The Law on Amendments to the Electricity Market Act and other laws

The bill takes over the changes made by the EU directive to improve the organization of the electricity market. The goal of improving the organization of the internal electricity market is a well-integrated energy market that allows member states to benefit economically from the single energy market under all market conditions, also ensures security of supply and supports the reduction of CO2 emissions in order to achieve the Union's climate neutrality goal. The background of the energy crisis is the current organization of the electricity market highlighted various bottlenecks related to the impact of high and volatile fossil fuel prices in short-term electricity markets, forcing households and businesses to face price spikes and their impact on electricity bills. The proposed changes in the bill ensure that consumers are protected from energy price crises and from disconnection from the network during the settlement of out-of-court proceedings. Network connection the possibility for users to enter into a flexible connection agreement in areas where the capacity of the electricity network for new connections is limited also offers the network operator a solution for the development of scattered settlements, ensuring that the priority is to strengthen the planned network. Nuclear Energy and Safety Act

Seaduse väljatöötamise eesmärk on luua Eestis terviklik õiguslik raamistik tuumaenergia rahumeelseks kasutamiseks ning tagada kõrge ohutustase kogu tuumaenergia kasutamise protsessi vältel. Eelnõu reguleerib tuumakäitiste kogu elukaart alates planeerimisest ja ehitamisest kuni käitamise, kasutusest kõrvaldamise ning tuumajäätmete lõppladustamiseni, samuti tuumamaterjali käitlemist ja transporti. Eelnõu seab piirangu tehnoloogia valikule, lubades kasutada vaid juba praktikas tõestatud lahendusi. Eelnõuga kehtestatakse tuumaohutusloa süsteem, riiklik järelevalve ning tarbijakaitse ja tehnilise järelevalve ameti roll sõltumatu regulaatorina. Eelnõus kehtestatakse ka põhimõte, et tuumajaama rajaja ja käitaja kannab täielikku vastutust rajatise ohutuse ning selle elukaare lõpus tekkivate kulude eest. Tuumajaama kasutusest kõrvaldamiseks luuakse riiklik dekomissioneerimisfond, kuhu käitaja kogub jaama tööajal raha jaama lammutamiseks ja jäätmete lõppladustamiseks. Eelnõu sätestab ka tuumajulgeoleku, füüsilise kaitse, hädaolukordadeks valmisoleku ning rahvusvaheliste kontrollimeetmete rakendamise põhimõtted. Lisaks reguleeritakse tuumajäätmete ja kasutatud tuumkütuse käitlemist, lõppladustamist ning nende kulude katmiseks vajalikke finantsmehhanisme. Eelnõuga täidetakse senised õiguslikud lüngad ning viiakse Eesti regulatsioon vastavusse ELi õiguse ja IAEA standarditega.

Eesmärk on parandada ülevaadet ja ligipääsu elektri- ja muude alternatiivkütuste laadimis- ja tankimistaristule ning muuta roheenergial põhinev liikumine lihtsamaks ja kindlamaks kogu Euroopa Liidus. Seaduse muutmine võimaldab luua tervikliku ülevaate elektri- ja muude alternatiivkütuste laadimis- ja tankimispunktide asukohtadest ning nende kättesaadavusest, sealhulgas sellest, kas laadijad on parasjagu vabad. See parandab tarbijate võimalusi oma liikumist planeerida ja toetab liikuvusteenuste ja digilahenduste arengut. Muudatused puudutavad laadimis- ja tankimistaristu käitajaid ning digiteenuste pakkujaid, kes koondavad ja kuvavad tarbijatele liikumisinfot. Mõju avaldub eelkõige suurematele energia- ja kütuseettevõtetele ning taristu käitajatele, sealhulgas Enefitile, Eleportile, Alexelale, Elektrumile, Terminalile, Nestele, Ignitisele ja Circle K-le. Neil tekib kohustus teha taristuandmed standardiseeritult kättesaadavaks, mis suurendab mõningal määral halduskoormust, kuid parandab teenuste kvaliteeti ja andmete usaldusväärsust. Pädevaks asutuseks määratakse Transpordiamet ning riiklikuks juurdepääsupunktiks kavandatakse Eesti teabevärav. Riikliku juurdepääsupunkti funktsiooni loomist rahastatakse Eesti taaste- ja vastupidavuskava andmehalduse reformi raames. Tasakaalustamaks mõningast halduskoormuse suurenemist muudetakse autoveoseadust, edendades e-asjaajamist.

