Le titre I er du livre III du code pénal est complété par un chapitre V ainsi rédigé : « Chapitre V « De l’occupation frauduleuse d’un immeuble «  Art. 315‑1 . – L’occupation sans droit ni titre, de mauvaise foi, d’un immeuble appartenant à un tiers s'apparente à un vol. «  Art. 315-2 . – Il incombe au tiers occupant sans droit ni titre de prouver sa bonne foi par la présentation d’un titre de propriété, d’un contrat de bail en cours de validité le liant au propriétaire de l’immeuble occupé ou bien d’une convention d’occupation à titre gratuit signée par le propriétaire du bien. »
