Après l’alinéa 5, insérer l’alinéa suivant : « Le droit de préemption institué au profit des établissements publics de coopération intercommunale mentionné au premier alinéa ne peut s’exercer qu’en l’absence d’exercice préalable respectivement des droits de préemption reconnus en application des articles L. 412‑5 et L. 143‑1 du présent code. »