Traffic Act Amendment Act

Seadust muudetakse, et Eesti põhimaanteedel saaks kasutada pikemaid ja raskemaid autoronge. Praegu sõidavad Eesti teedel valdavalt kuni 18,75 meetri pikkused ja 44 tonni rasked autorongid. Uue korra järgi saaks eriloa alusel kasutada kuni 25,25 meetri pikkuseid ja 60 tonni raskeid autoronge. Muudatuse mõte on vedada ühe sõiduga rohkem kaupa. Kaks 25,25 meetri pikkust autorongi veaks sama koguse kaupa, mille vedamiseks oleks muidu vaja kolme tavapärast poolhaagisega veokit. See võib vähendada ettevõtete veokulusid, liikluskoormust maanteedel ja transpordi keskkonnamõju. Pikemad autorongid oleksid lubatud ainult eriloaga ja kindlatel marsruutidel, kus möödasõiduks on hea nähtavus. Peamiselt puudutab see Tallinna–Tartu–Luhamaa, Tallinna–Narva ja Tallinna–Pärnu–Ikla põhimaanteed. Kasutuselevõtt on kavandatud järk-järgult, et liiklejad saaksid uue lahendusega harjuda. Eriloa tingimustes nähakse ette täiendavad tehnilised nõuded, mis puudutavad sõiduki tähistamist, võimsust, rehve ja keskkonnanorme. Loa andjal on võimalus kehtestada ka ajapiiranguid.

An Act to amend the Electricity Market Act, the Alcohol, Tobacco, Fuel and Electricity Excise Act and the Income Tax Act

The law is amended to reduce the renewable energy fee for energy-intensive companies and to improve the competitiveness of the Estonian industrial sector and encourage investments. Energy is one of the biggest costs of many industrial companies, and the price drop helps to make the products of Estonian companies more competitive in both domestic and foreign markets. According to the amendment, from January 1, 2026, companies with annual electricity consumption exceeding 1 GWh can pay renewable energy fee at a lower rate than before. There are approximately 80 such companies in Estonia. Depending on the sector, the discount reaches 75–85 percent, which means an average of 6.8 euros less per MWh consumed. The biggest impact is on the wood and paper industry, the food industry and the chemical industry. The discount applies retroactively, the reimbursement is made through Elering and it is related to the conditions: the company must use energy management systems or audits, and the discount will gradually be linked to the existence of long-term direct renewable energy contracts. This ensures that the support reaches only those companies that systematically improve energy efficiency and reduce emissions. The annual cost of the measure is approximately 9 million euros, it is covered from the state budget, and the deficit in the renewable energy fee is compensated from the revenues of the EU greenhouse gas trading system. Change does not lead to an increase in the fee for renewable energy for other consumers. The implementation of the bill requires the European Commission's state aid permit.

Public Transport Act Amendment Act

The bill consolidates the data of economic activities with special requirements into one register in order to ensure more efficient data management, reduce administrative costs and security risks. For this purpose, the processing and issuing of requests for attendant cards and their management (data structure) will be transferred from the National Public Transport Register (ÜTRIS) to the Register of Economic Activities (MTR). Hosting the data structure in ÜTRIS poses serious security risks to the Transport Board, as the system is outdated and unmaintained. The continued hosting of outdated and unmaintained data composition also threatens other systems in use by the Transport Authority, which are located in the same cluster. Therefore, the public display of service cards in the current way will end. Currently, service cards are applied for and processed in MTR, but physical cards are issued, managed and published in ÜTRIS. It was also possible to find issued service cards in ÜTRIS. Such fragmentation increases the administrative and work load of both the state and entrepreneurs. As a result of the change, the application, issuance and record keeping of attendant cards will be transferred to the MTR. This reduces duplicate management of registers, improves data security and simplifies administration for both the state and companies. The change will reduce the administrative burden on entrepreneurs.

