Mrs. Stéphanie Rist draws the attention of the Minister of Solidarity and Health to the situation of people suffering from an illness relating to a Long-Term Illness (ALD) who cannot benefit from sick leave depending on their care or the manifestation of symptoms, but according to a timetable constrained by poorly adapted legislation. Indeed, these chronic illnesses often require regular work stoppages, but short-term. However, in the current state of the law, according to articles L. 323-1 and R 323-1 of the social security code, patients on ALD can benefit from daily allowances in the event of sick leave for three consecutive years. Beyond this period, it is expected that a whole year must pass without sick leave, so that people with ALD can continue to receive daily allowances from the Security Social. If we take the example of diabetes, we know that the symptoms do not suddenly disappear after three years, and that the need to stop temporarily can arise at any time. However, the legislation in force, which imposes a period of twelve months without sick leave so that rights are “recharged”, does not seem compatible with the daily life of people on long-term care who need to resort to split leaves, without being oriented towards disability. In order to compensate for these imbalances, it wishes to know whether an evolution of the current system is envisaged in order to allow the payment of daily allowances beyond the three-year period, since the maximum number of days giving rise to the payment of daily allowances has not been reached by the insured person affected by an ALD, and thereby whether the public authorities intend support the continued employment of citizens suffering from long-term illnesses.

However, given the ever-increasing number pet abandonment, the action of these associations, in addition to those with shelters, whose capacities are insufficient, is essential to the protection and safeguarding of abandoned animals. Indeed, the lack of replacement structures leads owners to abandon animals in the wild. Article L. 211-25-II of the rural code provides that the pound manager can “transfer the animals for free to foundations or animal protection associations with a shelter which alone are authorized to offer animals for adoption to a new owner. The MP recalls that the medicine transparency commission had decided in favor of a classification allowing 15% reimbursement of Hyalgan, an AHIA. She draws the attention of the Minister to the effectiveness of AHIA in the fights against pain in cases of knee osteoarthritis. The scientific literature reports more than 100 references to clinical trials of AHIAs versus placebo or comparators of meta-analyses or systematic reviews in symptomatic knee osteoarthritis, including numerous clinical trials. 14 published meta-analyses, including 11 versus placebo, conclude positively for 9 of them (some moderately) on the effectiveness of AHIA in the gonarthrosis. The state of research appears to make AHIAs the pharmacological therapeutic option with the best benefit/risk ratio in knee osteoarthritis. The alternatives proposed in the previously cited decree, paracetamol and oral NSAIDs, do not seem capable of truly replacing AHIAs. This situation should push patients to resort more to prostheses. This is already the case in many countries, where the socket in charge is more systematically oriented towards prostheses, to the detriment of a real assessment of the patients' situation in terms of benefit/risk ratio, for lack of alternative. It also entails a significant cost for patients, with a risk of social injustice. The MP underlines that the texts mentioned to justify the delisting of AHIA are recommendations with a national vocation formulated to the United States and Great Britain, countries where the treatment of joint disorders is very different from that in France. She would therefore like to know if, in light of these facts, the Minister of Solidarity and Health could reconsider the decision to delist AHIA in order to define, in conjunction with the health professionals concerned, the conditions of use and reimbursement of this useful medication.

For this type of structure, the question of the skills of volunteers is therefore vital; training actions can be undertaken for volunteers, to enable them to best respond to the missions assigned to them. Therefore, the CPF credits accumulated throughout their life as employees by retirees under the age of 65 could be used to finance their development of skills within the associative framework. However, the use of the CPF is currently reserved for full-time salaried activity and ipso facto excludes young retirees, even though their associative commitment is very often similar to a full-time activity, the only one of which is The difference with salaried employment lies in the free nature of their approach. Victimes collatérales de ces épisodes de gel, elles doivent faire face à la perte de production de leurs fournisseurs et se retrouvent privées d'une part importante de leur activité. Elle souhaiterait savoir si ces entreprises pourraient prétendre à être intégrées aux mesures d'aide et d'accompagnement mises en place pour soutenir les agriculteurs.

