Act on Amendments to the Funded Pensions Act and the Tax Organization Act

The draft aims to strengthen the II pension pillar and more clearly restore the principle that money is collected there for retirement age. The main change is that people who have left the II pillar can rejoin it after 5 years instead of the previous 10 years. For example, those who left the pillar in 2021 or 2022 would be able to apply for reinstatement of contributions after the draft comes into effect. Another important change concerns the early maturity of money extraction. From now on, a person does not have to withdraw the entire accumulated amount before retirement age, but can use only a part of the money if necessary. Even after a partial withdrawal, you can start collecting again after 5 years.

Insurer Crisis Prevention and Resolution Act

The bill transposes two EU insurance directives into Estonian law (transposition deadline January 29, 2027). The aim is to establish a framework for early intervention and resolution of insurers' financial difficulties and to modernize insurance regulation in order to strengthen financial stability, protect policyholders and make regulation more proportionate and future-proof. One of the goals of the bill is to simplify requirements and market entry conditions especially for small and uncomplicated insurers. For example, a small and uncomplicated insurer does not need to prepare a liquidity risk management plan or climate change scenarios, its risks and solvency will be assessed not annually, but every two years, and it also does not need to assess macroeconomic factors.

The purpose of the bill is to organize the regulation of the register of personal data processing and support management, to bring solutions developed from practice to the level of law. The bill reduces the number of outdated norms. The beneficiary's right to claim interest based on the State Liability Act is excluded if the decision to recover the subsidy is later canceled, as the current regulation allows interest to be demanded even if the beneficiary has not actually suffered a loss. From now on, the damage claim is based on the actual damage. The law specifies the categories of personal data processed in the register.

Act on amending the Social Tax Act and amending other related laws

The purpose of the bill is to reduce the administrative burden on the payer when taxing the fees paid for services provided on the basis of a debt contract between natural persons, and to increase the legal clarity and uniformity of the tax rules and thus tax compliance. For this purpose, the service fee payer who is a natural person is exempted from paying social tax and social insurance contributions, submitting the tax declaration TSD, and entering the service provider's TÖR of obligation. Similar to income tax, the obligation to pay social tax and social security contributions is imposed on the service fee recipient. The burden on non-resident employers is also reduced by exempting them from registration and tax obligations if their employee stays in Estonia for a short period of time (up to 183 days) and the employer does not have a permanent place of business here. The changes are aimed primarily at diginomats, as well as various short-term performers, for educators, athletes and participants in film shoots.

Riigikogu decision "Making a proposal to the Government of the Republic on the establishment of a fair graduated income tax"

Act amending the Savings and Loans Association Act and amending other related laws

The bill increases the transparency of savings and loan cooperatives and the activity of members, and directs cooperatives to the form of a bank or cooperative bank operating under greater supervision. The reform will be implemented in three stages between 2026 and 2029. In the first stage, the establishment of new cooperatives and the advertising of deposit interest rates will be prohibited, as well as the entry and contribution fees for new members will be increased. In the second stage, authorization, signing of loan and deposit agreements will be restricted and strengthened members' rights and management and control requirements are tightened. In the third stage, cooperatives wishing to include deposits must apply for an operating license from the Financial Supervision Authority, others may continue as payment institutions or credit providers, and those who cease operations must officially notify.

Act on Amendments to the Payment Institutions and E-Money Institutions Act and the Payment and Settlement Systems Act

The law is being amended to allow payment and e-money institutions to access settlement systems enabling instant payment services. Flash payment means a payment where money moves from the payer's account to the recipient's account within a few seconds and it works 24/7. Currently, only banks offer such a service, as only they have access to the necessary current accounts at Eesti Pank. Other payment institutions and e-money institutions have so far avoided this possibility, which is why they it has not been possible to provide equivalent services.

An Act to amend the Law of Debt Act and consequently to amend other laws

The draft aims to specify the regulation of the basic payment service, the powers of misdemeanor and supervisory proceedings related to the financial field, and the payment of the state fee in cash, as well as to stipulate the obligation of providers of vital services to offer offline card-based payments in emergency situations. The law is being changed so that people can use their bank card especially in emergency situations even if the internet service is interrupted. It can do a vital service in shops, gas stations and pharmacies selected as providers. For this purpose, banks selected as vital service providers must start offering customers the option of offline card payment. The bank must set an offline individual limit on the customer's bank card chip, and merchants' payment terminals must be able to carry out offline card payments. This ensures that people can buy critical essentials even when the merchant's payment terminal fails and is not connected to the bank's payment system. In Estonia, five banks have been designated as vital service providers: AS SEB Pank; Swedbank AS; Luminor Bank AS; AS LHV Pank and Coop Pank AS. There are also six ETO fuel sellers: AS Alexela, Olerex, Circle-K, Neste Eesti AS, Terminal, Premium 7, Jetoil. In terms of grocery stores and pharmacies, providers of vital services have not yet been selected. As another important change, the regulation of opening and closing a private person's main payment account. Clear grounds are laid down in which cases the bank can close the bank account concluded with the consumer. For example, this is possible in case of reasonable suspicion of money laundering or if the consumer has used the account for illegal activities. Among other things, the payment of state fees in cash is specified. The institution to which the state fee is paid may decide that it can be paid in cash in an amount greater than 10 euros.