Decision of the Riigikogu "Making a proposal to the Government of the Republic to develop a plan for increasing competition in the mobile communications market and accelerating number mobility"

According to the statistics of the Consumer Protection and Technical Supervision Agency, more than 50% of mobile number porting initiatives were discontinued in 2024, which suggests that existing telecommunications companies will only offer discounts when the customer wants to leave. Such practice suggests that many loyal customers pay more for services than new subscribers or those who express a desire to change operators. It is a phenomenon that damages the principles of fair and effective competition. Making number portability faster - preferably in real time or at least within one business day - allows consumers to easily and quickly switch service providers, which creates real price pressure and a fairer competitive environment.

Act on Supplementing the Traffic Insurance Act (Insurance of motor vehicles)

The purpose of the bill is to ensure that light vehicles participating in traffic through the use service have equal conditions and are all insured, because they participate in traffic significantly more often (e.g. compared to a light vehicle in private use) and therefore the risks associated with it are also greater. The current traffic insurance law stipulates in § 4 subsection 1 point 5 mandatory traffic insurance for vehicles with a speed exceeding 25 kilometers per hour or with a design speed exceeding 14 kilometers and a mass exceeding 25 kilograms. The explanatory letter states that such a criterion has created a situation where Bolt electric scooters, which weigh 24 kg, are not covered by the insurance obligation of the market's largest rental company. At the same time, the second largest rental company Tuul Mobility, whose scooters weigh more than 25 kg, must insure the rental scooters. This draft will be done a proposal to include a provision in the law according to which the obligation to insure all kinds of motor vehicles arises for persons who own more than ten motor vehicles for rent used in traffic.

Act on Amendments to the Energy Economy Organization Act

The bill amends the law, according to which renewable energy will make up at least 42 percent of the total domestic final energy consumption by 2030. Renewable energy accounts for at least 40 percent of the total final consumption of electricity and at least 63 percent of the total final consumption of heat. Renewable energy used in road and rail transport accounts for at least 14 percent of the total energy consumed in the transport sector. The bill is related to frequency reserve and island operation. Amending the law has two central goals, firstly, the service of island functionality must be ensured, and secondly, the relevant directive must be adopted and the shortcomings of its adoption up to now have to be eliminated. The bill eliminates double taxation of electricity storage and establishes a separate metering point for this storage. The regulation of aggregation and consumption echo is improved, which increases the flexibility of consumption. The procedure for financing the cost of obtaining balancing capacity is established. The principle of net metering is introduced during the trading period when presenting invoices to consumers. As an important innovation, the regulation of the service of guaranteeing island functionality will be created, which will allow from 2026 to maintain the necessary amount of power generation capacity to maintain the stability of the Estonian electricity system. Without the measure, there would be a risk that from 2026 there would not be enough production capacity available. The system manager, i.e. the grid operator Elering AS, analyzes and assesses whether there is enough power generation capacity available at any given time to cope with the island operation situation. Elering AS has estimated that the minimum need for controllable power in the Estonian electricity system is approx. 1000 MW. With the support of the service for ensuring the islanding capability, Estonia would have the independent ability of the electricity system to cope with the situation if we were to end up in islanding. Only the capacities located on the territory of Estonia are able to ensure the independent operation of the electricity system in the situation of island operation. Until now, oil shale power plants have maintained the necessary controllable capacity, but due to the decrease in the competitiveness of oil shale energy, oil shale power plants do not earn enough from the electricity market for the owner to keep them on the market in the future. The estimated cost of procuring the island capability service is in the order of 34 million euros per year, which leads to an estimated increase in electricity bills for consumers by about 2.4% (0.42 cents per kilowatt-hour). In order to ensure the service of guaranteeing island functionality, the system manager Elering AS carries out public procurement, which is technology-neutral in nature and all Estonian electricity producers who meet the conditions can bid for it. Elering AS plans to submit the technical conditions and procurement principles to public consultation in 2025. during May-June, and the public procurement is estimated to take place in the period August-October. The conditions are coordinated by the Competition Authority. The main condition is that the power producer must be able to provide production capacity for ten consecutive days in the situation of island operation.

