Rétablir cet article dans la rédaction suivante : « Le I de l’article L. 441‑2 du code de commerce est ainsi modifié : « 1° Après le premier alinéa, il est inséré un alinéa ainsi rédigé : « Dans la promotion par les opérateurs de vente d’un produit alimentaire, le terme « gratuit » ne peut être utilisé comme outil marketing et promotionnel dans le cadre d’une relation commerciale. » ; « 2° Au troisième alinéa, les mots : « ou deuxième », sont remplacés par les mots : « au troisième ».
