Après l’article 227‑17‑2 du code pénal, il est inséré un article 227‑17‑3 ainsi rédigé : « Art. 227‑17‑3 . – Lorsqu’un mineur est condamné pour une infraction relevant des articles 222‑34 à 222‑40 du code pénal, ses parents ou responsables légaux peuvent être condamnés à une peine pouvant aller jusqu’à deux ans d’emprisonnement et 30 000 euros d’amende, s’il est établi qu’ils ont délibérément facilité, encouragé ou négligé gravement l’éducation et la surveillance de leur enfant, entraînant directement sa participation aux faits incriminés. »
