance des cartes grises et permis de conduire depuis leurs récentes dématérialisations. Or de nombreuses administrations ne permettent pas encore un accès numérique à leurs documents ou un téléchargement des documents remplis accompagnés des pièces justificatives. Pour exemple, la MDPH de la Savoie doit attendre 2 ans avant une mise en service totale des documents dématérialisés, communs à l'ensemble des départements. Par ailleurs, elle continue d'être l'intermédiaire de l'Imprimerie nationale pour la réalisation des cartes de mobilité inclusion sans pouvoir, par exemple, télécharger la photo d'identité directement par le récipiendaire. Il souhaite donc connaître la position du Gouvernement sur la mise en œuvre d'un plan ambitieux d'accès à la dématérialisation de l'ensemble des titres et documents administratifs.

Mr. Patrick Mignola draws the attention of the Minister of the Economy and Finance to the VAT regimes applicable to real estate transactions involving the sale of plots of land extracted from built complexes. According to tax doctrine, VAT can only be calculated on the margin if the resold property is identical to the acquired property. It bases its position on article 268 of the general tax code (CGI) which provides that VAT can be calculated on the margin if it is established that the acquisition of the property by the transferor did not give rise to the right to deduction. However, the tax administration, in its comments on article 268 of the CGI, reserves the application of the VAT regime on the margin only to deliveries of buildings acquired and resold while keeping the same classification. It specifies that only building land that has been previously acquired is subject to margin VAT. as land not having the character of built buildings, or buildings completed more than five years ago having previously been acquired in the state of an already built building. It follows from this condition of identity that construction-sale operations, as well as sales of building land after demolition of the buildings built there, are excluded from taxation on the margin. Thus, in the event of a parcel division occurring between the initial acquisition and the transfer having resulted in a change of qualification, the taxation must be based on the total sale price. This situation is particularly damaging for small municipalities in France which are required to carry out comprehensive urbanization operations, often lacking in the private sector, and which must therefore repay VAT which they have not collected from buyers. This position nevertheless been reaffirmed on several occasions by the Government. However, the Grenoble administrative court, in its decision of November 14, 2016, ruled in favor of the taxpayer by noting in Article 268 of the CGI that “the application of VAT on the margin (...) is conditional on the sole fact that the acquisition by the transferor did not give rise to the right to deduct VAT; that contrary to what the administration maintains, it does not appear not of these provisions that the land resold as building land must necessarily have been acquired as land not having the character of a built building”. This decision should lead the tax administration to modify the terms of its doctrine. Today, France only detects five rare diseases at birth, while other countries, such as the Netherlands or Spain, already detect more than 20. The current national neonatal screening program is aimed at all newborns born in France, and aims to detect babies susceptible to to be affected by certain diseases. These are 5 severe diseases whose frequency is rare in the French population, and which affect children early in the absence of treatment: phenylketonuria, congenital hypothyroidism, congenital adrenal hyperplasia, sickle cell disease, as well as cystic fibrosis. In fifty years, 33 million newborns have been screened, which has made it possible to identify and treat nearly 30,000 of them. Today, the technique has become widely sophisticated and makes it possible to screen for up to several dozen metabolic diseases, such as MCAD deficiency which affects one in 15,000 children. A reform in the organization of this screening has already been announced for 2018. The reorganization of the program should therefore take place soon, and should make it possible to move from associative management to hospital management under the aegis of regional agencies (ARS). The finance bill for 2018 provides for a complete overhaul of the model of program 157 relating to disability and dependency. This program is narrowed around three actions including "steering the program and leading inclusive policies" bringing together the credits allocated to support policies for supported employment, the promotion of good treatment of elderly and disabled people, legal costs in the event of litigation linked in particular to departmental homes for disabled people (MDPH), as well as subsidies to organizations such as the national institutes for young blind and deaf young people (16.6 million euros in 2017). This overhaul results in a negative scope measurement on the budget of program 157 reaching a total of around 2 billion euros. These budget reductions are notably offset by the increase in credits allocated to the allowance for disabled adults (AAH). In total, program 157 appropriations fall by 9.2% compared to the previous year, to reach an amount of 10.6 billion euros in 2017. The inter-union staff of the national institutes for young deaf people (INJS) and the national institute for young blind people (INJA) is concerned about these budget cuts which endanger the guarantee of quality education for all. Since this announcement, staff, families and union organizations have mobilized to demand the opening of a real consultation allowing the construction of a coherent policy of specialized education for deaf young people and blind and visually impaired young people. The CIOs of national education are reception structures anchored in a training and employment pool. They are established in the territories in order to offer the population an information and advice service promoting integration through training, the best way to fight against exclusion and inequalities in employment. Their missions are to offer solutions for people who have questions about their training and professional path. They have an institutional mission in the education system and a proximity to students but also to school stakeholders that other structures do not have (school heads, teachers, CP.). CIOs are essential pivots within an education pool for monitoring and analysis of guidance policies and dropout prevention. They have developed expertise and collaborative work with multiple local partners (local mission, educational services, PJJ, universities, cities, professional branches). They are also a neutral and free place, appreciated for this, where all audiences are welcomed, middle and high school students, students, adults but also young people. out of school, dropped out of any training system, young people newly arrived in France. He thanks him for confirming that this closure is not on the agenda.

