M. Pascal Jenft attire l'attention de M. le ministre des transports au sujet du poids total autorisé en charge (PTAC) du permis B et de ses conséquences pour les véhicules électriques. L'article R. 221-4 du code de la route dispose que le PTAC est de 3,5 tonnes pour les véhicules concernés par le permis B. Parmi ces véhicules figurent les camionnettes, majoritairement utilisées dans le cadre d'activités professionnelles. Cependant, le passage des véhicules thermiques à électriques étant de plus en plus encouragé, il convient de s'attarder sur l'incidence que cela peut avoir sur le PTAC. En effet, une batterie pour véhicule électrique est bien plus lestée qu'une batterie classique et peut atteindre 600 kilogrammes, voire une tonne dans certains cas. Ce qui signifie que ce poids entame le PTAC des véhicules et en particulier pour les camionnettes, ces dernières étant naturellement utilisées par les TPE et PME pour le transport de matériel ou de marchandise. Donc, en cas d'utilisation d'une camionnette électrique, une certaine partie du poids de transport disponible serait utilisée par la batterie, ce qui réduit l'utilité du véhicule pour le professionnel, pouvant même l'obliger à en utiliser un second. Bien qu'une révision de la directive européenne 2006/126/CE relative au permis de conduire soit actuellement en cours - elle prévoit notamment un relèvement du PTAC du permis B à 4,25 tonnes -, une anticipation de cette évolution serait de nature à soutenir efficacement l'économie. C'est pourquoi il lui demande s'il envisage d'augmenter le PTAC du permis B à 5 tonnes afin de prendre en compte le poids d'une batterie électrique et ainsi soutenir l'activité des TPE et PME utilisant une camionnette pour leur activité, dans le cas où elles décideraient d'utiliser un véhicule électrique.

Mr. Pascal Jenft alerts the Minister of Labor, Health, Solidarity and Families about the difficulties in applying the extension of the Ségur bonus. Since June 4, 2024, an agreement provides for an increase in the Ségur bonus with retroactive effect from January 1, 2024 for all eligible employees. However, this retroactive revaluation involves a cost of several hundred thousand euros, especially since it is necessary add employer contributions. Initially, this bonus is partly financed by the State, the regions and the departments. However, the presidents of the different departments, as well as the Grand Est region, to contest this new expense, announce that they will no longer finance Ségur bonuses towards obligated employers in their territory. Consequently, employers with employees eligible for this bonus will have to pay for it themselves. Ségur premiums revalued, since January 1, 2024. Otherwise, their employees would be entitled to legally attack them. This problem raises an issue of compliance with the law by the regions and departments which seem to ignore article L. 1111-2 of the labor code as well as articles L. 1211-1 et seq. of the general code of local authorities which require them to contribute to solidarity policies national, of which Ségur bonuses are part. But still, the financial viability of organizations subject to payment of the Ségur bonus is at stake. As their budgets cannot absorb such an expense, they could ultimately be forced to make dramatic decisions such as layoffs. This is why he asks him to ensure that the presidents of regions and departments comply with their legal obligations and guarantee the implementation of the agreement of June 4, 2024. Mr. Pascal Jenft draws the attention of the Minister to the Minister of the Economy, Finance and Industrial and Digital Sovereignty, responsible for industry and energy, to the situation in territories where a local distribution company (ELD) exercises a virtual monopoly on the distribution of energy. Since the nationalization law of 1946, some energy suppliers have refused nationalization in order to retain their independence. Today, these ELDs cover around 5% of French territory. Although pricing regulations are imposed on them, these ELDs still offer prices between 10% and 20% more expensive than national suppliers. Residents of areas where an ELD is established have no other choice than to subscribe to the local supplier. Although ELDs provide certain benefits, such as local job creation and a close customer relationship, the fact remains that the obligation to pay more can cause a certain frustration and a feeling of injustice. This is all the more problematic in this context of high inflation in the cost of electricity. Indeed, an increase in prices of more than 45% is observed in 2024 compared to 2023. It seems entirely legitimate to be concerned about such a price difference between ELDs and national suppliers. He asks what measures could be considered to harmonize energy prices across the entire territory, while preserving the economic viability of LDCs, which play an important local economic role.

Question 3180 — pensions: civil and military civil servants

Mr. Pascal Jenft questions the Minister of Labor, Health, Solidarity and Families about the effect of the reform of article L. 89 bis of the code of civil and military retirement pensions. Under certain conditions, this article allows civil servants, a few years before their retirement, to benefit from a partial retirement pension in order to be able to opt for half-time working. Since the modification by Law No. 2023-1322 of December 29, 2023, the article provides that civil servants who already have a pre-retirement system via a contract with their employer can no longer benefit from the partial pensions provided for by Article L. 89 bis of the Civil and Military Retirement Pensions Code. This non-cumulation is not imposed on employees in the private sector. However, the latter can also benefit from a pre-retirement system via a contract with their employer. For example: the Orange company offers senior part-time work (TPS) to its private and civil servant employees. If we can detect a desire to avoid a double pension, we can also wonder why such a difference between civil servants and employees in the private sector. Is this an oversight by the legislator or is there a motivation? He asks him to explain the motivations for the difference treatment between private sector employees and civil servants regarding the accumulation of a progressive retirement pension and a pre-retirement benefit via an employer contract.

