Act on Amendments to the Health Insurance Act and the Health Services Organization Act (psychiatry referral, e-consultation and lay doctors)

The draft creates a clearer and more unified legal basis for the use of e-consultation, establishes a requirement for a referral in the specialty of psychiatry, and specifies the basis for the operation of non-specialist doctors. The aim of the changes is to improve the availability of specialist care, make the use of health services more efficient and reduce the administrative burden and the number of unnecessary admissions. Expanding the possibilities of e-consultation supports cooperation between healthcare professionals and allows patients and referring doctors to receive feedback about the need for further treatment or a specialist appointment within a certain period of time. As an important change, going to the psychiatrist's appointment will be done on the basis of a referral. If until now a person could turn to a psychiatrist directly, in the future the patient's condition will first be assessed by a family doctor or a mental health nurse. The Health Insurance Fund pays for the appointment of a psychiatrist only if there is a referral letter. The change the aim is to direct psychiatric help more quickly to those patients who need it the most, and to reduce unjustified referrals to a specialist. In addition, the regulation of non-specialist doctors, i.e. general practitioners, will become more legal. If until now their role in the provision of health care services has been legally unclear and allowed for different interpretations, then according to the amendment, a non-specialist doctor cannot perform activities within the competence of a specialist doctor or can be given such tasks by the healthcare provider. A lay doctor can act only within the limits of his competence and acquired profession. Hospital reporting will also be simplified, as the obligation to submit separate budget data to the Ministry of Social Affairs will be removed - the necessary financial data is already available in the balance data of the Ministry of Finance. This helps reduce duplicative reporting and administrative burden.

Family Benefits Act Amendment Act

The Act on Amendments to the Employment Contracts Act and Amendments to Other Acts Related thereto

Seadust muudetakse, et lihtsustada alaealiste töötamise reegleid ja muuta noorte tööle võtmine paindlikumaks. Eesmärk on anda 7–17-aastastele rohkem võimalu eakohaseks töötamiseks ja varase töökogemuse omandamiseks, kahjustamata seejuures õppimist, mis jääb alaealise peamiseks kohustuseks. Muudatuste jõustumisel saavad 7–17-aastased töötada oma pereettevõttes ilmategevusvaldkonna piiranguteta. Samuti võimaldatakse alaealistel koolivaheaegadel töötada senisest pikemalt, kusjuures iga koolivaheaja kohta sätestatakse eraldi maksimaalne töötamise periood. Lisaks lühendatakse 7–12-aastase alaealise töölevõtmiseks vajaliku Tööinspektsiooni loa menetlustähtaega kümnelt tööpäevalt viiele. Alaealise töötaja iga-aastane põhipuhkus ühtlustatakse täiskasvanute omaga ning see hakkab olema 28 kalendripäeva. Mõttekoja Praxis analüüsi kohaselt jäi 13–16-aastaseid alaealisi palganud tööandjate arv perioodil 2021–2023 vahemikku 2500–2700. Statistikaameti andmetel oli 2023. aastal ettevõtete koguarv ca 156 200. Seega moodustavad alaealisi palganud ettevõtted ca 1,7% kõikidest ettevõtetest. 13–16-aastaseid palganud tööandjatest on 47% kuni 10 töötajaga ettevõtted, 34% on 10–49 töötajaga ettevõtted ning üle 49 töötajaga ettevõtteid on 19%. Kõige suurem osa nendest ettevõtetest tegutseb majutus- ja toitlustusvaldkonnas (25%), järgnevad hulgi- ja jaekaubandus (14%) ning töötlev tööstus (11%). Koolivaheaegadel lubatud töötamise perioodi pikendamine leevendab tööjõupuudust suvisel ajal. Praxise analüüsi tarbeks tehtud intervjuudest tööandjatega selgus, et enamik tööandjaid ongi alaealisi palganud peamiselt suvehooajal.

Act on Supplementing the Act on the Organization of Health Care Services (Implementation of Control Measures)

The draft creates a clear legal basis for the implementation of restraint measures in situations where the patient's condition resulting from a mental disorder or physical illness renders him incapable of making decisions and creates a direct threat to his own or others' life and health. Such situations may arise during the provision of emergency care, emergency care, inpatient specialist care or inpatient nursing care, if the patient's behavior does not allow the continued provision of health care without immediate without interference. Currently, restraints may only be used within involuntary psychiatric treatment, but in practice there is often a need to intervene with patients who are voluntarily receiving treatment or patients who are outside a psychiatric unit, such as in emergency medicine, intensive care or the emergency department. Such a need can be caused, for example, by intoxication, delirium or another condition that changes the patient's behavior unpredictable and dangerous. Creating a clear legal basis is necessary, because restraint measures are an intense infringement of the fundamental right to freedom. The establishment of a legal framework ensures the safety of patients and healthcare professionals, as well as uniform and high-quality treatment, allowing to avoid situations where the legality of an intervention is debatable. Although the implementation of containment measures entails additional monitoring and documentation obligations for health care providers, the new one reduces once the administrative burden in resolving disputes.

