Summary

I. – A l’alinéa 5, après les deux occurrences du mot : « santé » insérer les mots : « ou l’établissement ». II. – En conséquence, après l’alinéa 8, insérer les deux alinéas suivants : « II bis . – Les établissements de santé ou les établissements et services mentionnés à l’article L. 312‑1 du code de l’action sociale et des familles, lorsqu’ils ne sont pas gérés par une personne publique, peuvent refuser de mettre en œuvre ou d’accueillir en leur sein un acte mentionné au premier alinéa, lorsque ce refus résulte de principes fondamentaux, y compris religieux, relatifs au respect de la vie humaine, expressément inscrits dans leur son projet d’établissement, leur objet social ou leurs statuts et présidant de manière constante à leur activité. « Ces principes ne peuvent être opposés que s’ils ont été établis avant la demande du patient et présentent un caractère stable et public ».
