Summary

Après le III de la section V du chapitre premier du titre premier de la première partie du livre premier, il est inséré un III bis ainsi rédigé : « III bis : Déchéance des droits à perception de certains avantages fiscaux « Art. 200‑0 B. – I. – Les personnes morales qui ont fait l’objet d’une condamnation définitive pour l’une des infractions prévues aux articles 1729 A bis et 1741 du code général des impôts sont inéligibles à l’un des avantages fiscaux suivants : « 1° Les allègements d’imposition prévus aux articles 44 octies A, 44 terdecies , 44 quaterdecies , 44 quindecies du présent code ; « 2° Les crédits d’impôts prévus aux articles 244 quater B, 244 quater C du présent code ; « 3° Les réductions d’impôts prévus à l’article 238 bis du présent code. » « II. – L’inéligibilité à l’un des avantages fiscaux énumérés au I est automatique et porte pour une durée de 10 ans à compter de la condamnation définitive. « III. – Un décret fixe les modalités d’application du présent article. »