Decision of the Riigikogu "Making a proposal to the Government of the Republic to develop measures to alleviate mental health problems arising from children's use of social media"

The bill proposes to the government to develop concrete measures to protect children's well-being and mental health, which prevent and reduce problems arising from the use of social media. According to the draft, the government must ensure that the Consumer Protection and Technical Supervision Agency supervises social media platforms as stipulated in the Digital Services Regulation, which is currently not carried out in Estonia to a large extent. According to the explanatory note, they show studies that excessive screen time, inappropriate content, addictive mechanisms, and privacy threats affect children's mental health, concentration, and overall well-being. There are still no effective measures in Estonia. which would help prevent health problems for children caused by the use of social media.

Act to amend the Social Welfare Act and other Acts

The bill establishes a sign language remote interpretation service and a written translation service as a national service, which has been financed from the funds of the European Social Fund. It also specifies the co-payment of assistive devices and the obligations of care service providers in providing assistive devices in order to increase legal clarity. The changes in the regulation of subsistence allowance make applying for allowance easier and fairer. Changes to subsistence allowance also cover families and employment support and fairer and more transparent organization of compensation for housing costs. In addition, the right to establish the rate of support for a pensioner living alone is given to the minister responsible for the field. In order to calculate the multi-pillar pension, the data components to be transmitted to the social protection information system are specified. Amendments to the Social Tax Act harmonize the rules for the distribution of social tax, ensuring equal treatment for employees with partial or no work capacity in the formation of pension rights. Amendments to the assistive device service, sign language remote translation service and written translation service, support for a pensioner living alone, and the Social Tax Act are planned to enter into force on January 1, 2026. The changes to the subsistence allowance are scheduled to enter into force on April 1, 2027. Family Benefits Act Amendment Act

The bill creates an opportunity for adult patients to prepare a declaration of intent at the end of life available in the health information system (TIS). You cannot request euthanasia with an end-of-life statement. The patient's declaration of will must contain clear instructions in which situations, such as terminal illness or irreversible brain damage, and which health care services are desired, including the option to opt out of all medical interventions.

The Act on Accession to the Optional Protocol to the Convention on the Elimination of All Forms of Discrimination Against Women and Approval of the Amendment to Article 20, Paragraph 1 of the Convention

According to the draft, Estonia joins the optional protocol of the UN Convention on the Elimination of All Forms of Discrimination against Women and approves one amendment to the convention. Estonia joined the convention in 1991. As of November 8, 2024, the Convention has 189 States Parties and is one of the UN Human Rights Conventions with the largest number of States Parties. The Optional Protocol to the Convention was adopted and opened for signature by the United Nations General Assembly on October 6, 1999 with a resolution. The protocol entered into force internationally on December 22, 2000. As of November 8, 2024, 115 countries have ratified or acceded to the protocol. The purpose of the Optional Protocol is to provide additional protection to ensure the principles set forth in the Convention. By joining it, Estonia undertakes to ensure that individuals and their associations have the opportunity to submit to UN Women complaints to the Committee for the Elimination of Discrimination regarding violations of the rights stipulated by the Convention. It also gives the committee the right to initiate an investigation on its own initiative in case of continuous violation of women's rights and to make recommendations to the States Parties to ensure the rights provided for in the Convention and to improve the situation. Joining the Optional Protocol will enhance the achievement of the goals of the Convention, increase the transparency of the requirements of the Convention and supports the promotion of gender equality and the actual implementation of women's rights both in Estonia and internationally. Regarding Estonia, the Optional Protocol will enter into force three months after the date of deposit of the instrument of accession with the UN Secretary General.