In order to fulfill the renewable energy goals adopted by Estonia, it is necessary to develop and strengthen the Estonian electricity grid so that new wind and solar farms can be added to it. The bill changes the concept of the connection fee established in the Electricity Market Act in such a way that half of the connection costs of producers wishing to connect to the existing electricity network are covered by electricity consumers and the other half by those connecting to the network, and a separate fixed price list. The explanatory letter states that this enables potential producers and consumers to better forecast the costs associated with connecting to the electricity grid. In places where there is no existing electricity grid, the cost-based connection fee will still apply. Secondly, with the changes made in the draft, the scope of the development obligation for the main grid operator (Elering AS), but also for other electricity grid operators, is expanded, which allows above all, to make prudent and prudent investments in the main grid in order to meet the goal of 100% renewable electricity adopted by the Estonian state by 2030. Thirdly, in order to encourage optimal network use, the provisions related to the implementation of the network underutilization fee are specified with the proposed legal amendments, and in certain cases it is possible to change the previously requested electricity production technology if this is accompanied by a more efficient electricity network usage. As electricity prices fall with the growth of renewable electricity consumption, and investments strengthen the electricity grid and replace outdated lines, the changes will have a positive effect on electricity consumers.

Competition Act Amendment Act

The bill creates a solution that enables the application of EU block exemptions in domestic competition law as well. Block exemptions are one of the most used EU competition law tools. Block exemptions cover a large number of contract types that are widespread in commercial activities and which, despite the presence of anti-competitive provisions, have a positive effect on consumers and the economy. Block exemptions are developed and established at the EU level by the European Commission and they apply to Estonian companies if their agreements have an impact on trade between member states. In the case of the proposed solution, it is a so-called hybrid solution, where on the one hand the EU block exemptions become essentially directly applicable in national competition law, but on the other hand, the possibility is still left within the country to review these block exemptions in advance and to confirm by ministerial regulation that these block exemptions are indeed suitable and necessary for the Estonian legal system. There is also the possibility to introduce group exemptions within the country, if necessary. The latter can be done by government regulation. The offered solution allows to ensure legal certainty and effective competition supervision, while reducing the administrative and bureaucratic burden. It also helps to increase the legal certainty of entrepreneurs and save costs related to legal advice. Enhanced regulation no affect the current competitive situation. In Estonia, there is currently one group exemption regarding vertical agreements established by government regulation. As a result of the change, a total of six group exemptions will be valid in Estonia, two of which: group exemptions concerning railway, road and inland water transport and technology transfer agreements, had not yet been adopted into Estonian law. The law is planned to enter into force in a general manner.

Act on Amendments to the Traffic Act and the Police and Border Guard Act

The law is being amended to increase road safety, especially the safety of less protected road users, and clearer rules for the use of electric shocks will also be created. According to the bill, the parking rules for electric scooters will be stipulated. In the future, scooters must be parked parallel to the edge of the sidewalk, if possible no further than 20 cm. At least 1.5 meters wide part of the road must remain free for other road users. The local government gets the right limit the speed of the pushchairs in places where it is necessary, for example near kindergartens or on streets with heavy traffic. In order to increase safety, a motor vehicle must keep a side gap of 1.5 m when passing a rider, scooter or mini-moped driver. In order to ensure traffic safety, the maximum permitted alcohol limit for drivers of light vehicles, cyclists and mopeds is established, which is 0.5 per milliliter or 0.25 milligrams of alcohol in one liter in exhaled air. Until now, the police had to make a subjective assessment during the check, whether it was a case of intoxication or not. A clear limit will make it easier to maintain public order in the future and give everyone the opportunity to assess their own situation. Changes will also be made to the stopping of motor vehicles on the sidewalk, in the future it may only be done if a traffic sign permits it. Until now, the principle was that you could stop on the sidewalk to load goods with a motor vehicle, even if there are no prerequisites for this in terms of traffic management. Local government, land owner, company or, for example, an apartment association can organize loading and parking places for loading goods marked with the corresponding traffic management tool. In order to influence parking violators, the maximum fines related to violations of stopping and parking requirements will also increase - from 40 euros to 80 euros in the general procedure and in written in the warning procedure from 20 euros to 40 euros. If the violation is dangerous for other road users or significantly disturbs the traffic, the penalty rate increases from 40 euros to 60 euros in the summary procedure, and a fine of 60 euros is set in the written warning procedure. In addition, the bill makes an amendment that terminates the database of the automatic traffic monitoring system and transfers its data to the police database POLIS. The law is planned to enter into force in general in order, with the exception of the changes concerning the prohibition of motor vehicles stopping on the sidewalk and keeping a 1.5-meter side distance, are planned to be enforced from 2025. This way, road users have time to adapt to the requirements; also, local governments, companies and, for example, apartment associations can organize a stop to load goods, and state authorities can make the necessary notification.