Question 2221 — animaux

M. Pascal Jenft attire l'attention de Mme la ministre de l'agriculture, de la souveraineté alimentaire et de la forêt sur la situation des abattoirs sur le territoire français. La législation en vigueur dispose que toutes les précautions doivent être prises pour épargner de la douleur les animaux. Le code rural et de la pêche maritime, en particulier les articles R. 214-65 et R. 214-67, exige que tous les moyens soient employés pour réduire les actes de violence et de cruauté envers les animaux d'élevage abattus. Notamment via l'étourdissement avant leur mise à mort. Le non-respect de la loi peut s'avérer dramatique, c'est d'ailleurs ce qui a été signalé par l'association L. 214 au sujet de l'abattoir de la ville de Maurienne. Le préfet de Savoie a pris la décision de suspendre, temporairement, l'abattoir afin de mener un audit. Cet exemple pose la question légitime de la conformité juridique des abattoirs français. Il lui demande si elle va s'assurer que tous les abattoirs, de tout le territoire national, respectent les réglementations en vigueur au sujet de l'abattage.

M. Pascal Jenft alerte Mme la ministre du travail et de l'emploi sur la situation délicate dans laquelle se trouvent les professionnels de la coiffure. L'activité de coiffeur est une activité professionnelle réglementée par les articles L. 121-1 et R. 121-1 du code de l'artisanat. La législation impose aux coiffeurs et aux gérants d'un salon de coiffure d'être détenteur d'un diplôme (CAP, BEP ou autre diplôme homologué). Si un premier contrôle est effectué lors de l'immatriculation de la société par le Registre national des entreprises (RNE), le contrôle des salons de coiffure par la direction régionale de l'économie, de l'emploi, du travail et des solidarités (DREEST) permet de s'assurer que les établissements de coiffure sont bien tenus par des personnes qualifiées. Cependant, il est observé une augmentation des salons de type barbier, depuis l'année 2019. Or ces derniers ne se limitent pas aux prestations d'entretien de barbes, certains se permettent de proposer des services de coiffure au rabais sans les diplômes requis par le code de l'artisanat. Outre cette illégalité, ils opposent une concurrence déloyale aux salons de coiffure. Alertée par cette situation, la préfecture d'Eure-et-Loir a réalisé une série de contrôle de l'activité des salons de type barbier sur son territoire. Le constat fut sans appel : des salons sont contraints de fermer pour exercice illégal de l'activité de coiffure et pour emplois de personne en situation irrégulière. C'est pourquoi il lui demande si elle va faire en sorte que les contrôles des salons de coiffure par la DREEST soient systématiquement effectués pour tous les salons de type barbier présents sur le territoire.

M. Pascal Jenft alerte M. le ministre de l'intérieur sur l'impact de la multiplication des normes de procédures sur le travail des forces de l'ordre. Suite à la décision n° 2021-817 du Conseil constitutionnel du 20 mai 2021, les articles L. 256-1 et suivant du code de sécurité intérieur (CSI) ont restreint et conditionné le placement sous vidéo-surveillance des gardés à vue. De tel sorte que seul un gardé présentant un sérieux risque de violence, de suicide ou d'évasion peut être filmé. Depuis le 1er octobre 2024, les dispositions réglementaires R. 256-1 et suivant du CSI sont en vigueur et imposent une demande précise auprès de l'autorité administrative pour obtenir le placement d'un gardé sous vidéo-surveillance. Les gardés ont par conséquent le droit de contester cette décision. Outre l'alourdissement procédural, ces dispositions peuvent constituer un réel danger. En effet, pour se plier aux exigences du CSI en matière de vidéosurveillance, les agents de police auront moins de temps à consacrer à la garde à vue et aux actions qu'elle requiert. Pour des raisons de sécurité évidentes, un officier de police judiciaire (OPJ) devra être dédié à la surveillance des gardés non filmés. Faute de recrutements, ce seront des agents de police en moins sur la voie publique ; or l'actualité criminelle démontre bien que leur présence est impérative. Un autre élément inquiétant est la carence d'OPJ au sein de la police. Ces derniers sont sensés passer d'un effectif de 17 900 à 22 000 en 2027 mais, sur la dernière promotion, on recense 80 admis sur 709 élèves. Cela s'explique en partie par des primes jugées trop faibles, mais surtout par la complexité croissante de la procédure pénale, encore accentuée la semaine passée. Il lui demande s'il compte prendre des mesures pour annuler la réforme de l'usage des vidéo-surveillances lors des gardes à vue et ce qu'il envisage pour rendre attractifs les postes d'officiers de police judiciaire.