The Act on Amendments to the Unemployment Insurance Act and Amendments to Other Acts Related thereto

According to the bill, the payment of unemployment benefits will be stopped. In the future, in case of job loss, the registered unemployed person will be paid either income-based unemployment insurance benefit or the new basic rate unemployment insurance benefit created by the bill. The current unemployment insurance benefit will be renamed income-based unemployment insurance benefit and the conditions for receiving it will not be changed. Unemployment insurance benefit at the basic rate is assigned to a person who is unemployed before being registered worked for at least 8 months during the previous 36 months. Compensation is paid for up to 180 days, and the amount of compensation is the same for everyone, 50% of the minimum salary of the previous calendar year (in 2024, the amount of compensation would be 374.50 euros per month). People who do not meet these requirements can apply for subsistence allowance from the local government. According to the forecast, the costs of the implementation of the law will increase by 2.3 million euros in 2026, because at the same time payments will be made before the unemployment benefits and unemployment insurance benefit at the base rate determined according to the new system. In the years 2027 and 2028, there will be cost savings of approx. 23.2 and approx. 25.3 million euros, respectively. The changes will take effect on January 1, 2026. In addition, the problem raised by the Chancellor of Justice, that the current procedure allows a student up to the age of 24 living separately from his family, to pay subsistence allowance only if his family was awarded subsistence allowance in the previous or current bullet. It is also provided for the possibility to pay subsistence allowance as an exception to students up to the age of 24 who live separately from their families, if their relationships with family members have been broken or the parents lack the ability to support their children. During the procedure, the Social Committee made an amendment proposal to bring the Work Ability Support Act into line with the Constitution. On June 6, 2024, the plenary session discussed the proposal of the Chancellor of Justice, the plenary session supported it proposal of the chancellor of justice, and the social committee was tasked with initiating a draft to bring the work ability support act into line with the constitution. A person can apply for the recalculation of the work capacity allowance if he proves to the unemployment fund that his income exceeds 90 times the daily rate because he has been paid in one calendar month both the salary of the previous month and the salary earned in the same month due to the termination of the employment contract, but not yet paid. In order to recalculate the work capacity allowance, an application and employer's certificate must be submitted to the unemployment fund, where you can see the received fees and the type of fees, and an extract from the employment contract, where you can see the agreed time of receiving the salary.

Eesti pikaajalise hoolduse korraldamise süsteem vajab kiiremas korras põhimõttelisi muudatusi, mis vähendaks pereliikmete hoolduskoormust ning tagaks hooldusvajadusega inimestele vajadustele vastava abi.

Ametiühingute seaduse, Eestisse lähetatud töötajate töötingimuste seaduse ja teiste seaduste muutmise seadus

Eelnõuga kehtestatakse meetmed lähetatud töötajate õiguste paremaks kaitsmiseks. Täpsustatakse, et lähetatud renditöötaja, kelle kasutajaettevõtja teenuseid pakkudes edasi lähetab, on samuti lähetatud töötaja. Muudetakse töötingimusi, mida lähetatud töötajale Eestis viibimise ajal tagada tuleb. Töötasu alammäära asemel tuleb eelnõu kohaselt töötajale tagada töötasu ning lisaks tuleb hüvitada lähetusega seotud kulud. Kehtestatakse pikaajalise lähetuse regulatsioon, mille kohaselt tuleb lähetatud töötajale pärast 12 või 18 kuud Eestis töötamist seaduses loetletud minimaalsete töötingimuste asemel hakata kohaldama kogu Eesti tööõigust. Eelnõu sisaldab ka sätet, mille kohaselt peab järelevalveorgan tuvastatud rikkumiste eest karistust määrates arvestama sellega, kas informatsioon Eestisse lähetatud töötajate töötingimuste kohta on ühtsel veebilehel olemas või mitte. Eelnõuga kaotatakse piirang, mille kohaselt saab teenuse Eesti-poolne tellija olla vaid Eesti resident. Eelnõu kohaselt on oluline see, et tellija tegutseks Eestis. Tööandjale kehtestatakse selge kohustus lähetatutud töötajate kohta esitatud teavet ajakohasena hoida. Tööinspektsioonile tuleb teatada ka lähetatud töötaja isikut tõendava dokumendi number. Eelnõuga lühendatakse seitsmelt aastalt kolmele perioodi, mille jooksul peale lähetuse lõppu on Tööinspektsioonil õigus lähetuse kohta järelevalveks vajalikke dokumente nõuda. Ühtlustatakse väärtegude trahvimäärad, mille tulemusena on mõlema väärteo puhul füüsilise isiku maksimaalne trahvimäär 300 trahviühikut ja juriidilise isiku trahvimäär 32 000 eurot.

