Après l’alinéa 16, insérer les alinéas suivants : « 4° bis Après le II de l’article L. 443‑8, il est inséré un alinéa ainsi rédigé : « Est abusive toute pratique commerciale ayant pour objet ou pour effet de neutraliser, directement ou indirectement, la prise en compte ou la sanctuarisation de la part de matière première agricole dans les conditions de négociation commerciale. Pour apprécier l’existence d’une telle pratique, l’autorité administrative peut tenir compte de l’ensemble des avantages financiers, commerciaux, promotionnels ou logistiques consentis dans le cadre de la relation commerciale. »
