Summary

Le titre II du livre IV du code de commerce est complété par un article L. 420‑8 ainsi rédigé : «  Art. L. 420‑8.  – L’inobservation à caractère habituel ou récurrent des réglementations afférentes aux domaines de la santé, de la sécurité, de la sûreté et de l’environnement, est susceptible de constituer un acte de concurrence déloyale, lorsqu’elle a pour effet de conférer un avantage économique injustifié sur son marché à l’entreprise contrevenante. « Des dommages et intérêts peuvent être accordés par le juge civil, commercial ou administratif aux entreprises victimes de cette pratique. »