Sotsiaalhoolekande seaduse, puuetega inimeste sotsiaaltoetuste seaduse ning tööturuteenuste ja -toetuste seaduse muutmise seadus

Eelnõu olulisemad muudatused puudutavad sotsiaalse rehabilitatsiooni teenust, erihoolekandeteenuseid, turvakoduteenust, asendus- ja järelhooldusteenust. Sotsiaalse rehabilitatsiooni teenuse muudatustega nähakse esmasesse psühhoosi haigestunud inimestele ette võimalus saada rehabilitatsiooniravi ravimeeskonna hinnangul väljaspool rehabilitatsioonijärjekorda. Muudatus on vajalik, kuna pakub esmasesse psühhoosi haigestunutele õigeaegset ja katkematut tuge ning paremat taastumist. Muudatused kavandatakse jõustada 1. jaanuaril 2021. Eelnõuga luuakse paindlikkus, mis võimaldab laste huvidest lähtuvalt suurendada asendus- ja perekodu pere maksimaalset (kuuelapselist) suurust. Erandi tegemine on põhjendatud kui asendushooldust vajavad näiteks ühe perekonna lapsed, keda võib olla rohkem kui kuus. Järelhooldusteenuse puhul laiendatakse kohalike omavalitsuste võimalusi järelhooldusel viibivate noorte teenuse rahastamiseks toetusfondi vahenditest. Muudatus võimaldab kohalikel omavalitsustel edaspidi toetusfondi vahendite arvelt toetada näiteks noori, kes õpingute katkestamise järgselt asuvad uuesti õppima. Muudatused kavandatakse jõustada üldises korras. Puuetega inimeste sotsiaaltoetuste seaduse muudatusega antakse sotsiaalkindlustusameti ekspertarstile võimalus tuvastada inimese puue ja puude raskusaste tööealistel inimestel terviseandmete alusel. Praegu peab taotleja puude raskusastme tuvastamiseks ise kirjeldama piirangute esinemist tegutsemisvaldkondade kaupa. Samuti võimaldatakse eelnõu kohaselt tuvastada muutumatu või progresseeruva püsiva seisundiga raske ja sügava puudega lastel puude raskusastme kestus kuni tööealiseks saamiseni. Praegu määratakse puue olenevalt raskusastmest üheks kuni kolmeks aastaks. Muudatus kavandatakse jõustada 1. aprillil 2020. Tööturuteenuste ja -toetuste seaduse muudatus annab Eesti Töötukassale võimaluse töötu isiklikult vastuvõtule kutsumise asemel nõustada teda telefoni (sh Skype) teel või e-töötukassa kaudu. Seni on see olnud võimalik kui töötu on haige, erivajadusega või osaleb samal ajal tööturuteenuses.

Narkootiliste ja psühhotroopsete ainete ning nende lähteainete seaduse ja tervishoiuteenuste korraldamise seaduse muutmise seadus

Eelnõuga luuakse võimalused Tervise Arengu Instituudi (TAI) juures tegutseva riikliku narkomaaniaraviregistri (NARIS) andmete omavaheliseks seostamiseks. Eesmärk on registrite (rahvastikuregister, tuberkuloosiregister, nakkushaiguste infosüsteem ja surma põhjuste register) omavaheline sidumine. Muudatused annavad võimaluse tagada andmete korrektsus ning võimalus neid isikustamise kaudu omavahel seostada. See omakorda tagab tõhusama ravi ja kiirema suhtluse arsti ja patsiendi vahel. Korrastatud ja omavahel seotud registriandmed võimaldavad saada ka tervikpildi haiguse levikust Eestis ning saada adekvaatset statistikat teenuse mahtude prognoosimisel. Praegu sisestatakse andmed NARISesse selliselt, et patsiendi isikut ei ole võimalik tuvastada. Selleks kodeeritakse narkomaaniaravi alustamisel ja lõpetamisel patsiendi isikukood unikaalse NARIS-e koodiga, mis seotakse konkreetse ravijuhu andmetega (st andmed ei ole andmekogus isikustatud). Teenuse osutaja jaoks on patsient alati isikustatud ravijuhu alguses ka juba praegu, kuid NARIS-es need andmed ei kajastu. Edaspidi hakatakse NARIS-sse andmeid sisestama iga narkomaaniaravi juhtumi kohta isikustatult. Teiste registrite puhul tehakse seda juba praegu. Näiteks sisestatakse patsiendi andmed isikustatult tuberkuloosiregistrisse. Eelnõuga kavandatud muudatuste tõttu tõstetakse NARIS-e turvaklassi ja nähakse ette juhud, millal on õigus teistele isikutele andmeid väljastada. Muudatus ei puuduta narkomaaniaravi pakkuvaid teenuse osutajaid. Kuna NARISe teatistele lisanduvad täiendavad andmeväljad, mis sisaldavad isikuandmeid, võib muutuda vaid Tervise Arengu Instituudi töötajate töökorraldus.
