Summary

Les préfets et sous-préfets ont la possibilité, à titre dérogatoire, d’exempter des sociétés ou collectivités territoriales de l’application de normes dans les cas suivants : 1° Lorsque sa mise en œuvre apparaît comme étant manifestement inapplicable ; 2° Lorsque son application impliquerait un coût économique manifestement disproportionné pour l’entreprise ou la collectivité concernée. La décision est prise par arrêté spécialement motivé et notifié à l’intéressé. Un décret fixe les conditions et modalités d'application de cette disposition dans les cas d'exemption de normes réglementaires.