The Act on Amendments to the Traffic Insurance Act and Amendments to Other Acts Related to It

With the changes, the amendments of the European Union Road Insurance Directive, the deadline for adoption of which was 23.12.2023, will be adopted into Estonian law. On January 24 this year, the European Commission initiated infringement proceedings against Estonia for untimely transposition of the directive. The directive does not bring major changes, as the traffic insurance system has worked well both in Estonia and in Europe in general. The basic essence of insurance remains the same: first, it protects the victim, who was involved in an accident and who receives compensation from motor insurance. On the other hand, the culprit himself, for whom the insurer compensates the victim. When the law enters into force, road insurance will also cover parts of light scooters, among others, for example, electric scooters with a speed of over 25 kilometers per hour or over 14 kilometers per hour if the vehicle weighs more than 25 kilos. In order to understand more easily whether the vehicle is subject to mandatory traffic insurance or not, the Eesti Liikluskindlustus Fund plans to make the corresponding help material for the web. If an insurance company goes bankrupt, the directive stipulates that there must be a guarantee fund in each member state, which in such case compensates for the losses. In Estonia, this will be the Estonian Traffic Insurance Fund, which collects funds from insurance companies to cover insolvency. By changing the law, the maximum amount of insurance that can be reimbursed will also be increased limits: in case of material damage from 1.2 million to 1.3 million euros and in case of personal damage from 5.6 million to 6.45 million euros. As technical changes, a uniform EU-wide form for proof of loss history is provided, which may be necessary in cases where a person changes insurance company or country of residence and wants to prove his previous loss history. In Estonia, the corresponding confirmations are issued by the Estonian Traffic Insurance Fund. The bill affects more or less that way insurance companies offering traffic insurance and brokers of insurance contracts; vehicle owners who are required to insure their liability; traffic accident victims and the activities of the Estonian Traffic Insurance Fund. The impact is related, for example, to the fact that certain types of light vehicles must also be insured, in case of more serious accidents, an increase in the insurance sums may have an impact.

With the bill, the EU directive is adopted into Estonian law, the purpose of which is to create competition supervision that functions throughout the European Union. The competition supervision procedure helps to create and maintain a free market, which encourages innovation and makes companies more competitive in foreign markets. The purpose of amending the Competition Act is to strengthen competition supervision in order to ensure a fairer price, higher quality and wider merchandise selection. Competition supervision would be carried out in all member states on the same basis and with similar investigation methods, which would increase the transparency of the field and increase the ability to process violations across member states as well. The deadline for the transposition of the EU directive, which is the basis of the bill, was February 4, 2021. To date, the European Commission has filed a lawsuit against Estonia in the European Court of Justice regarding the non-transposition of the directive. The most important part of changing the law is establishing a comprehensive regulation of the competition supervision procedure. The Competition Authority will be the executor of the competition supervision procedure. The new procedure will help the Competition Authority to perform better supervision, as its investigative measures have been developed specifically to investigate competition law violations. If a violation of competition law is detected, the company or association of companies that committed it may be fined up to 10 percent of the company or from the global total turnover of the association of entrepreneurs in the financial year preceding the application of the fine. Procedural actions typical of criminal proceedings, such as surveillance and detention, cannot be used in competition supervision proceedings.

An Act to amend the Precious Metal Products Act, the State Duties Act and the Equipment Safety Act

The bill removes restrictions on manufacturers, importers and sellers of gold and silver products that have become unreasonable today. Manufacturers and importers of precious metal products must put their name tag on the product, which must be registered in the national name tag register. The bill enables the electronic submission of name tag data, and the validity of this registration is extended from one to ten years. Physical ones are also eliminated sample submission requirement. The volume of data to be provided on the sales document is also reduced, for example the product weight is no longer mandatory. The bill repeals restrictions on the retail sale of precious metal products. The explanatory letter states that currently, for example, precious metal watches and gold jewelry may not be sold in street trade, markets, door-to-door sales, public events or kiosks, in the future this will be allowed. The current ban no longer justifies itself in practice, because compared to 20 years ago, consumer protection law has further developed and, among other things, the regulation of unfair trading practices has been established, which protects the consumer's purchase transactions more broadly. The state fee for the payment of a name tag will be increased from 20 to 30 euros, and the rate of extortion from 2004 will be increased from 640 to 9,600 euros. The registration of name tags will be transferred from AS Metrosert to TTJA, which has better technical capacity and also substantive competence. Technical ones are made also changes in the Equipment Safety Act, where from now on the entrepreneur must also add a confirmation from a competent person when submitting an economic activity notice of equipment work, where the person confirms that he is aware of his association with the entrepreneur and is responsible for performing equipment work in the company.