Mme Stéphanie Rist interroge Mme la secrétaire d'État, auprès du Premier ministre, chargée des personnes handicapées, sur l'évaluation de l'inclusion des personnes en situation de handicap dans la fonction publique. En effet, selon l'article L. 323-2 du code du travail, comme dans le secteur privé, tout employeur public occupant au moins 20 agents à temps plein est tenu d'employer des personnes handicapées dans la proportion de 6 % de l'effectif total des agents rémunérés. Au 1er janvier 2017, 240 691 agents publics en situation de handicap travaillaient dans la fonction publique dont 57 % en catégorie C. Les tribunaux administratifs sont en charge de la vérification et, le cas échéant, et de la mise en place de sanctions pour toute atteinte au droit des travailleurs handicapés à l'accès à la fonction publique. Cependant le renforcement du contrôle et une évaluation globale et qualitative sont nécessaires pour identifier les obstacles à l'inclusion des personnes en situation de handicap dans le secteur public. Elle l'interroge donc afin de savoir ce que le Gouvernement prévoit pour améliorer l'évaluation et le contrôle des employeurs publics pour l'emploi des personnes en situation de handicap.

En effet, selon l'article D. 2224-5 du code général des collectivités territoriales, seules les communes ou les établissements publics de coopération intercommunale de plus de 3 500 habitants sont soumis à une obligation de mise à disposition de ces rapports. Or les informations contenues dans ces rapports permettent aux citoyens d'avoir connaissance de la qualité de l'eau potable, participent à la prévention contre toute catastrophe écologique et permettent de lutter contre la pollution de l'eau. L'article L. 124-1 du code de l'environnement, transposant la directive européenne 2003/4/CE, dispose que l'accès aux informations environnementales détenues, reçues ou établies par les autorités publiques ou pour leur compte est garantie. Or le fait que l'obligation de publication de ces rapports annuels ne s’applique pas pour les communes de moins de 3500 habitants ne permet pas de répondre à cet engagement de transparence. La mise à disposition de certaines données telles que la quantité de boue en tonne de matière sèche issue des ouvrages d'épuration pourraient par exemple répondre à ce défaut d'information. À ce titre, elle souhaiterait savoir s'il est prévu une extension de la règle de mise à disposition des rapports, ou de certaines de leurs données, pour les communes de moins de 3 500 habitants.

Mme Stéphanie Rist attire l'attention de M. le ministre de l'intérieur sur la concurrence à laquelle font face les établissements d'enseignement de la conduite, avec le développement des plateformes en ligne, qui mettent en relation de jeunes apprentis conducteurs et des enseignants indépendants, qui officient avec leurs propres véhicules. Les représentants départementaux du Conseil national des professions de l'automobile - Éducation routière l'alertent sur le fait que les candidats ayant recours à cette offre dématérialisée n'ont pas de moyens à leur disposition pour s'assurer que les véhicules utilisés sont en bon état, qu'ils sont couverts par une police d'assurance, et qu'ils bénéficient de l'agrément les autorisant à exercer. Elle souhaite savoir quels dispositifs peuvent être envisagés en termes de transparence et d'information, afin de garantir aux usagers des conditions optimales d'apprentissage, tant sur le plan de la sécurité routière que sur celui de la qualité de la formation dispensée.

Mme Stéphanie Rist alerte Mme la secrétaire d'État auprès de la ministre des solidarités et de la santé sur un apparent dysfonctionnement de la pension d'invalidité. Tous les mois, les ayants droit à la pension d'invalidité doivent déclarer leur salaire brut auprès de la CPAM. La pension d'invalidité est alors versée dans son intégralité tant que la totalité des ressources du pensionnaire, qui inclue le salaire brut et la pension d'invalidité, ne dépasse pas le salaire de comparaison, celui-ci étant déterminé à partir des salaires de l'année civile précédant l'invalidité. Si la pension n'a pas pour but d'enrichir ses bénéficiaires, le mode de calcul utilisé n'encourage pour autant pas la valeur « travail ». Les primes ou augmentations sont mécaniquement annulées dès lors que le salaire de comparaison est dépassé. Les primes exceptionnelles, d'ancienneté, collectives ou personnelles sont donc concernées, la progression professionnelle impactée. Afin de bénéficier de ces différentes primes, les bénéficiaires sont donc encouragés à travailler moins, afin que le cumul de leur salaire, primes et pension d'invalidité ne dépasse jamais le salaire de comparaison. Elle souhaiterait savoir s'il est envisagé de réviser les conditions de versement de la pension d'invalidité, afin de mieux accompagner les bénéficiaires dans leurs carrières professionnelles.

