Summary

Après le premier alinéa de l’article L. 480‑5 du code de l’urbanisme, il est inséré un alinéa ainsi rédigé : « Le prononcé de mesures de mise en conformité, de démolition ou de réaffectation des sols visant des constructions qui sont le support d’activités économiques ne peut intervenir qu’après que le Tribunal ait exercé un contrôle de proportionnalité entre l’intérêt général de protection poursuivi d’une part, et d’autre part l’intérêt économique que représente la structure notamment en termes d’emploi, et l’atteinte au droit de propriété privé constituée par la mesure. »