Furthermore, they propose the removal of recruitment thresholds and the opening of the employment framework to internal promotion based on seniority. He thanks him for his analysis and the opening of a consultation on these subjects.

M. Patrick Mignola appelle l'attention de Mme la garde des sceaux, ministre de la justice, sur le nécessaire désengorgement des maisons d'arrêt. À Chambéry, les mobilisations se multiplient afin de dénoncer une surpopulation carcérale atteignant les 210 %. Dans une maison d'arrêt comptant 63 places disponibles, 133 personnes sont incarcérées. Parmi les facteurs identifiés d'aggravation de ce phénomène, l'échec du dispositif destiné à confier à l'administration pénitentiaire le transfert des détenus des maisons d'arrêt aux tribunaux a sa part puisqu'il conduit à un allongement des durées de détention provisoire. En effet, le « plan pour la sécurité pénitentiaire et contre la radicalisation violente » du 25 octobre 2016 prévoyait la création d'équipes de sécurité pénitentiaire (ESP) afin de limiter le recours à la police et à la gendarmerie à des circonstances exceptionnelles et ainsi rendre plus efficace le dispositif d'extraction judiciaire. Seulement, ce dispositif ne concerne qu'un tiers des transferts de détenus au niveau national. Ainsi, et par dérogation à la règle générale établie dans le plan d'action, la maison d'arrêt de Chambéry fait partie des 21 établissements pénitentiaires dont les extractions judiciaires de proximité sont assurées par les forces de sécurité intérieure. Elle n'est donc pas concernée par le dispositif de création d'équipes de sécurité pénitentiaire. Il la remercie des précisions qu'elle pourra apporter sur l'évolution de ce plan afin de participer efficacement au désengorgement des maisons d'arrêt.

M. Patrick Mignola appelle l'attention de Mme la garde des sceaux, ministre de la justice, sur la menace pesant de nouveau sur la pérennité des cours d'appel de Chambéry et de Riom dans la région Auvergne-Rhône-Alpes. À l'occasion du lancement des "cinq chantiers de la justice" en octobre 2017, le Gouvernement a énoncé sa volonté de maintenir l'actuel maillage des sites judiciaires. Malgré cette annonce, les barreaux de la région se sont associés pour faire connaître leur crainte de voir les cours d'appel de Riom dans le Puy-de-Dôme, et de Chambéry en Savoie, ne devenir que des antennes de la cour d'appel de Lyon, voire de disparaître complètement, dans la continuité de la réforme mise en place en 2007. Il la remercie des précisions qu'elle pourra apporter quant à l'éventuelle refonte de la carte judiciaire de la région Auvergne-Rhône-Alpes.

M. Patrick Mignola attire l'attention de M. le ministre d'État, ministre de l'intérieur, sur les difficultés rencontrées par les élus de Savoie face à l'occupation illégale de terrains publics et privés par les gens du voyage. La loi n° 2000-614 du 5 juillet 2000 relative à l'accueil et à l'habitat des gens du voyage impose aux communes de plus de 5 000 habitants et aux établissements publics de coopération intercommunale exerçant la compétence d'aménagement, d'entretien et de gestion des aires d'accueil une obligation d'organisation de l'accueil des gens du voyage sur leurs terrains respectifs. Malgré la mise à disposition de camps familiaux, d'aires de passage et d'aires de grands passages sur les agglomérations d'Aix-les-Bains et de Chambéry, de plus en plus de communes de la région de Savoie se retrouvent confrontés à la recrudescence d'installations illégales de campements de gens du voyage. Les situations se répètent et ne manquent pas de susciter de vifs mécontentements, notamment chez les agriculteurs qui ont récemment organisé des manifestations pour lutter contre ces occupations illégales. Les élus ne disposent pas systématiquement du concours de la force publique pour faire évacuer les lieux. Il lui demande donc de prendre toutes les mesures de nature à seconder efficacement les collectivités territoriales concernées lorsqu'elles sollicitent la mise en œuvre de la procédure d'évacuation des terrains illégalement occupés.