M. Pascal Jenft interroge Mme la ministre déléguée auprès du ministre des solidarités, de l'autonomie et de l'égalité entre les femmes et les hommes, chargée des personnes en situation de handicap, sur la prise en charge des fauteuils roulants. Plus d'un million de Français sont contraints d'utiliser un fauteuil roulant. La moitié de ces personnes n'obtient pas le remboursement intégral lors de l'achat d'un fauteuil. Ce qui est un réel problème au vu du prix : en moyenne 600 euros pour un fauteuil manuel et environ 10 000 euros pour un fauteuil électrique. Le restant à charge peut représenter une somme colossale, d'autant plus dans le contexte économique inflationniste. Fautes de moyens, certains Français souffrants de handicap sont dans l'impossibilité d'acquérir ou renouveler leur fauteuil roulant, condamnant ainsi leurs déplacements. Lors de la conférence nationale sur le handicap en 2023, le Président de la République avant annoncé la prise en charge totale de l'achat d'un fauteuil roulant par la sécurité sociale. Cette annonce fut confirmée par Mme Christine Vautrin, ministre du travail, de la santé et des solidarités et par Mme Fadila Khattabi, ministre déléguée chargée des personnes handicapées, le 11 avril 2024. Cela grâce à une extension de l'enveloppe budgétaire du ministère (initialement d'un montant 300 millions d'euros). Avec une telle somme, l'objectif devait être atteint à la fin de l'année 2024. Cependant, force est de constater que cela n'est toujours pas effectif en septembre 2024, bien que l'année ne soit pas encore terminée, il est légitime de se demander si ce projet verra le jour à temps. M. le député demande à Mme la ministre si les moyens mis à disposition de son prédécesseur sont toujours disponibles et prêts à emploi. Si non, il souhaite savoir si elle compte solliciter à nouveau une aide pour répondre au besoin urgent de milliers de Français.

Question 461 — maladies

M. Pascal Jenft interroge Mme la ministre de la santé et de l'accès aux soins au sujet du syndrome de fibromyalgie. Ce dernier provoque des vives douleurs chroniques, dont des douleurs articulaires, une haute sensibilité à la pression et également des troubles du sommeil. Dans les cas les plus extrêmes, les patients sont contraints de se déplacer en fauteuil roulant. Environ 1,2 million de Français sont atteint de Fibromyalgie. Selon la Haute Autorité de santé (HAS), 80 % des patients sont des femmes. Parmi eux, il est estimé que 70 % des patients n'ont pas un traitement adapté. L'Organisation mondiale de la santé (OMS) a reconnu la fibromyalgie comme syndrome en 1992 puis comme maladie en 2006. C'est également le cas pour d'autres pays tels que l'Allemagne, le Canada et l'Australie. Bien que la HAS ait participé à une meilleure prise en charge de la douleur via trois plans de luttes nationaux de la douleur entre 1998 et 2010, la majorité des patients n'ont pas un traitement adapté et passent par plusieurs années d'errances médicales. Pour endiguer cette problématique, une des solutions pourrait être de poursuivre les recherches sur la fibromyalgie afin d'en connaître les causes. Mais encore, la reconnaissance de la fibromyalgie en tant que maladie, à l'instar de certains pays dont l'Allemagne, pourrait encourager et améliorer sa prise en charge. Il lui demande si elle compte œuvrer pour la recherche et la reconnaissance en tant que maladie de la fibromyalgie.

Question 28 — enseignement

M. Pascal Jenft alerte Mme la ministre de l'éducation nationale sur les conséquences préoccupantes de l'article 49 de la loi n° 2021-1109 du 24 aout 2021 confortant le respect des principes de la République. Cette dernière dispose que l'instruction à domicile, dite l'école à la maison, ne serait accordée qu'à la suite de l'étude d'un dossier de demande d'autorisation, là ou précédemment, il suffisait d'une déclaration soumise à un contrôle régulier. Si des dérogations ont été mises en place entre 2022 et 2024, les demandes pour l'année scolaire 2024-2025, invoquant l'alinéa 4 de l'article L. 131-5 du code de l'éducation, se voient pour la plupart refusées au motif que l'enfant en question ne présente pas une spécificité incompatible avec une scolarisation classique et que le programme serait insuffisant. Cela même pour des familles fortes d'une expérience de plusieurs années et dont les contrôles sont irréprochables, tant sur le niveau scolaire que sur les moyens mis en place. Au-delà de la remise en question de la liberté de choisir l'éducation et la scolarité de leurs enfants, les familles se heurtent à des décisions arbitraires et inégalitaires suivant les directeurs académiques de l'éducation nationale. En plus d'une rupture d'égalité, il semble paradoxal d'interdire la scolarisation à domicile pour des familles en capacité de le faire alors que plus de 3 500 postes d'enseignants sont vacants pour la rentrée 2024. Sans compter que la scolarisation à domicile représente pour l'État une économie de plus de 500 millions d'euros sur une année. L'alinéa 4 de l'article L.131-5 du code de l'éducation étant large d'interprétation, met en danger la liberté et le choix des parents. Poussés dans leurs retranchements, certains pourraient être tenté par la désobéissance civile. Il lui demande de prendre en considération cette problématique afin de proposer une solution viable, respectueuse du choix des familles et de la qualité de l'enseignement des écoliers.
