Summary

I. – Après le mot : « service », rédiger ainsi la fin de l’alinéa 2 : « , exclusivement parmi les personnels non grévistes et interdit le recours à des personnels externes ou contractuels pour remplacer des salariés en grève. » II. – Substituer aux alinéas 4 à 8 les trois alinéas suivants : « Art. L. 1222‑7‑1 . – En cas de grève, le niveau minimal de service doit être assuré uniquement par les personnels non grévistes appartenant à l’entreprise. Il est interdit de réquisitionner les salariés en grève ou de recourir à des personnes externes, y compris par le biais de contrats temporaires ou de réservistes, pour remplacer les grévistes. » « Art. L. 1222‑7‑2 . – L’entreprise de transport est tenue de respecter strictement l’interdiction de réquisition des grévistes et du recours à des personnels externes. Toute infraction à cette règle est passible de sanctions disciplinaires et administratives. » « Art. L. 1222‑7‑3 . – Les personnels non grévistes affectés au service minimal doivent être informés au moins vingt‑quatre heures avant le début de leur prise de service, conformément aux dispositions de sécurité et d’organisation de l’entreprise. »
