Summary

Dans un délai de trois mois suivant la promulgation de la présente loi, le Gouvernement remet au Parlement un rapport sur l’application de la loi n° 2000‑647 du 10 juillet 2000 tendant à préciser la définition des délits non intentionnels. Le rapport porte également sur l’historique et la jurisprudence des cas où des élus locaux, chefs d’entreprises, dirigeants d’associations ont pu voir leur responsabilité personnelle engagée en matière de santé publique. Il propose enfin des pistes de clarification du cadre dans lequel les élus locaux exercent leur mandat, notamment lorsqu’ils agissent en tant qu’agents de l’État.
