L’article 122‑1 du code pénal est complété par un alinéa ainsi rédigé : « Toute personne poursuivie pour une infraction mentionnée aux chapitres I et II du titre II du livre II du présent code commise sur son conjoint, son concubin ou son partenaire lié par un pacte civil de solidarité ne peut se prévaloir d’un trouble psychique lorsque celui-ci résulte d’une faute antérieure de sa part. »
