Le II de l’article L. 612‑1 du code monétaire et financier est complété par un 8° ainsi rédigé : « 8° Dans le périmètre de ses actions et moyens existants, d’établir une recommandation de bonnes pratiques à destination des établissements d’assurance en matière d’évaluation des risques de santé graves et des pathologies pris en compte dans la définition des modalités et des montants de la mise en place des surprimes. Les modalités d’établissement et du suivi de cette recommandation sont définies par décret. »