Mme Stéphanie Rist interroge Mme la ministre de la cohésion des territoires et des relations avec les collectivités territoriales sur les garanties d'emprunts offertes par les petites communes aux bailleurs sociaux. Les petites communes qui souhaitent favoriser le développement de housing social accordent régulièrement aux bailleurs sociaux des garanties de prêts immobiliers. Si le non acquittement d'une dette relève de situations rares, il n'en demeure pas moins possible. Ces communes prennent donc un grand risque pour aider au développement du housing social en France. Ce risque est pris car les établissements bancaires, et notamment les caisses de dépôt, requièrent une caution. Aussi, elle souhaite savoir si d'autres systèmes de garantie seraient envisageables, afin d'accompagner la création de housing social dans les petites communes.

Mme Stéphanie Rist attire l'attention de M. le ministre de l'agriculture et de l'alimentation sur la situation des ostéopathes animaliers. Ceux-ci sont en effet assimilés depuis 2011 à des actes vétérinaires, contrairement aux actes d'ostéopathie humaine qui ne relèvent pas de la médecine. Par ailleurs depuis le 19 avril 2017, par décret, un concours conditionne l'accès à cette profession, sous le contrôle exclusif de l'ordre national des vétérinaires. Étant donnée l'existence d'instances représentatives des ostéopathes animaliers, et en tenant compte de la différence reconnue entre ostéopathie humaine et pratique de la médecine, elle souligne qu'il serait opportun de donner une place plus grande aux représentants des ostéopathes animaliers diplômés d'institutions reconnues par l'État dans l'organisation des épreuves donnant accès à la profession d'ostéopathe animalier. Elle souhaite savoir si un accompagnement spécifique des praticiens déjà en exercice est prévu.

Mme Stéphanie Rist attire l'attention de Mme la ministre des solidarités et de la santé sur la situation des enfants nés par assistance médicale à la procréation (AMP) avec don de sperme ou d'ovocyte. La législation actuelle garantit l'anonymat total des donneurs. Les évolutions de la technique - accessibilité technique et financière des tests génétiques « récréationnels » notamment - rendent ces dispositions de moins en moins tenables, comme l'ont montré de récents exemples d'enfants nés par AMP qui ont pu retrouver leur géniteur suite à une analyse génétique. Par ailleurs, l'impossibilité d'avoir accès au dossier médical du donneur empêche d'avoir connaissance d'antécédents familiaux, ce qui peut notamment poser un problème dans des cas de pathologies où les prédispositions héréditaires jouent un rôle particulièrement important. Elle souhaite donc savoir si son ministère envisage une évolution du droit d'accès à ces données pour les enfants nés par AMP avec donneur tiers.

Si le vieillissement a des conséquences sur la qualité de la conduite, aucune évaluation n'est menée pour déterminer les capacités réelles des personnes et limiter ou interdire la conduite notamment de nuit. Cela peut avoir des conséquences dramatiques. Alors que le nombre de conducteurs âgés est amené à augmenter, il faudrait mettre en place des procédures de contrôle. Elle souhaite savoir si une visite médicale obligatoire à des âges définis peut être envisagée.

En 2016, le rôle des comités d'éducation à la santé et à la citoyenneté a été réaffirmé par une circulaire et le parcours éducatif de santé a été mis en place. Elle souhaite savoir quel bilan il peut tirer de ces mesures. Elle souhaite également savoir s'il considère que le volet prévention actuel est suffisant et si les effectifs d'infirmiers scolaires sont en adéquation avec les besoins.