The Act on Amendments to the Energy Economy Organization Act, the Electricity Market Act and the Environmental Impact Assessment and Environmental Management System Act

The bill establishes a framework for accelerating the deployment of renewable energy. More specifically, Estonian law stipulates the possibility for accelerated construction of renewable energy projects of overwhelming public interest arising from the corresponding regulation of the European Union. Criteria are set under which conditions the environmental impact assessment can be omitted. At the same time, a system of mitigation and compensation measures for natural values ​​will be created for renewable energy projects. Overwhelming public projects of energy sources determined by the National Energy and Climate Plan 2030, such as wind energy, solar energy, heat pump and biomethane production projects, are considered renewable energy projects with interest. In the case of the mentioned projects, it is possible to make exceptions from the Nature Directive, the Birds Directive and the Water Policy Framework Directive. Overriding public interest is applicable only during project planning and the activity permit procedure. Overwhelming public the renewable energy project of interest must be located outside the NATURA 2000 network and must not harm protected species. In order to resolve the infringement procedure initiated by the European Commission, the law specifies the content of the environmental impact assessment program and report disclosure notice.

Energiamajanduse korralduse seaduse ja teiste seaduste muutmise seadus

Eelnõuga võetakse üle ELi vastavast direktiivist tulenevad taastuvenergia edendamist soodustavad põhimõtted ja kohustused, mis aitavad saavutada Euroopa Liidu energiapoliitika eesmärki suurendada säästliku ja taastuva energia kasutamist. Muu hulgas seatakse direktiivis liikmesriikidele kohustuslikud ühtsed põhimõtted üld- ja alameesmärkide täitmiseks ja toetuste maksmiseks. Valdav osa direktiivist on üle võetud energiamajanduse korralduse seadusega 4. mail 2022. Euroopa Komisjoni põhjendatud arvamusele tuginedes sätestatakse eelnõus direktiivist tulenevad lisatingimused, mille alusel arvestatakse toodetud energia taastuvenergiaks ja makstakse toetusi. Lisaks tuuakse eelnõuga seadusesse täpsed terminid, mis tähistavad taastuvenergia tootmise, tarbimise või tarnimisega seotud mõisteid.

Elektrituruseaduse ja teiste seaduste muutmise seadus (universaalteenuse lõpetamine ja varustuskindluse tagamine)

Eelnõuga muudetakse elektrituruseadust, elektrituruseaduse ja konkurentsiseaduse muutmise seadust, maagaasiseadust ja maksukorralduse seadust. Seaduse muutmisega nähakse ette universaalteenuse lõpetamine alates 2024. aasta maist ning luuakse õiguslik regulatsioon elektrienergia reservvõimsuse mehhanismi kasutusele võtmiseks. Lisaks arvatakse seaduse muutmisega strateegilise gaasivaru varumakse hulka ka LNG haalamiskai ja taristuga seotud halduskulud, et suurendada Eesti varustuskindlust maagaasiga. Ühtlasi sätestatakse, et hädaolukorras peab võrguettevõtja edastama tarbijale gaasi sama hinnaga, mis see strateegilisest varust soetati. Konkurentsiametil on tehtavate muudatuste tulemusel õigus alustada väärteomenetlust, kui selgub, et müüja on müünud strateegilisest gaasivarust soetatud gaasi tarbijale edasi selle soetushinnast kõrgema hinnaga.