Act on amending the State Border Act and other related laws

The amendments to the bill give the state better opportunities to prevent mass immigration in an emergency situation, when foreigners illegally cross the Estonian state border and make unjustified requests for international protection. According to the amendment, the Police and Border Guard Board (PPA) may refuse to accept the application for international protection of an alien who has illegally arrived in the country in an emergency situation, and may not issue a departure order or an entry ban decision send back without doing. You may enter Estonia from the external border only through an open border point. The law also gives the PPA the right to determine the locations where a foreigner can submit applications for international protection. The draft also makes the involvement of the Defense Forces and the Defense League more flexible in the protection of public and constitutional order, in the event that the PPA's resources are not sufficient. Currently, the Defense Forces or the Defense Forces can be engaged for a maximum of 30 days, but that does not correspond to the changed security situation, where the need for involvement may be longer. The explanatory letter states that the artificially created migration pressure in the region showed that the Estonian legal order must be ready to manage such a hybrid attack and to ensure security in an emergency situation of mass immigration.

The Act on Amendments to the Act on the Benefits of the Office of the President of the Republic

The bill adds to the list in the President's Perks Act, in which cases the outgoing president cannot use the benefits. Cases are added to the list when the outgoing president applies for or is elected to the Riigikogu, the European Parliament or is appointed to a ministerial post. The explanatory letter points out that according to the current law, the outgoing president is entitled to certain benefits due to his special status. The benefits are the right to use residential, representative and work premises with reimbursement of the rent and maintenance costs of the premises by the state, or to receive compensation from the state for reasonable costs related to the maintenance of the president's residence; have an advisor and a secretary at their disposal, who are employees of the Office of the President of the Republic; receive a one-time compensation in the amount of one year's professional salary; to use a company car at the expense of the state and related to its maintenance and use services; receive compensation for travel expenses and other justified expenses in accordance with the procedure specified in the law. After the end of his term of office, the president is also paid an official pension at the rate of 75 percent of the president's official salary.

Draft amendment to the State Border Act

The bill provides for the creation of a legal basis for preventing massive illegal border crossings or attempted border crossings and for returning foreigners who have crossed the border to the foreign country from which or through which they arrived in Estonia. Act on the ratification of agreements necessary for joining the Convention on the Establishment of the European Center for Medium-Range Weather Forecasts

According to the draft, the Republic of Estonia accedes to the Convention on the Establishment of the European Center for Medium-Range Weather Forecasts and the Protocol on Privileges and Immunities attached thereto, the Protocol on Amendments to the 2005 Convention and ratifies the agreement between the Government of the Republic of Estonia and the European Center for Medium-Range Weather Forecasts (ECMWF) on the accession of the Republic of Estonia to the Convention on the Establishment of the ECMWF and related conditions, which was signed on 3. in June 2020. The main task of the center is to develop medium-range weather forecasting capabilities and to ensure medium-range weather forecasts for member states. The ECMWF member status allows for additional information to be used to use the results of model calculations from the center to create high-quality products and services that meet local needs. The available information helps to implement instant predictions, adopt and implement ensemble predictions, increase the reliability and accuracy of forecasts of different lengths. The products and services provided by ECMWF are the basis of the daily work of the State Meteorological Service of the Environmental Agency, and the accuracy of Estonian weather forecasts and warnings depends on them.

Act on Amendments to the Local Self-Government Organization Act

The amendment proposed by the bill concerns people working in the same municipal or city authority under an employment contract, who will be subject to the suspension of the council member's powers in the future instead of the termination of their current powers. Officials are not affected by the proposed change. The impetus for the initiation of the bill is the corresponding request of the Chancellor of Justice to the Supreme Court to take a position. The Supreme Court found that the established restrictions on employment contracts of local government authorities are not necessary for employees and excessively limit the right to apply. Due to this, the commission also considers it necessary to soften the restriction and supports the suspension of the authorization instead of the termination of the authorization. The law is scheduled to enter into force on October 17, when the Supreme Court's decision also enters into force. From this date on, it is no longer possible to prematurely terminate the powers of council members who are employees of the municipal authority.