Mme Stéphanie Rist attire l'attention de Mme la secrétaire d'État, auprès du Premier ministre, chargée des personnes handicapées, sur la scolarisation des enfants souffrant de troubles du spectre autistique. De nombreux parents font état de difficultés dans le traitement des dossiers de scolarisation de leurs enfants. D'une part, le temps d'attente de traitement des dossiers par les maisons départementales des personnes handicapées (MDPH) reste relativement long (plus de trois mois) et les familles ne disposent souvent pas d'un conseiller privilégié qui peut les informer de leurs droits. D'autre part, faute de pouvoir bénéficier d'un(e) auxiliaire de vie scolaire (AVS) à plein temps, certains enfants sont redirigés vers les instituts médico-éducatifs (IME), qui manquent de place. Ils sont donc placés en liste d'attente sur lesquelles les parents manquent d'information. L'engagement du Président de la République de généraliser l'accès aux AVS et l'implication de Mme la secrétaire d'État est de nature à apporter des solutions aux familles. En complément, elle souhaite connaître les mesures qu'elle compte mettre en œuvre pour lever les difficultés évoquées ci-dessus et fluidifier la scolarisation des élèves handicapés.

Mme Stéphanie Rist attire l'attention de Mme la secrétaire d'État, auprès du Premier ministre, chargée des personnes handicapées, sur les articles R. 241-1 et R. 231-2 du code de l'action sociale et des familles. En vertu de ces articles, toute personne handicapée dont l'incapacité permanente est au moins égale à 80 % peut bénéficier des services ménagers à son domicile. Pour ce faire, ses ressources ne doivent toutefois pas dépasser 803,20 euros mensuels (hors aides au logement). Or de nombreuses personnes handicapées à 80 % perçoivent l'allocation aux adultes handicapés (AAH) qui est à ce titre de 810,89 euros depuis le 1er avril 2017. Cela signifie que pour 7,69 euros, sauf si le conseil départemental en décide autrement, les allocataires de l'AAH ne peuvent bénéficier des services ménagers à leur domicile. Elle souhaite savoir si elle compte mener une réflexion sur cette situation, notamment dans le cadre la revalorisation de l'AAH.

Dans le cadre de la modernisation de l'action publique, la ministre de l'éducation nationale avait confié en juin 2015 un rapport sur l'évaluation de la médecine scolaire à une équipe constituée de membres de trois inspections (IGAENR, IGEN et IGAS). Sauf erreur, ce rapport n'a pas été remis au cours du quinquennat 2012-2017. Elle souhaite savoir s'il dispose d'informations sur la non-publication de ce rapport et sur les suites qui pourraient y être données.

Mme Stéphanie Rist alerte M. le ministre de l'agriculture et de l'alimentation sur le programme « lait scolaire ». Ce programme consiste en l'octroi d'une aide communautaire pour la distribution de lait et de certains produits laitiers aux élèves dans les établissements scolaires. Ces derniers doivent faire l'objet d'un agrément par FranceAgrimer. Or les mairies concernées ont observé une augmentation des contraintes administratives et une réduction importante de la liste des produits exigibles au programme. À titre d'exemple, des mesures pédagogiques doivent désormais être obligatoirement mises en place, ce qui nécessite des moyens humains (mobilisation du corps en enseignants) et financiers supplémentaires. Face à cette situation, certaines mairies renoncent à demander l'agrément à FranceAgrimer, ce qui est dommageable compte tenu de l'utilité de ce programme pour la filière laitière. Elle souhaite donc connaître les mesures de simplification qu'il pourrait mettre en œuvre.

Lancée en partenariat avec la Fédération nationale des cinémas français (FNCF), les modalités de cette opération ont varié au fil des ans, mais avec un résultat positif pour le cinéma français. Elle souhaite connaître le bilan qu'elle tire de cette Fête du cinéma, qui a fêté son 33ème anniversaire en 2017. Plus précisément, elle souhaite connaître son avis sur la durée actuelle de la fête (quatre jours depuis 2016) et sur l'idée qui consisterait à la prolonger à nouveau quelques jours en juillet, afin que les familles puissent en bénéficier le plus possible.
