Mr. Stéphane Demilly questions the Minister of Territorial Cohesion and Relations with Local Authorities on the financing of apprenticeship within local authorities. Law No. 2019-828 of August 6, 2019 on the transformation of the civil service provides that from January 1, 2020, apprenticeship in communities will be financed equally between the national center of the territorial civil service (CNFPT) and local authorities. Mr. Stéphane Demilly alerts the Minister of State, Minister of Ecological and Inclusive Transition, to the incompatibility between the desire to promote the ivory trade and the fight against elephant poaching. On average, 20,000 African elephants are poached each year for their ivory and their numbers have never been so low. These fell by more than a third between 2007 and 2014. The legal trade in ivory in the European Union fuels this decline by serving as a cover for illicit trade, and legal exports from the European Union help fuel demand in consuming countries in Southeast Asia. According to an IFOP survey, commissioned by IFAW in April 2017, 72% of French people are completely in favor of a total and complete ban on the ivory trade. Due to a lack of social housing, many workers from ESAT (work support establishment and service) and adapted companies (EA) are encountering difficulties in finding accommodation. This is why some non-profit structures with a public service mission and agreed with the State (like the Departmental Association of Parents and Friends of People with Mental Disabilities of the Somme (ADAPEI 80)) innovate by building diverse habitats adapted to the situations of workers with disabilities, in order to meet the social inclusion needs of these physically and psychologically fragile populations. These Social residences constitute an intermediate formula between isolated home and collective accommodation and aim to promote the autonomy of each resident. They are intended for autonomous or semi-autonomous people, working in ESAT or EA. An agreement with the State for these residences would allow tenants to receive personalized housing assistance (APL) under the most favorable conditions possible and to give the housing concerned the legal status of social housing. In the Somme department, however, state services rejected a request for an agreement for a project carried out by ADAPEI80, as it did not fall within the existing legal framework. Various studies (Etseban survey in particular) and numerous organizations in charge of public health (French Cardiology Federation among others) warn about the decline in the physical capacities of young people, about a sedentary lifestyle, about the development obesity, screen addiction and show the absolute need for an increase in physical activity for all. PE at school is from this perspective the only place of practice and learning for students, girls and boys, without any discrimination. This discipline is also a path to academic success, a space for surpassing oneself, for efforts and for deepening sporting and artistic activities. However, PE is gradually being undermined by a set of decisions which weaken it and therefore degrade its effects on students and make the work of teachers more and more difficult. It should therefore be noted the 21% drop in recruitment for the external certificate of aptitude for teaching physical and sports education (CAPEPS) 2018 while the number of candidates, students in the sciences and techniques of physical and sports activities sports (STAPS), is progressing, as is the number of students in secondary education. While more than 2.5 million French people already live in one of the 192 medical deserts in France, the phenomenon tends to get worse and no longer only concerns small towns. It extends to cities, notably due to departures in retirement not replaced. Between 2012 and 2017 the average waiting times to obtain an appointment in the city literally exploded from 104 to 117 days for an ophthalmologist, from 55 to 68 for a gynecologist, from 41 to 64 for a dermatologist, from 38 to 53 for a cardiologist, from 36 to 51 for a rheumatologist or even from 33 to 43 days for an ENT specialist. These unbearable waiting times have thus become the first cause of renunciation cared for by French people. Furthermore, 47% of general practitioners are over 55 years old, and 27.3% are over 60 years old compared to only 16% are under 40 years old. Specialist doctors are on average 51 years old in France, 27.6% are over 60 while barely 20% are under 40. The arrival of newly trained doctors will therefore not make it possible to compensate for future retirements or to cope with the increase in needs linked to the aging of the population. If nothing is done, the phenomenon will continue to get worse. Waiting times for patients as well as distances to travel will lengthen to an even more unbearable extent for our fellow citizens. He therefore asks her what measures she intends to take to stop this phenomenon against which nothing serious has been done in recent years. Mr. Stéphane Demilly questions the Minister of Solidarity and Health on her position regarding the situation of certain retired veterinarians, who carried out health mandates during their career, and who today wish the lifting of the four-year limitation period which would allow them to receive a retirement pension for these activities. Indeed, in the years 1955-1970, numerous epizootics ravaged the cattle herd French, leading the State to put in place a major prophylaxis plan. In order to carry out the treatments necessary to contain these epizootics, the State has used private veterinarians by entrusting them with health mandates. The remuneration of veterinarians was partly the responsibility of the operators. The other part of the remuneration was paid by the State to private veterinarians, in the form of fees, which had the effect of consequence of not affiliating them with social organizations, and in particular retirement organizations. The administrative jurisdiction was seized by veterinarians who considered that they were in reality subordinate to the State for the exercise of these missions within the framework of a hierarchical link with the State, which characterizes a salaried activity. The Council of State, in two judgments of November 14, 2011 (No. 334197 and 341325) considered that the State committed a fault which deprived the veterinarians concerned of their pension rights, which justifies compensation. However, if some of the veterinarians concerned were able to obtain this retirement pension, those having liquidated their pensions more than four years before, face the four-year limitation period (CE, July 27, 2016, no. 388198). The Council of State considers that they should have known, when liquidating their pension, that the State should have affiliated them with pension funds. However, the veterinarians affected by this prescription were unaware that the sums paid should be classified as salaries and not fees, as the State maintained. They learned this with the decisions of November 14, 2011. Furthermore, it seems that the people concerned are those who currently benefit from the most modest pensions, while they were the most exposed to epizootics and on the front line facing the complex management of these crises. Also, in order to answer the questions of retired private veterinarians who find themselves in this situation, he would like to know the Government's intentions on this issue.