Ehitusseadustiku ja teiste seaduste muutmise seadus (taastuvenergia kasutuselevõtu kiirendamine)

Eelnõuga luuakse uue loa liigina meretuulepargi hoonestusluba. Muudatustega koondatakse seni kolme erineva loamenetluse (hoonestusluba, vee erikasutuse keskkonnaluba ehk veeluba ja ehitusluba) nõuded üheks meretuulepargi hoonestusloa taotlemiseks. Kolme senise loamenetluse liitmisel tekkiv meretuulepargi hoonestusloa taotlemine on mahukam kui seni iga menetlus eraldi, ent see on kiirem, kuna dokumentide esitamist ja eri toiminguid on kokkuvõttes vähem. Meretuulepargi hoonestusloa saamine annab õiguse alustada tuulepargi ehitusega ja selleks vajaliku vee erikasutusega. Edaspidi väljastatakse vaid üks haldusakt, mis vähendab ka kohtuvaidluste arvu. Taastuvenergia projektid mõjutavad keskkonda ja seetõttu on projektide läbi töötamisel oluline roll keskkonnamõju hindamisel (KMH). Eelnõu järgi viiakse mitu seni üksteisele järgnenud KMH tegevust samaaegseks, mis vähendab nendele kuluvat aega. Samuti luuakse eelnõuga erisus ELi otsekohalduva taastuvenergia arendamise kiirendamise määrusega ettenähtud tuule- või päikeseparkide ajakohastamise projektide kiireks KMH-ks. Vajalikku tegevusluba on siis võimalik väljastada kuue ning teatud juhtudel kolme kuuga. Eelnõuga võetakse Eesti õigusesse üle ka Euroopa Parlamendi ja nõukogu direktiiv, et tõhustada üleeuroopalise transpordivõrgu (TEN-T) väljaarendamist. Direktiivi eesmärk on kiirendada liikmesriikide teede põhivõrgukoridoride projektide loamenetlust. Selleks luuakse ühtse ehitusloa menetluse õigusraamistik, mis vähendab halduskulusid ja hoogustab EL-i jaoks strateegiliselt tähtsate ühenduste ehitamist. Direktiiv annab diskretsiooni ühe konkreetse pädeva asutuse määramiseks. Direktiivi rakendamisega Eestile täiendavat mõju pole, sest sisuliselt on nõuded juba Eesti õiguses olemas, seadusesse viiakse normitehniline viide.

Liiklusseaduse ja autoveoseaduse muutmise seadus

Eelnõuga muudetakse seadusega kehtestatud veoauto teekasutustasu määrasid, mille eesmärgiks on veoautode energiatõhususe parandamine ning negatiivse keskkonnamõju vähendamine, rakendades rohkem „saastaja maksab“ printsiipi viisil, mis ei halvenda ebamõistlikult ettevõtjate konkurentsivõimet ja elanike toimetulekut. Eelnõu on seotud ELi vastava direktiivi Eesti õigusesse ülevõtmisega asjakohases ulatuses. Teekasutustasu määr sõltub veoauto ja selle haagise täismassist, EURO-heitgaasiklassist ja telgede arvust. Eelnõuga kavandatud päevane teekasutustasu määr jääb vahemikku 4-40 eurot (kehtiv päeva määr 9-12 eurot) ning aastane teekasutustasu määr vahemikku 200-2000 eurot (kehtiv aasta määr 500-1300 eurot). Teekasutustasu määrade diferentseerimisel, kus saastavamad ja raskemad veokid maksavad proportsionaalselt rohkem kui vähem saastavamad sõidukid, vähenevad Eestis sõitvate veoautode CO2 heitkogused eeldatavalt u 2,41 kt võrra esimesel aastal võrreldes stsenaariumiga, kui teekasutustasude suurused jääksid kehtivale tasemele. Lisaks muudetakse sätestatud trahviühikuid isikutele, kes lubavad teisi sõitma või juhivad ise veoautot teekasutustasu tasumata või kui teekasutustasu on tasutud väikesemas määras. Uued trahvimäärad on kooskõlas karistusseadustikuga sätestatud ulatuses ning piisavalt motiveerivad, et vältida teekasutustasu maksmata jätmist. Trahvide tõstmist puudutavad muudatused tulenevad riigisisesest vajadusest ja ei ole seotud direktiivi ülevõtmisega. Täiendavalt võetakse eelnõuga Eesti õigusesse üle ELi direktiivi reisijate- või kaubaveol kasutatavate teatavate maanteesõidukite juhtide alus- ja jätkuõppe kohta (kodifitseeritud) reisijaid vedavate juhtide vanust ja väljaõpet puudutavad sätted. Eelnõuga tehtav autoveoseaduse muudatus on seotud ELi direktiivi ülevõtmisega.
